-7 !e8uire,ents of +rior En1iron,ental 6learance (E6)9 . ;he following projects or activities shall re9 ire prior environmental clearance from the concerned reg lator" a thorit", which shall hereinafter referred to be as the 'entral (overnment in the <inistr" of %nvironment and =orests for matters falling nder 'ategor" >+? in the Sched le and at State level the State %nvironment #mpact +ssessment + thorit" ,S%#++- for matters falling nder 'ategor" >@? in the said Sched le, before an" constr ction wor!, or preparation of land b" the project management except for sec ring the land, is started on the project or activit"A ,i+ll new projects or activities listed in the Sched le to this notification5

,ii%xpansion and modernization of existing projects or activities listed in the Sched le to this notification with addition of capacit" be"ond the limits specified for the concerned sector, that is, projects or activities which cross the threshold limits given in the Sched le, after expansion or modernization5

,iii- +n" change in prod ct . mix in an existing man fact ring nit incl ded in Sched le be"ond the specified range. 37 State :e1el En1iron,ent I,+act &ssess,ent &uthority9- ()) + State *evel %nvironment #mpact +ssessment + thorit" hereinafter referred to as the S%#++ shall be constit ted b" the 'entral (overnment nder s b.section ,3- of section 3 of the %nvironment ,&rotection- +ct, 1/01 comprising of three <embers incl ding a 'hairman and a <ember B Secretar" to be nominated b" the State (overnment or the )nion territor" +dministration concerned. ,2,3,3,5;he <ember.Secretar" shall be a serving officer of the concerned State (overnment or )nion territor" administration familiar with environmental laws. ;he other two <embers shall be either a professional or expert f lfilling the eligibilit" criteria given in +ppendix C# to this notification. One of the specified <embers in s b.paragraph ,3- above who is an expert in the %nvironmental #mpact +ssessment process shall be the 'hairman of the S%#++. ;he State (overnment or )nion territor" +dministration shall forward the names of the <embers and the 'hairman referred in s b. paragraph 3 to 3 above to the 'entral (overnment and the 'entral (overnment shall constit te the S%#++ as an a thorit" for the p rposes of this notification within thirt" da"s of the date of receipt of the names. ;he non.official <ember and the 'hairman shall have a fixed term of three "ears ,from the date of the p blication of the notification b" the 'entral (overnment constit ting the a thorit"-. +ll decisions of the S%#++ shall be nanimo s and ta!en in a meeting. 6ate4orization of +ro;ects and acti1ities9-

,i+ll projects and activities are broadl" categorized in to two categories . 'ategor" + and 'ategor" @, based on the spatial extent of potential impacts and potential impacts on h man health and nat ral and man made reso rces. ,ii+ll projects or activities incl ded as 'ategor" >+? in the Sched le, incl ding expansion and modernization of existing projects or activities and change in prod ct mix, shall re9 ire prior environmental clearance from the 'entral (overnment in the <inistr" of %nvironment and =orests ,<o%=- on the recommendations of an %xpert +ppraisal 'ommittee ,%+'- to be constit ted b" the 'entral (overnment for the p rposes of this notification5 ,iii+ll projects or activities incl ded as 'ategor" >@? in the Sched le, incl ding expansion and modernization of existing projects or activities as specified in s b paragraph ,ii- of paragraph 2, or change in prod ct mix as specified in s b paragraph ,iii- of paragraph 2, b t excl ding those which f lfill the (eneral 'onditions ,('- stip lated in the Sched le, will re9 ire prior environmental clearance from the StateD)nion territor" %nvironment #mpact +ssessment + thorit" ,S%#++-. ;he S%#++ shall base its decision on the recommendations of a State or )nion territor" level %xpert +ppraisal 'ommittee ,S%+'- as to be constit ted for in this notification. #n the absence of a d l" constit ted S%#++ or S%+', a 'ategor" >@? project shall be treated as a 'ategor" >+? project5 07 Screenin4, Sco+in4 and &++raisal 6o,,itteesA.

