Ha'in been con'ened at $ene'a by the $o'ernin Body of the International Labour Office& and ha'in met in its (inety)fifth Session on *+ ,ay -../& 0eco ni%in the lobal ma nitude of occu1ational injuries& diseases and deaths& and the need for further action to reduce them& and 0ecallin that the 1rotection of workers a ainst sickness& disease and injury arisin out of em1loyment is amon the objecti'es of the International Labour Or ani%ation as set out in its Constitution& and 0eco ni%in that occu1ational injuries& diseases and deaths ha'e a ne ati'e effect on 1roducti'ity and on economic and social de'elo1ment& and (otin 1ara ra1h III2 3 of the 4eclaration of !hiladel1hia& which 1ro'ides that the International Labour Or ani%ation has the solemn obli ation to further amon the nations of the world 1ro rammes which will achie'e ade5uate 1rotection for the life and health of workers in all occu1ations& and ,indful of the ILO 4eclaration on 6undamental !rinci1les and 0i hts at "ork and its 6ollow)U1& +778& and (otin the Occu1ational Safety and Health Con'ention& +78+ 2(o9 +::3& the Occu1ational Safety and Health 0ecommendation& +78+ 2(o9 +/;3& and other instruments of the International Labour Or ani%ation rele'ant to the 1romotional framework for occu1ational safety and health& and 0ecallin that the 1romotion of occu1ational safety and health is 1art of the International Labour Or ani%ation<s a enda of decent work for all& and 0ecallin the Conclusions concernin ILO standards)related acti'ities in the area of occu1ational safety and health ) a lobal strate y& ado1ted by the International Labour Conference at its 7+st Session 2-..*3& in 1articular relatin to ensurin that 1riority be i'en to occu1ational safety and health in national a endas& and Stressin the im1ortance of the continuous 1romotion of a national 1re'entati'e safety and health culture& and Ha'in decided u1on the ado1tion of certain 1ro1osals with re ard to occu1ational safety and health& which is the fourth item on the a enda of the session& and Ha'in determined that these 1ro1osals shall take the form of an international Con'ention=

ado1ts this fifteenth day of >une of the year two thousand and six the followin Con'ention& which may be cited as the !romotional 6ramework for Occu1ational Safety and Health Con'ention& -../9

I. &'FINI(IONS Article 1 +9 6or the 1ur1ose of this Con'ention? 2a3 the term national policy refers to the national 1olicy on occu1ational safety and health and the workin en'ironment de'elo1ed in accordance with the 1rinci1les of @rticle ; of the Occu1ational Safety and Health Con'ention& +78+ 2(o9 +::3= 2b3 the term national system for occupational safety and health or national system refers to the infrastructure which 1ro'ides the main framework for im1lementin the national 1olicy and national 1ro rammes on occu1ational safety and health= 2c3 the term national programme on occupational safety and health or national programme refers to any national 1ro ramme that includes objecti'es to be achie'ed in a 1redetermined time frame& 1riorities and means of action formulated to im1ro'e occu1ational safety and health& and means to assess 1ro ress= 2d3 the term a national preventative safety and health culture refers to a culture in which the ri ht to a safe and healthy workin en'ironment is res1ected at all le'els& where o'ernment& em1loyers and workers acti'ely 1artici1ate in securin a safe and healthy workin en'ironment throu h a system of defined ri hts& res1onsibilities and duties& and where the 1rinci1le of 1re'ention is accorded the hi hest 1riority9

II. O)*'C(I+' Article 2 -9 2+3 Aach ,ember which ratifies this Con'ention shall 1romote continuous im1ro'ement of occu1ational safety and health to 1re'ent occu1ational injuries& diseases and deaths& by the de'elo1ment& in consultation with the most re1resentati'e or ani%ations of em1loyers and workers& of a national 1olicy& national system and national 1ro ramme9 -9 2-3 Aach ,ember shall take acti'e ste1s towards achie'in 1ro ressi'ely a safe and healthy workin en'ironment throu h a national system and national 1ro rammes on occu1ational safety and health by takin into account the 1rinci1les set out in instruments of the International Labour Or ani%ation 2ILO3 rele'ant to the 1romotional framework for occu1ational safety and health9 -9 2*3 Aach ,ember& in consultation with the most re1resentati'e or ani%ations of em1loyers and workers& shall 1eriodically consider what measures could be taken to ratify rele'ant occu1ational safety and health Con'entions of the ILO9

III. N,(ION,L POLICArticle 3 *9 2+3 Aach ,ember shall 1romote a safe and healthy workin en'ironment by formulatin a national 1olicy9 *9 2-3 Aach ,ember shall 1romote and ad'ance& at all rele'ant le'els& the ri ht of workers to a safe and healthy workin en'ironment9 *9 2*3 In formulatin its national 1olicy& each ,ember& in li ht of national conditions and 1ractice and in consultation with the most re1resentati'e or ani%ations of em1loyers and workers& shall 1romote basic 1rinci1les such as assessin occu1ational risks or ha%ards= combatin occu1ational risks or ha%ards at source= and de'elo1in a national 1re'entati'e safety and health culture that includes information& consultation and trainin 9

I+. N,(ION,L S-S('. Article 4 ;9 2+3 Aach ,ember shall establish& maintain& 1ro ressi'ely de'elo1 and 1eriodically re'iew a national system for occu1ational safety and health& in consultation with the most re1resentati'e or ani%ations of em1loyers and workers9 ;9 2-3 The national system for occu1ational safety and health shall include amon others?

