Subject: Political Disorder

Dear Sir, In reference to the political happenings during the past week, and following the disengagement of long-term sit-ins within the perimeter of several public squares in Egypt, which caused acts of rebellion and riots among protestors in many governances, the government was forced to declare a month long enforcement of the Emergency Law and strict curfew hours (from 7:00 p.m. to 6:00 a.m., imposed by military forces), starting Friday August 16, 2013. Also, further to the E-mail received by the Contractor on August 17, 2013 (Attachment # 1) and in the same context of DETACs correspondence ref. # DTC-ECG-098 sent on July 9, 2013, please note the following: In consequence to the events that started on August 14, 2013, main roads and highways (namely but not exclusively; Ring Road, Cairo-Alex. Agr. Road, Cairo-Alex. Desert Highway, Nile Corniche, 26th of July Axis & Gesr El Suez) were cut-off, disenabling workers and supplies of materials and goods to arrive at site. Accordingly, work progress halted on site at mid-day of Wednesday, August 14, 2013 for reasons of security, and resumed today Sunday, August 18, 2013 - in conjunction with almost every construction project in Egypt-. Currently, the prescribed events are causing disruption to the progress of Works due to reduced productivity, which is attributable to the lack of workers and supplies on site, again as a result of difficulties in transportation caused by roads cut-off and curfew hours.

That being defined by the Conditions of Contract as Excepted Risks, pertaining to Sub-Clause 18 (ii) stating:

The "Excepted risks" are war, hostilities (whether war be declared or not), invasion, act of foreign enemies, rebellion, revolution, insurrection or, military or usurped power, civil war or (other than among the Contractor's own employees), riots, commotion or disorder or any such operation of the forces of nature as reasonable foresight and ability on the part of the Contractor could not foresee or reasonably provide against (all of which are herein collectively referred to as "the Excepted risks")., DETAC is hereby giving notice of entitlement to Extension of Time and relevant cost as a result of such happenings, in compliance with the Conditions of Contract SubClause (42): EXTENSION OF TIME FOR COMPLETION. Quantification of the effects shall follow in due course, noting the continuing effects of such events.
