Be it enacted by the Senate and House of Representatives of the Philippines in Congress asse bled! Section 1. Short "itle - "his #ct shall be $nown as the %"obacco Regulation #ct of &''()% Section 2. Policy - it is the policy of the State to protect the populace fro ha*ardous products and pro ote the right to health and instill health consciousness a ong the ) +t is also the policy of the State, consistent with the Constitutional ideal to pro ote the general welfare, to safeguard the +nterests of the wor$ers and other sta$eholders in the tobacco industry) ,or these purposes, the govern ent shall institute a balanced policy whereby the use, sale, and advertise ents of tobacco products shall be regulated in order to pro ote a healthful environ ent and protect the citi*ens fro the ha*ards of tobacco s o$e, and at the sa e ti e ensure that the interest of tobacco far ers, growers, wor$ers and sta$eholders are not adversely co pro ised) Section . Purpose - +t is the ain thrust of this #ct to! a) Pro ote a healthful environ entb) +nfor the public of the health ris$s associated with cigarette s o$ing and tobacco use-

c) Regulate and subse.uently ban all tobacco advertise ents and sponsorshipsd) Regulate the labeling of tobacco productse) Protect the youth fro being initiated to cigarette s o$ing and tobacco use by prohibiting the sale of tobacco products to inorsf) #ssists and encourage ,ilipino tobacco far ers to cultivate alternative agricultural crops to prevent econo ic dislocationand g) Create an +nter-#gency Co ittee on "obacco /+#C-"obacco0 to oversee the i ple entation of the provision of this #ct) Section 0. 1efinition of "er s - #s used in this #ct! a) %#dvertise ent% - refers to any visual and2or audible essage disse inated to the public about or on a particular product that pro ote and give publicity by words, designs, i ages or any other eans through broadcasts, electronic, print or whatever for of ass edia, including outdoor advertise ents, such as but no li ited to signs and billboards) ,or the purpose of this #ct, advertise ent shall be understood as tobacco advertise ent) b) %#dvertising% - refers to the business of conceptuali*ing, presenting, a$ing available and co unicating to the public, through any for of ass edia, any fact, data or infor ation about the attributes, features, .uality or availability of consu ers products, services or credit) ,or the purpose of this #ct, advertising shall be understood as tobacco advertising) "his shall specifically refer to any essages and i ages pro oting s o$ing- the purchase or use of cigarette or tobacco trade ar$s brand na es, design and anufacturer3s na esc) %#dvertiser% - refers to a person or entity on whose account of for who an advertise ent is prepared and disse inated by the

advertising agency, which is service established and operated for the purpose of counseling or creating and producing and2or i ple enting advertising progra in various for s of ediad) %Cigarette% - refers to any roll or tubular construction, which contains tobacco or its derivatives and is intended to be burned or heated under ordinary conditions of usee) %1istributor% - refers to any person to who a tobacco product is delivered or sold for purposes of distribution in co erce, e4cept that such ter s does not include a anufacturer or retailer or co on carrier of such productf) %Mass Media% - refers to any ediu of co unication designed to reach a ass of people) ,or this purposes, ass edia includes print edia such as, but not li ited to, newspapers, aga*ines, and publications- broadcast edia such as, but not li ited to, radio, television, cable television, and cine a- electronic edia such as but not li ited to the internetg) %Minor% - refers to any person below eighteen /560 years oldh) %Manufacturer% - refers to any person entity, including a repac$er, who a$es, fabricates, asse bles, processes, or labels a finished producti) %Pac$age% - refers to pac$, bo4es, cartons or containers of any $ind in which any tobacco product is offered for sale to consu ers7) %Persons% - refers to an individual, partnership, corporation or any other business or legal entity$) %Point-of-sale% - refers to any location at which an individual can purchase or otherwise obtain tobacco productsl) %Pro otions% - refers to an event or activity organi*ed by or on behalf of a tobacco anufacturer, distributor or retailer with the ai of pro oting a brand of tobacco product, which event or activity would not occur but for the support given to it by or on

