You will graduate in the School of Law in the year 2015. It is your intention to take the bar examinations to be administered by the Supreme Court in the same year. Pepe Smith comes to your law office seeking legal advice. He informs you that he is an operator of a taxi unit and that Juan Jones is his driver. He also narrated that while Juan Jones was driving the said taxi unit he bumped a certain Nena Clark while the latter was walking somewhere in Session Road, Baguio City. Because of the injuries that she sustained, Nena Clark sued Pepe Smith and Juan Jones for a civil case for damages before the Municipal Trial Court of Baguio City. Write an Internal Office Memorandum to your senior partner advising him to accept the case and summarizing the facts and possible defenses that you will be interposing for and in behalf of Pepe Smith. 3. Assume that in the immediately preceding number, your senior partner gave you the go signal for you to accept and handle the case for Pepe Smith. Write a Letter to Pepe Smith informing him that your law office had accepted his case and advising him how you will proceed representing him in the said case.

4. Assume that in the immediately preceding number, your law office wants to formalize your attorney-client relationship with Pepe Smith. Draft a Retainer Proposal/Contract to be signed by you and Pepe Smith stating the terms and conditions of your engagement as a lawyer. 5. Ignacio Rivera is the proprietor of a hardware store. Hilario Gomez bought items from the hardware of Ignacio Rivera amounting to P20,000.00 and the latter paid the former using his personal check. When Ignacio Rivera presented the said personal check for encashment to the bank, it was dishonored for the reason drawn against insufficient funds (DAIF). If you were the lawyer of Ignacio Rivera, draft a Demand Letter to Hilario Gomez demanding him to make good the value of the personal check and explaining the possible consequences if he will not comply. 6. John Lopez was charged with the crime of rape before the Regional Trial Court of Baguio City. After his arrest and detention, the relatives of John Lopez asked you to represent the latter in the said case. Draft an Entry of Appearance for John Lopez in the said case before the Regional Trial Court of Baguio City. 7. You are a new lawyer and you want to be appointed as a notary public to augment your income. In a criminal case for slight physical injuries filed against Bruno Mars and pending before the Municipal Trial Court of Baguio City, the prosecution witness in the person of Justin Biber, testified on the following facts: On February 14, 2014, at about 9:00 oclock in the evening, he was with four of his friends drinking beer at Zola Bar along Session Road, Baguio City. While drinking, Bruno Mars approached their table to talk to the group. Bruno Mars and Justin Bieber exchanged some words and the discussion soon developed into an ugly argument. Bruno Mars then left and went to the comfort room. When he returned, Bruno Mars walked towards the table of the group again and without uttering a word boxed Justin Bieber and ran away. Justin Bieber suffered a black eye as a result of the incident. If you were the private prosecutor of the case, draft a Judicial Affidavit for Justin Bieber. 10. Kim Jung Soo is a Korean citizen living in Baguio City, Philippines for six (6) years now. He is married to Christy Reyes a Filipino national for more than five (5) years. Assume that Kim Jung Soo possesses all the qualifications and none of the disqualifications to become a naturalized Filipino citizen. Draft a Petition for Naturalization for Kim Jung Soo to be filed before the Regional Trial Court of Baguio City. 11. Manny Paksiw is a resident of Baguio City and a world class boxing champion. Because of his extraordinary achievements in the sport of boxing the City Council of

If you are a member of the City Council of Baguio, draft a City Council resolution supporting the recognition as an honorary resident of Baguio City of Manny Paksiw. 12. Assume that it is the year 2015 or one year before the National and Local Elections in the year 2016. You are the lawyer of Jun Malabo and he intends to run as the City Mayor of Baguio in the year 2016. Draft a Certificate of Candidacy for Jun Malabo stating his qualifications as a candidate for City Mayor of Baguio to be filed before the COMELEC. 13. Assume that in the immediately preceding number, Jun Malabo successfully filed a Certificate of Candidacy to run as the City Mayor of Baguio and was proclaimed as the winning candidate after the voting. Buboy Ortega is a losing candidate for the same position. Buboy Ortega believes that there were irregularities committed during the casting and counting of votes for the position of City Mayor. If you were the lawyer for Buboy Ortega, draft an Election Protest against Jun Malabo before the COMELEC. 14. Tony De Leon obtained a loan of P10,000.00 from Andrew Garcia. To secure the said loan, draft a Promissory Note in favor of Andrew Garcia to be signed by Tony De Leon as the debtor or maker. 15. Arlene Nang wants to sell his titled land located in Quezon Hill, Baguio City valued at P3,500,000.00 to Annie Damasco. Draft a Contract to Sell setting forth the terms and conditions of the sale and the date by which the sale shall be completed. 16. Assume that in the immediately preceding number, Arlene Nang and Annie Damasco already complied with the terms and conditions of the Contract to Sell. Draft a Deed of Sale evidencing the full transfer of ownership of the subject titled land to Annie Damasco. 17. Marlon Sy obtained a loan from a bank amounting to P650,000.00 to acquire and finance a brand new Toyota Vios Sedan. After three (3) years of use, Marlon Sy decided to sell the motor vehicle to Marc Lansing. However, Marlon City has not yet fully paid the loan from the bank and to date he still has a balance of P200,000.00. Assume that Marlon Sy will sell the motor vehicle to Marc Lansing for the price of P300,000.00 with assumption of balance of the loan, draft a Deed of Sale of the subject motor vehicle. 18. Popoy Magno and Berta Lim are newlyweds. To constitute a family home, Popoy Magno and Berta Lim decided to buy a house and lot from Jerry Lachica located at Bakakeng, Baguio City valued at P5,000,000.00. The mode of payment will be fifty percent (50%) down payment upon consummation of the sale. The remaining balance will be paid on equally monthly installments payable in ten (10) years. Draft a Deed of Sale covering the subject house and lot. 19. Maria Reyes wants to donate the sum of P500,000.00 to his nephew Jim Jimeno. The donation is subject to the condition of the donor that the said sum of money will be used to finance the study of Jim Jimeno in college. Draft the Deed of Donation

Assume that in the immediately preceding number, Paul Gomez obtained a loan of P2,000,000.00 from Abner Mercado payable within two (2) years. However, to secure the loan, Paul Gomez would want to mortgage his Mercedes Benz motor vehicle valued at P1,500,000.00 in favor of Abner Mercado. Draft the Chattel Mortgage. 22. Elena Bascos is an incoming freshman at Saint Louis University and wants to rent an apartment owned by Mario Perez in Rimando Road, Baguio City for P3,000.00 a month exclusive of city services.
