These rules take effect 15 days after filing vith the Secretary of State
(By authority conferred on the state fire safety board by section 3c of
Act No. 207 of the Public Acts of 1941, as amended, being 29.3c of the
Michigan Compiled Lavs)
R 29.2301 Definitions.
Rule 1. As used in these rules:
(a) "Act" means Act No. 207 of the Public Acts of 1941, as amended,
being 29.1 et seq. of the Michigan Compiled Lavs.
(b) "Board" means the state fire safety board created in section 3b
of the act.
R 29.2305 Storage of flammable and combustible liquids on farms and
isolated construction projects.
Rule 5. The provisions of the national fire protection association
pamphlet no. 395, 1980, entitled "Storage of Flammable and
Liquids on Farms and Isolated Construction Projects, are incorporated
by reference and adopted as part of these rules. Copies of the adopted
code are available for inspection and distribution either at the office
of the State Fire Safety Board, Fire Marshal Division, 7150 Harris
Drive,Lansing, Michigan 48913, or from the Fire Protection
Association, Batterymarch Park, Quincy, Massachusetts 02269. The cost
as of the time of adoption is $6.00 per copy.
R 29.2307 Fuel storage for oil-burning equipment.
Rule 7. The provisions of the nat:ional fire protection association
pamphlet no. 31, 1978, entitled "Oil Burning Equipment," as applicable
to a fuel storage tank, appurtenances thereto, and associated valves,
pipes, and vents for oil-burning equipment are incorporated by reference
and adopted as part of these rules. Copies of the adopt:ed code are
available for inspection and distribution either at the office of the
State Fire Safety Board, Fire Marshal Division, 7150 Harris Drive,
Lansing, Michigan 48913, or from the National Fire Protection Association,
Batterymarch Park, Quincy, Massachusetts 02269. The cost as of the time
of adoption is $8.50 per copy.
R 29.2321 Flammable and combustible liquids code; adoption by reference.
Rule 21. The provisions of the national fire protection association
pamphlet no. 30, 1981, entitled "Flammable and Combustible Liquids
Code," including appendix E, are incorporated by reference and adopted
as part: of these rules. Copies of the adopted code are available for
inspect:ion and distribution either at the office of the State Fire
Safet:y Board, 7150 Harris Drive, Lansing, Michigan 48913, or from the
National fire Protection Association, Batterymarch Park, Quincy,

AMENDMENTS TO FLAMMABLE AND COMBUSTIBLE LIQUIDS CODE
R 29.2322 General provisions. .
Rule 22. Sections 1-1.7.2 and 1-1.7.3 are deleted, the definition of
"authority having jur:l.sdiction" in section 1-2 and section 1-4.2 are
amended, and section 1-1.9 and the definition of "processing vessel" in
section 1-2 are added to read as folloWs:
1-1. 9. The requirements of these rules shall not apply to class IIIB
liquids.
1-2. "Authority having jurisdiction" means the state fire marshal or
his designee.
"Processing vessel." means a vessel which. is utilized to carry out or
control the heating, cooling, mixing, blending, separating, metering, or
chemical. action of liquids. The processing is done on a regular basis
and it is the primary function of the vessel.
1-4.2. Each unfired pressure vessel shall be constructed in accordance
vith recognized standards of design. An unfired pressure vessel. meeting
the standards of the American society of mechanical. engineers boil.er and
pressure vessel code, section VIII, divisions 1 and 2, 1980 edition, and
its addenda, shall be deemed to be in compliance w:i.th this rule.
R 29.2323 Delivery refusal.
Rule 23. Section 1-6 is added to read as follows:.
1-6. Delivery refusal. .
1-6 .1. A person shall. refuse to deliver a liquid into any type of
container to any person who, in his or her judgment, :is not of suffi-
cient age or sufficiently responsible to Understand the proper use of
the liquid or when he or she has reason to believe that the intended use
of the l.iquid could constitute a hazard to l.ife or property.-
1-6.2. A person shal.l refuse to del.iver a liquid into any tank or
container under any circumstances prohibited by these rules.
R 29.2324 Plans and specifications; submittal; inspection; certification.
Rule 24. Section 1-7 is added to read as follows:
1-7. Plans and specifications; submittal.; inspection; certification.
1-7.1. Plans shall be submitted to the state fire marshal p r ~ o r to
construction for any new installation or addition to an exiSting instal.l.ation
invol.ving either of the following:
(a) Outside aboveground installations where individual storage capacity
~ a class I liquid is 1,000 gallons or more or where the individual. or
aggregate storage capacity of cl.ass II or class III liquid :i.s 10,000
gallons or more.
(b) Underground installations where individual storage capacity :is
20,000 gallons or more.
1-7.2. The plans and specifications shall. include all of the folloving:
(a) A plot map showing all of the following:
(i) The location of buildings, public roadways, railroad mainlines,
and powerlines as specified in section 2-2.1.
(ii) The proposed location of tanks and buildings.
(iii) The location of property lines.
(iv) The location of adjacent, existing tanks.
(b) Material. of construction

