This registered, copyrighted work has been published and distributed unaccredited and unauthorized on your organizations website and subsequently posted on the link below, where it appears as of the date of this letter. http://www htm

The poem, The Dash, is a registered, copyrighted work. A search on the Internet would have found for you the author of the poem, as well as copyright information. The copyright number for the poem The Dash is TXu 858-108 as filed with The Library of Congress. This poem is a product of Ms. Ellis company, Lindas Lyrics. Please understand, it is irrelevant how you obtained the work, or if yours is a profit, or non-profit organization, the damages to Ms. Ellis and her company are the same. You had a legal (and ethical) obligation to find the author and/or copyright information. You have not only distributed this product without consideration of the author, you have done so without the authors permission, information or copyright and subsequently posted it on the worldwide web. As illustrated by your own actions, many to whom you have distributed this work will inevitably distribute it also, thereby perpetuating the illegal distribution of copyrighted material causing irreparable, immeasurable harm to the value and integrity of Ms. Ellis work. Your actions have negatively affected her company monetarily, by freely distributing the product which is the cornerstone of her livelihood and furthermore posting its text on the worldwide web, thus diverting Internet traffic from her website where the product is sold. As a result of your illegal use of this work, Lindas Lyrics will inevitably have to pay intellectual property attorneys to defend the copyright because of those who were exposed to it through your unauthorized use. At this point, removal of the poem is not enough. There are now damages to consider. You should be aware that to protect her rights in "The Dash" and other works, Ms. Ellis has, and will continue to, vigorously enforce her copyright(s). The U.S. District Court for the Northern District of Georgia recently awarded to her, and the United States Court of Appeals for the

Eleventh Circuit affirmed, the maximum award in statutory damages and attorneys' fees for infringement of the copyright of "The Dash." United States Copyright Laws prohibit the unauthorized copying, distribution and/or use of copyrighted materials. These laws entitle a copyright owner to receive actual damages resulting from the infringement plus any additional profits of the infringer, or statutory damages of up to $30,000 for each act of infringement. 17 U.S.C. 504. In addition, the laws provide for statutory damages to be increased up to $150,000 in cases involving deliberate infringement, such as where the infringement persists even after the infringer receives notice from the copyright owner. The copyright statute also provides for a recovery of attorneys' fees and costs against an infringing party. 17 U.S.C. 505. We must continue to enforce our copyright standards and practices to maintain the value and integrity of this work. However, we do wish to settle this matter fair and amicably. Our company, Linda's Lyrics, has an established system in place for the use of our original, copyrighted works. The current standard royalty rate for your unauthorized and unaccredited use and distribution of this registered, copyrighted work is $7,500.00 (US). We are willing to offer you and your organization a full release from liability for this copyright infringement, required licensing fees and associated statutory damages, at this established rate. Additionally, we will require the immediate removal of the poem from the web site and that you publish a correction, with verbiage that will be supplied in our Liability Release. We are hopeful of resolving this matter without having to refer it to our legal counsel to protect the intellectual property rights of "The Dash" and Linda's Lyrics.
