WHEREAS, the plaintiffs George Capsis, Fritz Beaute, Herbert Wheeler and
Olatokumbo Erinosho commenced this action by filing a complaint on or about March 7, 2013,
alleging that the defendants violated plaintiffs' federal civil and state common law rights; and
WHEREAS, defendants Raymond Kelly, New York City Police Department,
Samuel Sharman, Juan Perez, Christian Rich, Efrain Jiminez and Philip Picciano have denied
any and all liability arising out of the allegations of the plaintiffs George Capsis, Fritz Beaute,
Herbert Wheeler and Olatokumbo Erinosho; and
WHEREAS, the aforementioned parties now desire to resolve the issues raised in
this litigation, without further proceedings and without admitting any fault or liability; and
WHEREAS, the plaintiffs George Capsis, Fritz Beaute, Herbert Wheeler and
Oiatokumbo Erinosho have authorized their counsel, Arthur Z. Schwartz, Esq, to settle this
matter on the terms set forth below;
NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED, by
and between the undersigned, as follows:
1. All of the above-referenced claims brought by George Capsis, Fritz
Beaute, Herbert Wheeler and Olatokumbo Erinosho are hereby dismissed against all defendants,

withprejudice, and withoutcosts, expenses, or attorneys' fees in excessoftheamountspecified
inparagraph"2"through"5"below.
2. The City ofNew York hereby agrees to pay plaintiffGeorge Capsis the
sum ofForty Five Thousand ($45,000.00) Dollars in full satisfaction ofall claims, including
claims for costs, expenses and attorneys' fees. In consideration for the payment ofthis sum,
plaintiffagrees to dismissal ofall the claims against the defendants Raymond Kelly, the New
YorkCityPoliceDepartment, Juan Perezand ChristianRich, and to release the defendants, the
City ofNew Yorkand any presentorformer employeesand agents ofthe CityofNew Yorkor
any entity represented by the Office ofthe Corporation Counsel, from any and all liability,
claims, ar rights ofaction alleging aviolation ofplaintiffs civil rights and any and all related
state law claims, from the beginningofthe worldto the date ofthe General Release, including
claims for costs, expenses, and attorneys' fees, except only for the plaintiff Capsis'
counterclaims against Juan Perez that are set forth in 116-8 of Capsis' "Answer and
Counterclaim" in Juan Perez v. George Capsis, Cause No. 155478/13, which is pending in the
SupremeCourtofthe StateofNewYork, County ofNew Yark. ThisStipulationofSettlement
is intendedto resolve all claimsofthe plaintiffCapsisagainstthe Cityof NewYork, butnotthe
foregoing counterclaimsofCapsis in Cause No. 155478113, SupremeCourtoftheStateofNew
York,CountyofNewYork,towhichtheCityofNewYorkisnotaparty.
3. TheCityofNewYorkhereby agreestopay plaintiffFritzBeautethe sum
ofTen Thousand ($10,000.00) Dollars in full satisfaction ofall claims, including claims for
costs,expensesandattorneys' fees. Inconsiderationfor thepaymentofthissum,plaintiffagrees
to dismissal ofall the claimsagainstthe defendants RaymondKelly, the NewYorkCityPolice
Department and Efrain Jiminez, and to release the defendants, the City ofNew York and any
presentorformeremployeesandagentsoftheCityofNewYorkoranyentityrepresentedbythe
OfficeoftheCorporationCounsel,from any andall liability,claims, orrightsofaction alleging

aviolationofplaintiff'scivil rightsand any and alll'elated statelaw claims, from thebeginning
ofthe world to the date ofthe General Release, including claims for costs, expenses, and
attorneys' fees.
4. The City of New York hereby agrees to pay plaintiff Olatokumbo
Erinosho the sum ofTen Thousand ($12,500.00) Dollars in full satisfaction ofall claims,
includingclaimsfor costs,expensesand attorneys' fees. Inconsiderationforthepaymentofthis
sum, plaintiffagrees to dismissal ofall the claims against the defendants Raymond Kelly, the
New YorkCityPoliceDepartmentand Samuel Sharman, and to releasethedefendants, theCity
ofNew Yorkand any presentor former employees and agents oftheCity ofNewYorkor any
entityrepresentedbytheOfficeoftheCorporationCounsel,from any and allliability,claims,or
rights ofaction alleging a violation ofplaintiff's civil rights and any and all related state law
claims, from the beginning oftheworldto the date oftheGeneral Release, including claimsfor
costs,expenses,and attorneys' fees.
5. TheCityofNewYorkherebyagreesto payplaintiffHerbertWheelerthe
sum ofTwentyFiveThousand ($25,000.00) Dollars in full satisfaction ofall claims, including
claims for costs, expenses and attorneys' fees. In consideration for the payment ofthis sum,
plaintiffagrees to dismissal ofall the claims against the defendants Raymond Kelly, the New
YorkCityPoliceDepartmentandPhilipPicciano,andtoreleasethedefendants,the CityofNew
York and any present or former employees and agents ofthe City ofNew York or any entity
representedbytheOfficeof theCorporationCounsel, from any and all liability,claims,orrights
ofaction alleging aviolation ofplaintiffs civil rights and any and all related state law claims,
from the beginningofthe world to the date ofthe General Release, including claims for costs,
expenses,and attorneys'fees.
6. Plaintiffs shall execute and deliver to defendants' attorney all documents
necessaryto effectthis settlement, including,without limitation, aGeneralRelease basedonthe

terms ofparagraphs 2 though 5 above and an Affidavit ofStatus ofLiens. IfMedicare has
provided paymentand/or benefits for any injury or condition that isthe subject ofthis lawsuit,
priorto tenderingthe requisite documents to effect this settlement, plaintiffs shall have notified
Medicare and shall submit with the settlement documents a Medicare final demand letter for
conditional payments. A Medicare Set-AsideTrust may also be required iffuture anticipated
medical costs are found to be necessary pursuant to 42 U.S.C. 1395y(b) and 42 C.F.R.
411.22through411.26.
7. Nothing contained herein shall be deemed to be an admission by the
defendants or the City ofNew York that thcy have in any manner or way violated plaintiffs'
rights, or the rights of any other person or entity, as defined in the constitutions, statutes,
ordinances,rulesorregulationsofthe United States, the StateofNewYork, ortheCityofNew
YorkoranyotherrulesorregulationsofanydepartmentorsubdivisionoftheCityofNewYork.
This stipulation shallnotbe admissible in, nor is itrelated to, any other litigation orsettlement
negotiations.
8. Nothingcontainedhereinshallbedeemedtoconstituteapolicyorpractice
of theCityof NewYorkoranyagencythereof.
9. Plaintiffs agree to hold harmless defendants and the City ofNew York
regarding any liens or past and/or future Medicare payments, presently known or unknown, in
connectionwiththismatter. Ifconditionaland/orfuture anticipatedMedicarepaymentshavenot
been satisfied, the City ofNew York reserves the right to issue a mUltiparty settlement check
namingMedicareasapayeeorto issueachecktoMedicaredirectlybaseduponMedicare'sfinal
demandletter.
10. ThisStipulationofSettlementcontainsall theterms andconditionsagreed
upon by the parties hereto, and no oral agreement entered into at any time nor any written
agreement entered into prior to the execution ofthis Stipulation ofSettlement regarding the

subjectmatterofthe instantproceedingshallbe deemedto exist, orto bindthe partieshereto, or
tovarythetermsandconditionscontainedherein.
