COMES NOW, Plaintiff Christopher Baker, by and through the undersigned counsel, pursuant to Rule 12(f) of the Federal Rules of Civil Procedure, and moves this Court to issue an Order striking the so-called amicus brief submitted by the State of Hawaii, a named Defendant in this lawsuit. In support of this Motion, Mr. Baker would show: 1. Defendant State of Hawaii has twice affirmatively sought to NOT participate in this lawsuit. It first filed a Motion to Dismiss in the court below. Then, in the attached correspondence, Defendant State of Hawaii informed this Court that it did not wish to participate in this appeal. 2. Defendant State of Hawaii admitted it was a Defendant in their October 15, 2012, correspondence with this Court (attached). 3. It is a complete misapplication of Rule 29(a) of the Federal Rules of Appellate Procedure to allow this untimely brief. The purpose of the rule is to allow a State Actor to file an amicus brief when it is not a named party to a lawsuit. 4. Despite its persistent efforts to decline participation in this case, Defendant State of Hawaii has now filed a brief as a purported amicus. 5. Yet, Defendant State of Hawaii had two separate avenues in which it could have participated in this petition for en banc despite its earlier efforts to forego and an all participation. First, it could have independently filed a

petition for en banc. Second, it could have filed a joint petition alongside the City and County of Honolulu pursuant to Rule 28-4 of the Federal Rules of Appellate Procedure. Defendant State of Hawaii has affirmatively declined its right to participate in this case and has, even now, sat on its right to file. It now belatedly files an amicus brief in an appeal where it is a named Defendant. Defendant State of Hawaii should not be permitted to ignore procedure and then change its role in this case when aggrieved by a result a result that it had multiple opportunities to attempt to prevent, as inevitable as the result may have been. Mr. Baker respectfully requests this Court issue an Order striking the brief from the record.
