INTERNSHIP REPORT

Priya Arora BSLS 2nd sem Roll No: 6

Day: 1 1st December , 2013 On first day, I reached office at 10.30 am. My sir introduced me to the office staff and Share his college experience and inform me about his practice about Criminal and Civil Matters. On 1st day I have only observed working atmosphere in office. From my very first day I learned the procedure of maintaining the daily board of court matters in the advocates office. I was asked to learn the specifications as further I may be asked to go to courts and bring the next date of the on-going cases. I was also guided and introduced to the atmosphere of court and was suggested that I have to wear formals at the office and while we visit the court. As it was my first day, I was told to read those cases, which has its next hearing on coming dates. I went through the files of different cases and understand the memorial of the file that in which manner such cases should be submitted. Day: 2 2nd December, 2013 On Second day, I reached office at 10.30 am. My sir was busy with client. I had the opportunity of witnessing the client counseling.

The hearing board containing the case which will be deal on that day or heard by the judge and non - hearing board contain on the case which is for service of summonses Notice or for reply and next date is given. Again I read few more files of different cases which my sir had suggested me to read.

Day: 3 3rd December, 2013 On third day I was given the task to arrange case files Datewise. I got to learn how all the case records are so well mantained. And how all the necessary documents related to case are so nicely preserved

I also studied a case and sir asked me my queries aout the case.

Day: 4 4th December, 2013 I reached office at 10.00am. Sir has given me instruction to post the notice via RPAD (Real Property Assessment Division) which he had made me do on previous day and then come back to office. I spent my whole day in office in helping in fixing the cases, their stages, next dates, and some research work relating to cases, in computer. Then I went to court and attended those cases which I read on previous day.

Day: 5 5th December, 2013

1. Ramsey Karshandas Vasava Businessman 2. Kamleshbhai Some Farmer 3. Kanhabhai Joshi Businessman Subject: To make cancellation regarding the sale of land as property and for seeking complete right over property and civil suit filed for the same.

We went up for the hearing learned up new things, it was a great experience. Then went to office n read some more cases till 8:00 pm.

Day: 6 6th December, 2013 I was at 10.00am at office. Went to court by 12.00 on that day Sir had appealed on 3 hearings. And on 1 case there was cross, from which I learned a lot. I leaved court by 5:00pm and directly went to office. Sir called me asked me about my queries if I had any and also asked some questions about the same.

Day: 7 7th December, 2013 We reached at 12.15 p.m. to the court. We went directly to court as Advocate. S.K. Vora was taking cross of the opponent. The case was regarding the property disputes. Then after the break we attended the court of Mr. P.O.Lad in the consumer redressal district forum. The case was regarding deficiency in the service of a doctor in which we were from the respondents side. After the completion of the submission we left the court as than it was turn of the applicants turn after 1 week.

Day: 8 9th December, 2013 Reported to office at 10 am sir was busy with some clients. There are two types of stamp papers, Judicial and Non Judicial. For filling of court case judicial stamp paper are used. For any declaration, agreements, deeds and documents, Non judicial

stamps are used. For Affidavit, minimum stamp of Rs. 20 is required or for other then

affidavit, for any other agreement, deeds, and document, stamp is required as per the rules and regulation of Stamp Act.

I gained some more knowledge about the court. I left office at 8.00 PM.

Day: 9 10th December, 2013 Today I reached office at 10:00 am. My sir had given me a very interesting case to read and also told me to give my opinions on that case. Case Riyasuddin Fakruddin Shaikh v /s State of Guj CrMA/14265/2012

In this case, This case was related to sec 186 of CrPc. Where two or more courts have taken cognizance of the same offence and a question arises as to which of them ought to inquire into or try offence, the question shall be decided1. If the courts are subordinate to the same HC, by that HC.

2. If the courts are not subordinate to the same HC, by the HC within the local limits of whose appellate criminal jurisdiction the proceedings were first commenced and thereupon all other proceedings in respect of that offence shall be discontinued. Related judgments Assam HC Rule made absolute Malta boat tragedy caseMetropolitan Magistrate, Delhi shall try the cases concerning the Malta Boat tragedy case. Order accordingly. According to the provisions and related judgments this case should transfer in the Gujarat High Court.

Day: 10 11th December, 2013 We went to the court at 12.20 p.m. with our senior. They sent us with their clerk Mr.Girish to know more about the procedure and system of the court. They make us understood that how to take dates of the board of our senior. We spent our whole day with him as there are more than 30 courts in total it was very difficult to remember the names of the judges. At least after spending our whole day with him we understood something new about the court.

Day: 11 12th December, 2013 I reached office at 9.00 AM. Sir has given me instruction to post the notice via RPAD which he had made me do on previous day and then come back to office. Then I came to know more about real estate and contracts.

REAL ESTATE

To execute all contracts, deeds, bonds, mortgages, notes, checks, drafts, money orders.

To manage, compromise, settle, and adjust all matters pertaining to real estate.

To lease, collect rents, grant, bargain, sell, or borrow and mortgage.

CONTRACTS, AGREEMENTS

To enter into contacts. Perform any contract, agreement, writing, or thing. To make, sign, execute, and deliver, acknowledge any contract, agreement. I leaved office by 7.30 pm.

Day: 12 13th December, 2013 I reported office at 10 a.m. Today one of our clients Mr. Pinkesh Patel came to the office to meet sir. He has taken land near Mahapura village. That is outskirts of city of Ahmedabad. He already discussed the matter with sir. I just simply heard the matter and tried to understand the thing. That day sir giving advice to

the client, today he is coming for the preparation of agreement for sale with development agreement. He give all the details required for the agreement for sale with development agreement, the matter was then handwritten in Gujarati. Went to court by 12.00 on that day Sir had appealed on 3 hearings. And on 1 case there was cross, from which I learned a lot. I leaved court by 8.00pm.

