CHAPTER I

GENERAL INFORMATION
1.0 BUILDING PERMIT & COMPLETION CERTIFICATE A
MUST:
No person shall erect or re-erect or make alteration or cause the same to be done without
first obtaining a separate building permit for each such building from the M.C.D. It is in
the interest of the public to get the Building Plans sanctioned to ensure that building
constructed has adequate structural strength and has proision for light! entilation!
h"gienic conditions and conform to the proisions of Master Plan and #oning
regulations. Constructions raised without sanction are liable for demolition under
section $%$ and $%% of D.M.C. &ct and owner'builder can also face regular prosecutions
under section $%(& read with section %))& of the &ct.
It is also mandator" under section $%) of the DMC &ct to obtain a completion
certificate without which no person is permitted to occup" or permit to be occupied an"
such building or permit to be used an" building or a part thereof effected b" an" such
work until permission has been granted b" the Commissioner in this behalf.
2.0PROCEDURE FOR OBTAINING BUILDING PERMIT*

.er" person who intends to erect or re-erect or make alterations in a building! shall
gie notice in writing in the prescribed form No. I /Please see Appendix 'A'0 and such
notice shall be accompanied b" the following*
i0 Copies o p!"# "#$ s%"%e&e#%s ' Normall" %-copies of plans and statements
shall be made aailable along with the notice. In case of building schemes!
where clearance is required from Delhi 1ire 2erice! the number of copies of
the plans and statements accompan"ing the notice shall be ). In case of schemes
requiring clearance of both Delhi 3rban &rt Commission and Delhi 1ire
2erices! the number of copies shall be 4 and in addition special drawings and
model! as desired b" Delhi 3rban &rt Commission shall be made aailable. In
case of sites requiring the clearance of 5and and Deelopment office! 6-copies
of the plan shall be made aailable.
ii0 P(oo o O)#e(s*ip shall hae to be submitted along with building plan
application in the form of 5ease-deed! sale deed etc. dul" accompanied b" an
anne7ed site plan giing the ph"sical description of the plot'propert". In such
cases where lease deed has not been e7ecuted! N.8.C. from the competent
authorit" shall be submitted.
iii0 Spe+ii+"%io#: 9wo copies of the specifications of the proposed construction in
the prescribed form No. II /Please see Appendix 'A'0

9he concept of single window clearance for sanction of building plan
application was initiall" introduced at Building -D. 2eeing the oer whelming
response this serice was e7tended in all #ones of the Corporation. 3nder this
single window serice! following facilities are made aailable*

A.0 PROCEDURE FOR PROCESSING BUILDING PERMIT
APPLICATION:
,. 8n the da"! application for grant of building permit is receied! building
section shall gie a suitable date and time for the site inspection. In an" case the
date will be gien within ,< da"s from the receipt of application.
+. &fter the site has been inspected! the case shall be scrutini;ed within $<
da"s from the date of inspection. In case there are no ob>ections and corrections
requiring compliances from the owner! the sanction shall be released within )<
da"s from the date of submission.
1or other cases where corrections or compliances of other ob>ections is
necessar"! the same is intimated to the applicant within %( da"s from the date of
submission. 2uch correction' compliance should be completed within $< da"s
after compliance of which the building permit shall be released within ,( da"s
from the date of such compliance.
In case of non-compliance b" the applicant within stipulated period! the
building permit shall be refused. In case of such applications for building permit
which are not in conformit" with the b"e-laws'Master Plan'#oning ?egulations
or deficient in papers'documents and required information! the application shall
be liable to be re>ected.
(., Falidit" period of building permit
9he sanction once accepted through building permit shall remain alid for fie
"ears from the date of sanction for the residential! industrial! commercial buildings
as well as well as larger comple7es and multi-store"ed buildings! and such buildings
as classified under clause +.(%.+! +.(%.$ @ +.(%.%. 9he building permit shall be got
realidated before the e7pir" of this period. ?ealidation shall be sub>ect to the
Master Plan'#onal Plan regulations and Building B"e-laws.

(.+ Procedure for obtaining realidation of building permit*
9he Building Permit can be realidated for a period of one "ear at a time from the date
of e7pir" of the alidit" of the original permit on pa"ment of the required realidation
fees. &pplication for such realidation shall be submitted on plain paper along with the
following documents* -
/a0 8riginal sanctioned plan=
/b0 ?ealidation fee that shall be as the fee of the original
permit fee per "ear of lapsed sanction.
/c0 N8C from competent authorit" as per terms and conditions
of lease-deed! if required=
/d0 N8C' No dues certificate from -ouse 9a7 Deptt. of
M.C.D.

