CommonwealthCourtThursdaydismissedtheremainingchallengestotheAct13drillinglawremanded
forreconsiderationbythePASupremeCourt,butdidenjointhePublicUtilityCommissionfrom
reviewinglocalordinancesregulatingdrillingconsistentwiththehigherCourtsrulinginDecember.
IssuesconsideredbytheCourtinclude
DrinkingWaterSupplyNotification:Whethernoticetoonlypublicdrinkingwatersystems
followingaspillresultingfromdrillingoperations,butnotprivatewatersuppliers,isunconstitutional
becauseitisaspeciallawand/orviolatesequalprotection.
TheCourtruledtherearevalidreasonsfortreatingnotificationofpublicdrinkingwatersupplies
andprivatewellownersdifferentlybasedonthefactDEPdoesnotregulateprivatewells,mayhaveno
knowledgeofthelocationofallthewellsandthatpublicdrinkingwatersystemscannotbeeasily
replacedifaffectedbyaspill.
TheCourtsaid,however,thatdoesnotmeanDEPorthedrillingcompanyshouldnotuseits
besteffortstonotifyaffectedwellowners.
HealthProfessionalMedicalDisclosure:WhetherthoseprovisionsofAct13prohibitinghealth
professionalsfromdisclosingtootherstheidentityandamountofhydraulicfracturingadditivesreceived
fromthedrillingcompaniesimpedestheirabilitytodiagnoseandtreatpatients,isunconstitutional
becauseitisaspeciallawand/orviolatesequalprotectionandviolatesthesinglesubjectrule.
TheCourtruledAct13doesnotunreasonablyrestrictthesharingofinformationwithhealth
professionals
EminentDomain:Whetherconferringthepowerofeminentdomainuponacorporationempowered
totransport,sell,orstorenaturalgasinthisCommonwealthtotakethepropertyofothersforits
operationsisunconstitutionalbecauseitpermitsatakingforprivatepurpose.
TheCourtdismissedthisallegationsayingtheexistingstatutorylanguageonlyconferstherightof
eminentdomainonapublicutility.
LocalOrdinanceReview:Whether58Pa.C.S.3302and3305to3309,whichauthorizesthe
PublicUtilityCommissiontoreviewlocalzoningordinancesandtowithholdimpactfeesfromlocal
governments,areseverablefromtheenjoinedprovisionsofAct13.
TheCourtfoundtheprovisionsarenotseverableandandenjoinedthePublicUtility
Commissionfromreviewinglocalordinancesthatregulatedrillingoperations.

CommonwealthattorneysFridayannouncedtheyhavenegotiateda
settlementinthecaseofPEDFv.Commonwealth,ensuringthe
DepartmentofConservationandNaturalResourcesreceivesessential
fundingwhilepreservingtheopportunitytopresentthe
Commonwealthscaseincourt.
Underthetermsoftheagreement,thedepartmentwillcontinue
toworktoprepareforleasingofDCNRmanagedlandthatdoesnot
involvesurfacedisturbanceonthenewlyleasedareas,butnottakeany
finalactionpendingtheCommonwealthCourtsfinaldecisionontheunderlyingcase.
Withoutthissettlement,DCNRscapacitytopreservePennsylvaniasnaturaltreasureswould
havebeendecimated,Gov.TomCorbettsaid.Wecannotallowourcommitmenttoprotecting
Pennsylvaniasstateparksandforeststobeheldhostageduringthedurationofthislawsuit.
ThepreliminaryreliefthatPEDFwasseekingwouldhaveeliminatedmorethan$120millionin
fundingappropriatedtothedepartment,DCNRSecretaryEllenFerrettisaid.Thisagreementwill
allowthecriticaloperationsofDCNRtocontinue,includingallstateparksremainingopenandstaff
beingavailableduringourbusiesttimeofyear,andnointerruptiontotheworkofourBureauof
Forestry,suchasmanagingthemultipleusesofourstateforests,monitoringgasdevelopmentonthe
foreststoprotecttheirnaturalandrecreationalvalues,fightingfires,forestpestmanagementandother
operations.
ThePatriotNewsreportedFriday,JohnChilde,theleadattorneyforthePAEnvironmental
DefenseFoundation,said:"ShouldthecourthaveenjoinedtheuseoftheOilandGasleaseFunds,
DCNRwouldbeleftwithouttheabilitytooperateforthenextyear,andourParksandForestswould
havehadtoclosedown.
"PEDFisbringingtheircasetosupportDCNR'sabilitytoprotectourParksandForests,notto
shutthemdown,"headded."Withthefearoflosingmoreparkandforestlandtonewleasesforgas
extractiongone,PEDFisanxioustogetthecasedecidedasquicklyaspossible."

