Aith reference to the su!-ect mentioned a!o8e, and 8ide Refs(91,2: I here!4 !ring to 4our attention that the undersigned is
aggrie8ed !4 the lac1 of response till date, from the registrar $ pu!lic information officer, regarding the same, e8en after the
mandator4 time limit of '0 da4s to pro8ide the reCuested information as per the mandate of the R#I act, 2005(
>ence, this first appeal is filed !4 the undersigned for appropriate action !4 the first appellate authorit4, ?ithin the time limit
mandated !4 the aforementioned act(
Aith regard to the time !ound disposal of applications $ representation !4 pu!lic functionaries, it is held !4 the -udiciar4 that
eDpeditious disposal of applications $ letters $ representations !4 the pu!lic officials is a right ingrained in Article 21 of the
5onstitution of India( #he rele8ant portion of the -udgment 8ide Ref(9': , is placed here on record .E Indu!ita!l4, eDpeditious
decision on the representation or application is a right ingrained in Article 21 of the 5onstitution of India( For, eDistence of po?er
to decide such application $ representation is coupled ?ith dut4 to decide the same eDpeditiousl4( It ?ill not !e out of place to
restate the legal position eDpounded !4 the *i8ision =ench of this 5ourt in a recent decision in the case of +aishali Atmaram
Sur4a?anshi +$s the State of &aharashtra in Arit ,etition o(3055$2009 decided on 1/th *ecem!er, 2009( ota!l4, due to the
inaction of the Authorit4 (officials), not onl4 the citiFen has to suffer the agon4 of uncertaint4 and dela4ed -ustice, !ut at the same
time the State eDcheCuer is incurred on legal proceedings, ?hich is ?holl4 a8oida!le(G
#he said court further mandated the 5hief Secretar4 to issue appropriate instructions or circular for eDpeditious disposal of
an4 application $ representation from the pu!lic, including appropriate *epartmental action for dereliction of dut4( #he rele8ant
portion of the -udgment in the aforesaid ?rit petition, is placed here in on record .
E In our 8ie?, the 5hief Secretar4 of the State of &aharashtra should issue appropriate instructions or circular to all the
concerned officials of the respecti8e departments, not onl4 to one referred to a!o8e, !ut a general circular, instructing all the
*epartments that if the officials are reCuired to dispose of an4 application or representation under the pro8isions of la? the4 shall
do so ?ithin a reasona!le time and in an4 case not later than the time specified in the said circular, failing ?hich the concerned
official ?ill !e held personall4 responsi!le and ma4 !e proceeded for appropriate *epartmental action including for dereliction of
dut4( G
It is further mentioned that the practice of forcing the pu!lic to run from pillar to post,
resulting in un?arranted and a8oida!le appeals $ litigation, ?as clearl4 decried !4 the Supreme
5ourt of India( #he rele8ant portion of the -udgment 8ide Ref(9): is placed here on record .

8ests in the people( <8er4 lim! of the constitutional machiner4 is o!liged to !e people oriented( o functionar4 in eDercise of
statutor4 po?er can claim immunit4, eDcept to the eDtent protected !4 the statute itself( ,u!lic authorities acting in 8iolation of
constitutional or statutor4 pro8isions oppressi8el4 are accounta!le for their !eha8ior !efore authorities created under the
statute li1e the commission or the courts entrusted ?ith responsi!ilit4 of maintaining the rule of la?(G
As per Section 19(/) of the R#I Act, 2005, the First appeal should !e disposed ?ithin a maDimum time limit of )5 da4s from
the date of filing the same( &oreo8er, as per the decision of the Supreme 5ourt 8ide Ref(95:, the procedure under Section (19) of
the R#I Act, 2005, dealing ?ith appeals is a #I&< =;7* ,R;5<*7R<( >ence it is mandator4 on the Appellate authorit4 to
decide the First appeal ?ith a maDimum time limit of )5 da4s from the date of receipt of the same, as specified u$s 19(/) of the R#I
act, 2005(
Also, as per Section 1) of %eneral 5lauses Act 1B93. E,o?ers conferred to !e eDercisa!le from time to time(. (1) Ahere, =4