9he application for realidation shall be processed and realidation cone"ed within ,(
da"s from the date of submission! if the case is in order. In case of an" ob>ection! either

(.$ &ppeals against re>ection of building plans:
In case the building plan is re>ected on certain grounds and ob>ections! an appeal can be
made after satisf"ing the ob>ections! in the office where the plans were re>ected along
with an appeal ta7 at the rate of (B of the Building ta7 alread" deposited. &ppeal can be
considered= if the refund of the building ta7 alread" deposited has not been claimed.
(.% ?efund of building permit fee
In case building plan application is re>ected! (B of the building permit fee shall be
retained and balance shall be refunded to the applicant proided the claim is made
within three "ears from the date of issue of re>ection. 2uch application shall be made to
the office where application was submitted.
(.( ?eocation of building permit*
9he MCD ma" reoke an" building permit issued under the proisions of the b"e-laws
if there has been an" false statement or an" mis-representation of material facts in the
application on which the building permit was based.

If the building permit! so issued! is found to be in iolation of building b"e-laws '
Master Plan '#onal Plan regulations

If during construction it is found that the owner has iolated an" of the proisions of the
Building B"e-5aws or sanctioned plan.

It will be obligator" on the part of eer" owner to displa" a cop" of sanctioned plan at
some conspicuous place during the construction of the building! failure to do so ma"
result in reocation of the building permit and the construction carried out will be
treated as unauthori;ed construction.
B.0 PROCEDURE DURING CONSTRUCTION 3ORC

)., Intimation for taking up work at site
9he owner ' applicant who has been granted such buildings permit shall intimate the
authorit" in writing in form III Appendix B before A da"s of starting of construction
work at site. -e shall obtain an acknowledgement from the authorit" of this notice.
&fter receiing such notice authorit" ma" depute an officer for inspection of the site.
1ailure to send this intimation is a iolation of the condition of sanction and is sub>ect to
prosecution u's $$A /%0 of D.M.C. &ct! which ma" inite a fine upto ?s. ,<!<<<! and

).+ Intimation at completion of the work upto plinth leel
&t this stage! the owner through his licensed &rchitect'.ngineer'2uperisor shall gie a
notice to the MCD in the Performa as per Appendix B-1 "++o&p"#ie$ )i%* " ee o Rs.
1A5' on completion of work upto plinth leel to enable the MCD to ensure that work
conforms to the sanctioned plans and Building B"e-laws. 9he following documents are
also to be submitted along with the notice*
,0 Cop" of alid Certificate of 5icensed &rchitect'.ngineer'2uperisor=
+0 Building plans! indicating the plinth constructed at site in relation to the plot
dimensions! area and setbacks! dul" signed b" the 8wner and licensed
&rchitect'.ngineer'2uperisor.
It will be obligator" on the part of the local bod" /MCD0 to inspect the work and submit
the ob>ection! if an"! to the owner and architect'engineer within $< da"s from the receipt
of such notice in form B-2 "i!i#4 )*i+* )o(7 )i!! $ee&e$ %o .e +!e"(e$ o( ,(%*e(
+o#s%(,+%io#. It will be the responsibilit" of the owner'architect'superisor to ensure
further construction of the building in accordance with the sanctioned building plan.
D.0 PROCEDURE FOR OBTAINING COMPLETION
CERTIFICATE:

per Appendix F to the &uthorit" regarding completion of the work as described in the
Building Permit. 9he notice of completion shall be submitted b" the owner through the
licensed &rchitect ' .ngineer or group! as the case ma" be who has superised the
construction! accompanied b" the following documents and along with a fee of ?s.+<'-.

b"e-laws remain unnoticed! the M.C.D. reseres the right to amend the plans as and
when infringement come to the notice and M.C.D. will stand indemnified against an"
claim on this account.
(. & notice in writing shall be sent to M.C.D. before commencement of the erection of the
building as per b"e-laws. 2imilar notice will be sent to M.C.D. when the building has
reached up to plinth leel.

A. M.C.D. will stand indemnified and kept harmless from all proceedings in court and

roads.

+. Motels are required for long distance traelers and setting up of these motels in
National Capital 9erritor" of Delhi need to be iewed in the conte7t of necessar" of
maintaining a green buffer ;one around Delhi as well as essential serices in these
areas. 9he matter has been further e7amined and the setting up motels in the NC9
of Delhi shall be in accordance with the following guidelines. -enceforth! Motels
can be permitted in rural ;one'green belt as well as commercial areas along National
-ighwa"s and Inter-2tate roads /defined to mean a e7presswa"'highwa" which
directl" connects the National Capital 9erritor" of Delhi with a neighbouring 2tate0.

$. Motel located in commercial ;ones will be sub>ect to the norms and building
standards applicable to hotels.

