Gordon Nye Frank 68 was brutally strangled and beaten in front of his wife 8/05/07. The
family of Nye Frank had requested victim advocate Kim Emmerling, her boss, DA office for
a referral to a elder advocate. We were told many times Riverside County did not have a
elder victim division. I have my written request. (just saw award DA Pacheco got for this
division)

The 27 year old man Ty Reddish who strangled Nye Frank is professionally trained
wrestler by his father who is a coach at Norco High School. Ty is also a adult baseball
player. In the recorded interview with Ty Reddish he admits to choking Nye Frank with two
signature wrestling moves, and hitting him.

No drug test was done on Ty Reddish while on probation for DUI and prior other arrest with
charges dropped.

Phil Reddish, Sherry Reddish parents of Ty Reddish stalked and followed in their car Lee
Frank and family the evening of the homicide as they were invited as guest to a neighbors
home for dinner. They jumped out of their car to insist that the neighbor not allow Lee
Frank's family in their house. During dinner they called every few minutes. They then
proceeded to watch Lee Frank's home and harass anyone who visited from the area. And
go door to door telling neighbors Nye attacked Ty.

Ty Reddish was released without bail three days after the event.

Fourth day Ty Reddish along with his Family stood across from mail boxes, 2 houses from
Lee Frank, stared at her, waived to her and family and guest. This is the road to and from
Lee Franks home to got to store and doctors. This still continues. The sheriff department
said they cannot stop this.

Nye Frank's Family informed not investigation as they stated Coroner reports Nye Frank
had a heart attack. Sheriff and DA office they there were no visible physical injuries.

August 25 return call from Coroner office stated that it was never reported as a heart
attack.

Head Homicide Detective states he guesstimated it.

Asked to meet with coroner. Two Homicide sheriff detectives met with us. We were told a
story that they claim Lee Frank stated. It did not match any statements we have heard. We
asked for the documents that was refused.

Requested Riverside County victims rights and police procedures in writing and told they
did not have them in writing for 5 months.

Rod Pacheco's office, Coroner, Sheriff office refused to give sheriff report and autopsy.

Cabazon Sheriff Station Manager told us even with court order would give the report
blacked out. Also states never seen victims rights book.

When Sheriff Report finally released report refused to allow a family member with Lee
Frank's general power of attorney pick it up. Lee had to drive in snow and rain at 72 years
old to get report.

Internal Affairs was contacted by Nova to investigate why we were being refused crime
report, and autopsy as case had been closed

Mike Ruston at DA office stated to go ahead and go to the Grand Jury that they do not
share information with them.

DA office finally allowed me to see the autopsy in their office without anyone else except
their victim advocate Kim Emmerling. Mike Rushton stated that we wanted someone to
blame for my dads heart attack. When I saw report I pointed out it shows strangulation as I
had a police procedures white paper on strangulation. Mike Rushton raised arms and said
well that's not why we did not prosecute. This was a mutual combat. He also states Lee
Frank is not a victim and cannot apply for victim funds as Nye was the cause of his own
death.

We asked how they came to this conclusion. He pointed to a large book that he states they
used at the meeting headed by Diema Calhoun. I asked to see the affidavits sent in. When
he opened the book and looked for them they were not there.

I asked for the drug testing results of Ty Reddish that he claimed was done. I asked for it as
I had been asking for months. It turned out not to be done.

Conspiracy against Rights- Section 241- The Sheriff department, district attorney office,
Coroner office, internal affairs, victims advocates, Chp, Riverside fire, City supervisors,
Human Resources department have all participated.

Internal Affairs was contacted by Nova to investigate why we were being refused crime
report, and autopsy as case had been closed. After finally getting the reports from internal
affairs we requested with the FOIA the audio records and photos. From these we
discovered and reported the misconduct of several parties. We contacted Internal affairs
after hearing the audio and seeing the pictures and asked if currently they were
investigating the case. Mr Ohara confirmed that they were not investigating. He stated I
would have to make a complaint. We requested they report and investigate the case. Our
request for autopsy documents to be able to have the autopsy reviewed for a investigation
of the crime against Nye Frank. Mr Ohara stated that due to privacy laws we could not have
the documents unless we filed a court case. After looking into that and talking to a public
defender and being informed because there is not a criminal case number I could not still
get the documents. I called Mr Ohara and stated how frustrated I was. He encouraged me
again to file a complaint. He then told me I could possibly get the documents by filing a
claim with the city. Which I did. After doing this Mr. Ohara informed me that now that a
complaint was filed his office could no longer communicate with me.

Audi and pictures clearly showed evidence of a homicide.

Statements by Phil Reddish state he was coached what to say by Brian Floyd and his
attorney. Brian Floyd campagne manager for Sheriff, DA, CHP, past student of Reddish

Showed claim by Ty Reddish of mutual combat to be false

Statement on audio to main homicide detective stating how and who will help, showing
knowledge of lie.

Prosecutor -Diema Calhoun- refused at all times to give her contact and business card to
family members of Nye Frank. She also said if they continue to pursue this case she will
have Lee Frank arrested. Deprivation of rights under the color of the law, section 242 of
title 18 makes it a crime for a person acting under the color of any laws

Homicide detectives would not return our phone calls. Refused to investigate case.
Refused affidavetes from other recent victims. Planted false statements in file, stated false
statements. Refused family's rights to get documents of own statements they claimed had
been made.
