This section provides a comprehensive consolidation and summary of all known commitments, responsibilities and assurances given by RAVCo and the Concessionaire to be fulfilled at various points following receipt of the BCCEA/CEAA Approval for the RAV Project. To the extent possible, we have incorporated the results of recent discussions with involved Federal, Provincial and Municipal agencies, the BCEAO, and CEAA Responsible Authorities, the findings of all pertinent RAV Project investigations and studies, and any recommendations regarding project design which are intended to avoid, mitigate or compensate for potential adverse impacts. Terrestrial Environment a) General Design Parameters Protection of Soil and Vegetation The Concessionaire will be responsible for adhering to the terms and conditions of the Concession Agreement and the EAC, the EMP and any applicable permits, licences and approvals related to protection of soil and vegetation resources. The Plan will identify all expected areas of temporary and permanent vegetation loss (e.g., specific numbers and locations of guideway footings; areas to be disturbed for laydown and storage areas, construction access, stockpiles, etc.) and will describe site-specific measures for reclamation, including but not limited to the following: Stabilization of soils and reestablishment of vegetation upon completion of work at a location. Involvement of qualified professionals (i.e., landscape architect, wildlife biologist, aboriculturalist / horticulturist, etc.) in providing requisite planning advice and onsite direction to ensure reclamation success. Establishment of vegetation in and adjacent to the right-of-way that is compatible with safe operation of the RAV line, particularly as it relates to slope stability and tree hazard control. Subject to discussions with municipal authorities, preference for selection of native species of grasses, herbs, shrubs and trees when re-planting is required along the RAV alignment. Species are to be selected at each location based on their ability to survive site-specific conditions and to afford cover and food for wildlife. Assurance that selected vegetation meets all applicable safety standards and addresses safety standards and concerns for adjacent users. Integration of revegetation plans for habitat replacement with other impact mitigation objectives (e.g., noise reduction/aesthetic enhancement), where feasible and cost-effective. c) Landscape Design and Restoration The Concessionaires Landscape Design and Restoration Plan will also include provision for: Preparation of a detailed post-construction report documenting the mitigation and compensation conducted for review and approval by RAVCo. Post-construction care of planted areas and plant stock for the period of time required to ensure its survival, as identified by qualified professionals. An annual assessment program, including site-specific guidelines, with detail sufficient to demonstrate that criteria for measuring the success of site restoration.

Commitments Applicable to Fraser River Crossing Middle Arm RAVCo and the Concessionaire are committed to the following final IFC design and construction specifications for avoidance, mitigation and compensation of impacts, if required, to intertidal and aquatic resources associated with construction of this crossing, along with the general requirements identified in the EMP. Commitments Applicable to Effects of the Environment on the Project The Project will be designed to withstand maximum wind conditions for the project area. Operations The Concessionaires Operations Environmental Management Plan (EMP), to be developed during the construction phase of the project, will address all environmental issues applicable to RAV line operations and maintenance.