welookforwardtopresentingourcaseincourt,saidtheGovernorsGeneralCounselJimSchultz.

revenuewastocomefromadditionalnonimpactleasingofnaturalgasdrillingrightsunderStatePark
andStateForestland.

HayleyBook,DEPsDirectorPolicy,elaboratedsayingtheexistingChapter78packagewill
besplitintotwopartsChapter78willcoverconventionalwellsandChapter78Awillcover
unconventional(MarcellusShale)wells.
BooksaidDEPhasdecidedtoreleaseanAdvancedNoticeofFinalRulemakinginearly2015
toallowthepublictocommentonnotonlythereformattedconventionalunconventionalwellrules,but
alsothechangesDEPmadeinresponsetotheoriginalpubliccommentperiodonChapter78.
BurtWaite,theCouncilsrepresentativeonDEPsOilandGasTechnicalAdvisoryBoard,said
theBoardisexpectingtogetacopyoftherevisedChapter78regulationstostartitsreviewbeforethe

DEPSecretaryChrisAbruzzotoldtheDEPCitizensAdvisoryCouncilTuesdayhewasverygratefulfor
the$11.5millionincreaseinDEPsFY201415budgetthisyearandsaidhewouldcontinueto
advocateforanincreaseinDEPsbudgetbecauseofthecriticalworkdonebytheagency.
Whileotheragencieswereaskedtotreadwater,wereceivedanincrease,saidSecretary
Abruzzo.IwillaskforanotherincreasenextyearandcontinuetoadvocateforgrowthinDEPs
budget.
DEPwasrequiredtogiveupanadditional55vacanciesinthenewbudget,bringingthetotal
DEPcomplementto2,653ofwhich2,490positionsarefilled.In200203,DEPhadacomplementof
3,211withabout3,000ofthosepositionsfilled,butthatwasbeforeGov.RendellcutDEPsbudget
andstaffsignificantly.Theagencyisjustnowtryingtorecoverfromthosecuts.
InresponsetoaletterfromtheCouncilinMayurgingamajorreviewoftheAct537onlot
sewageprogram,SecretaryAbruzzoinvitedCouncilandtheSewageAdvisoryCommitteetoappoint
memberstoasmallworkgrouptodeveloprecommendationsonimprovingtheuseofsocalled
alternativeonlotsewagetechnologiesandintegratingthemintothesewageplanningprocess.
CouncilappointedTimWeston,ThadStevensandJanetKeimtothegroupandtheSewage
AdvisoryCommitteesaidtheywouldalsoappointmembers.