KB!$4. Re4,!"%io#sK. 9his notification onl" e7empts the residents of abadl area from
the sanction of Building Plans for their residential units. It! howeer! does not
e7empt the buildings from the puriew of Building B"e-laws.
5al Dora is basicall" the abadi! the residential area! where the landowners of
agricultural land around! dwell. 9he e7tension of the 5al Dora is also meant for meeting
the residential needs of the landowners. &n" actiit" contrar" to aboe! cannot be
regarded as permissible actiit" in the 5al Dora.
It has been obsered that the ;onal offices of MCD and the staff responsible for
controlling the building actiities hae been mis-interpreting the aboe notification!
thereb" permitting all sorts of illegal and unauthorised construction within 5al Dora. It
is further clarified that onl" a building! residential in character! and not going be"ond
+-,'+ store"s and owned b" the original resident'his descendant is to be permitted. &n"
other building in 5al Dora'e7tended 5al Dora requires prior approal and sanction of
the Building Plans from the Municipal Corporation of Delhi! as per the proisions of
MPD-+<<,! #onal Plan and Building B"e-laws.
It is! needless to mention that! once a illage is urbani;ed! there is no 5al Dora and
no e7emption and all buildings come under the puriew of sanction of Building Plans.

proisions of Master Plans and #oning ?egulations. Constructions raised
without sanction are liable for demolition under section $%$ and $%% of
D.M.C. &ct and owner'builder can also face regular prosecutions under

9his regulation shall appl" to heritage sites which shall include those
buildings! artifacts! structures! streets! areas and precincts of historic!
architectural! aesthetic! cultural or enironmental alue /hereinafter referred
to as 5isted -eritage Buildings ' 5isted -eritage Precincts0 and those
natural feature areas of enironmental significance or of scenic beaut"
including but not restricted to! sacred groes! hills! hillocks! water bodies

(a) Heritage building" means and includes an" building of one or more

and'or enironmental and'or ecological purpose and includes such
portion of land ad>oining such building or part thereof as ma" be
required for fencing or coering or in an" manner presering the
historical and'or architectural and'or aesthetic and'or cultural alue of
such building.
(b) "Heritage Precincts" means and includes an" space that require
conseration and 'or preseration for historical and ' or architectural
and'or aesthetic and'or cultural and'or enironmental and'or
ecological purpose. 2uch space ma" be enclosed b" walls or other
boundaries of a particular area or place or building or b" an

