Leave Rules

General Principles
Cannot be claimed as a matter of right.
Sanctioning authority may refuse leave but cannot
alter the kind of leave applied for.
One kind of leave may be converted into
different kind of leave at a later date at the
request of official and at the discretion of
sanctioning authority within 30 days of
completion of relevant spell of leave while in
service and not after quitting service. This can not
be claimed as matter of right.
No leave can be granted for a continuous period
exceeding 5 years except with the sanction of the
President.
No service or employment while on leave without
permission of competent authority.
Official on leave on medical ground will be permitt-
ed to return to duty on production of MC of fitness
from AMA.
Willful absence after expiry of leave liable to
disciplinary action.
Absence without leave will constitute an interrup-
tion of service unless regularized.
Sanctioning authority may commute retrospectively
periods of absence without leave into EOL.
1.Earned Leave
Credit - 15 days on 1
st
of Jan and Jul every year.
To be reduced by 1/10 of EOL or dies-non period
during previous half-year .
Accumulation- up to 300 days.
Credit @ 2.5 days for the half year in which a
Govt servant appointed/retired/death for each
completed calendar month.
Un-availed joining time shall be credited to EL
account. EL plus JT should not exceed 300 days.
When proceeds alone to new place or ordered to
join without availing full joining time.
EL can be availed up to 180 days at a time.
EL exceeding 180 days but not exceeding 300
days at a time may be granted to Grup A
and B officers, if at least the quantum of
leave in excess of 180 days is spent outside
India, Bangladesh, Bhutan, Burma, Sri Lanka,
Nepal and Pakistan.
EL upto 300 days may be taken as leave
preparatory to retirement.
Fraction of a day to be rounded off to nearest
day.

2.Half Pay Leave
Advance credit @ 10 days on 1
st
Jan and
Jul every year. Credit will @ 5/3 days for
the half year in which a Govt servant
appointed/retired/death for each completed
calendar month.
The grant of HPL to temp official is subject
to sanctioning auth satisfying himself that
the official will return to duty after its expiry.
Fraction to be rounded off to nearest day
HPL can be availed with or without MC.

3.Commuted Leave
Not exceeding half the amount of HPL due
can be taken on medical certificate.
It can be taken without MC:- up to 90 days
in entire service for approved course of
study. Upto 60 days by a female official in
continuation of maternity leave and for
adopting a child less than one year old with
less than two living children.
Twice the number of days of commuted
leave availed is debited in the HPL account.

Commuted leave may be granted at the
request of Govt servant even when EL is
available.
Where a Govt servant granted commuted leave
quits service voluntarily without returning to
duty, the commuted leave shall be treated as
HPL and excess leave salary recovered. If the
retirement is by reason of ill-health
incapacitating him for further service or in the
even of death, recovery should not be made.
Can not be granted as leave preparatory to
retirement.

