now with emails to ensure each ministry appropriately takes their own extension.
Each ministry will receive only their own information and will be asked to confirm we have the correct new due
date where those highlighted in yellow require confirmation.
Tables 2 and 3 are where the ministries have already communicated with the applicant and/or other
circumstances apply.

Background:
The administration in the Government of Alberta is working to address the Implementation
of a coordinated approach to processing common FOIP requests.
In the past several months, the same and/or similar (common) FOIP requests have been
received by multiple ministries, resulting in the need for further discussions across
government on developing a consistent approach and process.
Previously. an informal process has existed to address processing of common FOIP requests
uld

particular common request. Ministries would then have the discretion on whether or not to
comply with the consistent approach.
As part of cycle three of the Results Based Budgeting Review, FOIP Services across
government will be examined; including how common FOIP requests are processed.
On July 18, 2013 representatives from Policy and Governance met with Jay Ramotar, Deputy
Minister of Service Alberta to request assistance for the Corporate FOIP Office to implement
an interim process that would help to ensure impacted ministries apply the consensus
reached when processing a common FOIP Request.
Agreement was provided by the Deputy to implement the use of a Record of Decision (ROD}
following each meeting on a common FOIP Request. If a FOIP Coordinator from a ministry
feels they cannot process the request as per the consensus reached, they are to discuss the
rationale with their Deputy Minister who must then speak to the Deputy Minister of Service
Alberta about their rationale for departing from the Government of Alberta approach.
FOIP Coordinators have been advised of this new process and have also been instructed to
ensure that it is either the FOIP Coordinator from the ministry or a representative who has
decision making authority who attends meetings on common FOIP requests. If a ministry
does not participate in a meeting and they are impacted by a common FOIP request, they
will be obliged to apply the consensus reached.
On July 30, 2013, Peter Watson, Deputy Minister of Executive Council sent an email to all
conduit for ensuring a coordinated approach to the request.
An evaluation of the processing of this request will take place and will contribute to
establishing a formal process to address common FOIP requests in the future.

MLAs.
(Timejrame of records: Apri/1, 2013 to July 4, 2013}.
2. Municipal Affairs is compiling a list from ARTS and identifying our recommendations on the application of
section 22 (and/or 24) for Executive Council, along with a general rationale as to why item should or should not
be protected. Municipal Affairs plans to consult with Executive Council on or before August 6th.
3. Under section 14(1)(c) of the FOIP Act, the time line will be extended for an additional 30 days to consult with
another public body.
Please provide clarification on the scope of the role of Service Alberta due to DM Watson's direction - FOIP Office at
Service Alberta has responsibility for responding to the applicant on behalf of all Ministries from this point forward,
including advising the applicant afthe time extensions.
1. Since Service Alberta will be responding to the applicant on behalf of Municipal Affairs, including on the
additional 30 days to consult with another public body,. will you use our new due date or will SA assign the same
new due date to all involved Ministries (although not all ministries received the request the same day)?
2. If SA assigns a new due date, when will you notify us of that new due date?
3. How will the sign off on the release of the list be handled- will SA sign off the decision letter to the applicant on
behalf of all involved Ministries? To do this, SA will need the Executive Council recommendation to each
Ministry on release of information on their specific list. How will this process be handled?
4. Will SA (on behalf of all Ministries) or each Ministry release the l ist(s) to the applicant?
5. Does Service Alberta require a copy of Municipal Affairs' list?

For Service Alberta, we took an extension for 30 days however we always
advise the Applicant we will respond sooner, if possible.
I recommend that each public body also take 30 days and try to respond
as soon as possible regardless of the due date.
This extension should be taken due to consultation required with
Executive Council. This is a requirement under our existing processes.
Taking the full 30 days is necessary due to the volume of consultations
that Executive Council will have to manage. While I am sure there will be
some staggering of the responses and Executive Council will endeavour
to coordinate with all of us the best order for responding to these

some that come last.