/c) "Conseration" means all the processes of looking after a place so as
to retain its historical and'or architectural and'or aesthetic and'or
cultural significance and includes maintenance! preseration!
restoration! reconstruction and adoption or a combination of more
than one of these.
/d0 "Preseration" means and includes maintaining the fabric of a place
in its e7isting state and retarding deterioration.
/e0 "!estoration" means and includes returning the e7isting fabric of a
place to a known earlier state b" remoing accretions or b"
reassembling e7isting components without introducing new
materials.
/f0 "!econstruction" means and includes returning a place as nearl" as
possible to a known earlier state and distinguished b" the introduction
of materials /new or old0 into the fabric. 9his shall not include either
recreation or con>ectural reconstruction.
"#$" !esponsibility of the %wners of Heritage &uildings
It shall be the dut" of the owners of heritage buildings and. buildings in
heritage precincts or in heritage streets to carr" out regular repairs and
maintenance of the buildings. 9he :oernment! the Municipal Corporation
of Delhi or the 5ocal Bodies and &uthorities concerned shall not be
responsible for such repair and maintenance e7cept for the buildings owned
b" the :oernment! the Municipal Corporation of Delhi or the other local
bodies.
+$.$ !estrictions on Deelop'ent ' !e(deelop'ent ' !epairs etc
/i0 No deelopment or redeelopment or engineering operation or additions '
alterations! repairs! renoations including painting of the building!
replacement of special features or plastering or demolition of an" part
thereof of the said listed buildings or listed precincts or listed natural feature
areas shall be allowed e7cept with the prior permission of Commissioner!
MCD! Fice Chairman DD&'Chairman NDMC. Before granting such
permission! the agenc" concerned shall consult the -eritage Conseration
Committee to be appointed b" the :oernment and shall act in according
with the adice of the -eritage Conseration Committee.
/ii0 Proided that! before granting an" permission for demolition or ma>or
alterations ' additions to listed buildings /or buildings within listed streets or
precincts0! or construction at an" listed natural features! or alteration of
boundaries of an" listed natural feature areas! ob>ections and suggestions
from the public shall be inited and shall be considered b" the -eritage
Conseration Committee.
/iii0 Proided that! onl" in e7ceptional cases! for reasons to be recorded in writing!
the Commissioner! MCD' Fice Chairman DD& ' Chairman NDMC ma" refer
the matter back to the -eritage Conseration Committee for reconsideration
-oweer! the decision of the. -eritage Conseration Committee after such
reconsideration shall be final and binding.
"#$) Penalties
Fiolation of the regulations shall be punishable under the proisions
regarding unauthori;ed deelopment. In case of proed deliberate neglect of
and'or damage to -eritage Buildings and -eritage precincts! or if the
building is allowed to be damaged or destro"ed due to neglect or an" other
reason! in addition to penal action proided under the concerned &ct! no
permission to construct an" new building shall be granted on the site if a
-eritage Building or Building in a -eritage Precinct is damaged or pulled
down without appropriate permission from Commissioner! MCD' Fice
Chairman DD&' Chairman NDMC.
It shall be open to the -eritage Conseration Committee to consider a
request for re-building'reconstruction of a -eritage Building that was
unauthori;edl" demolished or damaged! proided that the total built-up area
in all floors put together in such new construction is not in e7cess of the total
built-up area in all floors put together in the original -eritage Building in the
same form and st"le in addition to other controls that ma" be specified.
+$.( Preparation of *ist of Heritage Sites including Heritage &uildings+ Heritage
Precincts and *isted ,atural -eature Areas
9he list of heritage sites including -eritage Buildings! -eritage Precincts
and listed Natural 1eatures &reas is to be prepared and supplemented b" the
Commissioner! MCD' Fice- Chairman DD&'Chairman NDMC on the
adice of the -eritage Conseration Committee. Before being finali;ed!
ob>ections and suggestions of the public are to be inited and considered.
9he said list to which the regulation applies shall not form part of this
regulation for the purpose of Building B"e-laws. 9he list ma" be
supplemented from time to time b" :oernment on receipt of proposal from
the agenc" concerned or b" :oernment suo 'oto proided that before the
list is supplemented! ob>ections and suggestions from the - public be inited
and dul" considered b" the Commissioner! MCD Fice Chairman
DD&'Chairman NDMC and'or :oernment and'or the -eritage
Conseration Committee.
Hhen a building or group of buildings or natural! feature areas are listed it
would automaticall" mean /unless otherwise indicated0 that the entire propert"
including its entire compound . plot boundar" along with all the subsidiar"
structures and artifacts! etc. within the compound'plot boundar"! etc. shall
form part of list.
+$.) Alteration ' /odification ' !ela0ation in Deelop'ent ,or's
8n the adice of the said -eritage Conseration Committee to be appointed
b" the :oernment and for reasons to be recorded in writing! the
Commissioner! MCD ' Fice Chairman DD&' Chairman NDMC shall follow
the procedure as per DD& &ct! ,6(A to alter! modif" or rela7 the
Deelopment Control Norms prescribed in the Master Plan of Delhi! or
Building B"e-laws of Delhi if required! for the conseration or preseration
or retention of historic or aesthetic or cultural or architectural or
enironmental qualit" of an" heritage site.
+$.A Heritage Precincts ' ,atural -eature Areas
In cases of streets! precincts! areas and! /where deemed necessar" b" the
-eritage Conseration Committee0 natural feature areas notified as per the
proisions of this Building B"e-5aws No. +$.$ aboe! deelopment
permissions shall be granted in accordance with the special separate
regulation prescribed for respectie streets! precincts ' natural feature areas
which shall be framed b" the Commissioner MCD' Fice Chairman
DD&'Chairman NDMC on the adice of the -eritage Conseration
Committee.
Before finali;ing the special separate regulations for precincts! streets!
natural features! areas! the draft of the same shall be published in the official
ga;ette and in leading newspapers for the purpose of initing ob>ections and
suggestions from the public. &ll ob>ections and suggestions receied within a
period of $< da"s from the date of publication in the official ga;ette shall be
considered b" the Commissioner! MCD ' Fice- Chairman DD& ' Chairman
NDMC ' -eritage Conseration Committee.
&fter consideration of the aboe suggestions and ob>ections! the agenc"
concerned acting on the adice of the -eritage Conseration Committee
shall modif" /if necessar"0 the aforesaid draft separate regulations for streets!
precincts! areas and natural features and forward the same to :oernment for
notification.

Hidening of the e7isting roads under the Master Plan of Delhi ' #onal
Deelopment Plan or in the 5a"out Plan shall be carried out considering the
e7isting heritage buildings /een if the" are not included in a -eritage
Precinct0 or which ma" affect listed natural features areas.
"#$3 .ncentie 4ses for Heritage &uildings
In cases of buildings located in non-commercial use ;ones included in the
-eritage Conseration 5ist! if the owner ' owners agree to maintain the listed

New Delhi Municipal Council shall continue to be imposed in addition to
Deelopment Control ?egulations. -oweer! in case of an" conflict with the