behalf of the tobacco anufacturer3s na e, trade ar$, logo, etc) on non-tobacco products) "his includes the paid use of tobacco products bearing the brand na es, tradena es, logos, etc) +n ovies, television and other for s of entertain ent) ,or the purpose of thus #ct, pro otion shall be understood as tobacco pro otion) %Public Conveyance% - refers to ode of transportation servicing the general population such as, but not li ited to, elevators, airplanes, buses, ta4icabs, ships, 7eepneys, light rail transits, tricycles, and si ilar vehiclesn) %Public Places% - refer to enclose or confined areas of all hospitals, edical clinics, schools, public transportation ter inals and offices, and building such as private and public offices, recreational places, shopping alls, ovie houses, hotels, restaurants, and the li$e3 o) %Retailer% - refers to any person who or entity that sells tobacco products to individuals for personal consu ptionp) %S o$ing% - refers to the act of carrying a lighted cigarette or other tobacco products, whether or not it is being inhale or s o$ed.) %Sponsorship% - refers to any public or private contribution to a third party in relation to an event, tea or activity ade with the ai of pro oting a brand of tobacco product, which event, tea or activity would still e4ist or occur without such contribution) ,or the purpose of this #ct, sponsorship shall be understood as tobacco sponsorshipr) %"obacco% - refers to agricultural co ponents derived fro the tobacco plant, which are processed for use in the anufacturing of cigarettes and other tobacco productss) %"obacco Products% - refers to any product that consists of loose tobacco that contains nicotine and is intended for use in a cigarette, including any product containing tobacco and intended

s o$ing or oral or nasal use) 8nless stated otherwise, the re.uire ents of this #ct pertaining to cigarettes shall apply to other tobacco productst) %"obacco 9rower% - refers to any person who plants tobacco before the enact ent of this #ct and classified as such by the national "obacco #d inistration /:"#0- and u) %;arning% - refers to the notice printed on the tobacco product or its container and2or displayed in print or alert in broadcast or electronic edia including outdoor advertising and which shall bear infor ation on the ha*ard of tobacco use(#A&T(/%& #N-'R,N.#NT Section 1. S o$ing in Public Places - S o$ing shall be absolutely prohibited in the following public places! a) Centers of youth activity such as playschools, preparatory schools, ele entary schools, high schools, colleges and universities, youth hostels, and recreational facilities for persons under eighteen /560 years oldb) <levator and stairwellsc) =ocation in which fire ha*ards are present, including gas stations and storage areas for fla able li.uids, gas, e4plosives or co bustible aterialsd) ;ithin the buildings and pre ises of public and private hospitals) Medical, dental, and optical clinics, health centers, nursing ho es, dispensaries and laboratoriese) Public conveyance and public facilities including airport and ship ter inals and train and bus stations, restaurant and conference halls, e4cept for separate s o$ing areas- and f) ,ood preparation areas) Section 2. 1esignated S o$ing #nd :on-S o$ing #reas - +n all enclosed places that are open to the general public, private

wor$places, and other places not covered under the preceding section, where s o$ing ay e4pose a person to the other than the s o$er to tobacco s o$e, the owner, proprietor, possessor, anager or ad inistrator of such places shall establish s o$ing areas) Such areas ay include a designated s o$ing area within the building, which ay be in an open space or separate area with proper ventilation, but shall not be located within the sa e roo that has been designated as a non-s o$ing area)5>vvph?@)ABt #ll designated s o$ing areas shall at least one /50 legible and visible sign posted, na ely %SMCD+:9 #R<#% for the +nfor ation and guidance of all concerned) +n addition, the sign or not posted shall include a warning about the health effects of direct or secondhand e4posure to tobacco s o$e) :on-s o$ing areas shall li$ewise have at least one /50 legible and visible sign, na ely! %:C SMCD+:9 #R<#% or %:C SMCD+:9%) ACC#S R#STR'CT',NS Section 3. Eending Machines, Self-Service ,acilities - unless the vending achine has a echanis for age verification, the sale or distribution of tobacco products to inors by eans of a vending achine or any self-service facility or si ilar contraption or device is prohibited, e4cept at point-of-sale establish ents) Section 4. Retailer Co pliance ;ith Respect "o Self-Service ,acilities) - <ach retailer shall ensure that all tobacco-related selfservice displays or facilities, advertising, labeling and other ite s that are located in the establish ent of the retailer and that do not co ply with the re.uire ents of this #ct are re oved or are brought into co pliance with the re.uire ents of this #ct) Section 9. Mini u

