ENVIRONMENTAL ISSUES
India was the first country to insert an amendment into its
'onstitution allowing the State to protect and improve the
environment for safeguarding public health, forests and wild life.
The ()nd amendment was adopted in *+,- and went into effect
.anuary /, *+,,. The language of the "irective %rinciples of
State %olicy 01rticle (,2 re3uires not only a protectionist stance
by the state but also compels the state to seek the improvement
of polluted environments. This allows the government to impose
restrictions on potentially harmful entities such as polluting
industries.
1n important subtlety of the directive4s language is the provision
that the article 5shall not be enforceable by any court, but it shall
be the duty of the State to apply these principles in making laws.5
This allows the directive to be an instrument of guidance for the
government, while at the same time, since no law has been
passed, no individual can violate e6isting law.
The Indian 7orest 1ct was a product of $ritish rule in *+),. The
legislation granted the government uncontested rights over
natural resources, with state governments authori8ed to grant

licenses to lumber contractors and oversee protection of the
forests. 9ven at this early stage, awareness of man4s destructive
tendencies was emerging.
The 7actory 1ct also addressed public safety and health issues.
Section *) of the 1ct empowered each state government to
legislate its own rules and throughout the *+&:4s and *+-:4s
individual states framed their own versions of the bill. The
legislation addresses the discharge of water and effluents by
factories, calling for effective arrangements for disposal at the
plant-level. 1s in the Indian %enal 'ode, penalties have been
provided.
The government of %rime ;inister <ajiv =andhi in *+>& created
the ;inistry of 9nvironment and 7orests 0;o972. ;o97 was
more comprehensive and institutionali8ed, and had a ?nion
;inister and ;inister of State, two political positions answering
directly to the %rime ;inister. The agency was comprised of *>
divisions, and two independent units, the =anga %roject
"irectorate and the !ational ;ission on @astelands
"evelopment. It continued the same functions that "A9
originally had, such as monitoring and enforcement, conducting

environmental assessments and surveys, but also did
promotional work about the environment.
The ;o974s implementation of a monitoring system was also
aggressive. In *+,,, India had *> monitoring stations for water.

country had )> air monitoring stations in seven cities. $y *++(,
the !ational 1mbient 1ir Buality ;onitoring %rogram had )+:
stations in ++ cities.
"uring the intervening years, other laws have been passed to
address specific issues, including The @ild Cife %rotection 1ct,
and The 1tomic 9nergy 1ct.

RESEARCH METHODOLOGY
In order to accomplish the objectives of the study, it is essential
to articulate the manner in which it is to be conducted, i.e., the
research process is to be carried-out in a certain framework. The
<esearch ;ethodology, which follows, is the backbone of the
study.

various sources like DSI"' and other agencies.

.ournals, $ooks, Internet and printed articles will be collected.
Information will also collected on the 9nvironmental Issues in

A"()/*%*: 'ollected information will be analy8ed under the light
of the literature.
C&"3)u*%&": The findings from the information gathered and
after doing the analysis conclusion will be drawn.

limitations. Time will be the major constraint in this

research. Information will be gathered from the
corporate office and this report will be prepared on the
basis of the information provided.