;he same %xpert +ppraisal 'ommittees ,%+'s- at the 'entral (overnment and S%+'s ,hereinafter referred to as the ,%+'- and ,S%+'- at the State or the )nion territor" level shall screen, scope and appraise projects or activities in 'ategor" >+? and 'ategor" >@? respectivel". %+' and S%+'?s shall meet at least once ever" month. ,a;he composition of the %+' shall be as given in +ppendix C#. ;he S%+' at the State or the )nion territor" level shall be constit ted b" the 'entral (overnment in cons ltation with the concerned State (overnment or the )nion territor" +dministration with identical composition5 ,b;he 'entral (overnment ma", with the prior conc rrence of the concerned State (overnments or the )nion territor" +dministrations, constit tes one S%+' for more than one State or )nion territor" for reasons of administrative convenience and cost5 ,c;he %+' and S%+' shall be reconstit ted after ever" three "ears5

,d;he a thorised members of the %+' and S%+', concerned, ma" inspect an" site,sconnected with the project or activit" in respect of which the prior environmental clearance is so ght, for the p rposes of screening or scoping or appraisal, with prior notice of at least seven da"s to the applicant, who shall provide necessar" facilities for the inspection5 ,e;he %+' and S%+'s shall f nction on the principle of collective responsibilit". ;he 'hairperson shall endeavo r to reach a consens s in each case, and if consens s cannot be reached, the view of the majorit" shall prevail. /7 &++lication for Prior En1iron,ental 6learance (E6)9-

+n application see!ing prior environmental clearance in all cases shall be made in the prescribed =orm 1 annexed herewith and S pplementar" =orm 1+, if applicable, as given in +ppendix ##, after the identification of prospective site,s- for the project andDor activities to

which the application relates, before commencing an" constr ction activit", or preparation of land, at the site b" the applicant. ;he applicant shall f rnish, along with the application, a cop" of the pre.feasibilit" project report except that, in case of constr ction projects or activities ,item 0 of the Sched le- in addition to =orm 1 and the S pplementar" =orm 1+, a cop" of the concept al plan shall be provided, instead of the pre.feasibilit" report. <7 Sta4es in the Prior En1iron,ental 6learance (E6) Process for Ne( Pro;ects9-

<(i) ;he environmental clearance process for new projects will comprise of a maxim m of fo r stages, all of which ma" not appl" to partic lar cases as set forth below in this notification. ;hese fo r stages in se9 ential order areA. Stage ,1- Screening ,Onl" for 'ategor" >@? projects and activitiesStage ,2- Scoping Stage ,3- & blic 'ons ltation Stage ,3- +ppraisal

Sta4e ()) - Screenin4A #n case of 'ategor" >@? projects or activities, this stage will entail the scr tin" of an application see!ing prior environmental clearance made in =orm 1 b" the concerned State level %xpert +ppraisal 'ommittee ,S%+'- for determining whether or not the project or activit" re9 ires f rther environmental st dies for preparation of an %nvironmental #mpact +ssessment ,%#+- for its appraisal prior to the grant of environmental clearance depending p on the nat re and location specificit" of the project . ;he projects re9 iring an %nvironmental #mpact +ssessment report shall be termed 'ategor" >@1? and remaining projects shall be termed 'ategor" >@2? and will not re9 ire an %nvironment #mpact +ssessment report. =or categorization of projects into @1 or @2 except item 0 ,b-, the <inistr" of %nvironment and =orests shall iss e appropriate g idelines from time to time. ##. Sta4e (-) - Sco+in4A ,iEScopingFA refers to the process b" which the %xpert +ppraisal 'ommittee in the case of 'ategor" >+? projects or activities, and State level %xpert +ppraisal 'ommittee in the case of 'ategor" >@1? projects or activities, incl ding applications for expansion andDor modernization andDor change in prod ct mix of existing projects or activities, determine detailed and comprehensive ;erms Of 6eference ,;O6- addressing all relevant environmental concerns for the preparation of an %nvironment #mpact +ssessment ,%#+- 6eport in respect of the project or activit" for which prior environmental clearance is so ght. ;he %xpert +ppraisal 'ommittee or State level %xpert +ppraisal 'ommittee concerned shall determine the ;erms of 6eference on the basis of the information f rnished in the prescribed application =orm1D=orm 1+ incl ding ;erns of 6eference proposed b" the applicant, a site visit b" a s b. gro p of %xpert +ppraisal 'ommittee or State level %xpert +ppraisal 'ommittee concerned onl" if considered necessar" b" the %xpert +ppraisal 'ommittee or State *evel %xpert +ppraisal 'ommittee concerned, ;erms of 6eference s ggested b" the applicant if f rnished and other information that ma" be available with the %xpert +ppraisal 'ommittee or State *evel %xpert +ppraisal 'ommittee concerned. +ll projects and activities listed as 'ategor" >@? in #tem 0 of the Sched le ,'onstr ctionD;ownshipD'ommercial 'omplexes DGo sing- shall not re9 ire Scoping and will be appraised on the basis of =orm 1D =orm 1+ and the concept al plan.

,ii;he ;erms of 6eference ,;O6- shall be conve"ed to the applicant b" the %xpert +ppraisal 'ommittee or State *evel %xpert +ppraisal 'ommittee as concerned within sixt" da"s of the receipt of =orm 1. #n the case of 'ategor" + G"droelectric projects #tem 1,c- ,i- of the Sched le the ;erms of 6eference shall be conve"ed along with the clearance for pre.constr ction activities .#f the ;erms of 6eference are not finalized and conve"ed to the applicant within sixt" da"s of the receipt of =orm 1, the ;erms of 6eference s ggested b" the applicant shall be deemed as the final ;erms of 6eference approved for the %#+ st dies 7 ;he approved ;erms of 6eference shall be displa"ed on the website of the <inistr" of %nvironment and =orests and the concerned State *evel %nvironment #mpact +ssessment + thorit". ,iii+pplications for prior environmental clearance ma" be rejected b" the reg lator" a thorit" concerned on the recommendation of the %+' or S%+' concerned at this stage itself. #n case of s ch rejection, the decision together with reasons for the same shall be comm nicated to the applicant in writing within sixt" da"s of the receipt of the application. ###. Sta4e (3) - Public 6onsultationA ,i- E& blic 'ons ltationF refers to the process b" which the concerns of local affected persons and others who have pla sible sta!e in the environmental impacts of the project or activit" are ascertained with a view to ta!ing into acco nt all the material concerns in the project or activit" design as appropriate. +ll 'ategor" >+? and 'ategor" @1 projects or activities shall nderta!e & blic 'ons ltation, except the followingA. ,a,bmodernization of irrigation projects ,item 1,c- ,ii- of the Sched le-. all projects or activities located within ind strial estates or par!s ,item 7,cof the Sched le- approved b" the concerned a thorities, and which are not disallowed in s ch approvals. expansion of 6oads and Gighwa"s ,item 7 ,f- of the Sched le- which do not involve an" f rther ac9 isition of land. all @ ilding D'onstr ction projectsD+rea Hevelopment projects and ;ownships ,item 0-. all 'ategor" >@2? projects and activities. all projects or activities concerning national defence and sec rit" or involving other strategic considerations as determined b" the 'entral (overnment.