Hi Richard et al,
For Service Alberta, we took an extension for 30 days however we always advise the Applicant we will respond
sooner, if possible.
I recommend that each public body also take 30 days and try to respond as soon as possible regardless of the
due date.
This extension should be taken due to consultation required with Executive Council. This is a requirement
under our existing processes.
Taking the full 30 days is necessary due to the volume of consultations that Executive Council will have to
manage. While I am sure there will be some staggering of the responses and Executive Council will endeavour
to coordinate with all of us the best order for responding to these consultations, big and little, there will still be
some that come first and some that come last.
We will have additional discussion with Executive Council and please call me if you have any other questions.

2. For all ministries, the request applies only to BNs and memos listed in the Action Request
Tracking System (ARTS). The request does not include any attachments in ARTS, i.e. no actual
BNs and memos are to be included in the responsive records.
3. All ministries will treat this as a formal FOIP Request, collect the $25 application fee and process
the records accordingly. Whether or not any ministries generate enough ARTS report pages to
warrant more fees will be re-visited if necessary. Extensions will be taken only where applicable.
4. Each ministry will generate reports in ARTS based on the date range of April1, 2013 to the date
the request was received by the ministry (ranging to date from June 28, 2013 to July 4, 2013).
5. Reports will be generated using the parameters that Service Alberta will provide.
The columns generated in ARTS wlll be as attached in the example from Infrastructure/
Transportation. Report Header pages will remain in the records.
6. Records filed in the ARTS system will continue to be dealt with in accordance with the
appropriate records management schedule.
7. Ministries will complete their severing process before sending their ARTS lists to Executive
Council for section 22 review under formal consultation processes. Redaction would not be
limited to personal information but should include all information subject to an exception.

It looks like we correctly captured the Ministries who have received this request and the direction we

Section 22 Cabinet and Treasury Board Confidences
This is policy interpretation and general guidance but not legal advice.
Section 22 is a mandatory exception, meaning if a ministry determines that it applies, the ministry must
withhold the information in question from disclosure under an access request.
Section 22 requires a ministry to withhold information:
" ... that would reveal the substance of deliberations of the Executive Council or any of its
committees or of the Treasury Board or any of its committees, including any advice,
recommendations, policy considerations or draft legislation or regulations submitted or prepared
for submission to the Executive Council or any of its committees or of the Treasury Board or any
of its committees."
They key to understanding what this exception to disclosure applies to are the words "reveal the
substance of deliberations".
The "substance" not the "subject" of deliberation is withheld under this exception in support of a full and
frank conversation.
In Alberta, the practice is for ministries to identify when they think section 22 applies and then they consult with
the Executive Council FOIP Office. From that consultation, the ministry that has control of the record then
applies section 22 accordingly.
Reasons why Executive Council are integral to the application of this section include the fact that the ministry
must prove the information in the record is the substance of deliberation and not simply a subject for
deliberation or background information to inform deliberations. Sometimes, for example, a Cabinet minute must
be produced to prove this.
Policy and Governance's FOIP Guidelines and Practices clearly interprets that Executive Council and Treasury
Board make all decisions as to whether information meets the criteria for applying section 22. This would imply
that it is Executive Council and Treasury that apply section 22 not the ministries with control of the records.
This increases the reasonableness for them to review records in all cases where section 22 might apply and
assess the information for application of section 22.

Or do we consult on only those records which we identify as possibly revealing the substance of deliberat ions of
Executive Council (or its committees and so on)?
As you know, the requests to each ministry is for a list of the subject lines of each Ministries' ARTS over a set
period of time. I would imagine that the subject titles would not generally reveal the "substance of
deliberations", unless worded quite specifically.
Your clarification would greatly assist. Looking forward to hearing from you.

Sorry for another email Cheryl but one more thing - this is a practice in some other jurisdictions.
All Cabinet Confidences were reviewed at one time by the Ministry of Finance in BC. We also were the FOIP
Office for the Office of the Premier.
While this has likely changed with the centralization of access services in BC, I imagine they still have a select
number of senior advisors reviewing records to apply this exception.

