Ubalde who died on September 21, 2013 at Virac, Catanduanes. Photocopy of our sister's certificate of death is hereto attached as Annex "A"; That we are the siblings of the deceased considering that our father, the late Manuel de la Riva, is one and the same; That our sister died single and without issue or any compulsory heir to succeed her in the property she left; That said deceased died intestate, without Will or Testament, without any outstanding debts i n favor of any person or entity; and

That aside from the foregoing personal property or bank deposits our sister also left the following real properties i n Virac, Catanduanes, registered i n her name either by way of tax declaration or original/transfer certificate of title (OCT/TCT) registered with Registry of Deeds for the Province of Catanduanes, and more particularly described as, to wit: 1. A parcel of land covered by TCT No. 17169, consisting of One Hundred Forty Square Meters'fMO), more or less, located at Bigaa, Virac, Catanduanes;

Hundred Forty Seven Square Meters^(147), located at Bigaa, Virac, Catanduanes;

A parcel of land covered by TCT No. 13741, consisting of Six Hundred Seventy One Square Meters/(671), more or less, located at Cavinitan, Virac, Catanduanes; 4. A parcel of land covered by TCT No. 13742, consisting of Seven Hundred Forty Seven Square meters'(747), more or less, located at Cavinitan, Virac, Catanduanes; A parcel of land covered by TCT No. 12095, consisting of Two Thousand Five Hundred Twenty Five Square Meters'(2,525), more or less, located at Cavinitan, Virac, Catanduanes; A parcel of land covered by OCT No. 1845, consisting of One Hundred Seventy Square Meters''(170), more or less, located at Sta. Elena, Virac, Catanduanes; A parcel of land covered by Tax Declaration No. 009-1175; Lot No. 11241, consisting of Twenty Nine Thousand Seventy Four Square M e t e r s ' (29,074), more or less, located at Cavinitan, Virac, Catanduanes; 8. /, A memorial lot i n Himlayang San Lorenzo II situated at - Barangay Gogon, Virac, Catanduanes, and described in the Deed of Sale and Certificate of Memorial Park Care as being a portion of Lot No: 11884: Pls-662-D; and more particularly described i n the maps and lot books on file in tiie office of the seller, Himlayang San Lorenzo II, as Block: 3, Plot: 3, Type: Family Estate, Lot No: 21. Furthermore, during the lifetime of our sister she was able to acquire, by way of succession^,! si^eral properties from her mother, Consolacion S. Ubalde, who died on Seplsember 10, 2000 at Virac, Catanduanes, copy of the latter's certificate of death is herein attached as Annex " B " . That said properties inherited by our late sister remains to be registered i n the name of her mother and the same being registered either with the Registry of Deeds for the Province of Catanduanes and/or covered by a tax declaration, more particularly described as follows, vi^: 1. A parcel of land covered by OCT No. 2740, consisting of Four Thousand Five Hundred Forty Square Meters (4,540), more or less, located at Sta. That pursuant to the provisions of Section 1 of Rule 74 of the Revised Rules of Court of the Philippines and by virtue of our laws on INTESTATE SUCCESSION, we, the siblings of the deceased do hereby adjudicate unto ourselves OWNERSHIP, TITLE and INTERESTS to all aforementioned real and personal properties, i n equal shares pro indiviso; Further, we, Mercedes Dela Riva-Sunico and Concepcion Dela RivaBanaga, have named, constituted and appointed and by these presents, do hereby name, constitute and appoint our brother, J O S E ANTONIO DELA RIVA as our own, true and lawful ATTORNEY-IN-FACT, for us and i n our name, place and stead to tramsact and/or arrange with the aforementioned banks for the tTEinsfer of the above-mentioned bank accounts to a new account/s under our names as co-owners; That he shall have fuU power and authority to act for and in our behalf, and to bind us on any action or undertaking he may pursue for the withdrawal and/or transfer of the above-mentioned bank accounts and real properties to our names and execute the requisite documents and/or instruments, consistent to the a:iktharity given to him, as may be required by said banks or existing laws an4 rejg^lations; H E R E B Y GIVING AND GRANTING unto said Attorney-in-Fact full power and authority to do and perform all and every act or things requisite or necessary which may be required or necessaiy to be done in and about the premises to c a n y into effect the foregoing authorit>% as fully to all intents and purposes as we might or could lawfully do if personally present and hereby RATIFYING and CONFORMING all that our attorney-in-fact shaU lawfully do or cause to be done under and by virtue of these presents.
