Nevada Sen. John Ensign (R) plans to announce Friday he resign his Senate seat, aides said
Thursday.
Ensign has been under investigation by the Senate Ethics Committee over whether he violated Senate
rules during his affair with Cindy Hampton, a former campaign aide. Hampton's husband, Doug
Hampton, was Ensign's deputy chief of staff during most of the extramarital relationship.
The move could clear the way for Nevada Gov. Brian Sandoval to appoint Rep. Dean Heller to fill
Ensign's seat, giving the GOP congressman the comforts of incumbency and a leg up as he pursues
term in 2012.
If Heller were appointed to the upper chamber, it would also trigger a special election in Nevada's 2nd
Congressional District, where Sharron Angle and former military commander Kirk Lippold are already

Ensign's Release Of E-mails To Senate Ethics Committee Led DOJ To Reconsider Criminal Probe.
Reuters (5/27, reports that the Justice Department is likely to reopen its probe of former Sen. John Ensign after
obtaining a number of emails between Ensign, his advisers, and his attorneys that Ensign had originally refused to turn over to the
department, saying they were privileged. As Reuters reports it, Ensign decided shortly before his resignation from the Senate to
provide the emails to the Senate Ethics Committee, and they contained information that convinced prosecutors to consider re-
opening the probe. Reuters cites a Justice Department official who is highly critical of the department's decision to announce it was
no longer pursuing a criminal probe of Ensign, saying the decision could have damaging effects on future prosecution of public
officials.

A constitutional clash over whether House members are immune from many forms of Justice Department scrutiny has helped derail or slow several recent
corruption investigations of lawmakers, according to court documents and sources.
At issue is a provision in the Constitution known as the "speech or debate" clause, which shields legislative work from executive branch House
members have increasingly asserted the privilege in conuption probes, often citing a 2007 court ruling that said FBI agents violated the Constitution when
they searched the office of William J. Jefferson (D-La.).
The Justice Department warned at the time that the court decision would "seriously and perhaps even fatally" undermine congressional corruption probes
limiting the FBI's ability to search for evidence and use wiretaps,

The widening assertions of criminal immunity have drawn little notice or controversy on Capitol Hill, In fact, the challenges have produced
rare bipartisanagreement: The incoming and outgoing House leaders, for example, have cited the constitutional clause to challenge much of the

administration to agree to limitations in Capitol Hill searches. But sources familiar with the negotiations said the talks broke down i n the fall.
The speech or debate clause derives from 17th-century English law and says that "for any speech or debate in either House, (members of Congress) shall not
questioned in any other place." Until recently, courts had interpreted the passage narrowly.
"Bringing cases now because of the state of affairs of speech or debate makes these cases much more difficult," said Lanny A. Breuer. the assistant attorney
general who oversees the Justice Department's Public Integrity Section. But he said that the provision "is not a roadblock. I f you're corrupt, we're going to
look at you, and we're going to prosecute you aggressively."
In the government has abandoned without filing charges seven investigations of current or former members of Congress since President
Obamattaok office, many in recent months. They include the inquiries involving Feeney and Doolittle and others that ended for reasons apparently unrelated to
speech or debate. . '
The other dropped investigations were examining Sen. John Ensign (R-Nev.), Rep. Don Young Rep. Jerry Lewis (R-Calif.), former representative
Mollohan (D~W.Va) and former House majority leader Tom Although the federal probe of DeLay was dropped, he was sentenced
last week to three years in prison in a separate, state money-laundering
Law enforcement officials declined to comment on specific cases but said probes were dropped for a variety of reasons. They cited other court
of limitation and a review by new Justice Department officials who decided that some cases were not progressing.
But lawyers familiar with the issue said speech or debate concerns come up in virtually every congressional probe because many involve legislative acts, such
whether the lawmaker obtained earmarks in exchange for campaign contributions.
"The essence of speech or debate is you can't introduce into evidence what the member did i f it's part of an official duty," said a lawyer who spoke on the
condition of anonymity because the challenges are often under court seal. "If you can't introduce legislation, a a speech on the floor, how do you make the
case?"
In the Visclosky investigation, prosecutors explored whether helped obtain earmarks for clients of powerful lobbying firms in exchange for
contributions. But Visclosky's lawyers refused to hand over much of the material sought in 2009 by a federal grand jury in Alexandria, citing speech or debate
concerns, according to sources familiar the investigation.
The investigation has not formally ended, but the sources said. Visclosky is unlikely to be charged. Justice Department officials declined to comment.
The dropped investigations covered subjects ranging from Ensign's alleged efforts to keep secret his affair with a staff member to a $10 million earmark
backed by Young a road project.
Mollohan announced last year that wi l l not be charged in a probe of his finances and nonprofit groups he created and helped fund in his district.
In an interview, Mollohan said the investigation was politically motivated. In each of the other cases, either the exonerated lawmaker or his attorney has
disputed the allegations.
" I think it's rap for people who don't the evidence to assume there is something improper when career prosecutors determine they're not going to
indict somebody," said Richard a former U.S. attorney in Virginia who is chairman of in Richmond. He represents DeLay, who
announced in August that the Justice Department had dropped its six-year probe of his ties to former lobbyist Jack Ahramoff.
Sources familiar with the federal investigation said that DeLay not back documents from prosecutors but that they were hampered by their inability
to persuade witness to testify him.
Attome'ys for Renzi, case has been delayed, have cited the speech or debate issue in their argument that the government violated rights when agents
wiretapped his cellphone, interviewed congressional aides without his consent and procured documents that aides took from his office.
Renzi's attorneys received support in June from the House general counsel, who argued in a brief on behalf of Speaker John A. Boehner (R-Ohio), Minority
Leader Nancy and other leaders that the Justice Department "repeatedly and flagrantly violated" Renzi's constitutional rights.