Councilheardseveralpresentationsonavarietyofissuesatthemeeting,including
EllenShultzabarger,DCNRDivisionsofConservationScience&EcologicalResources,
providedanoverviewofimprovementsplannedforthePANaturalHeritageProgramsonline
environmentalpermitandconservationplanningtools.
NatureServehasbeenretainedbyDCNRtoprovidesignificantupdatestothePNDIonline
toolsbuildingonitsworkforotherstates.Shultzabargersaidtheyexpecttorolloutthechangesin
earlier2015andprovidetrainingonthenewsystemtousers.
Whencompleted,Shultzabargersaid,theupdatedtoolswillbethemostadvancedintheUnited
States.
DCNRdeclinedtodiscusshowtheendangeredspeciesandnaturalresourceinformationthey
havewillbeusedtoevaluatethenewnonimpactnaturalgasdrillingtheagencymustundertakeaspart
oftheapprovedFY201415budget.
DennisWhitaker,DEPChiefCounsel,providedanupdateonthecourtrulinginDecember
declaringsomeportionsoftheAct13drillinglawunconstitutionalandaviolationofPennsylvanias
EnvironmentalRightsAmendment.
Whitakersaid,althoughPaynevs.Kassabisstillthecontrollingdecisioninconsidering
EnvironmentalRightsAmendmentissuesbecausetheAct13rulingwasbyapluralityofthejusticeson
thePASupremeCourt,DEPhasformedworkgroupsineachofitsprogramstodeterminewherethey
mightneedchangestomeettherequirementslaidoutintheAmendment.
HesaidheanticipatesthosereviewswillbecompleteinSeptemberbasedonachecklist
developedbyhisoffice.
Hesaidsofarfewerthan20newappealshavebeenmadetotheEnvironmentalHearingBoard
usingtheAct13caseaspartoftheappeal.
VinceBrisini,DeputySecretaryforWaste,Air,RadiationandRemediation,providedan
updatetoCouncilonEPAsproposedclimatechangeruleanditsimpactonexistingPennsylvania
coalfiredpowerplants.
BrisinisaidtheEPAgivesstates,inparticular,Pennsylvanialessflexibilityindevelopingaplanto
reducecarbonemissionsthanpressstatementsbyEPAwouldsuggestbecauseitincludesmethods,
suchasincreasingnucleargeneration,whichstatescannotcontrol.
UnderEPAsproposedrule,hesaidEPAprojectscoalfiredgenerationofelectricityin
Pennsylvaniawouldbereducedfromusing43.4milliontonsofcoalin2005tojust10.5milliontonsin
2030.
Henoted,however,thatifnaturalgascontinuestobesubstitutedforcoalinelectricgeneration
asithasbeeninthelastfewyearsandthepriceofgasstaysatabout$4/MMBus,theuseofcoalwould
probablybereducedtoaboutthesamelevelsasEPAprojectsanyway,evenwithouttheclimate

samplingin40ofthe135streamsegmentstheywouldliketodotoestablishbackgroundlevelsof
chlorideandsulfatelevelstohelptheagencysetwaterqualitystandardsforthosepollutants.Sampling
forthestudyhasbeendelayedbyhighwaterlevelsinsomeareas.
In2012DEPwithdrewaportionofaregulationthatwouldhavesetstandardsforchlorides,
sulfates,Molybdenumand14dioxanesayingtheydidnothaveenoughinformationtosetthose
standards.TheDEPstudyisdesignedtofillinthatgap.
DEPhasalsoretainedStroudWaterResearchCentertoprovidetoxicitydataonwhatlevelsof
chloridesbegintohaveanimpactonmacroinvertebratesinstreams,inparticular,mayflies.Theresults
ofthistestingareduebacktoDEPbytheendofthisyear.
Theagencyexpectstoawardanothercontracttodosimilartoxicitytestingforsulfates.
HeffnersaidtheagencyhasupdatedinNPDESwaterpermitformstoincludemonitoringmajor
dischargesforchlorides,sulfatesandmolybdenumasasteptowardimplementingastandardwhenitis
adoptedforthesepollutants.

WildlifeFoundationAwards$2.4MillionInDelawareRiverWatershedGrants

TheNationalFishandWildlifeFoundationWednesdayannounced$2.4millioningrantsaspartofthe
firstroundof$7millioninfundingtoimprovewatersthatcontributetotheoverallhealthoftheDelaware
River.
Thisinitialroundoffundingincludes15projects(9inPennsylvania)thatwillworktoward
restoringwaterqualityandfishandwildlifehabitatacrosstheDelawareRiverwatershed.Theprojects
willcollaborativelyrestore34acresofwetlandsand32milesofriparianhabitat,engage1,050
volunteersandmitigatenearlytwomilliongallonsofstormwaterrunoff.
Thesegrantsarepartofa$35millionmultistateinvestmentbytheWilliamPennFoundationto
protecttheDelawareRiver.
InApril,TheWilliamPennFoundationannounceda$7milliongranttotheNationalFishand
WildlifeFoundationtorestorehabitatintheDelawareRiveraspartofa$35millioninitiativethatalso
includestheAcademyofNaturalSciencesofDrexelUniversity,theOpenSpaceInstituteandmore
than40additionalnationalandregionalpartners.
Theinitiativeaimstopermanentlyprotectmorethan30,000acres,implementmorethan40
restorationprojects,pilotnewincentivesforlandownersandbusinesses,providereplicablemodelsfor
otherlocationsinthewatershed,anddeveloplongtermwaterqualitydataforthewatershedatan
unprecedentedscale.

