BASIS OF CLAIM
LG ELECTRONICS, INC. have knowingly and negligently designed, manufactured,
advertised, distributed, and sold defective and substandard consumer electronics (DP122
and DP132 DivX dvd players) in Augusta Maine which utterly fail to perform as advertised
seriously injuring the consumer with property damage, loss of property rights, emotional and
physical injury, emotional and physical distress, time lost, incidental injuries and out of
pocket expenses due to LG ELECTRONICS negligence.
I was using a Phillips brand dvd player until December 2012 to play self-created DivX
video discs without problems. I gave the Phillips player to my daughter after I purchased an
LG DP122 at Augusta Maine KMart primarily for playing self-created DivX video discs.
I used the DP122 (#1) for about 4 months before I returned it to Augusta KMart as
defective and requested and received an equal exchange for another LG DP122 (#2).

I used the DP122 (#2) for about 9 months before I returned it to Augusta KMart as
defective after seeing an advertisement for LG DP132 (#1) for the same price as I paid for the
DP122.
I operated under the reasonable expectation that the DP132 was an upgrade to the
DP122 and the problems with the DP122 had been resolved in the DP132.
I exchanged the DP122 (#2) for a DP132 (#1) at Augusta KMart on March 11, 2014.
I immediately experienced the same problems with DP132 (#1) as with both DP122s.
I exchanged the DP132 (#1) for another DP132 (#2) on July 20, 2014.
I immediately experienced the same problems with the DP132 (#2) as with DP132 (#1).
To date, I have owned, possessed and used four (4) LG DivX dvd players.
I have sought every technical solution and explored every administrative remedy
including making no less than three (3) phone calls to LGs liability department, to no avail.

The evidence listed above provides ample support for my claims of defective and unfit
consumer products which clearly violate LG ELECTRONICS express warranty and state law.
NATURE AND EXTENT OF INJURIES
I have suffered serious emotional and physical injury over a course of eighteen (18)
months from repeated attempts to remedy this problem on my own experiencing great pain
and suffering, anxiety, frustration, physical anger and rage, including property damage and
loss (discarded discs which I thought were bad), lost time, out of pocket expenses and other
incidental damages.

AMOUNT OF MONETARY DAMAGES
Claimant demands $100,000 for each dvd player purchased ($400,000 total), in
addition to pre-judgment interest beginning on this date pursuant to 14 MRSA 1602-B.
I, GINA LYNN TURCOTTE, swear under pains and penalties of perjury, upon my own
knowledge, information and belief, and so far as upon my information and belief, I believe
this information to be true and correct.
