Conference of Idaho, Nevada and Utah; National Action Network; National Council of La Raza; National Gay and Lesbian Task Force; National Organization for Women Foundation; Oklahomans for Equality; Public Advocates, Inc.; and the Equality Network, by their attorneys, respectfully request leave from the Court pursuant to Federal Rule of Appellate Procedure 27(a) to file an Attachment (the Attachment) to their Brief of Amici Curiae in the above-captioned proceedings. (The Attachment is attached hereto as Exhibit A.) The Attachment is a particularized statement of interest of each of the 22 Amici Curiae, made as short as was reasonably possible given their numbers. The Amici Curiae file this motion in an abundance of caution. The Attachment is not part of the Amici Curiaes substantive arguments in their Brief and their Brief can be considered without reference to the Attachment. If the the Attachment were part of their Brief, however, the Brief would exceed the word limit set in Federal Rules of Appellate Procedure 29(d) and 32(a)(7). Specifically, the Brief is 5,948 words long, well within the 7,000 word limit. The Attachment is 2,567 words long. Counsel for the amici curiae has contacted counsel for the parties to seek consent for this motion. The Defendant-Appellants and the Plantiff-Appellees in Kitchen et al. v. Herbert et al. and the Defendant-Appellant in Bishop et al. v. Smith et al. do not oppose the Amici Curiaes motion for leave to submit additional information. The Amici Curiae were unable to reach counsel for the Plaintiff-Appellee in Bishop et al. v. Smith et al.

FURTHER DESCRIPTION OF AMICI CURIAE The American Civil Liberties Union (ACLU) is a nationwide, nonprofit, nonpartisan organization with over 500,000 members dedicated to defending the principles embodied in the Constitution and our nations civil rights laws. The ACLU of Utah and ACLU of Oklahoma are two of its statewide affiliates. The ACLU, ACLU of Utah, and ACLU of Oklahoma advocate for equal rights of lesbian, gay, bisexual and transgender (LGBT) people and the freedom to marry for same-sex couples in Utah, Oklahoma, and across the country. The Leadership Conference on Civil and Human Rights (The Leadership Conference) is a coalition of more than 200 organizations committed to the protection of civil and human rights in the United States.1 It is the nations oldest, largest, and most diverse civil and human rights coalition. The Leadership Conference was founded in 1950 by three legendary leaders of the civil rights movement - A. Philip Randolph of the Brotherhood of Sleeping Car Porters; Roy Wilkins of the NAACP; and Arnold Aronson of the National Jewish Community Relations Advisory Council. Its member organizations represent people of all races, ethnicities, and sexual orientations. The Leadership Conference

works to build an America that is inclusive and as good as its ideals, and believes that every person in the United States deserves to be free from discrimination based on race, ethnicity, gender, or sexual orientation. The outcome of this case will directly affect our members and constituents rights and economic wellbeing, and that of their families. treatment of LGBT families through community education and advocacy. API Equality-LA recognizes that the long history of discrimination against the API community, especially Californias history of anti-miscegenation laws and exclusionary efforts targeted at Asian immigrants, parallels the contemporary exclusion of gays and lesbians from marriage. Advancing Justice | AAJC is committed to challenging barriers to equality for all sectors of our society and has supported same-sex marriage rights in numerous amicus briefs. Asian Americans Advancing JusticeAsian Law Caucus (Advancing Justice ALC), founded in 1972, is the countrys oldest civil rights and public interest legal organization dedicated to serving Asian and Pacific Islanders communities. The Asian Law Caucus is a member of the Asian American Center for Advancing Justice. Recognizing that social, economic, political, and racial inequalities continue to exist in the United States, the Advancing Justice ALC is 4a

committed to the pursuit of equality and justice for all sectors of our society and in advancing the integrity of the core constitutional principle of equal protection under the law to all Americans. Asian Americans Advancing JusticeChicago (Advancing Justice Chicago) is a pan-Asian,non-partisan, not-for-profit organization located in Chicago, Illinois, whose mission is to empower the Asian American community through advocacy, coalition-building, education, and research. Accordingly, AAI has a strong interest in this case. Asian Americans Advancing Justice - Los Angeles (Advancing JusticeLA) is the nations largest legal and civil rights organization for Asian Americans, Native Hawaiians, and Pacific Islanders (NHPI). NAACP Salt Lake Branch & NAACP Tri-State Conference of Idaho, Nevada and Utah. The mission of the Utah-Nevada-Idaho NAACP State-Area Conference (State-Area Conference) and the Salt Lake City, Utah NAACP Branch (Branch) is to ensure the political, educational, social, and economic equality of all Utah citizens, and to eliminate all forms of discrimination. Toward these ends, the State-Area Conference and Branch have worked tirelessly to protect every Utah citizens right to marry, which includes jointly supporting a heightened scrutiny standard to reject laws that attempt to unconstitutionally restrict this fundamental right based on gender. National Action Network (NAN) is one of the leading civil rights organizations in the nation, with chapters throughout the United States. Founded in 1991 by Reverend Al Sharpton, NAN works within the spirit and tradition of Dr. Martin Luther King, Jr. to promote a modern civil rights agenda that includes the fight for one standard of justice, decency and equal opportunities for all people. That effort is incomplete without working to ensure the equality of opportunities and treatment for the LGBT community. So long as one group is denied equal treatment under the law, the nation falls short of guaranteeing the right of all persons to life, liberty and the pursuit of happiness.

In addition, it provides capacity-building assistance to its Affiliates who work at the state and local level to advance opportunities for individuals and families. National Organization for Women Foundation (NOW) is a 501(c)(3) organization devoted to furthering womens rights through education and litigation. For decades, NOW has advocated for equal rights and full protection of the law for LGBT persons and has led the effort for recognition of same-sex couples equal marriage rights. Oklahomans for Equality has advocated for equal rights for LGBT Oklahomans for 33 years. Daily we see the impact of discrimination and noninclusive public policies in the lives of our clients. In 2013 we served over 45,000 unique individuals at our Tulsa based Dennis R. Neill Equality Center. Among those constituents were our most vulnerable, families with children who see a society that rejects their family, and our elderly who are denied services and equal accommodations because our long term relationships are not recognized. Public Advocates Inc. is a California-based civil rights law firm and advocacy organization that challenges the systemic causes of poverty and racial discrimination by strengthening community voices in public policy and achieving tangible legal victories. Since our founding in 1971, we have engaged in a wide range of cutting edge civil rights issues from school finance, urban development, transportation policy, and climate justice, to language access, employment discrimination, and health services disparities.
