AFFIDAVIT OF DESISTANCE


WE, Arnelli MAGALONG, 32 years old, married, housewife, and AGOT W. Desiderio, 22 years
old, single, student, both Filipino Citizens, and both with postal and residential address at 387 Central
park, Baguio City, Philippines, under oath hereby depose and state that:

1. We are the private complainants in the Land Transportation Offices (LTO) Alarm ID #
PU14334344 for RECKLESS DRIVING and DRIVING UNDER THE INFLUENCE OF LIQUOR
along Easter road, dumaguete City, Philippines on March 24, 2014 at around 6:30 PM;

2. Such incident was embodied under Police Blotter entry no. 143 dated March 24, 2014, and
that the motor vehicle involved is a 2008 White Mitsubishi Utility Vehicle with plate
number AIM 797, with chassis no. ILOVEYOU5NJ88888, and engine no. 4D56-AIM9999;

3. We have now settled our dispute with then operator of said vehicle, a certain Federick
Rilleroso, hence, we do not intend to testify anymore against the operator;

4. Rilleroso was the operator of the taxi when the incident happened, as supported by a
photocopy of his Affidavit attached as Annex A;

5. As per records of the LTO, the registered owner is still the previous owner, a certain
Rodolfo Ambiong, against whom we are not also interested in pursuing;

6. In view of said amicable settlement entered into with the operator, we are no longer
interested in pursuing the above-mentioned case;

7. This Affidavit of Desistance is our free and voluntary act;

8. We are executing this Affidavit for the purpose of desisting from pursuing the case against
the operator of this vehicle and to attest to the truth of all the foregoing statements.