l-7.3. Ypon acknovledged receipt of the plans, the state fire marshal
sha.ll issue a plan reviev report vithin 30 days. If such plan reviev
report is not issued vithin 30 days, the installat:ion may be conscruct:ed
according to the submitted plans .and shall be in accordance vith these
rules.
l-7 .4. The state fire marshal shall be not:ified up.on completion of
the inst:allat:ion prior to the insta.llation being placed in service or
covered from sight. The state fire marshal shall inspect: the installacion
follo'ldng the receipt of notificat:ion and shall certify the installation
if t:he requirement:s of these rules have been met. If the inspection is
not made vithin 2 vorking days, the installation .may be placed in service
or covered from sight and a not:arized affidavit: sha.ll be submitt:ed to
the st:ate fire marshal attesting to the fact that the insta.llation
complies vith the plans. submitted and applicable coi:les.
l-7 .5. Upon request, a.ll plans and specifications submitted to the
state fire marshal for his reviev shall be returned after the st:ate fire
marshal has certified the :installation or vithin 30 vorking days upon
notification of the completion of the insta.llation. Plans and specifications
may be marked "Confidential-Do not copy" at the time they are submitted.
l-7.6. The requirements in l-7.1 through l-7.5 do not alleviate the
firm of its legal responsibility to comply vith applicable local ordinances.
R 29.2325 Processing vessel.
Rule 25. Section l-8.1 is added to read as follovs:
l-8.1. Each processing vessel shall be constructed, installed, located,
and equipped as required for the process involved and consistent vith
good engineering and safety practices.
R 29.2326 Fabrication and repair.
Rule 26. Sections 2-1.2.3 and 2-1.2.4 are added to read as follovs:
2-1.2.3. An open tank shall not be used for the storage of a liquid.
2-1.2.4. An aboveground tank shall be repaired vith a material vhich
is equal to the original material specifications or vith a material
subject to approval by the state fire marshal.
R 29.2328 Installation of outside aboveground tanks.
Rule 28. Section 2-2.1.9 is added to read as follovs:
2-2.1.9. Location restrictions for the installation of outside
aboveground tanks are as follovs:
:(a) A storage tank shall not be erected less than 300 feet from any
of the folloving:
(i) A mine shaft:.
(ii) An air or escape shaft for a mine.
(iii) A school.
(iv) A church.
(v) A hospital.
(vi) A theater.
(vii) An assembly occupancy for 50 or more persons