1. The request has already been clarified. Some ministries have a slightly narrower version of the
request and clarification is in keeping with this.
2. For all ministries, the request applies only to Briefing Notes (BNs) and memos listed in the
Action Request Tracking System (ARTS). The request does not include any attachments in ARTS,
i.e. no actual BNs and memos are to be included in the responsive records.
3. All ministries will treat this as a formal FOIP Request, collect the $25 application fee and process
the records accordingly. Whether or not any ministries generate enough ARTS report pages to
warrant more fees will be re-visited if necessary.
4. Each ministry will generate reports in ARTS based on the date range of April1, 2013 to the date
the request was received by the ministry (ranging to date from June 28, 2013 to July 4, 2013).
5. Reports will be generated using the parameters that Service Alberta will provide.*
The columns generated in ARTS will be as attached in the example from Infrastructure/
Transportation.

To ensure consistency, we will provide some screenshots and direction to assist ministries.

As discussed, the following points summarize our understanding of the consensus reached at
the meeting on July 4, 2013 regarding the Cross-government request relating to a list of records
in ARTS.
1. The request has already been clarified, and the applicant is only looking for a list of
records in ARTS relating to Briefing Notes to the Minister, et cetera, not any of the
corresponding attachments. No further clarification is required.
2. All ministries will treat this as a formal FOIP Request and process the $25 application
fee and records accordingly.
3. While it was agreed that, for the majority of ministries, no additional fees would likely
arise, for those ministries where it does, they would be assessed as per usual practice
and a fee estimate would be provided to the applicant as applicable.
4. It was agreed that what the applicant will get is the report as generated by ARTS using
the subject matter as requested and the date range from April1, 2013 to the date the
request was received as the parameters for the search. To assist in determining what
should be included in the generated report, attached is a sample page from Susan Fox.
It was agreed that every ministry's report would include the same result fields.

Thanks to Dan for the help on this. I suggest you include the info below with the mail out:
Providing a list of all the ARs logged within the time frame would involve a very significant number of completely
unrelated ARs. Performing searches by Action Type seems to be the best option. There are slight variations in how each
department uses the ARTS system, and not all users fill out the same fields when creating ARs. Work with your ARTS
Administrator to determine what Action Types will yield the requested search results.
This is what Service Alberta will be using for the search as an example.
Recommended Steps to perform ARTS Search:
1) Searches need to be completed by ARTS Administrator or DMO/MCU level SuperUser as they are most familiar
with the ARTS system is customized to their needs & they can suggest which action types will best the
search parameters. They will also be able to view all ARs in the system.
2} Enter the date range "Logged Date- Start" (Aprill, 2013) and "Logged Date- End" (date the request was
received. Eg. June 28, 2013)

3) Select the Action Type: Eg) Briefing for Minister
4) Press Search
5) Repeat Steps 1 to 4 for all other relevant Action Types, depending upon your Ministry's listed Action Types:
a. Briefing for Associate Minister
b. Briefing for Deputy Minister
c. Briefing for MLA
d. Draft reply for Associate Minister
e. Draft reply for Minister
f. Draft reply for Deputy Minister
g. Draft reply for Deputy Minister & Provide Briefing
h. Draft reply for Minister & provide briefing
i. For Deputy Minister's Approval
j. For Minister's Approval
This search will still need to be vetted to determine if the Information falls within the scope of the FOIP Request.

I think the simplest way to find this information, without capturing all ARs in the system for the time range (e.g. ADM
ARs, or letters to the public) is to search with the date parameters & the specific action. Many of the FOIP people
wanted to just do one search & provide their full AR list to the applicant, but in our case that would mean additional ARs
are included which are out of scope. There will need to be separate searches for each action requested. I think we'll
leave this up to their MCUs/Michelie Talbot to explain If they don't understand the system.
Each Ministry ARTS Administrator will need to determine which specific searches will be appropriate. Since each
department uses ARTS differently, they also customize the "Action" field in the ARTS system. There isn't a search by
template field, so action is the closest option. Searching by "Correspondence type" may not yield consistent results if
this field isn't always used- you would also need to select the division to determine MO/OMO with this option & in a
couple of test searches this wasn't giving me the same number of total ARs, so I know we weren't using that field
consistently.
I suggest we provide what we will be using for the search as an example.

