P&2!3# Cu!"# E"$%&"'!"#() I**u!* %" I"+%( 4 ENVIRONMENTAL ISSUES India was the first country to insert an amendment into its 'onstitution allowing the State to protect and improve the environment for safeguarding public health, forests and wild life. The ()nd amendment was adopted in *+,- and went into effect .anuary /, *+,,. The language of the "irective %rinciples of State %olicy 01rticle (,2 re3uires not only a protectionist stance by the state but also compels the state to seek the improvement of polluted environments. This allows the government to impose restrictions on potentially harmful entities such as polluting industries. 1n important subtlety of the directive4s language is the provision that the article 5shall not be enforceable by any court, but it shall be the duty of the State to apply these principles in making laws.5 This allows the directive to be an instrument of guidance for the government, while at the same time, since no law has been passed, no individual can violate e6isting law. The legislation granted the government uncontested rights over natural resources, with state governments authori8ed to grant 5 licenses to lumber contractors and oversee protection of the forests. 9ven at this early stage, awareness of man4s destructive tendencies was emerging.
