Be it enacted by the Senate and the House of Representatives of the Philippines in Congress
assembled:

reclusion perpetua.

penalt7 shall be reclusion perpetua to 5eath&

0+hen the rape is atte4pte5 an5 a ho4ici5e is co44itte5 b7 reason or on the occasion thereof! the

penalt7 shall be prision mayor to reclusion temporal.
0 +hen b7 reason or on the occasion of the rape! the 6icti4 has beco4e insane! the penalt7 shall be
reclusion temporal.
0 +hen the rape is atte4pte5 an5 a ho4ici5e is co44itte5 b7 reason or on the occasion thereof! the
penalt7 shall be reclusion temporal to reclusion perpetua.
0 +hen b7 reason or on the occasion of the rape! ho4ici5e is co44itte5! the penalt7 shall be reclusion
perpetua.
" Reclusion temporal shall also be i4pose5 if the rape is co44itte5 /ith an7 of the ten
aggra6atingABualif7ing circu4stances 4entione5 in this article&
0 Article 266-C. Effect of Pardon.- The subseBuent 6ali5 4arriage bet/een the offen5er an5 the
offen5e5 part7 shall e>tinguish the cri4inal action or the penalt7 i4pose5&
0In case it is the legal husban5 /ho is the offen5er! the subseBuent forgi6eness b7 the /ife as the
offen5e5 part7 shall e>tinguish the cri4inal action or penalt7; Provided That the cri4e shall not be
e>tinguishe5 or the penalt7 shall not be abate5 if the 4arriage is void ab initio.

SEC. 3. Separabilit Clause.1 If an7 part! sections or pro6ision of this Act is 5eclare5 in6ali5 or
unconstitutional! the other parts thereof not affecte5 shall re4ain 6ali5&
SEC. 4. Repealing Clause.1 Article ''* of Act No& '()*! as a4en5e5! an5 all la/s! acts! presi5ential
5ecrees! e>ecuti6e or5ers! a54inistrati6e or5ers! rules an5 regulations inconsistent /ith or contrar7 to the
pro6isions of this Act are 5ee4e5 a4en5e5! 4o5ifie5 or repeale5 accor5ingl7&
SEC. 5. Effecti!it.1 This Act shall ta.e effect fifteen <)*9 5a7s after co4pletion of its publication in
