$ GENERAL POLICY
Tele(om -alaysia .erhad /0T-.12 is committed to the communication of the
results of its sponsored acti$ities in research and de$elopment and in house
commercial pro3ects and endea$ours. 4n recognising the efforts of its
employees5 T-. is also committed to allo!ing dissemination of their !or( to
ele$ate their profile in their respecti$e industries.
4n doing so ho!e$er5 T-. is to balance this against its interest to ensure that6
the proposed public communication does not re$eal confidential
information7 or
there is no ad$erse or negati$e impact on the protection of T-.8s
intellectual property rights7 or
a competiti$e edge in the industry is maintained by T-..
9e$ie! is therefore necessary to ensure that any communication is balanced
against these aims.
4n (eeping !ith this commitment5 T-. has adopted the follo!ing guidelines and
procedures that can encourage the dissemination of information but at the same
time pro$iding the means to preser$e intellectual property rights and maintaining
a competiti$e edge in the industry.
' INTELLECTUAL PROPERTY
4ntellectual property rights are a group of legal rights that e:ist in relation to the
results and outcome of intellectual acti$ity. These can be di$ided into 6 parts6

property rights under -alaysian la!. Where there are any further =ueries on
intellectual property rights5 these =ueries can be directed to the Secretariat.
& THE SECRETARIAT
The Secretariat is the +egal and 4ntellectual )roperty ?nit5 T-. /0+4)12 !hich
!ill be the custodian and manager of all intellectual property rights of T-. and
the Tele(om >roup of ;ompanies.
With the e:ception of Tele(om 9esearch and <e$elopment Sdn .hd /0T-
9@<12 and ?ni$ersity Tele(om Sdn .hd /0?TS.12 !hich !ill ha$e their separate
secretariats5 all intellectual property matters arising !ithin T-. and the Tele(om
>roup of ;ompanies must be referred to the Secretariat.
?pon the adoption of this policy by T- 9@< and ?TS.5 all intellectual property
matters of T- 9@< and ?TS. !ill be referred to the indi$idual secretariats of
T- 9@< and ?TS.. The T- 9@< and ?TS. secretariats !ill as such ha$e to
submit half yearly reports to +4) on all matters dealt !ith by them.

The impact of public communications is that it may lead to disclosure of
information !hich may ad$ersely affect the legal rights of T-. in respect of
patents5 industrial designs and confidential information. 4t may also affect the
general interest of T-. in respect of copyrighted material5 layout&designs of
integrated circuits and trade mar(s in its branding and mar(eting strategies.
* COMMUNICATIONS AFFECTING PATENT

* patent is a right in respect of an in$ention. The in$ention must be ne!5
ha$e in$enti$e step and be industrially applicable at the date of filing the
patent application.

4nformation about the in$ention a!!o" be disclosed until a patent
application has been filed. <isclosure before filing may cause the
in$ention to be no longer ne!.

/a2 When a patent application has been filed but not granted5 only a
brief description should be gi$en. This !ill pre$ent any third
parties from (no!ing the e:act technical specifications of the
in$ention. <etails of the specifications of the patent do not form
part of the public records at this stage.
/b2 When a patent has been granted5 the entire description of the
in$ention may be disclosed to the public as details of the patent
!ould ha$e been published by the patent office.

formal patent application by Telekom Malaysia Berhad is filed. Any
breach of conduct would be subject to legal prosecution based on
foregone economic impact1.

*n industrial design a right in respect of the shape5 configuration5 pattern
or ornament applied to an article. The industrial design must be ne! and
appeals to the eye in order for registration to be granted.

4nformation about the industrial design a!!o" be disclosed until an
industrial design application has been filed. <isclosure before filing may
cause the industrial design to be no longer ne!.

/a2 When an industrial design application has been filed but not
granted5 only a brief description should be gi$en. This !ill pre$ent

design. <etails of the design do not form part of the public records

entire industrial design may be disclosed to the public as details of

+ayout&design is a right in respect of integrated circuit. 4n order for rights
to $est5 the layout&design must be original and not copied5 must not be
common and must be incorporated into an integrated circuit.

as to !here the goods and ser$ices come from. *s such trade mar(s are
al!ays disclosed to the public.

may be rele$ant to trade mar(s !ould be mar(eting strategies or other