Decisions:
1. The request has already been clarified. Some ministries have a slightly narrower version of the
request and clarification is in keeping with this.
2. For all ministries, the request applies only to Briefing Notes (BNs) and memos listed in the
Action Request Tracking System (ARTS). The request does not include any attachments in ARTS,
i.e. no actual BNs and memos are to be included in the responsive records.
3. All ministries will treat this as a formal FOIP Request, collect the $25 application fee and process
the records accordingly. Whether or not any ministries generate enough ARTS report pages to
warrant more fees ':"fill be re-visited if necessary.
4. Each ministry will generate reports in ARTS based on the date range of April1, 2013 to the date
the request was received by the ministry (ranging to date from June 28, 2013 to July 4, 2013).
5. Reports will be generated using the search criteria that Service Alberta will provide.*
The columns generated in ARTS will be as attached in the example from Infrastructure/
Transportation.
*We discovered after the meeting there are a number of fields that must be set to run the report as requested.
To ensure consistency, we will provide some screenshots and direction to assist ministries.

Good day.
As discussed, the following points summarize our understanding of the consensus
reached at the meeting on July 4, 2013 regarding the Cross-government request relating
to a list of records in ARTS.
1. The request has already been clarified, and the applicant is only looking for a list
of records in ARTS relating to Briefing Notes to the Minister, et cetera, not any of
the corresponding attachments. No further clarification is required.
2. All ministries will treat this as a formal FOtP Request and process the $25
application fee and records accordingly.
3. While it was agreed that, for the majority of ministries, no additional fees would
likely arise, for those ministries where it does, they would be assessed as per
usual practice and a fee estimate would be provided to the applicant as
applicable.
4. It was agreed that what the applicant will get is the report as generated by ARTS
using the subject matter as requested and the date range from April 1, 2013 to
the date the request was received as the parameters for the search. To assist in
determining what should be included in the generated report, attached is a
sample page from Susan Fox. It was agreed that every ministry's report would
include the same result fields.

I think all of you have probably received the request for the list of AR's. 1 just spoke with the Applicant and he is
not looking for the responses to the AR's at this time, he is just looking for the list (AR It, due dates, subject line,
who to who from type of thing) and the reference to the briefings and memos is apparently a category of
AR. Once they get the list they will then decide which ones they want to FOIP. Do we need to meet on this?

It has been a busy day. We received this request Friday also I am betting; sounds the same.
However, Melissa is keeping an eye out for common or x-govt requests bul the request may actually not
appear for us as it is the weekly report we monitor- and there is a one week delay for them to appear when
we close and run the report from the FOIP Net system. Not even Service Alberta can see your open requests
nor the open requests of any other ministry- we can only generate the weekly report to see them.
So this is brilliant that you have caught onto this one so quickly.
I will send out a meeting request for Thursday? Friday? Which is best for you?

I think all of you have probably received the request for the list of AR's. I just spoke with the Applicant and he is not
looking for the responses to the AR's at this time, he is just looking for the list (AR #,due dates, subject line, who to who
from type of thing) and the reference to the briefings and memos is apparently a category of AR. Once they get the list
they will then decide which ones they want to FOIP. Do we need to meet on this?

To ensure consistency please share the following information with the person
conducting ARTS searches for your ministry in response to this request:
1) Searches are recommended to be completed by your ministry's ARTS
Administrator or DMOIMCU level SUperUser or equivalent as they are
most familiar with the ARTS. They wiU also be able to view all ARs in the
system.
2) ARTS searches are conducted under the AR Search Tab with the
Keyword "Action Requests" selected.
3) You must select under the Action field. Note: see step 11 below as you
must do more than one search depending upon what your ministry has
under the Action field: e.g. Service Alberta has both "Briefing for Minister"
and "Briefmg for Associate Minister" and so on and so forth.
4) For the Ministerial AR field, either select yes, no or leave it blank
depending on how this field is commonly used in your ministry in relation
to the records in the request.
5) It was decided as a group to use the "Logged Date - Start" (Apri11,
2013} and "Logged Date- End" (date the FOIP access request was
received by your ministry, e.g. June 28, 2013)
6) Select Search
7) Select Print
8) Add a Title that matches the search parameters (e.g. Briefing Notes-
Associate Minister- April1, 2013- June 28, 2013t
9) Order By should be "AR Number" and "Ascending"
10)Select Generate
11) Repeat above Steps for all other relevant Action Types, depending upon
your Ministry's listed Action Types, e.g.:
