The respondent, a native ad citizen of Mexico, has appealed fom the Imigation Judge's
decision dated March 12, 2013. The Immigation Judge denied the respondent's request fr
volunty departure, ad ordered the respondent removed to Mexico. The record will be
remanded to the Immigation Judge.
The Boad reviews an Immigation Judge's fndings of fct, including fndings as to the
credibilit of testimony, under the "clealy erroneous" standard. 8 C.F.R. 1003. l (d)(3)(i). The
Board reviews questions of law, discretion, and judgment and all other issues in appeals fom
decisions of Immigration Judges de novo. 8 C.F.R. 1003.l(d)(3)(ii); Matter of A-S-B-, 24 l&N
Dec. 493 (BIA 2008).
Upon review of the record, at the March 12, 2013 hearing, at which the respondent appeaed
pro se, the Immigation Judge declined to grant the respondent voluntary depaure without frt
explaining the diference between pre-conclusion ad post-conclusion voluntary deparure under
sections 240B(a) and (b) of the Immigation and Nationality Act, 8 U.S.C. 1229c(a) ad ().
See Matter of Argelles-Campos, 22 I&N Dec. 811, 817 (BIA 1999); Matter of Cordova, 22
I&N Dec. 966 {BIA 1999). The Immigation Judge concluded that the respondent declined to
request voluntary deparure based on the respondent's statement that he wished fr a additonal
continuace to seek legal representation (Tr. at 8). Under these circumstances, we conclude that
a remad is warranted fr the Immigration Judge to provide the respondent with an opportunity
to pursue voluntary departure, either pre-conclusion or post-conclusion, and fher fr the
Immigration Judge to adequately advise the respondent regarding the diference between the two
We note that the respondent has not established a due process violation fom the denial of a
right to counsel. Te record refects that the Immigration Judge, as required, infored the
respondent of his right to counsel and provided him with a list of persons who have indicated
teir availability to represent aliens in proceedings on a pro bono basis (Tr. at 1 ). 8 U.S.C.
1362; 8 C.F.R. 1240. lO(a). The respondent had adequate opporty to retain counsel ad
he has not established prejudice because he has not shown prima fcie eligibility fr ay relief
other than voluntary departure, which he will be able to pursue on remand. See Perera v. Holder,
750 F.3d 25 (1st Cir. 2014) (requiring a showing of prejudice to support a due process claim).
The respondent is not precluded fom seeking other relief befre the Immigation Judge,
provided that the standads fr reopening ae met. See Matter of Patel, 16 I&N Dec. 600 (BIA
1978); Matter of M-D-, 24 l&N Dec. 138 (BIA 2007).
