ORDINANCE NO. 06, s. 1998 Be it enacted by the Sangguniang Barangay of Pico, La Trinidad, Benguet, adopting an Ordinance imposing the collection of Clearance fee to all applicants for Business permit. WHEREAS, the members of the Sangguniang Barangay of Pico during its regular meeting held on January 30, 2014, have agreed unanimously to adopt an Ordinance imposing the collection of clearance free for business permits; WHEREAS, this Ordinance, if implemented, will contribute as additional income of the Barangay, as provided for under the Barangay Development Plan covered under Section 391, Chapter 4 of the Local Government Code of 1991, and under Section 3A-04 of the 1995 Municipal Revised Revenue Code. NOW THEREFORE, be it ORDAINED by the Sangguniang Barangay of Pico in session assembled that: Section 1, The amount of Fifty Pesos (P 50.00) shall be collected from any constituents who shall apply for a business permit, as clearance fee. RESOLVED FURTHER, that the Municipal Sangguniang Bayan shall also include and impose to business permit applicants the clearance first from the Barangay, before securing business permit forms from the Mayor`s office, copy of the clearance for business permit is herewith attached; RESOLVED FINALLY, as it is hereby done to submit copy of this Ordinance to the La Trinidad Municipal Sangguniang Bayan, thru the office of Honorable Mayor Nestor B. Fongwan, for favorable consideration and appropriate action; We hereby CERTIFY that the foregoing Ordinance No. 06, s. 1998 was duly enacted by the Sangguniang Barangay in its regular meeting on January 30,2014

ORDINANCE NO. 04, s. 1997 IMPOSING THE COLLECTION OF BARANGAY CERTIFICATION AND CLEARANCE FEE OF P50.00 FOR LOCAL PURPOSES AND P100.00 FOR ABROAD. WHEREAS, Sec. 129 of R.A. 7160 provides that Each local government unit shall exercise its powers to create its own resources of revenue and to laxy taxes,face and charges subject to the provisions herein consistent with the basic policy of the local autonomy WHEREAS, Sec. 152 of R.A. 7160 provides the scope of taxing powers of Barangay, NOW THEREFORE, BE IT ORDAINED by the Sangguniang Barangay of Pico, La Trinidad, Benguet Province, in session assembled that: SECTION 1. There shall be collection the amount of fifty pesos (P50.00)for local clearance and certifications, and one hundred pesos (P100.00) for clearance for abroad. SECTION 2. This Ordinance shall take affect upon its approved. RESOLVED, s it is hereby done, to submit copy of this ordinance to the office of Municipal Sangguniang Bayan, La Trinidad, Benguet Province, for favorable and appropriate action. ENACTING AN ORDINANCE ON THE COLLECTION OF FEES AND CHARGES ON BILLBOARD, SIGNBOARDS, NEON SIGNS AND OUTDOOR ADVERTISEMENTS OF WITHIN BARANGAY PICO

WHEREAS, the population of Barangay Pico has increased to an unimaginable percentage, thus requiring additional funds to support its maintenance and other operational expenses (MOOE), especially the promotion of the general welfare of its inhabitants; WHEREAS, the Barangay council of Pico has created a street sweeper position to carry out the purpose of the Solid waste management program of the Barangay. Other positions are planned to be created to carry out other purposes of the Barangay upon raising sufficient funds; WHEREAS, as provided in section 152 (scope of Taxing Powers), Article 4, Book 11 of the Republic Act 7160, the Barangay may levy reasonable fees and charges on billboards, Signboards, Neon signs and outdoor advertisement; On motion of ***********, be it; ORDAINED by the Sanggubiang Barangay of Pico, La Trinidad, Benguet, in session assembled that: Section 1. Title- This Ordinance shall be known as Collection of Fees and charges on Billboards, signboards, neon signs, and outdoor advertisements within Barangay Pico; Section 2. Purpose- To raise Barangay funds to support the Maintenance and other operational expenses (MOOE) of the Barangay so as to promote the general welfare of its inhabitants in an efficient, effective and economical manner; Section 3. Definition of terms- As used in this Ordinance. 1. Billboard- A wall of heavy boards for the display of advertisements and posters for business or professions 2. Signboard- Any boards or flat sheets on which is printed an advertisements for business or professions 3. Neon sign- Are signs for business or profession illuminated by neon lights 4. Outdoor advertisements- Advertisement of business or profession remote from the place of business or where the profession is conducted. Section 4. Imposition of Fees and charges- There are hereby imposed fees and charges on billboards, signboard, neon sign, and outdoor advertisements at ratez prescribed herein:

1. Billboards or signs for advertisement of business, per square meter or fraction thereof: Single Faced Twenty pesos (P20.00) Double Faced Forty pesos (P40.00) 2. Billboards, or signs for professionals, per square meter or fraction thereof; Twenty pesos (P20.00) 3. Billboards, signs or advertisements for business or profession painted on the building or structure or otherwise separated or detached therefrom, per square meter thereof- Twenty pesos (P20.00) 4. For the use of electric or neon lights in billboards, under Section 4, paragraphs 1 to 3, the amount of Twenty pesos (P20.00) per square meter or fraction thereof shall be imposed in addition to the prescribed rates. Section 5. Exemption The following are hereby exempted. 1. Billboards, signboards and other advertisements displayed at the place where the business or profession is conducted shall be exempted from fees or charges herein provided, unless separated or detached. 2. Billboards, signboards and other advertisements of business owned by charitable institutions, churches, business enterprises registered under the provisions of Republic Act 6810 (Kalakalan 20) shall be exempted from fees and charges herein provided. Section 6. Administrative Provisions- Any person or group of persons who desires to display billboards, signboards, neon signs and other advertisements not covered under Section 5 (Exemption) of this Ordinance shall be required to present the necessary plans and specifications to the Punong Barangay chairman for evaluation and shall pay the prescribed rate to the Barangay Treasurer. Any person or group of persons who owns existing displayed billboards, signboards, neon signs and outdoors advertisements shall pay the prescribed rate s provided herein upon receipt of notice of evaluation of the above mentioned signs from the Punong Barangay chairman. Section 7. Prohibitions- Construction on installation of billboards, signboards and outdoors advertisements of business or profession without paying the prescribed fees or charges and presenting the necessary plans and specifications for evaluation to the Punong Barangay chairman or to his duly authorized representative is hereby prohibited. Section 8. Time of Payment- Fees and charges shall be paid within the first twenty (20) days of January, or of its subsequent quarter. It shall be paid to the Barangay Treasurer, duly receipted and shall accrue to the general fund of the Baranga.

Section 9. Separability clause- If any part of this Ordinance is declared invalid, the remainder shall not be affected by such declaration and shall remain valid and enforceable. Section 10. Effectivity- This Ordinance shall take effected in accordance with the provisions of the Local Government Code of 1991.
