RELEASE OF LIABILITY

In exchange for participation in the activity of BOAT PARTY 2014 and all included activities related to this event, organized by Nathalie Phan (EVENT MANAGER) and/or use of the property, facilities and services of EVENT MANAGER, I, the undersigned, agree on behalf of myself and my family, to the following:

1. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by EVENT MANAGER and any hired staff of EVENT MANAGER, including the boat crew, the boat captain, and the bus drivers. I will pay any incurred fees related to any violations I cause either willfully or recklessly. These violations include disobeying any of the following rules:

A. No glass bottles are permitted on the boat. B. I will not bring any pets or animals onto the boat or the bus. C. I will not arrive intoxicated to the boat and am aware that I will not gain entry onto the boat if this rule is violated. D. I will not bring any trash can punch, jello shots, beer bongs or funnels onto the boat as they are not permitted on facilities. E. I will not leave any trash or debris on marina property or boat facilities. F. I will not destroy any marina property on or off the boat. G. I will not cause any excessive noise on marina property. H. I will not misuse any of the facilities including the water slide. I. I will not urinate on marina property. I afrm that I will only consume alcohol if I am of the U.S. legal drinking age.

3. I will not willfully harm or injure any persons including other guests, EVENT MANAGER, and other third parties. 4. I am aware that this event is not sponsored by any college or university including St. Edwards University and is not, in any way, associated or funded by any student organization on or off campus. 5. I recognize that there are certain inherent risks associated with the above described activity and assume full responsibility for personal injury to myself and further release and discharge EVENT MANAGER for injury, loss, or damage arising out of my presence upon the facilities, whether caused by the fault of myself, EVENT MANAGER, or other third parties.

6. I agree to indemnify and defend EVENT MANAGER against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my use of or presence upon the facilities.

7. I agree to pay for all damages to the facilities of EVENT MANAGER caused by my negligent, reckless, or willful actions. 8. Any legal or equitable claim that may arise from participation in the above shall be resolved under Texas law. 9. I agree and acknowledge that I am under no pressure or duress to sign this Agreement and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this Agreement if I so desire. I further agree and acknowledge that EVENT MANAGER has offered to refund any fees I have paid to use the facilities if I choose not to sign this Agreement.

I HAVE READ THIS DOCUMENT AND UNDERSTAND IT. I FURTHER UNDERSTAND THAT BY SIGNING THIS RELEASE, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS.