2a3 laws and re ulations& collecti'e a reements where a11ro1riate& and any other rele'ant instruments on occu1ational safety and health= 2b3 an authority or body& or authorities or bodies& res1onsible for occu1ational safety and health& desi nated in accordance with national law and 1ractice=

2c3 mechanisms for ensurin com1liance with national laws and re ulations& includin systems of ins1ection= and 2d3 arran ements to 1romote& at the le'el of the undertakin & coo1eration between mana ement& workers and their re1resentati'es as an essential element of work1lace)related 1re'ention measures9 ;9 2*3 The national system for occu1ational safety and health shall include& where a11ro1riate?

2a3 a national tri1artite ad'isory body& or bodies& addressin occu1ational safety and health issues= 2b3 information and ad'isory ser'ices on occu1ational safety and health= 2c3 the 1ro'ision of occu1ational safety and health trainin = 2d3 occu1ational health ser'ices in accordance with national law and 1ractice= 2e3 research on occu1ational safety and health= 2f3 a mechanism for the collection and analysis of data on occu1ational injuries and diseases& takin into account rele'ant ILO instruments= 2 3 1ro'isions for collaboration with rele'ant insurance or social security schemes co'erin occu1ational injuries and diseases= and 2h3 su11ort mechanisms for a 1ro ressi'e im1ro'ement of occu1ational safety and health conditions in micro)enter1rises& in small and medium)si%ed enter1rises and in the informal economy9

+. N,(ION,L P/O0/,..' Article 5 :9 2+3 Aach ,ember shall formulate& im1lement& monitor& e'aluate and 1eriodically re'iew a national 1ro ramme on occu1ational safety and health in consultation with the most re1resentati'e or ani%ations of em1loyers and workers9 :9 2-3 The national 1ro ramme shall?

2a3 1romote the de'elo1ment of a national 1re'entati'e safety and health culture= 2b3 contribute to the 1rotection of workers by eliminatin or minimi%in & so far as is reasonably 1racticable& work)related ha%ards and risks& in accordance with national law and 1ractice& in order to 1re'ent occu1ational injuries& diseases and deaths and 1romote safety and health in the work1lace= 2c3 be formulated and re'iewed on the basis of analysis of the national situation re ardin occu1ational safety and health& includin analysis of the national system for occu1ational safety and health= 2d3 include objecti'es& tar ets and indicators of 1ro ress= and 2e3 be su11orted& where 1ossible& by other com1lementary national 1ro rammes and 1lans which will assist in achie'in 1ro ressi'ely a safe and healthy workin en'ironment9 :9 2*3 The national 1ro ramme shall be widely 1ublici%ed and& to the extent 1ossible& endorsed and launched by the hi hest national authorities9

+I. FIN,L P/O+ISIONS Article 6 /9 This Con'ention does not re'ise any international labour Con'entions or 0ecommendations9 Article 7 B9 The formal ratifications of this Con'ention shall be communicated to the 4irector)$eneral of the International Labour Office for re istration9 Article 8 89 2+3 This Con'ention shall be bindin only u1on those ,embers of the International Labour Or ani%ation whose ratifications ha'e been re istered with the 4irector)$eneral of the International Labour Office9

89 2-3 It shall come into force twel'e months after the date on which the ratifications of two ,embers ha'e been re istered with the 4irector)$eneral9 89 2*3 Thereafter& this Con'ention shall come into force for any ,ember twel'e months after the date on which its ratification is re istered9 Article 9 79 2+3 @ ,ember which has ratified this Con'ention may denounce it after the ex1iration of ten years from the date on which the Con'ention first comes into force& by an act communicated to the 4irector)$eneral of the International Labour Office for re istration9 Such denunciation shall not take effect until one year after the date on which it is re istered9 79 2-3 Aach ,ember which has ratified this Con'ention and which does not& within the year followin the ex1iration of the 1eriod of ten years mentioned in the 1recedin 1ara ra1h& exercise the ri ht of denunciation 1ro'ided for in this @rticle& will be bound for another 1eriod of ten years and& thereafter& may denounce this Con'ention within the first year of each new 1eriod of ten years under the terms 1ro'ided for in this @rticle9 Article 10 +.9 2+3 The 4irector)$eneral of the International Labour Office shall notify all ,embers of the International Labour Or ani%ation of the re istration of all ratifications and denunciations that ha'e been communicated by the ,embers of the Or ani%ation9 +.9 2-3 "hen notifyin the ,embers of the Or ani%ation of the re istration of the second ratification that has been communicated& the 4irector)$eneral shall draw the attention of the ,embers of the Or ani%ation to the date u1on which the Con'ention will come into force9 Article 11 ++9 The 4irector)$eneral of the International Labour Office shall communicate to the Secretary)$eneral of the United (ations for re istration in accordance with @rticle +.- of the Charter of the United (ations full 1articulars of all ratifications and denunciations that ha'e been re istered9 Article 12 +-9 @t such times as it may consider necessary& the $o'ernin Body of the International Labour Office shall 1resent to the $eneral Conference a re1ort on the workin of this Con'ention and shall examine the desirability of 1lacin on the a enda of the Conference the 5uestion of its re'ision9 Article 13 +*9 2+3 Should the Conference ado1t a new Con'ention re'isin this Con'ention& then& unless the new Con'ention otherwise 1ro'ides? 2a3 the ratification by a ,ember of the new re'isin Con'ention shall ipso ure in'ol'e the immediate denunciation of this Con'ention& notwithstandin the 1ro'isions of @rticle 7 abo'e& if and when the new re'isin Con'ention shall ha'e come into force= 2b3 as from the date when the new re'isin Con'ention comes into force& this Con'ention shall cease to be o1en to ratification by the ,embers9 +*9 2-3 This Con'ention shall in any case remain in force in its actual form and content for those ,embers which ha'e ratified it but ha'e not ratified the re'isin Con'ention9 Article 14 +;9 The An lish and 6rench 'ersions of the text of this Con'ention are e5ually authoritati'e9
