The Director may independently determine whether a n owner or bus iness entity may be renting a residential unit for tourist or transient use as d efined in this Chapter. To determine if there is a violation of this Chapter, th e Director may initiate an investigation of the subject property. This investiga tion may inclu de, but is not limited to, an inspection of the subject property and a request f or any pertinent information from the owner, such as leases or other documents. The Director shall have discretion to determine whether there is a potential vio lation of this Chapter 41A and whether to conduct an administrative review hearing as set fort h below. \par }\pard \tab {\b0\i0\ul0\strike0\v0\expnd0\expndtw0\outl0\shad0\f0\fs24\cf0\ nosupersub (d)\tab }{\b\i0\ul0\strike0\v0\expnd0\expndtw0\outl0\shad0\f0\fs24\cf 0\nosupersub Civil Action.}{\b0\i0\ul0\strike0\v0\expnd0\expndtw0\outl0\shad0\f0 \fs24\cf0 \nosupersub Following the filing of a complaint and the determination of a viol ation by the Director through an administrative review hearing as set forth in t his Chapter 41A, any interested party may institute proceedings for injunctive a nd monetary re lief. In addition, the owner or business entity may be liable for civil penaltie s of not more than $1,000 per day for the period of the unlawful rental. If the City or the interested party is the prevailing party, the City or the interested party shall b e entitled to the costs of enforcing this Chapter, including reasonable attorney s' fees, up to the amount of the monetary award, pursuant to an order of the Cou rt. Any person convicted of a misdemeanor hereunder shall be punishable by a fi ne of not more than $1,000 or by imprisonment in the County Jail for a period of not more than six months, or by both. \f0\fs24\cf0\nosupersub No less than ten working days prior to the administrativ e review hearing, parties to the hearing shall submit written information to the Director including, but not limited to, the issues to be determined by the hea ring officer a nd the evidence to be offered at the hearing. Such information shall be forwarde d to the hearing officer prior to the hearing along with any information compile d by the Director. \par }\pard \tab \tab {\b0\i0\ul0\strike0\v0\expnd0\expndtw0\outl0\shad0\f0\fs24 \cf0\nosupersub (3)\tab }{\b\i0\ul0\strike0\v0\expnd0\expndtw0\outl0\shad0\f0\fs 24\cf0\nosupersub Hearing Procedure. }{\b0\i0\ul0\strike0\v0\expnd0\expndtw0\out l0\shad0\f0 \fs24\cf0\nosupersub If more than one hearing is requested for residential units located in the same building at or about the same time, the Director shall cons olidate all of the hearings into one hearing. The hearing shall be tape recorded . Any party to the hearing may at his or her own expense cause the hearing to be recorded by a certified court reporter. Parties may be represented by counsel and shall have the right to cross-examine witnesses. All testimony shall be given under oath. W ritten decisio ns and findings shall be rendered by the hearing officer within 20 working days of the hearing. Copies of the findings and decision shall be served upon the par ties by certified mail. \fs24\cf0\nosupersub (i)\tab Specify a reasonable period of time during which th e owner must correct or otherwise remedy the violation; and \par }\pard \tab \tab \tab {\b0\i0\ul0\strike0\v0\expnd0\expndtw0\outl0\shad0\f0 \fs24\cf0\nosupersub (ii)\tab State that if the violation is not corrected or ot herwise remedied within this period, the owner may be required to pay the admini strative penal ties set forth in Subsection 41A.6(c). \par }\pard \tab \tab {\b0\i0\ul0\strike0\v0\expnd0\expndtw0\outl0\shad0\f0\fs24 \cf0\nosupersub (8)\tab If the Hearing Officer determines that no violation has occurred, the determination is final. \par }\pard \tab {\b0\i0\ul0\strike0\v0\expnd0\expndtw0\outl0\shad0\f0\fs24\cf0\ nosupersub (c)\tab }{\b\i0\ul0\strike0\v0\expnd0\expndtw0\outl0\shad0\f0\fs24\cf 0\nosupersub Imposition of Administrative Penalties for Unabated Violations and Enforcement Co sts. \par }\pard \tab \tab {\b0\i0\ul0\strike0\v0\expnd0\expndtw0\outl0\shad0\f0\fs24 \cf0\nosupersub (1)\tab }{\b\i0\ul0\strike0\v0\expnd0\expndtw0\outl0\shad0\f0\fs 24\cf0\nosupersub Administrative Penalties. }{\b0\i0\ul0\strike0\v0\expnd0\expnd tw0\outl0 \shad0\f0\fs24\cf0\nosupersub If the violation has continued unabated beyond the time specified in the notice required by the Hearing Officer, an administrative penalty of not more than four times the standard hourly administrative rate of $104.00 shall be charged for each unlawfully converted unit from the day the unlawful use comm enced until such time as the unlawful use terminates. \par }\pard \tab \tab {\b0\i0\ul0\strike0\v0\expnd0\expndtw0\outl0\shad0\f0\fs24 \cf0\nosupersub (2)\tab }{\b\i0\ul0\strike0\v0\expnd0\expndtw0\outl0\shad0\f0\fs 24\cf0\nosupersub Enforcement Costs. }{\b0\i0\ul0\strike0\v0\expnd0\expndtw0\out l0\shad0\f0 \fs24\cf0\nosupersub The owner shall reimburse the City for the costs of enforce ment of this Chapter, which shall include, but not be limited to, reasonable att orneys' fees. \par }\pard \tab {\b0\i0\ul0\strike0\v0\expnd0\expndtw0\outl0\shad0\f0\fs24\cf0\ nosupersub (d)\tab }{\b\i0\ul0\strike0\v0\expnd0\expndtw0\outl0\shad0\f0\fs24\cf 0\nosupersub Notice of Continuing Violation and Imposition of Penalties.}{\b0\i0 \ul0\strike0 \v0\expnd0\expndtw0\outl0\shad0\f0\fs24\cf0\nosupersub The Director shall notif y the owner by certified mail that the violation has continued unabated and that administrative penalties shall be imposed pursuant to this Chapter 41A. The not ice shall stat e the time of the continued existence of the violation and the resulting imposit ion of penalties. Payment of the administrative penalties and enforcement costs shall be made within 30 days of the certified mailed notice to the owner. If the administrativ e penalties and enforcement costs are not paid, the Director shall initiate lien procedures to secure the amount of the penalties and costs against the real pro perty that is subject to this Chapter, under Article XX of Chapter 10 of the San Francisco Adm inistrative Code to make the penalty, plus accrued interest, a lien against the real property regulated under this Chapter.