#ge Sales - 8nder this #ct, +t shall be unlawful! a) ,or any retailer or tobacco products to sell or distribute tobacco products to any inorb) ,or any person to purchase cigarettes or tobacco products fro a inor-

c) ,or a and d) ,or a

inor to sell or buy cigarettes or any tobacco productsinor to s o$e cigarettes or any other tobacco products)

+t shall not be a defense for the person selling or distributing that he2she did not $now or was aware of the real age of the inor) :either shall it be a defense that he2she did not $now nor had any reason to believe that the cigarette or any other tobacco product was for the consu ption of the inor to who it was sold) Section 1". Sale of "obacco Products ;ithin School Peri eters - "he sale or distribution of tobacco products is prohibited within one hundred /5''0 eters fro any point of the peri eter of a school, public playground or other facility fre.uented particularly by inors) Section 11. Sinage - Point-of-Sale establish ents offering, distributing or selling tobacco products to consu ers, shall post the following state ent in a clear and conspicuous anner! %S#=<21+S"R+B8"+C: "C C8R P8RCH#S< BF M+:CRS C, "CB#CCC PRC18C"S +S 8:=#;,8=% or % +" +S =#;,8= ,CR "CB#CCC PRC18C"S "C B< SC=121+S"R+B8"<1 "C CR P8RCH#S<1 BF P<RSC:S 8:1<R 56 F<#RS C, #9<%) Section 12. Proof Cf #ge Eerification - +n case of doubt as to the age of the buyer, retailers shall verify, by eans of any valid fro of photographic identification containing the date of birth of the bearer, that no individual purchasing a tobacco is below eighteen /560 years of age) A*-#RT'S'N$ AN* PR,.,T',NS Section 1 . ;arning Cn Cigarette Pac$ages - 8nder this #ct! a) #ll pac$ages in which tobacco products are provided to consu ers withdrawn fro the anufacturing facility of all anufacturers or i ported into the Philippines intended for sale to the ar$et, starting 5 January &''G, shall be printed, in either

<nglish or ,ilipino, on a rotating basis o separately and si ultaneously, the following health warnings! %9CE<R:M<:" ;#R:+:9- Cigarette are #ddictive%%9CE<R:M<:" Children%- or ;#R:+:9"obacco Can har your

%9CE<R:M<:" ;#R:+:9- S o$ing Dills)% b) 8pon effectivity of this #ct until ('June &''H, the health warning shall be located on one side panel of every tobacco product pac$age and occupy not less than fifty percent /I'J0 of such side panel including any border of fra e) c) Beginning 5 July &''H, the health warning shall be on the botto portion of one /50 front panel of every tobacco product pac$age and occupy not less than thirty percent /('J0 of such panel including any border or fra e) "he te4t of the warning shall appear in clearly legible type in blac$ te4t on a white bac$ground with a blac$ border and in contrasts by typographylayout or color to the other printer aterials on the pac$age) "he health warning shall occupy a total area of less than fifty percent /I'J0 of the total warning fra e) d) "he warning shall be rotated periodically, or separately and si ultaneously printed, so that within any twenty-four /&G0 onth period, the four /G0 variations of the warnings shall appear with proportionate fre.uency) e) "he warning shall not be hidden or obscured by other printed infor ation or i ages, or printed in a location where ta4 or fiscal sta ps are li$ely to be applied to the pac$age or placed in a location where it will be da aged when the pac$age is opened) +f the warning to be printed on the pac$age is li$ely to be obscured or obliterated by a wrapper on the pac$age, the warning ust be printed on both the wrapper and the pac$age)

f) +n addition to the health warning al pac$ages of tobacco products that are provided to consu ers shall contain, on one side panel the following state ent in a clear, legible and conspicuous anner- %:C S#=< "C M+:CRS% or %:C" ,CR S#=< "C M+:CRS)% "he state ent shall occupied an area of not less than ten percent /5'J0 of such side panel and shall appear in contrast by color, typography or layout with all the other printed aterial on the side panel) g) :o other printed warnings, e4cept the health warning and the essage re.uired in this Section, paragraph , shall be placed on cigarette pac$ages) Section 10. ;arning Cn #dvertising - 8nder this #ct! a) #ll tobacco advertising in ass edia shall contain either in <nglish or ,ilipino, the following health warning- %9CE<R:M<:" ;#R:+:9! Cigarette S o$ing is 1angerous to Four Health)% b) ,or print and outdoor advertise ent, the warning fra e shall be centered across the botto of the advertise ent and occupy a total area of not less than fifteen percent /5IJ0 of such advertise ent including any border or fa e) "he te4t of the health warnings shall be clearly visible and legible, printed in a pro inent color as appro4i ate and shall appear in contrast by color, typography or layout with all other printed aterial in the advertise ent) "he warning shall not be hidden or obscured by other printed infor ation or i ages in the advertise ent) c) ,or television and cine a advertise ents, the warning shall be clearly shown and voiced over in the last five /I0 seconds of the advertise ent, regardless of the duration of the advertise ent, even when such advertise ent is silent) "he health warning shall occupy a total area of not less than fifty percent /I'J0 of the television screen and shall be clearly visible, legible, and audible, in blac$ te4t on white bac$ground or white te4t on blac$

