The City of Carmel-by-the-Sea is administering the upcoming April 8, 2014
General Municipal Election. Professional, impartial and ethical administration of this
process is of paramount importance to maintain the public trust.
As the Acting City Clerk for the City of Carmel-by-the-Sea, it is a privilege and
an honor to serve all of you. One of the primary duties of a Municipal Clerk is the
effective management of the electoral process.
As the Elections Official for this General Municipal Election to be held on
Tuesday, April 8, 2014, I want to reaffirm all of you that this election has been, continues
to be and will be conducted under complete neutrality, ethically and in full compliance
with a myriad of legal provisions including federal, state and local government laws,
regulations and protocols.
Please remember that the right to vote is a fundamental American right for all of
us as citizens of this great nation and as citizens of the world. Therefore, I encourage you
to exercise it and participate in this election.

ELECTION DAY SCHEDULE OF ACTIVITIES
TUESDAY, APRIL 8, (ELECTION DAY)
7:00a.m. (Polls Declared Opened)
Polls will be opened at this time. For this election the polls are set up at the Sunset Center, Carpenter Hall at
San Carlos & 9

Poll center is handicapped accessible from the north parking lot.
5:30p.m.
The Council Chambers will be opened at this time for members of the community to gather and enjoy light
snacks and refreshments while waiting for the ballot count to start.
6:00p.m.
At this time and as soon as members of the Canvassing Board arrive, take the oath of office and take their
seats at the dais, the processing of the Vote by Mail Ballots (VBMB) will begin. This process entails the
opening of the returned vote by mail sealed envelopes, removing the ballots, inspecting the ballots, accurately
duplicating any damaged or defective ballots and preparing the ballots for the ballot count.
8:00p.m. (Polls Declared Closed)
The Logic and Accuracy Test Deck will be performed prior to ballots being counted through the ballot
counter machine in order to ensure the accuracy of the ballot counter equipment. Following this procedure,
the Vote by Mail Ballots will be counted and the results announced. These results will also be projected onto
the large screen for the audience and those viewing the proceedings via the web.
9:00p.m.
It is anticipated that the ballots voted at the precincts and vote by mail ballots either surrendered or dropped-
off at the precincts and provisional ballots will arrive at City Hall at this time or shortly thereafter under escort
by the Carmel Police Department and Precincts Inspectors.
9:15p.m.
At this time, the Canvassing Board will receive, inspect, process all ballots received from the precincts.
9:15p.m. to 10:00 p.m.
Between this time ballots will be processed and counted and the results announced.

been concluded.

(Vote by Mail Processing & Canvassing-Post Election)
9:00a.m.
The post Election Day processing of Vote by Mail ballots and Provisional ballots will begin at this time at the
Monterey County Elections Office whereby vote by mail ballots and provisional ballots returned on election
day will undergo signature verification.
1:00 p.m.
The processing of the vote by mail ballots and provisional ballots taken to the County early this morning will
be processed at this time whereby the yellow (vote by mail) or purple envelopes (provisional) will be opened,
ballots removed, inspected and damaged or defective ballots will be accurately duplicated in preparation for
the count.
2:00p.m.
Ballots will be processed through the ballot counter machine and the results will be announced.
3:00p.m.
In compliance with provisions of California Elections Code section 15360, the manual count of the ballots in
1% of the precincts is expected to occur at this time.
TUESDAY, APRIL 22,2014
It is expected that the Results of the Official Canvass and the issuance of the certified statement of results of
the April 8, 2014 Election will be certified at a Special Meeting called for this purpose on this date whereby
the new officers will be sworn-in, a certificate of election will be issued to all successful candidates and the
new council members will take their seats at the dais.

The Election Official shall publish a notice of election once in a newspaper in the City.
The notice shall be headed "Notice of Election" and shall contain a statement of:
(a) The time of the election;
(b) The offices to be filled.
The notice shall also state that if no one or only one person is nominated for each office
the council may appoint someone to the office. If there is no newspaper of general
circulation published and circulated in the city, the notice shall be typewritten and copies
shall be posted conspicuously within that time in at least three public places in the city

In case any measure (or charter amendment) is to be submitted at the election, the
Election Official shall publish a synopsis of the measure once. The Election Official shall
consolidate the notice of election and the measure to be voted on into one notice if the
measure was placed on the ballot before the notice of election is published pursuant to
12101
(Form N-1).
Otherwise, the notice shall be published no later than 7 days before the election.

Last Day to File Arguments & Impartial Analyses I Must Be 14 days after Council

The Election Official shall set the date for the deadline for the filing of arguments and
impartial analyses to be fourteen (14) days after the City Council calls the election
in order to allow ample time for the 10-calendar-day public examination period,
translation, typesetting, printing and mailing to the voter. Arguments may be changed or
withdrawn by their proponents until and including the date fixed by the Election Official.

