This chapter states the m inim um requirem ents that help you protect the safety and health
of your em ployees during a response to a hazardous substance release in your
w orkplace or any other location.
This chapter applies if your em ployees are, or could becom e, involved in responding to
uncontrolled releases of hazardous substances in your w orkplace or any other location.
U se the scope flow chart, and definitions that follow, to determ ine if this chapter applies
to your w orkplace(s). D efined w ords are italicized in the flow chart.
Exe mption:
This chapter doesnt apply to you if your w orkplace is a hazardous
w aste site. If you arent sure about your site classification, see chapter
296-62 W A C , Part P, H azardous w aste operations and treatm ent,
storage, and disposal facilities.
If your w orkplace is a treatm ent, storage, and disposal site this chapter
m ay apply.
Not e :
R equirem ents in other chapters m ay also apply to your w orkplace. You
w ill find som e safety and health requirem ents (for exam ple, personal

Danger area - areas w here conditions pose a serious danger to
em ployees, such as areas w here:
Im m ediately dangerous to life or health (ID LH ) conditions could exist

H igh levels of exposure to toxic substances could exist

There is a potential for exceeding the low er explosive lim it (LEL), also
know n as the low er flam m ability lim it (LFL), of a substance.
Emergency response - a response to an anticipated release of a
hazardous substance that is, or could becom e, an uncont rolled
rel ease.
Hazardous subst ance - any biological, radiological, or chem ical
substance that can have adverse effects on hum ans (see W A C 296-824-
800 for a m ore specific definition).

I ncident al release - a release that can be safely controlled at the
tim e of the release and doesnt have the potential to becom e an
uncontrolled release.
Exam ple of a situation that results in an incidental release:
A tanker truck is receiving a load of hazardous liquid w hen a leak
occurs. The driver know s the only hazard from the liquid is m inor skin
irritation. The em ployer has trained the driver on procedures and
provided equipm ent to use for a release of this quantity. The driver puts
on skin protection and stops the leak. A spill kit is used to contain,
absorb, and pick up the spilled m aterial for disposal.
Limit ed act ion - action necessary to:
Secure an operation during em ergency responses
OR
Prevent an incident from increasing in severity.
Exam ples include shutting dow n processes and closing em ergency
valves.
Release - a spill, leak, or other type of hazardous substance discharge.

Uncont rolled release - a release w here significant safety and
health risks could be created. R eleases of hazardous substances that
are either incidental or couldnt create a safety or health hazard (i.e., fire,
explosion or chem ical exposure) arent considered to be uncontrolled
releases.
Exam ples of conditions that could create a significant safety and health
risk:
Large-quantity releases
Sm all-releases that could be highly toxic
Potentially contam inated individuals arriving at hospitals
A irborne exposures that could exceed a W ISH A perm issible exposure
lim it or a published exposure lim it and em ployees arent adequately
trained or equipped to control the release.
Exam ple of an uncontrolled release:
A forklift driver knocks over a container of a solvent-based liquid,
releasing the contents onto the w arehouse floor. The driver has been
trained to recognize the vapor is flam m able and m oderately toxic w hen
inhaled. The driver hasnt been trained or provided appropriate
equipm ent to address this type of spill. In this situation, it isnt safe for
the driver to attem pt a response. The driver needs to notify som eone of
the release so an em ergency response can be initiated.

Develop an emergenc y response plan

treatm ent, storage and disposal facilities or by state and locally
coordinated response efforts (Section 303 of Superfund A m endm ents
and R eauthorization A ct (SA R A ), Title III). You m ay use those plans to
com ply w ith this section, if they include the item s listed below.
B efore a w ritten em ergency response plan can be developed, you w ill
need to anticipate the types of uncontrolled releases that em ployees
could encounter in your w orkplace(s).

follow ing:

Training on specific substances m ay be appropriate depending on the

skills specified in Tables 3 through 6) on that single substance. If
em ployees m ight respond to a range of hazardous substances,
training m ay be required to cover categories of hazardous
substances.
Videos and autom ated training m ethods (for exam ple: Interactive
com puter-based program s) m ay be used in training; how ever,
instructors m ust m ust m ust m ust m ust be readily available to:
- Encourage and provide responses to questions for the benefit of the
group.
- Evaluate em ployee understanding of the m aterial.
- Provide other instructional interaction to the group.

Step 1. Ide ntify e xpe c te d ha za rds .
H azard assessm ent needs to be done by an individual w ho has appropriate technical know ledge
and experience.
This inform ation form s the basis for selection of personal protective equipm ent (PPE) and
developm ent of em ergency response procedures.
If confined spaces could exist site-specific evaluations and procedures m ay be necessary. Follow
requirem ents in C hapter 296-62 W A C , Part M to identify confined spaces.
Step 2. Make s ure all potential partic ipants are involved in planning,
whe the r the re s pons e involve s only your e mploye e s or othe r
employees at the site. Make a written agreement c overing all of the
following:
H ow potential participants w ill be notified w hen a release occurs. B e specific
about the com m unication system to be used (for exam ple: m ethod to use, and
sequence of contact).
W hat roles your em ployees w ill take during the response.
See Table 1 in C hapter 296-824 W A C for roles and duties em ployees m ay