bac$ground) :o other i ages e4cept in writing shall be included in the warning fra e) d) ,or radio advertise ent, the warnings stated after the advertise ent shall be clearly and audibly voiced over in the last five /I0 seconds of the advertise ent, regardless of its duration) Section 11. Restrictions Cn #dvertising - "he following restrictions shall apply to all tobacco advertising! a) #dvertise ent shall not be ai ed at or particularly appeal to persons under eighteen /560 years of age) b) #dvertise ent shall not feature a celebrity or contain an endorse ent, i plied or e4press by a celebrity) c) #dvertise ent shall not contain cartoon characters or sub7ects that depict hu ans or ani als with co ically e4aggerated features or that attribute hu an or unnatural characteristics to ani als, plants or other ob7ects) d) #dvertise ent shall not show, portray or depict scenes where the actual use of, or the act of using, puffing or lighting cigarettes or other tobacco products is presented to the public) Section 12. Restrictions on Print Media #dvertising - "he following restrictions shall apply to all print edia tobacco advertise ents! a) #dvertise ents shall not be placed in any printed publication unless there is a reasonable basis to believe that at least seventyfive percent /KIJ0 of the readers of such publication are eighteen /560 years of age and above, and the nu ber of youth who read it constitutes less than ten percent /5'J0 of all youth in the Philippines) b) #dvertise ents shall not be placed on the pac$aging or outside covers /front and bac$0 of a aga*ine, newspaper, 7ournal or other publication printed for general circulation) Section 13. Restrictions on Cutdoor #dvertising - "he following restrictions shall apply to all print edia tobacco advertise ents!

a) Cutdoor advertise ents shall not be placed on billboards, wall urals, or transport stops or stations which are within the one hundred /5''0 eters fro any point of the peri eter of a school, public playground or other facility fre.uented particularly by persons below eighteen /560 years of age) b) Cutdoor advertise ents shall not, either individually or when placed indeliverate co bination with other outdoor tobacco advertising, e4ceed seventy /K'0 s.uare eters in total si*e) c) Cutdoor advertise ents shall not be placed on ta4is, buses, trains or other public conveyance or in stations, ter inals or platfor s thereof, e4cept point-of-sale establish ents) Section 14. Restrictions on #dvertising +n Cine as - "obacco advertise ents are prohibited in connection with the showing of any fil where persons below eighteen /560 years old are per itted ad ission Section 19. Restrictions on "elevision - #dvertise ents shall not be broadcast on television, cable television, and radio between seven o3 cloc$ in the orning and seven o3 cloc$ at night) Section 2". Restriction on #dvertising +n #udio, Eideo #nd Co puter Cassettes2discs #nd Si ilar Mediu - :o electronic advertise ents shall be incorporated within any video or audio cassette, videoga e achine, optical disc or any si ilar ediu , unless access to the ite is restricted to persons eighteen /560 years of age or older) ,or the purpose of this Section, video ga e includes any electronic a use ent device that utili*es a co puter, icroprocessor, or si ilar electronic circuitry and its own cathode ray tube, or is designed to be used with a television set or onitor that interacts with the user of the device) Section 21. Restrictions on #dvertising Cn "he +nternet #nd Si ilar Mediu - #dvertise ent are prohibited on the internet and other si ilar ediu unless that +nternet site is restricted to persons eighteen /560 years of age or older) # site will be dee ed restricted if

