Letter: Greetings,
Appeal: Set aside the order dated July 9, 2014 of Hon'ble Special Environment
Court about Naresh Kadian, where as his matter is a fit case for acquittal: Case
No. 16 of 2007.
Sir,
It is humbly submitted that Naresh Kadian is a man of many distinctions and he
never committed any offense against wildlife, being an whistle blower in Nawab
Pataudi black buck hunting, his matter is a fit case for acquittal not holding him
guilty, as per order passed on July 9, 2014 and we are appealing against this
order, which needs to be set aside.
Where as Veterinary Surgeon, who conduct the postmortem of all hunted animals
along with the Wildlife Inspector and Soha Ali Khan needs punishments, because
her arms was used in crime by the offenders.
Merits of our appeal:
1. When Veterinary Surgeon completed the formalities of postmortem on June 4,
2005 then why he with held his postmortem report up to June 6, 2005 evening,
which was required by the Jhajjar Police, to convert DDR in to FIR?
2. As per section 50 (4) of the Wildlife Protection Act, 1972, the Wildlife Inspector
was required to obtain permission of Chief Wildlife Warden along with the
Competent Court of Law, to disposed the dead body of hunted wild animals.
3. The Chief Wildlife Warden, Haryana released Naresh Kadian from all
allegations, after inquiry and orders were passed to cancel the complaint against
Naresh Kadian but said orders were not obeyed.
4. The action of Naresh Kadian was justified, which was a bonafide omission due
to unavoidable circumstances, committed to protect the case property and to
obtain postmortem report from the competent Authority of Delhi zoo along with the
identification of the species hunted because we can not ruled out the replacement
of scheduled one wild animals body with some other dead body of compoundable
animals, like blue bull because high profile peoples were involved in the hunting,
who had good relations with the Govt. of Haryana.
5. All false charges under section 186, 332, 353, 342, 506, 297, 429 IPC read with
section 51 of the Wildlife Protection Act, 1972 were imposed on Naresh Kadian but
illegal charge sheet under section 186, 353, 341, 506, 297, 429 IPC read with the
section 51 of the Wildlife Protection Act, 1972 were also submitted bypassing the
section 55 of the Wildlife Protection Act, 1972 because there was no complaint
moved by the investigating Officer against Naresh Kadian, where as Ld ASJ,
Faridabad order dated 14-8-2008 also confirmed these requirement and legal
provisions in another matter.
6. Miss Soha Ali Khan was not booked in the crime because her arms license was
illegal, which was cancelled by the District Magistrate, Gurgaon and weapon used
in crime was belongs to Soha Ali Khan, hence she may kindly be booked under
law.
7. Naresh Kadian performance was according to the article 51 A (g) of Indian
Constitution, as fundamental duties, which needs appreciation not punishments
because his action was to assist Prosecution.
8. Hon'ble Special Environment Court at Faridabad hold Naresh Kadian guilty only
under section 341 IPC and section 51 of the Wildlife Protection Act, 1972, where
as no offense were made out by Naresh Kadian for the violation of the said
sections.
9. Hence it is humbly prayed that the order dated July 9, 2014 may kindly be set
aside and Naresh Kadian may kindly be acquitted from the charges under section
341 IPC read with section 51 of the Wildlife Protection Act, 1972 because Naresh
Kadian assisted the prosecution for exposing the illegal arms license of Soha Ali
Khan and he is working for animal rights and their welfare since last 30 years
besides his Government duties as Technical Supervisor (Leather) in Haryana
Khadi and Village Industries Board.
It would be pertinent to mention here that Hon'ble Supreme Court of India also
uphold the animal rights in recent judgement passed in Jallikattu bull taming cruel
event. It is further stated that neither there were no evidence against Naresh
Kadian nor any eye witness, where as openly under live telecast animal rights
activities were made out in day time, there were many more people, media
persons along with Naresh Kadian but they were not booked, only Naresh Kadian
was targeted, where as he has contributed a lot being party in the matter before
Hon'ble High Court and shifting the case of Nawab Pataudi and others from Jhajjar
to Special Environment Court at Faridabad. Neither it was proved that Naresh
Kadian was responsible for digging the carcass of black buck nor complainant
Wildlife Inspector was present at that time, in fact Chokidar and others handed
over the body of carcass to Naresh Kadian, Hon'ble Judge recorded the duties
assigned to the Chairman, PFA Haryana, which is not correct because said duties
were assigned as Master Trainer, AWBI and PFA Haryana objectives were not
considered, where as Naresh Kadian act was to support prosecution, purely in
public and in the interest of justice for hunted wild animals only not for personnel
gain and profit.
It is humbly submitted that People for Animals Haryana is a registered non
government organization duly recognized by the Animal Welfare Board of India
under the chairmanship of Naresh Kadian and the following objectives were not
considered by the trial court:
C). To campaign for the ethical treatment of animals, to promote vegetarianism , to
stop the export of meat, to shut down abattoirs like Al Kabeer, to set up animal
hospitals and shelters, to stop the killing of stray animals, to preserve wildlife in its
natural habitat, to demand animal welfare measures, to ban the misuse of animals
in movies, to campaign for proper animal rights laws, to create shelters for stray
animals, to rescue performing animals, to make animals rights education
compulsory, to close down animal markets, to stop the testing of drugs and
cosmetics on animals, to stop interstate traffic in cattle, to ban the export of rhesus
monkeys for testing, to close down the trade in furs and minks, to ensure a
nationwide ban on cattle slaughter, to protect endangered species, to stop wild
game hunting, to close down illegal and private zoos, to resist the entry of junk
food killer MNCs, to find new homes for abandoned pets, to network with animal
organizations worldwide, to educate people to give up ritual animal sacrifice, to
reveal the link between cancer and eating meat, to stop the dissection of animals
in schools and to institute awards for animal rights campaigners.
G). To work for checking and restraints on cruelty to animals, protection to wild
animals and for this purpose to establish veterinary hospitals, goshala, animal
shelters and research centers etc.
It would pertinent to mention here that Naresh Kadian name was considered many
times for Padma Shri awards by the Govt. of India.
Where as duties and functions of the Master Trainer, AWBI were also not properly
looked in to:
1. Make SPCAs means to establish Societies for Prevention of Cruelty to Animals.
2. Make any other animal welfare groups either general or specialized, groups can
be of different kinds running shelters and doing rescue work / fundraising /
lobbying / working for a specialized animal / patrolling markets / giving legal help
etc.
8. Train the Police on the laws related to animal care, welfare and protection of the
animals.
12. Develop links between your groups and local clubs / organizations / local
administration.
It is also intimated that Naresh Kadian efforts were appreciated by the Govt. of
Haryana nominating him as non official member of the State Committee for
Slaughter Houses, to comply with the orders passed by the Hon'ble Supreme
Court of India in CWP No. 309 of 2003, like wise Haryana Cattle Fairs Act, 2013
was introduced deleting elephant from the definition of cattle, on the point raised
by Naresh Kadyan and similar action is under process at the level of Govt. of
Punjab. It is further intimated that on the petition submitted by Naresh Kadian
before the Committee on Petition, Haryana Assembly, which is being processed
and comments were obtained in another petition, which was submitted before the
Speaker, Delhi Assembly, where as these petitions were moved for introduction of
strong animal welfare legislation's.