(b) An aboveground storage tank, loadng operation, or unloading
operation shall not be installed closer than 25 feet, plus 1 inch per
1,000 volts, measured horzontally, from the nearest conductor or under
power lines, except that servi.ce entrances and servi.ce tines may be
closer than 25 feet, but shall not be over a tank or the loading or
. unloadng area.
R 29.2330 Control of spillage from aboveground tanks.
Rule 30. Sections 2-2.3.l(a) and 2-2.3.3(j) are added, and 2-2.3.3(d)
and 2-2.3.3(h) are amended, to read as follows:
2-2.3 .l(a). Dikng or remote impounding_ shall be pronded for a tank
exceeding a capacity of 1,000 gallons of flammable liquid and exceeding
a capacty of 10,000 gallons of combustible liquid. Dik:i.ng shall also-
be provided for a tank of lesser capacity when necessary to prevent
liquid from endangering an important faclity, adjoining property, or
surface or groundwater or from reachng a waterway.
2-2.3.3(d). The walls of the dked area shall be constructed of
earth, steel, concrete, or solid masonry desgned to be liquid-tight and
to withstand a full hydrostatic head. Earthen walls 3 feet or more in
height shall have a flat section at the top which is not less than 2
feet wide. The slope of an earthen wall shall be consistent with the
angle of repose of the material of which the wall s constructed. A
diked area for tanks contaning liquid located in porous soils shall be
constructed of material which will prevent seepage of liquid to a low-
lying area, groundwater, or waterway.
2-2.3.3(h). A pronsion shall not be made for the automatic draining
of a dked area. The liquid shall be removed from within a dike by a
pump approved for use in a hazardous location or by other approved
means. A responsible person shall be in attendance during the pumping
operation.
2-2.3.3(j). A building shall not be located within a diked area or
within 10 feet of the outside toe of the dike. A noncombustible structure
housing equipment necessary for handling, transferring, blending, . or
controlling the liquid may be located within a dke, or less than the
required distance,if the structure has adequate ventilation. Heating
and electrical installation for the structures shall be approved for
hazardous locations.
R 29.2332 Tank openings other than vents for aboveground tanks.
Rule 32. Sections 2-2.7.l(a), 2-2.7.l(b), and 2-2.7.l(c) are added to
read as follows:
2-2.7 .l(a). Each horizontal tank or vertical tank having a capacity
of 40,000 gallons or less shall have all below-liquid level tines equipped
with an approved heat-actuated internal or external quick-closing valve
which wUl aut:omatically prevent: t:he flow of liquid from the tank in t:he
event: of a fire. The external quick-closing valve shall be inst:alled at:
t:he t:ank. The heat:-act:uated quick-closing valve is not: required on
crude pe t:roleum s t:orage t:anks.
2-2.7.l(b). Each- heat:-actuated quick-closing valve shall be maint:ained
in proper operating condition.
2-2.7.l(c). Each water drain valve shall be an approved non-freeze
valve and shall be locked or otherwise secured in a closed position when
not: in use.