,iiithe p blic hearing at, or in close proximit" to, the site,s- in all cases shall be cond cted b" the State &oll tion 'ontrol @oard ,S&'@- or the )nion territor" &oll tion 'ontrol 'ommittee ,);&''- concerned in the specified manner and forward the proceedings to the reg lator" a thorit" concerned within 35,fort" five - of a re9 est to the effect from the applicant. ,ivin case the State &oll tion 'ontrol @oard or the )nion territor" &oll tion 'ontrol 'ommittee concerned does not nderta!e and complete the p blic hearing within the specified period, andDor does not conve" the proceedings of the p blic hearing within the prescribed period directl" to the reg lator" a thorit" concerned as above, the reg lator" a thorit" shall engage another p blic agenc" or a thorit" which is not s bordinate to the reg lator" a thorit", to complete the process within a f rther period of fort" five da"s,. ,v#f the p blic agenc" or a thorit" nominated nder the s b paragraph ,iii- above reports to the reg lator" a thorit" concerned that owing to the local sit ation, it is not possible to cond ct the p blic hearing in a manner which will enable the views of the concerned local persons to be freel" expressed, it shall report the facts in detail to the concerned reg lator" a thorit", which ma", after d e consideration of the report and other reliable information that it ma" have, decide that the p blic cons ltation in the case need not incl de the p blic hearing. ,vi- =or obtaining responses in writing from other concerned persons having a pla sible sta!e in the environmental aspects of the project or activit", the concerned reg lator" a thorit" and the State &oll tion 'ontrol @oard ,S&'@- or the )nion territor" &oll tion 'ontrol 'ommittee ,);&''- shall invite responses from s ch concerned persons b" placing on their website the S mmar" %#+ report prepared in the format given in +ppendix ###+ b" the applicant along with a cop" of the application in the prescribed form , within seven da"s of the receipt of a written re9 est for arranging the p blic hearing . 'onfidential information incl ding non.disclosable or legall" privileged information involving #ntellect al &ropert" 6ight, so rce specified in the application shall not be placed on the web site. ;he reg lator" a thorit" concerned ma" also se other appropriate media for ens ring wide p blicit" abo t the project or activit". ;he reg lator" a thorit" shall, however, ma!e available on a written re9 est from an" concerned person the Hraft %#+ report for inspection at a notified place d ring normal office ho rs till the date of the p blic hearing. +ll the responses received as part of this p blic cons ltation process shall be forwarded to the applicant thro gh the 9 ic!est available means. ,vii+fter completion of the p blic cons ltation, the applicant shall address all the material environmental concerns expressed d ring this process, and ma!e appropriate changes in the draft %#+ and %<&. ;he final %#+ report, so prepared, shall be s bmitted b" the applicant to the concerned reg lator" a thorit" for appraisal. ;he applicant ma" alternativel" s bmit a s pplementar" report to draft %#+ and %<& addressing all the concerns expressed d ring the p blic cons ltation. I%7 Sta4e (*) - &++raisalA ,i+ppraisal means the detailed scr tin" b" the %xpert +ppraisal 'ommittee or State *evel %xpert +ppraisal 'ommittee of the application and other doc ments li!e the =inal %#+ report, o tcome of the p blic cons ltations incl ding p blic hearing proceedings, s bmitted b" the applicant to the reg lator" a thorit" concerned for grant of environmental clearance. ;his appraisal shall be made b" %xpert +ppraisal 'ommittee or State *evel %xpert +ppraisal 'ommittee concerned in a transparent manner in a proceeding to which the applicant shall be invited for f rnishing necessar" clarifications in person or thro gh an a thorized representative. +ppraisal 'ommittee concerned shall ma!e categorical recommendations to the reg lator" a thorit" concerned either for grant of prior environmental clearance on stip lated terms and conditions, or rejection of the application for prior environmental clearance, together with reasons for the same. ,ii;he appraisal of all projects or activities which are not re9 ired to ndergo p blic cons ltation, or s bmit an %nvironment #mpact +ssessment report, shall be carried o t on the basis of the prescribed application =orm 1 and =orm 1+ as applicable, an" other relevant validated information available and the site visit wherever the same is considered as necessar" b" the %xpert +ppraisal 'ommittee or State *evel %xpert +ppraisal 'ommittee concerned. ,iii- ;he appraisal of an application be shall be completed b" the %xpert +ppraisal 'ommittee or State *evel %xpert +ppraisal 'ommittee concerned within sixt" da"s of the receipt of the final %nvironment #mpact +ssessment report and other doc ments or the receipt of =orm 1 and =orm 1 +, where p blic cons ltation is not necessar" and the recommendations of the %xpert +ppraisal 'ommittee or State *evel %xpert +ppraisal 'ommittee shall be placed before the competent a thorit" for a final decision within the next fifteen da"s .;he prescribed proced re for appraisal is given in +ppendix C 5 <(ii)7 Prior En1iron,ental 6learance (E6) +rocess for Ex+ansion or Modernization or 6han4e of +roduct ,ix in existin4 +ro;ectsA +ll applications see!ing prior environmental clearance for expansion with increase in the prod ction capacit" be"ond the capacit" for which prior environmental clearance has been granted nder this notification or with increase in either lease area or prod ction capacit" in the case of mining projects or for the modernization of an existing nit with increase in the total prod ction capacit" be"ond the threshold limit prescribed in the Sched le to this notification thro gh change in process and or technolog" or involving a change in the prod ct Bmix shall be made in =orm # and the" shall be considered b" the concerned %xpert +ppraisal 'ommittee or State *evel %xpert +ppraisal 'ommittee within sixt" da"s, who will decide on the d e diligence necessar" incl ding preparation of %#+ and p blic cons ltations and the application shall be appraised accordingl" for grant of environmental clearance. 37Grant or !e;ection of Prior En1iron,ental 6learance (E6)9 ,i;he reg lator" a thorit" shall consider the recommendations of the %+' or S%+' concerned and conve" its decision to the applicant within fort" five da"s of the receipt of the recommendations of the %xpert +ppraisal 'ommittee or State *evel %xpert +ppraisal 'ommittee concerned or in other words within one h ndred and five da"s of the receipt of the final %nvironment #mpact +ssessment 6eport, and where %nvironment #mpact +ssessment is not re9 ired, within one h ndred and five da"s of the receipt of the complete application with re9 isite doc ments, except as provided below. ,ii;he reg lator" a thorit" shall normall" accept the recommendations of the %xpert +ppraisal 'ommittee or State *evel %xpert +ppraisal 'ommittee concerned. #n cases where it disagrees with the recommendations of the %xpert +ppraisal 'ommittee or State *evel %xpert +ppraisal 'ommittee concerned, the reg lator" a thorit" shall re9 est reconsideration b" the %xpert +ppraisal 'ommittee or State *evel %xpert +ppraisal 'ommittee concerned within fort" five da"s of the receipt of the recommendations of the %xpert +ppraisal 'ommittee or State *evel %xpert +ppraisal 'ommittee concerned while stating the reasons for the disagreement. +n intimation of this decision shall be sim ltaneo sl" conve"ed to the applicant. ;he %xpert