The Election Official shall make a copy of the materials referred to in 9223 (copy of
ordinance), 9280 (city attorney analyses) , 9281 and 9282 (arguments) , and 9285
(rebuttals), available for public examination in the Election Official's office for a period of
10 calendar days immediately following the filing deadline for submission of those
materials. Any person may obtain a copy of such materials from the Election Official for
use outside of the Election Official's office. The Election Official may charge a fee to any
person obtaining a copy of the material , which fee shall not exceed the actual cost
incurred by the Election Official in providing the copy.
During the 10-day examination period provided by this section, any voter of the
jurisdiction in which the election is being held, or the Electi on Official, himself or herself,
may seek a writ of mandate or an inj unction requiring any or all such materials to be
amended or deleted. A peremptory writ of mandate or an injunction shall be issued only
upon clear and convincing proof that the material in question is false, misleading or
inconsistent with the requirements of this chapter, and that issuance of the writ or
injunction will not substantially interfere with the printing or distribution of official election
materials as provided by law.
Last Day to Adopt Regulations for Candidates Statements
Last day for local agency to adopt or amend regulations regarding charges for printing
candidate's statements, length of statements, etc. , pursuant to 13307(e), Elections
Code. These regulations shall not be revoked or modified after this date.

Cities Conducting Own Election: The provisions of Elections Code 10104 say if the
last day for the performance of any act provided for or required by this code is a day
when the elections officials office is closed pursuant to a resolution or ordinance of the
legislative body, the act may be performed upon the next business day with the same
effect as if it had been performed upon the day appointed.
Nomination Papers
Between these days (both days included), during normal office hours, as posted, voters
may nominate candidates for election by signing a nomination paper. Each candidate
shall be proposed by not less than 20 nor more than 30 voters in a city of 1,000
registered voters or more, and not less than five nor more than 10 voters in a city of less
than 1,000 registered voters, but only one candidate may be named in any one
nomination paper.
No voter may sign more than one nomination paper for the same office, and in the event
the voter does so, that voter's signature shall count only on the first nomination paper
filed which contains the voters signature. Nomination papers subsequently filed and
containing that signature shall be considered as though his signature does not appear
thereon.
Each seat on the governing body is a separate office.
Any person at least 18 years of age or older may circulate a nomination paper.

Only one person may circulate each nomination paper.
A candidate shall not file nomination papers for more than one municipal office or term
of office for the same municipality in the same election.

Other Materials:
At the time nomination papers are issued, the Election Official shall give the candidate a
copy of the Code of Fair Campaign Practices and a copy of 20400- 20444,
Elections Code. Any candidate may subscribe to the code by filing a copy with the
Election Official who shall keep it as a public record.

representative at the time nomination papers are issued:

(b) Ballot Designation Worksheet.
(c) Candidates Statement form with word count standards.
(d) A written statement of the regulations with respect to charges for the Candidates
Statement (Resolution R-3).
{e) Statement of Economic Interest (State Law requires Mayor, Council, elected City
Treasurer and elected City Attorney filing. City codes may require filing for additional
offices).
(f) A copy of Government Code 84305.
(g) Code of Fair Campaign Practices forms.
Optional Items:
(1) Financial Worth Statement
(2) FPPC Forms 700, 410, 501 , 497, etc.
(3) "A Guide for Selecting Ballot Designations" (See Election Manual)
(4) Local information (explained below:)
(A) You may wish to give out the Financial Worth Statement only if requested by
the candidate.
(B) Election Officials have found it useful to give candidates the following items
not requi red by state law:
{i) City codes regarding campaign signs in publi c right-of-way and regarding
noise controls; and
(ii) Precinct maps.
The Election Official may wish to have the candidate sign a receipt for materials
provided by the Election Official.
Candidates Statements
Each candidate may prepare a Candidate's Statement according to guidelines provided
by the Election Official. Such statement may include the name, age, occupation, and a
brief description of no more than 200 words of the candidate's education and
qualifications expressed by the candidate himself or herself.
Such statement shall be limited to a recitation of the candidate's own personal
background and qualifications, and shall not in any way make reference to other
candidates for that office or to another candidate's qualifications, character or activities.
Such statement shall be filed at the time nomination papers are filed (unless a runoff or
general election is to occur within 88 days of a primary or first election, the statement
shall then be filed with the Election Official by the third day following the governing
body's declaration of the results from the primary or first election, unless the City
Charter or Municipal Code provides otherwise).

A Candidates Statement may be withdrawn but not changed during the period for filing
nomination papers and until 5:00 p.m. on the day following the close of nomination.
Candidates statements shall remain confidential until the expiration of the filing
deadline.