R 29.2334 Installation of underground tanks.
Rule 34. Sections 2-3.1 and 2-3.3 are amended to read as follows:
2-3.1 Location. Excavation for an underground tank shall be made
with due care to avoid undermining the foundation of an existing structure.
An underground tank or tanks under a building shall. be so located, with
respect to the existing building foundation and supports, that the loads
carried bythe building foundation and supports cannot be transmitted to
the tank. The distance from any part of a tank storing liquid to the
nearest wall of any basement or pit or to any property line shall be not
less than 10 feet.
2-3.3. Corrosion protection. Corrosion protection for an underground
tank shal.l. be provided by 1 of the following methods:
(a) Use of an approved, pre-engineered, factory installed corrosion
protection and monitoring system which utilizes exterior corrosion
control practices recommended by the national association of corrosion
engineers (N.A.C.E.). The system shall be factory-inspected by a
nationally recognized testing agency. The system shall be designed by a
N.A.C.E.-accredited corrosion engineer to comply with a design criterion
of not less than a 20-year anode life when a system-protected tank is
installed in soil of 2,000 ohm/centimeters or higher resistivity. The
system shall be proven to meet N.A.C.E. criteria by in-service test site
data. The system manufacturer shall provide a minimum 20-year limited
warranty against exterior corrosion. The system shall be monitored
between 1 and 13 weeks after completion of the installation, again after
1 year of operation, and then every 5 years to demonstrate cont:inued
corrosion protection. Records of this monitoring shall be maintained by
the owner and be made available to the authority having jurisdiction.
(b) Use of exterior corrosion control practices recomended by N.A.C.E.
(RP-01-69) designed into an engineered, jobsite-installed, monitored,.
cathodic protection system. Galvanic anode cathodic protection
systems shall be monitored between 1 and 1.3 weeks following completion
of installation, again after 1 year of.operation, and every 5 years
thereafter to demonstrate continued corrosion protection. Impressed
current cathodic protection systems shall be checked for proper operation
of the rectifier by monitoring monthly to insure proper functioning of
the rectifier and shall have the annual system test and inspection
performed by a qual.ified person to demonstrate continued corrosion
protection. Records of this monitoring shall be maintained by the owner
and be made available for inspection by the authority having jurisdiction.
(c) Use of corrosion-resistant material.s of construction, such as
fiberglass-reinforced pl.astics. tEach corrosion-resistant underground
storage tank shall be listed.
(d) Corrosion protection may be omitted if a soil resistivity test or
a detailed anal.ysis of the site is made available to the authority
having jurisdiction and found to be nonc.orrosive. For purposes of this
rule, corrosive soil conditions exist when soil. resistivity is less than
1.0,000 ohm/centimeters. The analysis shall include, at a minimum, all
of the following:
(i) A determination of soil conditions.
(ii) Water table level or drainage.
(iii) A review of the corrosion history of the area.
A person shall perform the required test or corrosion survey.
R 29.2336 Abandoned underground tanks.
Rule 36. Section 2-3.4.1 is amended to read as follows:

2-3.4.1. (l) Each underground tank taken out of service shall be
safeguarded or disposed of by any of the following means:
(a) Temporarily out-of-service tank. A tank shall be deemed temporarily
out of service only when it is planned that the tank will be returned to
active service at the location within 90 days. After 90 days, the tank
wi11 automatically be classified as indefinitely out of service.
To render a tank temporarily -out of service, all of the following successive
steps shall be taken: '
(i) The authority having jurisdiction shall be notified and a record
of the action maintained.
(ii) Each tank shall be filled with liquid, but the liquid shall not
be used during this period.
(iii) Cap or plug the fill line, gauge opening, and pump riser using
an appropriate sealing compound on the fitting. Fill lines and gauge
openings equipped with locking devices qualify for securing those openings.
(iv) Maintain vent lines as required for each tank in use.
(v) Inspect each tank monthly for proper maintenance.
(vi) Prior to the tank being reactivated for service, proper notification
sha11 be given to the aut:hority having jurisdict:ion.
(b) Indefinitely out-of-service t:ank. Each tank shall be deemed
indefinitely out of service only when it: is planned that the tank will
be ret:urned to active service at the location within 9 mont:hs. To
render a tank indefinitely out of service, all of the following successive
seeps be taken:
(i) The authority haVing jurisdiction shall be notified and arecord
of the action maintained.
(ii) Class I liquid shall be removed.
(iii) Each t:ank that: contained class I liquid shall be filled wit:h
water and copped with a non-freezing liquid, wit:h allowance for expansion.
Piping, fittings, and buried pumps shall be protect:ed wit:ha non-freezing
liquid.
(iv) Cap all lines and gLuge openings except vent lines.
(v) Prior t:o the tank being react:ivated, the authority having jurisdiction
sha11 be notified and the tank and piping shall be tested for tight:ness
in accordance with 2-7.
(c) Abandoned t:ank. Each tank shall be deemed abandoned when the
tank has become defective and is no longer suitable for liquid storage,
if the tank is out: of Use for more than 9 mont:hs, or if t:he tank is no
longer of incidental use to the type of occupancy on the property. All
of the following steps sha11 be t:aken for an abandoned tank:
(i) The aut:hority having jurisdict:ion shall be not:ified.
(ii) All liquid shall be removed.
(iii) Each t:ank sha11 be removed from the ground and the excavation
shall be backfilled to grade level.
(iv) Upon removal, the tank may be freed of flammable vapors on the
premises if condit:ions safely permit: or may be transported to an area
not accessible t:o the public and freed of flammable vapors at: t:hat:
location.
(v) When practical difficulty, such as structures above or near the
tank, precludes removal of the tank, the tank shall be safeguarded in a
manner approved by the authority having jurisdiction.
(2) Disposal of underground tanks. Each tank to be disposed of sha11
be rendered free of flammable vapors and tested for flammable vapors.

