An ordinance relating to small domestic animals, amending SMC sections 17A.020.040, 17C.310.010, 17C.310.100 and 17C.310.120 and adopting new sections 17C.310.115 and 17C.310.170 to chapter 17C.310 of the Spo ane M!nicipal Code. "he Cit# of Spo ane does ordain$ Section 1. "hat SMC section 17C.310.010 is amended to read as follows$

17C.310.010 Purpose A. Animal %eeping. "he p!rpose of this chapter is to ma e pro&isions for and set limits on the eeping of animals within the Cit# limits. "his section recogni'es the commercial and sport animal eeping acti&ities as well as the desire of citi'ens to eep pets. "he pro&isions of this section stri&e to pro&ide the (roadest personal discretion in animal eeping. )owe&er, since the Cit# is characteri'ed as an intense !r(an en&ironment with people li&ing in close pro*imit#, this section also emphasi'es the significant responsi(ilit# of animal owners and eepers to protect the rights and lifest#les of their neigh(ors. Animal owners and eepers are e*pected to meet the following re+!irements as a reflection of their responsi(ilit#. 1. ,nrestrained Animals. -wners and eepers are to eep all animals contained within a str!ct!re or fenced #ard or on a leash or other appropriate harness or retraining de&ice capa(le of safel# controlling the animal. As pro&ided in chapter ..10.24 SMC// 5.04 of the Spo ane Co!nt# Code, no ..animal// dog ma# (e permitted to r!n at large. 0acing1homing pigeons are allowed to fl# !nrestrained d!ring periods of e*ercise, training and racing. 2. 2ois# Animals. -wners and eepers are to pre&ent their animals from ma ing !nnecessar# or !n!s!al noises to the e*tent that ..other// reasona(le persons are anno#ed. Chapter ..10.03 SMC// 5.04 of the Spo ane Co!nt# Code and chapter 10.034 SMC relate to nois# animals. ..5otentiall# 6icio!s Animals.// 4angero!s 4og, 5otentiall# 4angero!s 4og and 7nherentl# 4angero!s Animals. ..Chapter 10.03 SMC re+!ires owners and eepers of potentiall# &icio!s animals to confine and control s!ch animals at all times so as to pre&ent them from endangering an# person or propert#.// "he eeping of dangero!s or potentiall# dangero!s dogs shall (e reg!lated p!rs!ant to chapter 10.03 SMC. "he eeping of inherentl# dangero!s animals is prohi(ited in all 'ones p !rs!ant to SMC 17C.310.150, e*cept as pro&ided in Chapter 5.12 of the Spo ane Co!nt# Code.