Jefferson was nevertheless convicted of corruption in a case made famous by $90,000 found in his freezer.
Despite decisions to drop Justice Department and FBI officials say they are as aggressive as ever in confronting congressional and other public
corruption. They say they are increasingly focused on corruption nationwide and cite an influx of FBI agents to fight corruption along the nation's Southwest
border and the recent indictment of people, including four current and former state lawmakers, in a bribery inquiry related to bingo legislation in Alabama.
During the past two weeks, a federal grand jury in Richmond indicted a former member of Virginia's House of Delegates, Phillip A. Hamilton, on bribery and
extortion charges, and Paul J. a former D.C. lobbyist, was sentenced to 27 months in prison for illegal campaign contributions.
"They may not be the sort of cases that will make headlines in Washington, but I think it's the sort of thing the American public wants us to do," said Jack
Smith, who became chief of the Justice Department's Public Integrity Section in May.
A review by Smith and other officials of hundreds of public corruption investigations was akey factor in the decisions to drop some of the inquiries on
Capitol Smith thought some investigations had lagged too long without sufficient progress, officials said.
Watchdog groups have criticized House leaders for their stance on speech or debate. The House brief in the Renzi case "was outrageous," said Melanie Sloan,
executive director of Citizens for Responsibility and Ethics in Washington. "They're basically saying that i f you are a member of Congress, you cannot be
wiretapped under any circumstances."
Nathan, who resigned this month as House counsel, countered that prosecutors can use evidence collected through wiretaps or other means hut must
exclude anything related to legislative

And several years ago, the House general counsel's office challenged the subpoena of a House appropriations panel staff member in the probe of a lobbying
firm's ties to Lewis. Sources said prosecutors wound up interviewing the staffer anyway.
U.S. attorney's office in Los Angeles said last month the Lewis investigation had been closed.

The Justice Department has shut down a wave of high-profile investigations of
members of Congress over the past few months, drawing criticism that the government's premier
agency has lost its nerve after the disastrous collapse last year of its case against
former Senator Ted Stevens.
This month, lawyers for Senator John Ensign, Republican of Nevada, announced that federal
prosecutors had told them they would not charge the senator with conspiring to help a former aide,
with whose wife had had an extramarital affair, violate a lobbying law.
A few days later, lawyers for Representative Jerry Lewis, Republican of California, facing scrutiny
for steering government spending to campaign donors, said they were told that their client would not
be charged, either.
Other federal corruption investigations known to have been ended without charges this year had
focused on Tom DeLay, the former House leader and Republican of Texas;

