On December 16, 2010, this matter was reassigned to Judge Robert O'Brien (Department 85) for all further proceedings. On January 7, 2011, Judge O'Brien denied a motion by Richard I. Fine to void the orders of Judge David P. Yaffe in this case. On February 1, 2011, Mr. Fine filed a motion to renew his previously denied motion, and set the matter for hearing on March 10, 2011 in Department 1. All judges of the Superior Court are independently elected constitutional officers. Neither the presiding judge nor a supervising judge has the authority to review, overrule, intervene in or otherwise affect the outcome of any matter proceeding before another judicial officer. Any dissatisfaction with the findings of fact or the rulings of law by any other judicial officer must be addressed to that judicial officer or to the Court of Appeal. The motion having been improperly set for hearing in Department 1, the court orders it off calendar. Clerk of the Court is to give notice.