If a candidate alleges to be indigent and unable to pay in advance the requisite fee for
submitting a candidate statement, the candidate shall submit to the local agency a
statement of financial worth to be used in determining whether or not he or she is
eligible to submit a candidate statement without payment of the fee in advance. The
statement of financial worth shall be submitted by the candidate together with his or her
candidate statement in accordance with the deadline specified in 13307.
For the 10 calendar days after the filing deadline, the Election Official shall make a copy
of the candidates statements available for public examination in the Election Official's
office. Any person may obtain a copy of the candidates statements from the Election
Official for use outside of the Election Official's office. The Election Official may charge
a fee to any person obtaining a copy of the material, which fee shall not exceed the
actual cost incurred by the Election Official in providing the copy.
During the 10-calendar-day examination period provided by this section, any voter of the
jurisdiction in which the election is being held, or the Election Official , himself or herself,
may seek a writ of mandate or an injunction requiring any or all of the material in the
candidates statements to be amended or deleted.
Last Day to Call Election For Ballot Measures
The earlier "Suggested Last Day" for placing a measure(s) on the ballot was
recommended so the measure(s) would be added to the ballot at the same time the
election is called and that the Argument filing would occur 14 days later and Rebuttal
filing 10 days after that. If calling the election on a later date, set argument deadline to
be 14 days from council action .

A measure placed on the ballot may be amended or withdrawn by resolution filed with
the election official by the 83rd day before the election.

Through the last day for filing for any office requi ring an extended filing period, a
candidate may withdraw his nomination paper after it is filed with the Election Official.
Last Day to Withdraw Measure(s) from Ballot
Notwithstanding any other provision of law, whenever a legislative body has ordered
that a measure or proposal be submitted to the voters of any jurisdiction at a special
election, the order of election shall not be amended or withdrawn after the 83rd day
prior to the election.

The order of election shall be amended or withdrawn upon the filing of a resolution by
the legislative body stating the specifics concerning the amendment or withdrawal. The
resolution shall be filed with the election official not later than the 83rd day prior to the
election.

Secretary of State to Determine Order of Names on Ballot
The Secretary of State shall conduct a drawing of the letters of the alphabet constituting
a randomized alphabet to be used in determining the order of all candidates on the
ballot. The results of the drawing shall be mailed immediately to each Election Official.

it may either:
(1) Appoint to the office the person who has been nominated.

Last day for elections official to designate polling places and appoint precinct board
members.

Following the designation of polling places and the appointment of precinct board
members, the elections official shall immediately mail or deliver to each precinct board
member a "Notice of Appointment" showing the polling place and election officers in the
precinct and any other matter that the election official determines.

Following appointment of precinct boards, the elections official shall instruct Inspectors
concerning their duties in connection with the conduct of the election. This can be done

Any individual, organization, or group that distri butes applications for vote-by-mail voter
ballots and receives completed application forms shall return the forms to the
appropriate elections official within 72 hours of receiving the completed forms, or
before the deadline for application, whichever is sooner. The name, address, and
telephone number of any organization which authorizes the distribution of the
applications shall be included on the application.
Upon receipt of any Vote-by-Mail ballot application, which arrives within the proper time,
the elections official should determine if the residence address (and signature) on the
ballot application appear to be the same as that on the original affidavit of registration.
The official may make this signature check upon receiving the voted ballot, but the
signature must be compared before the Vote-by-Mail voter ballot is canvassed.

Last day for the Election Official to mail to each registered voter (registered by 54 days
before the election) a sample ballot and a polling place notice showing the location of
the precinct polling place of the voter.

electors residing in the territory within which the election is to be held. Transfers of

Voters as provided in 15278 to check whether the voter has voted more than once in
any election.
Publish Notice of Central Counting Place
Whenever the ballots at any election or from any precincts are to be tallied at a central
place and not at the precincts, the elections official or secretary of the j urisdiction
conducting the election shall specify the public place to be used and give notice thereof
as follows:
(a) By at least one publication in a newspaper of general circulation published in the
jurisdiction where the election is to be held, provided that the publication is made at
least 1 0 days before the day of the election.
(b) If a newspaper of general circulation is not published in that jurisdiction, then by
prominently posting the notice in the office of the elections official for at least 10 days
before the day of the election.

voted in the office of the elections official as defined by subdivision (b) of Section 3018,
at the time of the request. This ballot shall be delivered by the elections official to any
authorized representative of the voter who presents this written statement to the official.

his city a list of the voters in that precinct applying for and receiving ball ots under the
provisions of this chapter.
Suggested Last Day to Post Notice of Manual Tally
The election official shall notify observers and the public at least 5 days in advance of-
the dates, times, and places where ballots of 1 precinct and the corresponding vote-by-
mail ballots will be manually counted. Cities with ballot groups must manually count as
many precincts as it takes to manually count each office that appears on the ballots, but
only the additional offices need be counted in the additional precincts.