R 29.2338 Vents for underground tanks.
Rule 38. Section 2-3.5.3 is amended to read as follows:
2-3.5.3. Location and arrangement of vents for class II or class III
liquid. Each vent pipefrom a tank storing class II or class III liquid
shall terminate outside of a building and higher than the fill pipe
opening. The vent outlet shall be above normal snow level and a minimum
of 12 feet above grade. The vent outlet may be fitted with return
bends, coarse screens, or other devices to minimize ingress of foreign
material.
R 29.2340 Underground tank restoration and repair.
Rule 40. Section 2-3.7 is added to read as follows:
2-3.7. Tank restoration and repair. The procedure for the repair of
leaking or deteriorated underground steel or nonmetallic liquid storage
tank.
2-3.i'.l. If tank repair is performed, it shall be accomplished in the
manner prescribed in 2-3.7.2 and 2-3.7.5. or with a material equivalent
to the original tank specifications.
2-3.7.2. Manufacturers desiring to have their product used within the
state shall register the specifications for the internal coating system
for the repair of a tank containing liquid with the state fire marshal.
The specifications shall clearly describe all of the following:
(a) The composition of the product .
(b) Strength.
(c) Limitations on use.
(d) Preparation procedures.
(e) Application procedures.
(f) Quality control techniques.
(g) Curing times and temperatures.
(h) Field thickness testing procedures.
(i) Field hardness testing procedures.
(j) A method of determining whether an existing tank. is repairable.
This information, together with the results of the standards tests,
shall be signed and sealed by a registered professional engineer.
2-3.7.3. Each manufacturer who has registered an internal coating
system shall submit to the st:at:e fire marshal a list: of qualified
applicat:ors. It is the responsibility of the manufacturer to keep t:his
list: current. The list shall indicate that the applicator is qualified
to seal metal tanks or nonmetallic tanks, or both.
2-3.7 .4. The applicator shall inform the following officials of the
location of each project in the following manner:
(a) Prior to the commencement of a project, the authority having
jurisdiction shall receive a written notice from the applicator stating
the location of the project and the applicator's timetable
for each stage of the project. ,, . ._-;;
(b) A current certificate of insurance covering/ the liability of the
applicator shall be filed with the state fire /

