AB 566 Update

Gov. Arnold Schwarzenegger
has vetoed AB 566, the Mobile
Home Resident Protection Act that
would have required mobile home
park owners to “survey” tenants
prior to subdividing properties
(condominium like conversions).
Now with the veto, mobile home-
owners face a precarious future, the
original agreements between home-
owners and park owners may
change forever.
The Governor said, “While the
intent of this bill is to preserve low-
income housing, the fact that a
majority of mobile home park resi-
dents do not support a conversion is
not an appropriate means for deter-
mining the legitimacy of a conver-
sion.”
A representative of a residents’
rights organization, in response to
the Governor’s veto message
explained that although the version
of the bill that originally passed the
Assembly required that the survey
show the support of a majority of
residents in order for a conversion
to proceed, the bill was narrowed in
the Senate to instead allow local
governments to consider [only]
whether a majority of residents
support the conversion.
The veto message ignores that
the bill allowed local jurisdictions
to evaluate if a “majority of mobile
home park residents” do, or do not,
support a conversion. But, there
was no mandate to act solely on the
resident survey.
The veto is viewed as a set-back
to efforts to prevent park owners
from “condoizing” without regard to
the wishes of their residents.