After tallying all eligible votes but prior to completi on of the official canvass and the
issuance of the certified statement of the results, the elections official, upon the request
of a qualified write-in candidate for an office being voted on in that election for an
examination of undervotes that is received within five days of completion of the
semiofficial canvass, may hand tally the remaining undervotes.
Election Official to Conduct the Manual Tally
During the official canvass, the election official shall conduct a public manual tally of the
ballots tablulated, including Vote-by-Mail voter ballots, cast in 1% of the precincts, or 1
whole precinct, chosen at random. For each race not included on the initial precinct, the
election official shall count additional precincts, until all races have been manually
tallied. The manual tally in the addtional precincts shall only apply to the race(s) not
previously tallied.
The ballots for the Vote by Mail ballot tally need not be from the same precinct as the
polling place ballots come from.

It has been an honor to serve as your Mayor and to work
with our City Council and staff. We have made substantial
progress and have often found broad consensus:
We put a $1 ,327,451 budget surplus into reserves for
the future, maintained our AA+ credit and refinanced
debt, saving $4 million,
The voters overwhelmingly approved a sales tax
measure, which helps ensure Carmel's quality of life,
and
We are investing in improvements to Carmel-by-the-
Sea's streets, parks, facilities and the beach.
Regionally, I help oversee the water supply projects
and successfully negotiated substantial savings for
ratepayers. I also helped complete fundraising for the
Veterans Cemetery.
Our goals for 2014 include active parking management,
investments in beach, forest, trail, and park improvements,
development of a Sunset Center campus plan, and
maintaining excellent public safety service and response
times.
As your Mayor, I will continue to promote the energy and
creativity of our citizens who make our economy and our
community so vibrant, protect our village's character and
natural beauty, tackle the tough issues in an open, honest
manner, and respect all points of view.
With your support and vote, I look forward to serving our

LUCAS MICHAEL AUSTIN
I am the newest resident of this city that is running for
office, but no less passionate for it. After our time in the
military my wife and I decided, Carmel-by-the-Sea was
the place we could call home. I am running for council
without ulterior agenda or motivations. Often city officials
feel inaccessible, and residents go unheard. I have no
outside influences casting my vote for me, and am willing
to listen to any reasonable request or argument at any
time. Whether you be a resident, business owner, or
employee working in the city, we must work together to
grow with the times.
I promise to bring a fresh and honest perspective to the
council. I will work hard to find solutions to the tough
problems like pensions and the drug culture among
teenagers. I hope to help resolve long standing problems
such as parking and handicap access which should have
been put to bed long ago. Patience is a virtue, but action
is eventually required.
As a businessman, I have a vested interest in making
sure Carmel-by-the-Sea grows as a community while
retaining its charm. If you feel the same I ask you cast

I have been coming to Carmel since I was a teenager,
working summers with my grandmother at the Hofsas
House. I grew to appreciate the inherent beauty and
charm of Carmel-by-the-Sea, and in 2000, my husband
and I moved here to operate the family hotel and raise our
son in Carmel public schools.
My advanced degrees in biology help me understand
and care for the natural beauty we have in our village.
Additionally, my experience in the private sector, in stat e
government, and now as a small business owner help me
understand how government operates and how it can be
improved to better our community.
Since my time on the City Council, we have enhanced
fiscal stability, refinanced CALPERS side-fund saving $4
million, added $1.3 million to reserves, and implemented
the HID (Hospitality Improvement District) for attracting
small conferences and expanding marketing efforts.
As your representative, my goal is to maintain a healthy
relationship among the City, its residents, and its
businesses. I hope to continue the cooperati ve spirit
of the council , enhance government transparency/
efficiency, and focus on beach and forest issues.

commissioner has honed my analytical skills, equipped
me with extensive knowledge of current issues, and given

Coastal Plan, Municipal Code and Design Guidelines.

priorities and making responsible choices.

GENERAL MUNICIPAL ELECTION
The City of Carmel-by-the-Sea is committed to an open and transparent election process.
Interested individuals have an opportunity to observe signature verification to be
conducted on an as needed basis on Friday, March 28, 2014 at the Monterey County
Elections Office in Salinas.
Individuals wishing to observe the signature verification process for vote-by-mail ballots
cast for the April 8, 2014 Municipal Election are encouraged to call City Hall at 620-
2007.
Signatures are verified at the Monterey County Elections Department office in Salinas on
a rolling basis. There is no set schedule for when this process will take place, so
interested parties should call ahead for more details.

days included) any voter unable to go to the polls because of illness or disability resulting