Day: 13 14th December, 2013 We reached at 11.30 a.m. to the court. As our senior lawyer told us to sit in the court of C.J.M.F.C. (Chief Judicial Magistrate First Class) They want us to sit there to experience the hearing for the bailment of people or prisoner whoever committed any crime & whosoever under custody of any police authority. Police authority brought them in front of the court to decide, whether the wrongdoer is bail able or not. We sat there almost for 2 hours. Then after the break we went to the court of small causes where one case was going on of the dispute between landlord and tenant. Then after it we left from the court.

Day: 14 16th December, 2013 On the very first day of this training we went to the office Mr Vijay Patel to gather some basic information of the High Court. They make us understood the basic infrastructure of the court. On the first day we made ourselves a little familiar with a new place.

We saw the chamber of Chief Justice of the High Court. There were mainly 30 courts but merely 22 courts are sitting regularly. We saw Advocates library, Public Library and Advocates chamber also. We visited the mediation centre also. Our lawyer didnt give us too much work load they told us to come on the 2nd day.

Day: 15 17th December, 2013 I reported office at 10 a.m. Today one of our clients Mr. Pinkesh Patel came to the office to meet sir. He has taken land near Mahapura village. That is outskirts of city of ahmedabad. He already discussed the matter with sir. I just simply heard the matter and tried to understand the thing. That day sir giving advice to the client, today he is coming for the preparation of agreement for sale with development agreement. Day: 16 18th December, 2013 We reached at 11 oclock to the court. Our senior told us to sit in the court of Honble Mr. Justice S.R.Brahmbhatt as there were cases of our senior. We sat there for 2 hours after the completion of the work we went in the court of Honble Ms. Justice Abhilasha Kumari.

In this court we found very difference between the district court or any other court from the High Court. Everyone was seemed very nervous in front of the Judges. Administration of the court was so good that even other judges also got energy to run as much cases they could. It was a very good and prideful moment for us all. We could see our future there and it gave us the strength to do hard work in our studies and many more other activities.

Day: 17 19th December, 2013 We reached court at 10:45 a.m. Our senior gave us there board of cases and from that basis we found that our sir had many cases in the court of Honble Mr. Mohinder Pal. We went there and heard the arguments of famous public prosecutor Mr.Mihir Thakore and also saw Mr.Yatin Oza. We also saw one party in person who was dealing in his case with his own knowledge and strength. We got shocked on seeing research made by him in his own case. He presented his case very wisely and politely and also with full confidence.

Day: 18 20th December, 2013 I reached office at 10 am. Today I am waiting for the party Mr. Rakish Patel because sir gives him time to come to office. The client came to office on time sir give him the papers as per his requirement and as per the details given by

him, he read the documents of the agreement for sale with development agreement. He is very happy with the work and gives approval to the document and said thanks to sir. He takes the documents. I left office at 7:00 pm.

Day: 19 21st December, 2013 We reached at 11 oclock to the court. Our senior has told us to sit in the court of Honble Mr. Justice A.J.Desai. After the break we went in the court of Honble Mr. Justice V.M.Sahais Court. We went in the criminal department also in the court of Honble Mr. Justice J.C.Upadhyay. Our senior had one matter regarding the detention of one motor vehicle and truck from one person other than police or any competetent authority.

Day: 20 23rd December, 2013 Today I reached to office at 10 am. Today sir has appointment with one of our client Mr. Praveen Shah. He is deal with the sir since long time. Today he is coming for the Power of attorney. He wants to prepare power of attorney for the land Modh village Baroda. For that sir wants Land village records 7/12. From that the name of the land owners, age, address etc. are taken from the party. Sir also takes the details about the name of the person for whom Power of Attorney made. Means the he required the name of the power of attorney holder. Sir gives all details to his junior advocate and me. Sir explain all the thing nicely and give the details of the power of attorney holders like name of the

parties, age, address, profession, etc. and teach us how to prepared the power of attorney. And give details. I left court at 7pm.

Day: 21 26th December, 2013 On this day we again visited ahemdabad high court. They taught us the filing of the case in the High Court and make us understood that the whole procedure of the High Court is very different from all other courts of the State. We enjoyed a lot there and then we left for Rajkot with full of new knowledge and experience.

Day: 22 27th December, 2013 I reported office at 10.00 am. Today one of the clients Mr. Kuna Aria came to office to meet sir. He came to the office for the sale deed of the new skim of flats. Sir took several document of the property like property card, map of the area, Building permission, N.A order, development agreement, revenue records etc. He also gave advice to client, to take one photograph of the property with party. Also take seller/ vendors or purchasers photo Identity card like PAN card, voting card, etc. and passport size photographs of seller/ vendors or purchasers.

Day: 23 28th December, 2013 Today I learned how to make Title Clearance Certificate and did a lot of typing of notices and documents and sir alo gave me the task of arranging case files and documents Day: 24 30th December, 2013 Today I reached to office at 10 am. Today sir has appointment with one of our client Mr. Praveen Shah. He is deal with the sir since long time. Today he is coming for the Power of attorney. He wants to prepare power of attorney for the land Modh village Baroda. For that sir wants Land village records 7/12. From that the name of the land owners, age, address etc. are taken from the party. Sir also takes the details about the name of the person for whom Power of Attorney made. Day: 25 31st December, 2013 As it was last day of my internship sir didnt assign me any work. Sir asked me about what new things I had learned and how was the experience with the new atmosphere.

My sir gives me leave on that day from office. I had a feedback session with both the sir. And I received my internship certificate on the date 7th January, 2014.