+ppraisal 'ommittee or State *evel %xpert +ppraisal 'ommittee concerned, in t rn, shall consider the observations of the reg lator" a thorit" and f rnish its views on the same within a f rther period of sixt" da"s. ;he decision of the reg lator" a thorit" after considering the views of the %xpert +ppraisal 'ommittee or State *evel %xpert +ppraisal 'ommittee concerned shall be final and conve"ed to the applicant b" the reg lator" a thorit" concerned within the next thirt" da"s. ,iii#n the event that the decision of the reg lator" a thorit" is not comm nicated to the applicant within the period specified in s b.paragraphs ,i- or ,ii- above, as applicable, the applicant ma" proceed as if the environment clearance so ght for has been granted or denied b" the reg lator" a thorit" in terms of the final recommendations of the %xpert +ppraisal 'ommittee or State *evel %xpert +ppraisal 'ommittee concerned. ,ivOn expir" of the period specified for decision b" the reg lator" a thorit" nder paragraph ,i- and ,ii- above, as applicable, the decision of the reg lator" a thorit", and the final recommendations of the %xpert +ppraisal 'ommittee or State *evel %xpert +ppraisal 'ommittee concerned shall be p blic doc ments. ,v- 'learances from other reg lator" bodies or a thorities shall not be re9 ired prior to receipt of applications for prior environmental clearance of projects or activities, or screening, or scoping, or appraisal, or decision b" the reg lator" a thorit" concerned, nless an" of these is se9 entiall" dependent on s ch clearance either d e to a re9 irement of law, or for necessar" technical reasons. ,viHeliberate concealment andDor s bmission of false or misleading information or data which is material to screening or scoping or appraisal or decision on the application shall ma!e the application liable for rejection, and cancellation of prior environmental clearance granted on that basis. 6ejection of an application or cancellation of a prior environmental clearance alread" granted, on s ch gro nd, shall be decided b" the reg lator" a thorit", after giving a personal hearing to the applicant, and following the principles of nat ral j stice. 27 %alidity of En1iron,ental 6learance (E6)9 ;he ECalidit" of %nvironmental 'learanceF is meant the period from which a prior environmental clearance is granted b" the reg lator" a thorit", or ma" be pres med b" the applicant to have been granted nder s b paragraph ,iv- of paragraph 7 above, to the start of prod ction operations b" the project or activit", or completion of all constr ction operations in case of constr ction projects ,item 0 of the Sched le-, to which the application for prior environmental clearance refers. ;he prior environmental clearance granted for a project or activit" shall be valid for a period of ten "ears in the case of 6iver Calle" projects ,item 1,c- of the Sched le-, project life as estimated b" %xpert +ppraisal 'ommittee or State *evel %xpert +ppraisal 'ommittee s bject to a maxim m of thirt" "ears for mining projects and five "ears in the case of all other projects and activities. Gowever, in the case of +rea Hevelopment projects and ;ownships Iitem 0,b-J, the validit" period shall be limited onl" to s ch activities as ma" be the responsibilit" of the applicant as a developer. ;his period of validit" ma" be extended b" the reg lator" a thorit" concerned b" a maxim m period of five "ears provided an application is made to the reg lator" a thorit" b" the applicant within the validit" period, together with an pdated =orm 1, and S pplementar" =orm 1+, for 'onstr ction projects or activities ,item 0 of the Sched le-. #n this regard the reg lator" a thorit" ma" also cons lt the %xpert +ppraisal 'ommittee or State *evel %xpert +ppraisal 'ommittee as the case ma" be.
