I am writing this email to you in an emotional state as myself and my family have lost
hope in the justice system and humbly request your kind intervention or at least refer us
to someone who may be able to assist us with this very disheartening situation that
currently faces our family.

My late sister was brutally attacked wherein she was raped and murdered while on duty
at her place of employment, Aquarius Mine !we"i #haft$ %ustenburg on the &th 'ctober
()*+. ,he perpetrator, who happened to be one of her colleagues was apprehended
immediately but thereafter released in -ecember ()*+ on a %+))).)) bail.

,he trial started this year in .anuary ()*/ at %ustenburg Magistrate court but the case
was postponed due to -0A results which were not yet available at the initial hearing.
,he second appearance was in March where it was said in court that an email from
1retoria confirming that the results will be available on the /th or 2th of April wherein the
Magistrate postponed the case to the 3th of April ()*/. 4e were eagerly awaiting the
hearing on the 3th as we believed that the -0A results would add gravitas to the case
and help bring justice to the memory of our late sister. -uring the hearing of the 3th of
April ()*/ prior to tea time, the 1rosecutor approach my family in an unpleasant manner
wherein he said there was some information that he wanted to discuss with the family
and not in court but rather during the tea break. 4e as the family went into his office
however he arrogantly dismissed other members of the family. ,he 1rosecutor
proceeded to tell
the remaining members of the family that the -0A results that came through were not
complete, but failed to tell my family the outcome of the -0A result already received thus
far. 4hat is troubling is the fact that during the previous court appearance it was never
mentioned that -0A results might be availed partially. 'f much greater concern is the
fact that this partial availability of -0A evidence should surely have been communicated
by the Magistrate in court and recorded as such rather that this dubious situation
whereby family members of the victim were herded into the 1rosecutor5s office and
offhandedly told of circumstances that have a serious bearing on this heart6breaking
case.


#ince the hearing on the 3th of April ()*/ in %ustenburg Magistrate court, the
1rosecutor and Investigating 'fficer have been very distance to my family which also
leads a lot of questions. ,o our surprise the perpetrator did not avail himself on the said
date where -0A results were supposed to be presented in court , the 1rosecutor never
bothered to advise the family of the delay caused as the case was number + on the roll
but we stayed there till the afternoon, we were only advised by one police man who
called my brother and advise him that the lawyer and the perpetrator are not around. 4e
patiently waited as our mother was also around.

At around */7+) that5s when the case was heard in court, the 8awyer representing the
perpetrator finally arrived without the accused, the Magistrate was not happy about that
as the lawyer did not know where the accused was and a warrant of arrest was issued
which was applicable as of the following daythe 9th April$ wherein the Magistrate said
should the accused not be around the ne:t day the police should go look for the
perpetrator.

,he following day on the 9th of April ()*/ the accused came to court with a doctor5s
letter which was presented to the Magistrate. ,he family patiently waited for the outcome
of the -0A test but to our surprise the usual 1rosecutor handed the case over to another
1rosecutor who said ;the case has been withdrawn6without any reasons<

My questions are as follows7

*. 4hy is the partial availability of -0A results clandestinely communicated to the
deceased5s family instead of being communicated and recorded by the Magistrate in
open court=
(. 4hy is it that a murder case that is still under investigation can be taken out of the
court roll, instead of being postponed until all the relevant information is gathered=
+. 4hy is there clear bias emanating from the 1rosecutor5s 'ffice=

,his has worsened my mother5s condition as she feels that justice will never be served
or seen to be served on this painful case of the brutal murder of her daughter.

'ur humble plea is for you to help us or refer the matter to someone who will take up
this matter and assist the family to find true justice for our dear sister.