a person cannot obtain access beyond the first page of the website unless the persons has established that he or she is at least eighteen /560 years old) "his li itation applies to co ercial co unications and shall not prevent the use of co pany +nternet websites to provide infor ation regarding a co pany, its products and s o$ing and health related infor ation) "his Section shall prohibit business-tobusiness transactions conducted on the +nternet, and other si ilar ediu between tobacco anufactures, retailers and distributors) Section 22. Ban Cn #dvertise ents - Beginning 5 January &''K, all tobacco advertising on television, cable television and radio shall be prohibited) Beginning 5 July &''K, all cine a and outdoor advertising shall be prohibited) :o leaflets, posters and si ilar outdoor advertising aterials be posted, e4cept inside the pre ises of point-of-sale retail establish ents) Beginning 5 July &''6, all for s of tobacco advertising in ass edia shall be prohibited e4cept tobacco advertise ents placed inside the pre ises of point-of sale establish ents) Section 2 . Restrictions on "obacco Pro otions - "he following restrictions shall apply on all tobacco pro otions) a) Pro otions ust be directed only to persons at least eighteen /560 years old) :o person below eighteen /560 years old or who appear to be below eighteen /560 years old ay participate in such pro otions) "he participants in pro otions ust be re.uired to provide proof of age) b) Co unications to consu ers about tobacco pro otions shall co ply with the provisions of this #ct governing tobacco advertising) +n addition to the re.uired health warning, the age re.uire ent for participation in any pro otion ust be clearly ar$ed on the progra aterials distributed to consu ers) c) #ll stalls, booths and other display concerning tobacco pro otions ust be li ited to point-of-sale of adult only facilities)

d) "elephone Co unications concerning pro otional offers, progra s or events ust include a recorded health warning essage in <nglish or ,ilipino consistent with the warnings specified in this #ct) e) :o place ent shall be ade by anufacturer, distributor, or retailer of any tobacco product or tobacco product pac$ages and advertise ent as a prop in any television progra or otion picture produced for viewing by the general public or in a video, or optical disc or on video ga e achine) f) "he na e, logo or other indicia of a cigarette brand ay appear on cigarette lighters, ashtrays, of other s o$ing related ite s) +f such na e, logo or other indicia of the cigarette brand is larger than fifty /I'0 s.uare centi eters, the ite ust carry a health warning consistent with the warnings specified in this #ct) g) :o erchandise such as, but not li ited to, t-shirts, caps, sweatshirts, visors, bac$pac$s, sunglasses, writing i ple ents and u brellas, ay be distributed, sold or offered, directly or indirectly, with the na e, logo or other indicia of a cigarette brand displayed so as to be visible to others when worn or used) Clothing ite s ust be in adult si*es only) h) :o na e, logo or other indicia of a cigarette brand or ele ent of a brand-related ar$eting activity, ay appear on ite s that are ar$eted to or li$ely to be used by inors such as but not li ited to sports e.uip ent, toys, dolls, iniature replicas of racing vehicles, video ga es, and food) "he anufacturer or co pany ust ta$e all available easures to prevent third parties fro using the co pany3s brand na es) =ogos or other proprietary aterial on products that are directed toward inors) i) :o tobacco advertise ents ay be placed on shopping bags) Section 20. :a ing Rights) - Sub7ect to the provision of this #ct! a) :o anufacturer ay enter into any agree ent pursuant to which pay ent is ade or other consideration is provided by

such anufacturer to any sports league, or any tea involved in any such league, in e4change for use of tobacco products brand) b) :o anufacturer ay enter into any agree ent for the na ing rights of any stadiu or arena using a tobacco product brand na e or otherwise cause a stadiu or arena to be na e with such a brand na e) Section 21. Restrictions on Sponsorships) Beginning 5 July &''H! a) :o sponsorship shall be provided for! 50 an event or activity which bears a tobacco product brand na e, unless there is reasonable basis to believe that all persons who co pete, or otherwise ta$en an active part, in the sponsored events or activities, are person eighteen /560 years of age or older&0 a tea or individual bearing a tobacco product na e, unless all persons under eighteen /560 years of age or older(0 a sponsored event or activity reasonably believed to be particular appear to persons under eighteen /560 years old) b) "obacco brand sponsorship shall be prohibited e4cept where there is a reasonable basis to believe that! 50 attendance at the sponsored event or activity will co prise no less than seventy-five percent /KIJ0 persons at least eighteen years of age or older&0 the sponsored event or activity will not be of particular appeal to persons under eighteen /560 years old(0 the sponsored event or activity will not receive e4posure, other than as a news ite , on television or radio or the +nternet, unless such e4posure co plies with the provisions of this #ct governing tobacco ar$eting through those edia- and