(c) A sample of the application for tank repairs may be obtained from
the state fire marshal.
2-3.7 .5. A certificate of performance shall be utilized as follows:
(a) A certificate of performance on each field application shall be
submitted to the authority jurisdiction. The certificate to be
designed by the state fire marshal and printed and supplied by the
contractor shall be signed by the qualified applicator and shall confirm
that the tank preparation and product application complies with the
sealant manufacturer's specifications which are registered with the
state fire marshal.
(b) A sample of the certificate of performance may be obtained from
the state fire marshal.
R 29.2344 Sources of ignition.
Rule 44. Section 2-6.2 is added tc read as fellows:
2-6.2. Protection and care of tank yard
2-6.2.1. The area which embraces the tank yard, including the dike
and all aboveground piping, shall have. proper security by means of
locking valves cr electrical controls for pumping equipment or metal
fencing tc discourage trespassing. Fencing shall be an industrial chain
link fence which is not less than 6 feet high. The tanlc. yard is not re-
quired to be fenced if the property surrounding it is properly fenced.
2-6.2.2. Property shall be kept free af combustible materials, including
weeds, high grass, rubbish, and litter.
R 29.2346 Testing.
Rule 46. Section 2-7.3 is amended tc read as follows:
2-7.3. In addition to the test called for in 2-7.1 and 2-7.2 of this
rule, all tanks and connections shall be tested for tightness. Except
fer used underground tanks, the tightness test shall be made at
pressure with air, inert gas, or water prier tc placing the tank in
service. Fer each field-erected tank, the test called for in 2-7.1 cr
2-7.2 of this rule may be considered to be the test fer tank tightness.
R 29.2348 Testing.
Rule 48. Sections 2-7.4 and 2-7.5 are amended, and 2-7.6, 2-7. 7, 2-
7.8, 2-7.9, and 2-7.10 are added, to read as follows:
2-7.4. (1) Before final backfilling is completed, each tank for
underground installations shall be tested under the previsions of 2-7.1
and, whether new or used, shall receive a final test after being installed
in the ground and shall be backfilled to the top of the tank.
(2) Each new empty tank at the time of installation shall be tight-
ness tested with air fer 30 minutes at 3 to 5 pounds per square inch
before installing in-ground and after installing in-ground and being
connected to piping to determine possible leakage or damage during
transportation and installation. The in-ground air tightness test cf a
new tank installation may be accepted as the final test by the authority
having jurisdiction. A pressure test with air shall not be performed on
a used empty tank or .a tank containing liquid. A test using air pressure
or other gasas i's not adequate fer detecting small leaks or leaks below
liquid level. The final test of a newly installed used tank, whether
aboveground or underground, or a test to determine leakage shall be a
volumetric test or other approved means cf testing, including electronic,

which is capable of detecting leaks as small as OS gallons in 1 hour
adjusted for variables. U.quid or water may be used for the testing
agent in the volumetric test.
(3) The t.mderground piping system, before being covered, enclosed, or
placed in use, shall be hydrostatically tested for tightness, independent
of the tank, to 150% of the mavimum anticipated pressure of the system
or pneumatically tested to 110% of the maximum anticipated pressure of
the system, but not less than 5 pounds.'per square inch gauge at the
highest point of the system. This test shall be maintained for 30
minutes.
2-7.5. Before a tank is initially placed in service, all leaks or
deformations shall be corrected in a manner and with materials equal to
the original fabrication process and subject to review by the authority
having jurisdiction.
2-7.6. Each tank to be operated at pressures below its design pressure
may be tested by the applicable provisions of 2-7.1 or 2-7.2 based upon
the pressure developed under full emergency-venting of the tank.
2-7.7. Each .tank which has been repaired, altered, or suspected of
leaking shall be tested in the manner specified in 2-7.2 and 2-7.3. The
authoricy having jurisdiction may require testing of any tank when there
is reason to believe the tank is defective. The ciwner or person in
control of the premises on which the tank is located shall provide tank
testing. The test shall be by a volumetric test or other suitable means
under the provisions of 2-7.4 as approved by the authority having
jurisdiction. The test shall be conducted in the presence of the
authority having jurisdiction or the results of the test shall be reported
to the authority having jurisdiction in the form of an affidavit.
2-7.8. If the test results show any leakage from the tank or the
piping system, the authority having jurisdiction may order, at the
expense of the owner, person, or firm in control of the premises, emptying
the tank, piping, or entire system or portions of the tank or piping
system of liquid; and the removal of the faulcy tank or repairing of the
tank, piping, or system in a manner acceptable to the authority having
juris diction.
2-7.9. The state fire marshal has the authority to approve or disapprove
any existing or future test procedures and testing devices.
2-7.10. If test results or the presence of liquid in the ground gives
cause to suspect any t.mderground tank leakage, the authority having
jurisdiction may order, at the expense of the owner, person, or firm in
control of the premises, the sinking of dry well test holes at one or
both ends of the suspect or adjoining tanks for the purpose of evaluating
or determining possible leaks. Each dry well test hole shall be not
less than 4 inches in diameter of polyvinyl chloride or culvert type
(concrete, tile, or steel) pipe and shall be capped and sealed on the
bottom and capped flush at ground level with a screw or expansion-type
cap. If the top of the pipe passes through concrete or asphalt, it
shall be located in a sleeve with a cover for protection against vehicular
damage and settlement. The test holes shall be located 1 to 3 feet from
the ends of the tank, and the bottom of the pipe shall extend to a depth
as determined by the authority having jurisdiction. Each pipe shall be
perforated with holes spread a maximum of 12 inches apart which will

prevent sand fill-up. Perforation of the pipe shall extend from the
bottom of the pipe to a po:l.nt opposite the center of the tank. The
authority hanng jurisdiction may accept other approved methods of leak
detection in :l.ndiv:l.dual cases.
R 29.2350 Fire protection; identification.

driver or operator of the tank vehicle or the plant operat:or shall gauge

used, an additional gauge reading shall be made after approximately 100
gallons have been del:!. vered to confirm that the !:!.quid is being delivered
to t:he tank int:ended. While t:his gauge reading is being made, t:he

storage tank in case of breakage of the piping or fittings.
3-8.3. Suitable shutoff valves shall be installed at strategic locations
in piping used for liquid so that the flow of liquid may be stopped at a
time of emergency, such as fire, line breakage, or building collapse.
Shutoff valves shall be installed on the upstream side where fire
separation walls are pierced, not less than 50 feet from each liquid
dispensing station, and at each en1:ry' point into the building. Each
valve shall be permanently identified as to the liquid which the valve
controls. The operation of a shutoff valve may be automatic or manual,
or both, depending upon the severity of the hazard involved. A shutoff
valve shall be installed on the suction side o.f lines under positive
static head pressure.

Rule 74. Section 3-12 is added to read as follows:
3-12. Liquid identification.
3-12.1. Loading and unloading risers shall be identified by a color
code or marking to identify the product for_which the tank is used. In
addition, tanks storing class II or class IIIA liquids for sale and in
the same immediate location with tanks for class I liquids shall be
provided with some positive means, such as different pipe sizes, fill
devices, special locks, or other method, designed to prevent the erroneous
delivery of gasoline or other class I liquid into such tanks used for
ciass II or class IIIA liquids.
R 29.2376 Cutoff rooms and attached buildings.
Rule 76. Section 4-4.2.5 is amended to read as follows:
4-4.2.5. A curb, scupper, special drain, or other suitable means
shall be provided to prevent the flow of liquid under emergency con-
ditions into adjacent building areas, except where the individual
container capacity is 5 gallons or less or if the liquid stored is class
III liquid. The drainage system, if used, shall have sufficient capacity
to carry off the expected discharge of water from the fire protection
systems and hose streams. Each drainage system shall be constructed to
prevent the liquid from endangering adjoining property or groundwater or
from reaching waterways.
R 29.2378 Indoor storage.
Rule 78. Section 4-5.2 is amended to read as follows:
4-5.2. Dwelling and residential-buildings containing not more than 3
dwelling units and accompanying attached or detached structures. Class
I or class II liquid is prohibited inside a dwelling or residential
building. Individual or combined storage of more than 25 gallons of
class I and class II liquid is not permitted in an attached or detached .
structure. Storage of more than 60 gallons of class IIIA liqUid is not
permitted.
R 29.2380 Outdoor storage.
Rule 80. Section 4-8.3 is amended to read as follows:
4-8.3. The storage area shall be graded to divert possible spills of
liquid away from each building or other exposure or shall be su=ounded
by a curb not less than 6 inches high. When a curb is used, provision
shall be made for draining accumulations of groundwater or rainwater or
spills of liquid. Each drain shall terminate at a safe location and be
constructed to prevent liquid from endangering adjoining property or
groundwater or from reaching waterways.
R 29.2382 Drainage.
Rule 82. Section 5-3.4.3 is amended to read as follows:
5-3 .4.3. Each industrial plant shall be designed and operated to
prevent the. normal discharge of liquid into a public waterway, ground-
water, public sewer, or adjoining property.

tank, warehouse, other building, loading and unloading facilities, or
nearest line of adjoining property by,a distance of not less than 25
feet. Vapor processing equipment shall be protected against physical
damage by remote location or by the use of guardrails, curbs, or fencing

Rule 88. Section 6-7.1 is amended, and 6-7.2 is added, to read as

6-7.1. Provision shal.l be made to prevent liquid which can be spilled
at a loading or unloading point from entering a public sewer, draining
system, natural watervay, or groundwater. The connection to a sewer,
drain, or watervay by which liquid might enter shal.l be provided with a
separator box or other approved means whereby liquid entry is prevented.
Crankcase drainings and liquid shall not be dumped into a sewer, but
shall be stored in a tank or tight drum outside of any building until
removed from the premises.
6-7.2. Drainage provided at a loading or unloading area shall not
drain liquid into the diked area for storage tanks.
R 29.2390 Inventory check.

on hand. If there is more than 1 system consisting of 1 or more tanks
serving 1 or more separate pumps or dispensers for any liquid, the
reconciliation shall be maintained separately for each tank system. The
mere recording of pump meter readings with shipment records
shall not constitute an adequate inventory record for the purpose of
this rule. An abnormal loss or gain of liquid which is not explainable
by spillage, temperature variations, or similar cause shall be reported
promptly to the authorit:y having jurisdiction.
7-2.1.7. The owner or operator shall-immediately notify emergency
personnel in the event of any substantial amount of spillage or leakage
of liquid.
R 29.2394 Remote pumping systems.
Rule 94. Sections 7-3.2.3 and 7-3.2.5 are amended to read as follows:
7-3. 2. 3. Each pump installed above grade outside of a building shall
be located not less than 10 feet from the lines of adjoining propert:y
and not less than 10 feet from any building opening. Each pump shall be
substantially anchored and protected against physical damage.
7-3,2.5. A listed rigidly anchored liquid emergency shutoff valve
which incorporates a fusible link or other the-rmally actuated device and
which is designed to close automatically in the event of severe impact
or fire exposure shall be properly installed in the supply line at the
base of each individual island dispenser or at the inlet of each overhead
dispensing unit. The automatic closing feature of the liquid emergency
shutoff valve shall be checked at the _time of initial installation and
not less than once a year. A slip joint coupling shall not be used in
any undiirground piping system.
R 29.2396 Location of dispensing devices and emergency power cutoff.
Rule 96. Section 7-4.1.1 is amended to read as follows:
7-4.1.1. Each dispensing device at an automotive service station
shall be located so that all parts of the vehicle being served will be
on the premises of the service st;,ation. Ea,ch dispensing device shall
not be located less than 10 feet from property lines, openings to
buildings of noncombustible construction, and buildings of combustible
construction. A dispensing device at a marine service station may be
located on an open pier, wharf, or floating dock; on shore; or on a
solid-filled pier and shall be located moay from other structures so as
to provide room for safe ingress and egress of the craft to be fueled.
Each dispensing device shall be not less than 20 feet from any activity
involving a fixed source ignition.

listed automatic-closing hose nozzle valve. The nozzle may be with or
without a listed latch-open device.
7-8.1.2(a). For any installation where the flow of product normally
is stopped other than by the hose nozzle valve, such as at pre-pay
stations, the system shall include listed equipment with a feature that
causes or requires the closing of the hose nozzle valve before product
flow can be resumed or before the hose nozzle valve can be replaced in
its normal position in the dispenser, or the hose nozzle valve shall not
be equipped with a hold-open latch.