Inrecentyears,deforestationfromcommercial,residentialandenergydevelopment,
contaminatedrunofffromfarmsandurbanstormwaterhaveincreasinglythreatenedthehealthofthe
DelawareRiver.
TheDelawareistheonlyfreeflowingrivereastoftheMississippiandprovidescleanandsafe
drinkingwatertomorethan15millionpeople,manyinmajorcitiesincludingPhiladelphia,NewYork,
Camden(NJ)andWilmington(DE).
TheDelawareRiverwatershedcovers13,539squaremilesoflandandwater,touchesa
populationofovereightmillionpeopleandishometonativebrooktrout,riverherring,oystersand
threatenedplantsandotherwildlife.

ThisgrantwillallowCSFtooperateandmaintainnineexistingwatertreatmentplantsthat
removeAMDfromnearbywaterways.Thisincludescostsincurredforwatermonitoring,treatment
chemicals,systemflushing,sludgeremoval,emergencyrepairs,amongotherthings.
Itisimportantforustofundfacilitieslikethesethataremakingabigimpactonthewater
qualityofourriversandstreams,saidDEPSecretaryE.ChristopherAbruzzo.
Collectively,theseninetreatmentfacilitiestreatnearlyonemilliongallonsofmineinfluenced
waterdaily.
ThegrantwillbepaidtoCSFoveraperiodoffiveyears.ThisisthesecondgrantDEPhas
awardedtoCSFfortheoperationandmaintenanceofthetreatmentfacilities.
In2005,DEPenteredintoaConsentOrderandAgreementwithC&KCoalCompanyto
addresspostminingissues,suchasAMD.InthatCOA,atrustfundwascreatedbyC&Kto
constructandoperateAMDtreatmentplantsinimpactedareas.CSFwasnamedasthetrusteeandis
nowresponsiblefortheoperationandmaintenanceoftheAMDtreatmentfacilities.
Untilthetrustgrowstocoveralloperationandmaintenancecostsforthesetreatmentfacilities,
DEPhasagreedtoprovidesupplementalfundingfromthefederalSurfaceMiningConservationand
ReclamationFund.Thefundissupportedbyafeeonthecoalindustryandisdistributedtostatesas
annualgrantstoreclaimabandonedminesites.

TheFishandBoatCommissionTuesdayannounced$500,000ingrantstodevelopandimplement

undertheNRCSWatershedRehabilitationProgram.

PondEddyBridgeinPikeCounty.
AccordingtoDGSSecretarySheriPhillips,her
departmentiscurrentlyacceptinglettersofinterestuntilAugust29
andbidsuntilSeptember5frompotentialbuyerswillingto
preservethebridgeinanewlocation.
Builtin1904,thePondEddyBridgecarriesRoute1011
overtheDelawareRiverinShoholaTownship,PikeCounty.The
twospanbridgeis504feetlongand16feetwide.Eachspanof
thebridgeis252feetinlength.Bothspansofthebridgeareavailableasasetorindividually.
"ThePondEddyBridgeisasignificantpartofthehistoryofthetownsofPondEddy,
Pennsylvania,andLumberland,NewYork,whereitservedastheonlyconnectionpointbetweenthe
twotownssinceitsconstruction,"Phillipsnoted."Bynomeansisthelifeofthisbridgeover.Thereare
manyotherwaysthisbridgecancontinuetobeapartofourstate'shistory."
Phillipsnotedthathistoricbridgescanbesuccessfullyadaptedtobecomebikeandwalking
bridgesontrails,inparksandoncollegecampuses.
