COMES NOW Benjamin John Smith, as Prosecuting Attorney of Sac County,
Iowa, and in the name and by the authority of the State of Iowa, accuses
defendant, CHAD RUSSELL SEXTON (defendant) of the crime of THEFT IN
THE FIRST DEGREE, a Class C Felony in violation of Iowa Code Sections
714.1(1), 714.2(1), and 714.3, committed as follows: On or about July 1, 2013, in
Sac County, Iowa, the defendant took possession or control of a 2001 S10
Chevrolet pickup truck having attached to it a specialized delivery box, laptop
computer, misc. tools, a safe, and over $100.00 cash (collectively, property),
the aggregate value of the property exceeding $10,000. The defendant took
possession of the property with the intent to deprive the victim, Iowa Automotive
Machine and Supply of Sac City, Iowa (victim), of the same. The property, at
the time of the taking, belonged to, and / or was in the possession of the victim.

COMES NOW Benjamin John Smith, as Prosecuting Attorney of Sac County,
Iowa, and in the name and by the authority of the State of Iowa, accuses
defendant, CHAD RUSSELL SEXTON (defendant) of the crime of BURGLARY
IN THE THIRD DEGREE, a Class D Felony in violation of Iowa Code Sections
713.1, 713.3, 713.5, 714.3, and 713.6A, committed as follows: On or about July
1, 2013, in Sac County, Iowa, the defendant entered an occupied structure Iowa
Automotive Machine and Supply in Sac City, Iowa (1705 West Main Street, Sac
City, Iowa) (structure), which defendant had permission to enter. The defendant
remained in the structure after his right, license, or privilege to be in the structure
expired or the defendant did not have permission or authority to break into the

NOW on the 19
th
day of February, 201+, the defendant submits his verified written Plea
of Guilty. The defendant is charged with Theft in the Third Degree, an Aggravated
Nisdemeanor, in violation of Sections 71+.1(+) and 71+.2(3) of the !owa Code. The State
appears by Sac County Attorney, Ben Smith. The Defendant waives his personal appearance
and appears by counsel, Nark Rasmussen.
The written plea of guilty shows that the defendant's plea is voluntary, being freely and
intelligently made, with an understanding of the charge, with knowledge of the penal
consequences of the plea, with full knowledge of his constitutional rights, and that said rights
are waived by a plea of guilty, without any threats, improper inducements or persuasion, and
the Court finds there is a factual basis for the defendant's plea of guilty.
The written plea indicates the defendant's informed understanding of his rights
contemplated in the cases of State v. Sisco, 169 N.W.2d 5+2; Brainard v. State, 222 N.W.2d
711; and State v. Reaves, 25+ N.W.2d +88, all as shown in the defendant's written plea of
guilty, which plea is made a part hereof by this reference.
The Court, therefore, accepts the defendant's plea of guilty, and it is entered of record.
The defendant indicates his understanding of his right to additional time and the right to
file a Notion in Arrest of Judgment and the necessity of doing so at least five days prior to the
date set for sentencing and indicates his voluntary waiver of those rights and his desire to
proceed immediately to sentencing. The Court, finding the defendant's waivers are voluntary
and made with an understanding of his rights, accepts the waivers and proceeds to entry of
judgment. The defendant's counsel indicates he knows of no legal cause why judgment and
sentence should not be pronounced.
The Defendant is adjudged guilty of the offense of Theft in the Third Degree, an
Aggravated Nisdemeanor, in violation of Sections 71+.1(+) and 71+.2(3), !owa Code.

The Defendant is sentenced to pay a fine in the sum of $625.00, plus a 35 surcharge,
a $125.00 Law Enforcement !nitiative Surcharge, the court costs of this action and attorneys
fees as certified by Nr. Rasmussen. Defendant shall further pay restitution in the sum of
$1,997.12 in favor of !owa AutofCar Quest.
Defendant shall pay these financial obligations to the Clerk of Court of this county or
online at www.iowacourts.gov. Defendant shall make payments by way of a plan of payment
developed by his probationary supervisor.
The Defendant is further sentenced to be committed to the custody of the Director of the
Division of Adult Corrections for a term not to exceed two years. Defendant is given credit for
any time served following his arrest on this charge. This sentence is suspended in its entirety
and Defendant is placed on probation to the Second Judicial District Department of Correctional
Services for a term of two years. Conditions of probation are as follows:
1. Defendant shall report to the Second Judicial District Department of Correctional
Services within 7 days of today's date to sign up for probation supervision.
2. Defendant shall pay a probation enrollment fee, the fine, surcharges, restitution,
costs and fees by way of a plan of payment developed by his probation officer.
3. Defendant shall obey all laws.
+. Defendant shall follow any other probation rules developed by his probation
supervisor.
The reasons for this sentence include the following: Defendant's age; prior criminal
history; attitude toward rehabilitation; facts and circumstances of this case; family and
employment circumstances; need for protection of the community and deterrent impact upon
Defendant and others similarly situated.
Any bond money previously posted is released and exonerated.
Appeal bond is set in the sum of $2,000.00.
!T !S FURTHER ORDERED that Count !! of the Trial !nformation is dismissed upon motion
of the county attorney and pursuant to plea agreement. Costs are taxed to Defendant and shall
be paid to the Clerk of Court.
