That text follows: Item 2: The city engineer will review all applications submitted for a proposed designated parking permit area and determine the following: a. No less than 75 percent of all available on-street parking spaces within the designated area are occupied and remain occupied for a minimum of two hours; b. No less than 25 percent of all available on-street parking spaces within the designated area are occupied and remain occupied by non-neighborhood vehicles; and c. The proposed designated parking area is a contiguous commercial or residential use and consists of a minimum of ten commercial or residential lots, except where there are less than ten commercial or single family lots on the entire length of the street, then the entire length of the street may be considered. Oops. Items (a) and (b) are complete unknowns. Looks like a study by the City Engineer is in order. But heres where it gets good. Planning Manager Shannon Mattingly got up before Council and told them she didnt think these studies had been done for any of the streets that have been declared permit only. Uh-oh. That would mean that the signs are unenforceable. Oh dear. Oh dearie dear. Oh my goodness. Katie, bar the door. But wait, it gets even better. The Mayor flat out asked City Attorney Val Acevado if it was legal for Council to vote to approve something that had not met the minimum legal standard as set out in the municipal code. Acevado, after her usual shuck-and-jive, replied with the same answer she always gives Council when passing an illegal ordinance: Its up to you. This is the same advice a gangsters moll would provide, by the way. You know best, honey (pops gum, files nails). Lets be clear: Both City Attorney Val Acevedo and, later in the meeting, City Manager Robert Camareno, told the Mayor that Council absolutely had the right to pass the ordinance, despite the legal standard

Hey. You know how the people at the Forbidden Island of Booneville Avenue slapped up some signs and declared the Island, and the waters around it, Private Property, without actually owning or paying taxes on any of it? Well, as fate would have it, we just got our hands on another tasty tidbit of information regarding more public property being converted to private use. The public streets near the river and Schlitterbahn have been, for years, designated as permit parking zones. That is, one must have a special pass to park on them and those passes are only provided to homeowners in the area. As with most things in this city that have to do with special privileges, there were some shortcuts taken in that whole process, shortcuts that might make this summer real interesting for Kathleen Krueger and Ken Valentine. Allow me to explain. The folks that live over near the Faust Street Bridge want to get in on some of that public-to-private property conversion that the Islanders and Guada-Coma/Lincoln Street residents have been enjoying forever, so they went to the City and requested that parking on nearby city streets be closed to the public as well. So far, so good. We even have a law on the books to facilitate just such a seizure. You can look it up in our municipal code under Section 126-354 Parking by Permit Only. The requirements are under Section (d), items 1, 2, and 3. At Mondays City Council meeting, Garry Ford, (our future former Assistant City Engineer Transportation), told Council that items 1 and 3 were all in order, reading through 1 and mentioning 3. Oddly, he didnt mention Item 2 at all. Hmm. District Two Councilwoman and TX Citizen landlady Aja Edwards directly asked Ford about rules about percentages of nonresidents parking on the streets in question, because she had, apparently, read Item 2. Towing Case Update

In its motion for appeal in a lawsuit over nonconsent towing contracts, the City of New Braunfels argues that it is immune from the suit because there is no ordinance to sue over. In December, 2012, City Council awarded contracts to four companies for all non-consent towing operations in New Braunfels. Part of the agreement with the companies allows the City 10 free tows per month and free storage of towed vehicles for 15 days. The City had passed an ordinance that would contract only one company for all non-consent towing, but changed its mind and awarded the contracts to four operators. In previous years, there were 17 towing companies on the rotation list, a number the City said was unwieldy. When the City was considering the use of only one towing firm, it had asked companies to submit a Request for Proposal (RFP), with a deadline set for Nov. 21, 2012. In an RFP, a company makes a claim as to why its services should be considered for contract. In its RFP request, New Braunfels made a list of requirements that any towing company selected must be able to meet, such as having the proper equipment to right an overturned 18-wheeler and the ability to tow heavy equipment, as well as have enough space to store 100 vehicles. Garrison Maurer, of Comal Towing, brought suit against the City claiming the four companies chosen could not meet the RFP requirements, while his company did. In fact, Maurer stated that the companies eventually chosen actually call him to perform those more difficult services. The City has not disputed Maurers comments. Jeramie Hernandez, of JJ Towing, and Robert Fleming, of Pro Care Wrecker Service, also sued, stating that they did not submit bids because they believed being the only company to handle all of the non-consent towing would have been too difficult. Hernandez and Fleming said that Council, with no public notice, changed the rules to allow four companies to handle the work well after the Nov. 21, 2012, deadline for proposals had passed. Both men say that had they known of the rule changes, they would have pursued the contracts. In February, Judge Dib Waldrip ruled that the City is not immune from suit in this issue and the court does have proper jurisdiction. The City appealed Waldrips decision to the Third Court of Appeals. 4

The main thrust of the Citys argument in its appeal on jurisdiction is that after Council rescinded the one-company ordinance, it did not issue another ordinance when it chose four companies for the rotation list. Since there is no ordinance, not suit can be brought. The City, and the public officials acting in their official capacities, retains immunity from all declaratory judgment actions which do not seek to invalidate an ordinance, New Braunfels argues in its motion. Since no ordinance exists in this case (in fact, one was repealed in this process), no declaratory judgment action can be maintained. The City also argues that it is not legally required to make a list for towing rotations or to even have a towing ordinance. This is a case about a list, the appeal motion states. A non-binding discretionary referral list at that. The City thus argues that any contracts made with towing companies were simply to be put on the list, not to actually provide services, since New Braunfels can use any towing company it wants and doesnt have to abide by its own list. Even though it asked towing companies to submit RFPs, the City argues that the requests were substantively closer to Request for Quotations (RFQ), which is a request for a product rather than a service. The City is not legally required to have a list, but if it does, it decides who to put on and who not to put on, the motion states. That is the contract at issue. Under this contract, the City retains immunity from having its decisions challenged in court. To choose the four companies, City personnel developed a scoring system and applied it to those companies that previously submitted bids to become the single nonconsent towing company. The four who had the highest scores were chosen for the rotation list. However, the City also argues in its motion that when it rejected the one-company towing option, all bids for that contract were rejected. In his February order, Waldrip ruled that the scoring system was arbitrary and unrealistic, noting that Maurer scored lower than companies that did not meet the Citys own criteria. Maurer, Hernandez and Fleming, who brought the suit, have until May 5 to file their response.
