Software Licensing Agreement

Please read this Agreement carefully before installation. This WABCO Licensing Agreement is a valid agreement between yourself natural !erson or legal entity" and WABCO #ahr$eugsysteme %mb&' ()*+,-* &annover hereinafter called WABCO". The WABCO !rogramme !ac.age com!rises the com!uter software' the media belonging thereto and its !rinted materials !lus any documentation in an online or electronic format. By installing' co!ying or otherwise using the software !rogramme' you agree to being bound by the terms of this Agreement. /n the event of you not agreeing with the terms of this Agreement' !lease return the !rogramme !ac.age to the sales outlet against reimbursement of the !urchase !rice. Programme name: ABS Presentation 3.1 Part Number: 815 000 317 3 This !rogramme !ac.age contains the above)mentioned software !rogramme and its o!erating instructions. The !rogramme is stored on a machine)readable storage medium.The WABCO software and the o!erating instructions are wor.s !rotected by co!yright. This Licensing Agreement entitles the buyer of the software !rogramme to utili$e the !rogramme in the sco!e as outlined below. Any utili$ation beyond this sco!e is !rohibited. 1 Scope of Uti i!ation 0" 1ntitlement to utili$e the software !rogramme e2tends to one data)!rocessing unit com!uter". The buyer may decide on the unit on which it is to be utili$ed. The buyer shall be entitled to re!eatedly or !ermanently store the software !rogramme on the unit defined for utili$ation' and to !roduce co!ies of the !rogrammes or !arts thereof as re3uired for such utili$ation. This entitlement shall' however' not e2tend to co!ying re!roducing" the software !rogramme for its simultaneous utili$ation on several data)!rocessing units. The utili$ation of the software !rogramme on several wor.stations which are connected to one central in)house data)!rocessing unit server' in)house networ." is !ermissible. Any re!roduction' in whole or in !art' of the documentation su!!lied with the !rogramme !ac.age re3uires the written consent of the holder of the res!ective rights. 4" The buyer shall not be entitled to modify or tem!er with the software !rogramme in any manner whatsoever. The connection with other !rogrammes for the !ur!ose of a dynamic data interchange lin." shall be !ermissible5 however' the buyer shall not be !ermitted to embed the software !rogramme' either in whole or in !art' in any other software !rogrammes or other media. The licence for the software !rogramme is granted for the individual !roduct. The buyer shall not be entitled to se!arate its com!onents in order to use them on more than one data)!rocessing unit. Any alteration of any com!any names' trademar.s' co!yright notices or other notices on the reservations of rights and entitlements to utili$ation which are contained in the software !rogramme is !rohibited. *" The buyer is entitled to ma.e a bac.u! co!y of the software !rogramme. " #ransfer of t$e Soft%are Programme 0" The buyer shall be entitled to transfer the software !rogramme in its original condition' together with the Licensing Agreement' as a whole to one of the following users' !rovided the conditions sti!ulated by WABCO are adhered to. This entitlement' however' does not e2tend to the transfer of co!ies' whole or in !art' of the software !rogramme. 4" With the transfer of the software !rogramme' the entitlement to its utili$ation shall !ass to its subse3uent user who will thus ta.e the !lace of the buyer for the !ur!oses of this Licensing Agreement. At the same time' the buyer6s entitlement to utili$e the software !rogramme shall cease. *" /mmediately u!on transfer' the buyer shall erase or otherwise destroy all co!ies of the software !rogramme. This also a!!lies to all bac.u! co!ies. ," Subsections 0" to *" shall also a!!ly whenever any transfer of !ossession is of a tem!orary nature. The software !rogramme or !arts thereof may not be hired out. 3 #ransfer b& Subse'uent Users /n the event of the software !rogramme being transferred by the res!ective user to a subse3uent user' the subse3uent user shall ta.e the !lace of the !revious user. Section 4 shall a!!ly accordingly.

 ( )t$er *ig$ts 0" All and any other entitlements to use and e2!loit the !rogramme !ac.age are reserved. /n !articular' neither the buyer nor any subse3uent users shall be entitled to utili$e the software !rogramme on more than one data)!rocessing unit at any one time' or to distribute co!ies of the !rogramme !ac.age in whole or in !art. 4" 7!on availability of a new version of the software !rogramme' the buyer shall be entitled to obtain such a new version of the corres!onding !rogramme !ac.age at an u!date !rice sti!ulated by the seller. The u!date will cover the whole of the !rogramme !ac.age as !urchased by the buyer. 7!on the ac3uisition of the u!dated version' the buyer6s entitlement to utili$e the software !rogramme as !er Section 0 shall cease. &is obligation to erase and destroy as !rovided in Section 4 *" shall a!!ly accordingly. 5 +arrant& 0" /t is understood that it is not !ossible to develo! any software !rogrammes in such a way that they are error)free for all conditions of a!!lication. The seller warrants and ensures that the !rogramme is suitable for use in the sense of the !rogramme descri!tion valid at the time of delivery as issued by the seller' and that it includes the 3ualities warranted. Any immaterial im!airment of its serviceability shall not be considered. 4" The seller warrants and ensures that the original !rogramme has been !ro!erly stored on a storage medium !reviously tested. *" /n the event of the !rogramme !ac.age turning out not to be serviceable in the sense of Subsection 0" above' or to be faulty in the sense of Subsection 4" above' the seller shall' within a warranty !eriod of si2 months beginning on the date on which the !rogramme !ac.age was delivered date of invoice" to the buyer' ta.e bac. the !rogramme !ac.age delivered and re!lace it by a new !rogramme !ac.age of the same title. Should this also turn out not to be serviceable in the sense of Subsection 0" above' or to be faulty in the sense of Subsection 4" above' and if it is not !ossible to achieve serviceability at reasonable e2!ense and within a reasonable time' the buyer or user shall' at his sole o!tion' be entitled to either reduce the !urchase !rice' or to return the !rogramme !ac.age and to have the !urchase !rice refunded. Section 4 Subsections 4" and *" a!!ly accordingly. ," 8o further obligations under the warranty shall a!!ly. /n !articular' there shall be no warranty in terms of the !roduct !ac.age meeting the s!ecific needs of the buyer or user. The buyer is solely res!onsible for its selection' installation and usage' and for the results thereby intended. /n addition' no warranty shall a!!ly regarding the connections lin.s" established according to Section 0 Subsection 4" for the !ur!ose of the dynamic interchange with other !rogrammes unless it is !roved that any such defects are in no way connected with the lin.s established. , -iabi it& 0" The seller is liable for any damage for which he or the holder of the res!ective rights is res!onsible' u! to the !urchase !rice. Any liability for loss of !rofit' non)materiali$ing savings' indirect or subse3uent damage shall be e2cluded. 4" The above limitations of liability shall not a!!ly to any warranted 3ualities or damage attributable to intent or gross negligence. *" The !rogram has been e2haustively tested by us and functions !erfectly on our systems. The !rogram runs under Windows 9-' 9:' ;1' 8T ,.+' 4+++' 4++* and <P. &owever' we e2!ressly declare that no guarantee can be given and no liability acce!ted in res!ect of the !rogram6s e2ecutability. We can acce!t no liability for any material damage sustained through use of the a!!lication unless such damage is the result of intent or gross negligence on our !art.
