COMES NOW the State of Iowa and requests the Court reschedule the review hearing in the above-entitled action to November 20, 2013, for the following reasons: 1. The defendant has pleaded guilty to Counts 2 and 3 of the Trial Information filed in Buena Vista County District Court Case No. FECR042732 and is scheduled to be sentenced March 31, 2014. 2. The defendant is currently being held in the Buena Vista County Jail. 3. The defendant is being represented in the aforementioned Buena Vista County matters by Attorney John Loughlin, who was appointed by the Court. 4. The aforementioned guilty plea in Buena Vista County was conditioned on the undersigned recommending defendants sentence for his guilty plea to Count 2 of the Trial Information herein run concurrent with the sentence imposed in the Buena Vista County case. 5. The defendant is not represented by an attorney in these proceedings and has yet to make application for court appointed counsel. However, defendant, through Attorney Loughlin, negotiated the aforementioned guilty plea in the Buena Vista County case on the condition that if defendant were to plead guilty to Count 2 of the Trial Information herein the undersigned would recommend that the sentence would run concurrent with the consecutive 15-year sentence in the Buena Vista County case. 6. The defendant was recently provided an application for court appointed counsel in these proceedings.