4.Leave Not Due
Granted to a permanent official with no HPL at
credit.
May be granted to temp official with minimum
one years service and suffering from TB,
Leprosy, cancer or mental illness if post likely to
last till his return.
It is granted on MC with reasonable prospect of
official returning to duty on expiry of leave.
May be granted without MC to a female Govt
servant - with maternity leave and on adoption of
child less then one year old with less than two living
children.
Should be limited to HPL likely to earn
subsequently.
Max limit 360 days during entire service.
Debited against HPL earned subsequently.
Not granted as Leave preparatory to
retirement.
Govt. servant having availed LND resigns
before earning such HPL, liable to refund
leave salary to the extent not earned.
Leave salary not to be recovered in case of
death or retirement due to ill-health.
5.Extra ordinary Leave
Granted when no other leave is due or other
leave is admissible but the govt. servant
applies for EOL.
Can not be availed when proceeding on
voluntary retirement.
Max limit 5 years to permanent employees.
For temp officials - Up to 3 months to all
officials with or without MC - Up to 6
months with MC for common ailments to
officials with one year service and
Up to 18 months with MC for Cancer, mental
illness, pulmonary tuberculosis , tuberculosis
and leprosy.
Officials with 3 or more year service - Up to
24 months for prosecuting higher studies in
public interest.
Two spells of EOL intervened by any other
kind will be treated as one continuous spell
for applying max limit.
EOL may be granted to regularize period of
absence without leave retrospectively.
6.Maternity leave
Admissible to female employees during -
Pregnancy - 135 days (less than 2 living
children)
Miscarriage/abortion - 45 days in entire service
irrespective of surviving children.To be
supported with MC from AMA
Granted on full pay. Can be combined with any
other kind of leave.
Counts for increments and pension. Not debited
to any leave account.
Not admissible for threatened abortion
7.Paternity Leave
Eligibility-Male govt.servants with less than
two surviving children.
Duration - 15 days during wifes
confinement.
Leave salary -equal to last pay drawn.
Not debited to any leave account and may be
combined with any other kind of leave.
Not to be refused normally.
To b e applied up to 15 days before or six
months from date of delivery.
8.Special disability leave
Admissible to all employees when-
Disabled by injury intentionally or
accidentally
Disabled by illness incurred in performance
of any particular duty.
Disability manifested within 3 months of
occurrence to which it is attributed.
Disability certified by AMA to be directly
due to performance of particular duty.
Period - May be granted more than once -
max 24 months as certified by AMA.
Count for pension and may be combined
with any other kind of leave.
Not to be debited to leave account.
Leave salary for first 120 days - pay last
drawn remaining equal to HPL.
May take HPL beyond 120 days with
disability leave and get leave salary equal
to EL. HPL will be debited leave account.
Appointing authority competent to sanction.
Period - May be granted more than once -
max 24 months as certified by AMA.
Count for pension and may be combined
with any other kind of leave.
Not to be debited to leave account.
Leave salary for first 120 days - pay last
drawn remaining equal to HPL.
May take HPL beyond 120 days with
disability leave and get leave salary equal
to EL. HPL will be debited leave account.
Appointing authority competent to sanction.
9.Hospital Leave.
Admissible to - Group C and D for
duties- handling of dangerous machinery,
explosives, poisonous drugs, hazardous
tasks while under medical treatment in a
hospital or illness/injury directly due to
official duties.
Granted for such period as considered
necessary against MC from AMA.
May be combined with any other kind of
leave. Total period not to exceed 28 months.

Leave salary for 120 days - Pay last drawn
and for remaining period equal to HPL.
Not to be debited to any leave account.
Facilities of getting full pay after 120 days
by taking HPL simultaneously unlike
disability leave not applicable.
Admissible to Industrial and work-charged
staff also.
10.Study Leave
Eligibility - Min 5 years service for special course
of higher studies or specialized training likely to
improve his ability.
Sanctioning authority -Ministry/department of
Central government/Administrator/
Comptroller and Auditor-General of India.
Course should be advantage to govt in public
interest.
Study or study tour should be approved by
authority competent to sanction leave.

Full report on work done during study leave
to be submitted on return .
Not granted -(I) for studies out of India if
facilities for such studies exist in India ;
(ii)To an official due to retirement with 3
years of return from the study leave.
Not debited to leave account. May be
combined with other leave. Max limit 28
months. 36 months for Ph.D degree.
Bonds in prescribed forms are required .
Fin Min consent to release foreign exchange is
necessary before grant of leave outside India.
Child care leave
Female employees having minor children
may be granted Child Care Leave for a
maximum period of 730 days during entire
service for taking care of upto two children
for rearing or to look after any of their
needs like exam, sickness etc. It shall not
admissible if the child is eighteen years of
age or older. During such leave, shall be
paid leave salary equal to the pay drawn
immediately before proceeding on leave.
It may be availed for in more than one spell but
not more than 3 spells in a calendar year.
It may be combined with leave of any kind due
and admissible.
Require prior sanction.
In r/o disabled/mentally challenged children it is
permitted upto the age of 22 years on submission
of requisite certificate.
It may not be granted for less than 15 days.
It is not granted during probation period except in
cases of certain extreme situations and a minimal
leave is sanctioned.
LTC can not be availed during CCL.