G0 the principal activity associated with the sponsorship does not re.uire above-average physical fitness for so eone of the age group of those ta$ing part) c) #ll persons authori*ed to bear tobacco product advertise ent, logos and brand na es at sponsored events shall be at least eighteen /560 years old) d) #ll for s of advertising associated with or ancillary to sponsorship shall co ply with the ar$eting provisions of this #ct) Section 22. Ban on Sponsorships) - Beginning 5 July &''6, cigarette and tobacco co panies are hereby prohibited fro sponsoring any sport, concert, cultural art or event, as well as individual and tea athletes, artists, or perfor ers where such sponsorship shall re.uired or involve the advertise ent or pro otion of any cigarette or tobacco co pany, tobacco product or tobacco use, na e, logo or trade ar$s and other words, sy bols, designs, colors or other depictions co only associated with or li$ely to identify a tobacco productProvided further, "hat no anufacturer ay register a tobacco brand na e as a co pany na e after the passage of this #ct)5>wph?@)ABt Section 23. Restriction on Sa pling) - "he distribution of sa ples of tobacco products to persons below eighteen /560 years old is prohibited) Section 24. =egal #ction) - #ny legal action in connection with the tobacco industry shall be governed by the provisions of the Philippine Civil Code and other applicable laws) '.P&#.#NT'N$ A$#NC5 AN* APP&'CAT',N Section 29. + ple enting #gency) - #n +nter-#gency Co ittee"obacco /+#C-"obacco0, which shall have the e4clusive power and function to ad inister and i ple ent the provisions of this #ct, is hereby created) "he +#C-"obacco shall be chaired by the Secretary of the 1epart ent of "rade and +ndustry /1"+0 with the Secretary of the

1epart ent of Health /1CH0 as Eice Chairperson) "he +#C-"obacco shall have the following e bers! a) Secretary of the 1epart ent of #griculture /1#0b) Secretary of the 1epart ent of Justice /1CJ0c) Secretary of the 1epart ent of <nviron ent and :atural Resources /1<:R0d) Secretary of the 1epart ent of Science and "echnology /1CS"0e) Secretary of the 1epart ent of <ducation /1ep<d0f) #d inistrator of the :ational "obacco #d inistration /:"#0g) # representative fro the "obacco +ndustry to be no inated by the legiti ate and recogni*ed associations of the industry- and h) # representative fro a nongovern ent organi*ation /:9C0 involved in public health pro otion no inated by 1CH in consultation with the concerned :9C3s"he 1epart ent Secretaries ay designate their 8ndersecretaries as their authori*ed representatives to the +#C) Section ". #pplication to "obacco Products - "his provision of this #ct shall apply to all tobacco products placed into co erce in the Philippines) <4cept as provided below, no provision of this #ct shall apply to tobacco products intended or offered by the anufacturer for e4port and not for /retail0 sale in the Philippines) "obacco products intended or offered for e4port shall be sub7ect only to the re.uire ent that the shipping container shall be pro inently ar$ed on the outside %<4port Cnly%! Provided, that tobacco products which are ar$ed for e4port, but are sold2traded or distributed in the Philippine ar$et, shall be sub7ect to i ediate confiscation and destruction) Section 1. Co pliance Monitoring - :ot later than one /50 year after the date of the effectivity of this #ct, and annually thereafter,

5) He or she has been a tobacco far er for the last three /(0 years prior to January 5, &''G&) He or she belongs to the tobacco producing provinces() He or she has certificate of eligibility to apply issued by the local govern ent 8nit and the :"#- and G) He or she has ceased to plant tobacco for the ne4t preceding season after the enact ent of this #ct) b) "obacco 9rowers Cooperative)- "his progra shall pro ote cooperative progra s to assist tobacco far ers in developing alternative far ing syste s, plant alternative crops and other livelihood pro7ects) "he re.uire ents of subsection /a0 shall li$ewise apply) c) :ational S o$ing Cessation Progra - # :ational S o$ing Cessation Progra shall be underta$en with the approval of the +#C-"obacco) "he i ple enting rules and guidelines to reinforce this progra shall be sub itted to the +#C-"obacco by the Secretary of Health within three /(0 onths after the effectivity of this #ct) d) Research and 1evelop ent Progra - "he +#C-"obacco shall establish a research and develop a progra to be spearheaded by the :"# in cooperation with the 1CS", which will underta$e studies concerning technologies and ethods to reduce the ris$ of dependence and in7ury fro tobacco product usage and e4posure, alternative uses of tobacco and si ilar research progra s) e) :ational "obacco-,ree Public <ducation Progra )- State 8niversities and Colleges and technical and Eocational Schools shall provide scholarships progra s to defendants of tobacco growers for which the ad inistrator of the :"# shall provide i ple enting rules and guidelines) "he guidelines shall be sub itted to the +#C- "obacco within three /(0 onths after the effectivity of this #ct)

f) 1isplaced Cigarette ,actory ;or$ers3 #ssistance Progra )- "he Secretary of =abor and < ploy ent with the concurrence of the +#C-"obacco shall establish a progra to assist displaced ter inated2 separated or retrenched cigarette factory wor$ers as result of the enact ent of the #ct) "he Secretary of =abor in coordination with the :"# and 1"+ shall provide the rules as guidelines to effectuate this progra and sub it the sa e to the +#C-"obacco within three /(0 onths after the effectivity of this #ct) g) Health Progra s)- "he +#C-"obacco, in consultation with 1CH, shall be responsible for awarding grants to all edical institutions for the purpose of planning, carrying out, and evaluating activities related to s o$ing-related illnesses) "he +#C-"obacco shall sub it to Congress and President of the Philippines the annual report of e4penditures related to this progra ) h) ;ithdrawal Clinics)- "he 1CH shall establish s o$ing withdrawal clinics to provide counseling regarding the ha*ardous health effects of tobacco2 cigarette s o$ing and to rehabilitate s o$ers for the ha*ardous effects of such products) +f a s o$er- inor voluntarily sub its hi self for treat ent, counseling or rehabilitation in s o$ing withdrawal clinic located in any edical institution in the Philippines, or through the parents2 guardian, the e4penses incurred shall be rei bursable outpatient service of the Philippine Health +nsurance Corporation) 'N/,R.AT',N PR,$RA. Section 0. +nfor ative 1rive) - Consistent with the provisions of this #ct, the 1CH shall, in cooperation with the 1ep<d and with the assistance of the Philippine +nfor ation #gency /P+#0, underta$e a continuous infor ation progra on the har ful effects of s o$ing) "he 1CH shall enlist the active participation of the public and private sectors in the national effort to discourage the unhealthy habit of s o$ing)

Section 1. +nstructions on the Ha*ardous <ffect of S o$ing as Part of School Curricula) - +nstruction on the adverse effects of cigarette tobacco s o$ing, including their health, environ ental and econo ic i plications, shall be integrated into the e4isting curricula of all public and private ele entary and high schools) "he 1ep<d Secretary shall pro ulgate such rules and regulations as ay be necessary to carry out the abovestated policy hereof, and, with, the assistance of the Secretary of Health, and with the approval of the +#C-"obacco, shall cause the publication and distribution of aterials on the unhealthy effects of s o$ing to students and the general public) .'SC#&&AN#,%S PR,-'S',NS Section 2. Congressional Cversight Co ittee on "obacco) - a Congressional Cversight Co ittee on "obacco /CCC-"obacco0 is hereby constituted which is andated to onitor and review the i ple entation of this #ct for a period not e4ceeding three /(0 years) "he CCC-tobacco shall be co posed of the Chairpersons of the Senate Co ittee on Health , "rade and Co erce, #griculture and Public +nfor ation and the House of Representative Co ittees on "rade and +ndustry, Health, Public +nfor ation and #griculture and a Me ber of the House of representatives representing the tobacco producing provinces, to be no inated by all the Me bers of the House of Representatives fro tobacco producing districts) "he Secretariat of the CCC-"obacco shall be drawn fro the e4isting secretariat personnel of the standing co ittees co prising the Congressional Cversight Co ittee and its funding re.uire ents shall be charged against the appropriations of both the House of Representatives and the Senate of the Philippines) Section 3. + ple enting Rules) - "he +#C-"obacco shall pro ulgate such rules and regulations necessary for effective i ple entation of this #ct within si4 /H0 onths fro the date of publication of this #ct) "he said rules and regulations shall sub itted to the CCC- "obacco