Representative Don Young, Republican of Alaska; and Representative Alan B. Mollohan, Democrat of
West Virginia.
"They're gun-shy," said J. Gerald the executive director of the Campaign Legal Center, a
nonpartisan group that seeks greater disclosure of how money influences politics.
But in interviews, Jack Smith, chief of the Public Integrity Section at the Justice Department, and his
supervisor, Lanny Breuer, the assistant attorney general for the Criminal Division, hotly contested the
contention that prosecutors were in retreat from taking on Congressional corruption.
"It's just not the case that anyone is gun-shy," Mr. Breuer said. "I f a case cannot be brought, it's
because we've taken a hard look made the determination this case cannot be proved beyond a
reasonable doubt. And with all due respect to those outside the department, they haven't seen the
evidence, They don't know the materials, and we've looked at i t all."
The officials would not discuss why they declined to bring charges in specific investigations. The
subjects of inquiries are free to announce that cases been closed, however, and frequently
portray such decisions as proof that they had done nothing wrong.
" I understand why the question is asked," Mr. Smith "But i f I were the sort of person who could
be cowed 1 know should bring this case, I the person did it, but we could lose, and that
bad,' I would find another line of work. I can't imagine how someone who does what or
has worked me could think that."
Mr. Smith took over the section six months ago. Before that, he helped prosecute police officers i n
the Abner police brutality casein New York and investigated war crimes for the International
Criminal Court.
One partial explanation behind the flurry of closings was the timing of Mr. Smith's arrival. One of his
first steps, he said, was to review every open case push for a conclusion one way or the other,
saying i t was not fair to let inquiries linger unnecessarily.
Mr. Breuer said, "There is no question that i f we thought a case was not going where i t needed to,
because the facts were what they were i t was too old, that we should make the tough decision and
on."
Both officials also said that whether the subject of an investigation was a member of Congress made
no difference to their evaluations of
That assertion drew some skepticism.
" I don't think there is any question that the decision to charge a sitting member of Congress is going
to get far more scrutiny and it's going to he agonized over by a lot more people," said Peter
Zeidenberg, a former public integrity prosecutor.
Mr. Zeidenberg also said prosecuting lawmakers had become more difficult in recent years because of
federal court rulings. They narrowed what counts as "honest services fraud" or an "official act" for the
purposes of a bribery charge, and banned certain searches that could expose legislative information
protected by the Constitution's "speech and debate" clause, he said.
It does not appear, however, that any of the recent decisions not to charge members of Congress
turned on those rulings.
Despite the quiet end to several of its highest-profile investigations, both Mr. Smith and Mr. Breuer
portrayed the Public Integrity Section as after the turbulence it experienced 20 months
ago, when its case against Mr. Stevens, Republican of Alaska, who died in August, collapsed because
the trial team had improperly failed to disclose mitigating evidence.
In the fallout, the trial team found itself under investigation, the section's top two leaders were re-
assigned and one member of the trial team later committed suicide.
But Mr. Smith said that morale in the section was now good and that hundreds of lawyers had applied
for recent job openings there, despite the travel and what he described as the inevitable
criticism that comes with handling corruption cases.
He also as instituted practice runs for trials, in which veterans critique opening statements and offer
advice, while telling prosecutors to focus less on the number of cases they bring than on bringing
"high impact" cases with deterrent effects.
As example, he pointed to the recent indictment of 11 Alabama state legislators, staff members and
lobbyists over an alleged vote-buying scheme. (One lobbyist pleaded guilty to bribery charges on
Monday.)
Mr. Smith also pointed to the case against the lobbyist, Paul Magliocchetti. A former aide to John P.
Murtha, the late Democrat of Pennsylvania and House Appropriations Committee chairman, Mr.
Magliocchetti pleaded guilty to making illegal campaign contributions in September.
Still, the record of a wider investigation into a circle of lawmakers who had steered federal spending
to Mr. Magliocehetti's clients is murkier.
One main figure, Mr. Murtha, died in February. Another, Representative Peter J. Visclosky, Democrat
of Indiana and an appropriations subcommittee chairman, received a subpoena in May 2009, but
there has been no public sign of further developments.

closed in January. Several months later, after his primary campaign opponent attacked his ethics, he

Mr. Breuer, emphasizing that he was not discussing any particular case, noted that criminal law was
just one of several ways by which society policed the behavior of elected officials.
"Conduct that people think is reprehensible or immoral doesn't mean it's criminal," Mr. Breuer said.
"If there is a criminal case to bring, we'll bring it. I f there isn't one to be brought no matter i f we like
the conduct or don't like the conduct, like or don't like the people we won't bring it."

The Justice Department subpoenaed at least six Las Vegas businesses in connection with a probe of Sen. John
Ensi gn (R-Nev.), who helped a former staffer secure a lobbying j ob after having an affair with the staffer's wife.

A lawyer from the department's Public Integrity Section and an FBI agent issued grand j ury subpoenas earlier this
month to unnamed businesses had dealings with the senator and his staff since 2008. According to the Las Vegas
television station KLAS

, federal investigators are trying to determine whether Ensign pressured the businesses to
hire former staffer Doug Hampton, and whether the senator offered anything in return.
The FBI and Senate Ethics Committee are looking into whether Ensign tried to curb political damage to himself by
helping Hampton find a new job as a lobbyist. Federal law prohibits congressional aides from lobbying their ex-bosses
or colleagues for one year after leaving Congress.
Federal prosecutors are presenting evidence to a grand jury in the District. One of the subpoenas

obtained by
KLAS, ordered recipients to testify on March 31 and to produce documents related to Ensign, his staff, Hampton and
his wife Cindy (with whom Ensign had the affair), and the lobbying fi rm that hired Doug Hampton.
I f Ensign were indicted, it would mark the second prosecution of a sitting senator since 2008, when Republican Ted
St evens was tried f or omitting gifts from his financial disclosure forms. Stevens was convicted, but the case was
dismissed after the department determined prosecutors improperly withheld evidence from team.
According to the subpoena, Public Integrity trial lawyer Deborah Sue Mayer and FBI Special Agent Frank D'AmIco
are working the Ensign investigation.

Update on the Ensign Database
in DC Office is still copying the data he received from FBI onto their network and
doesn't expect to be done with this until tomorrow sometime. He is out of the office on

and confirmed with him that under our current agreement, Senator Ensign's
office was preserving all computer hard drives in its possession. However, if the Senate Sergeant-at-Arms is
not prepared to preserve all hard drives, at a minimum, we need the following hard drives listed below
preserved either in their original form or by making a forensic image. If the Senate makes a forensic image of
each of these computers, we request that, prior to any imaging, the Senate inform the FBI of the process it

I have created a DVD containing a Concordance database, single page Tiff images, a Concordance load file and an iPro
load file. This encompasses all of the documents that we currently have. When it is loaded to your system, you will be
able to view the images in the iPro viewer by clicking the camera button in Concordance. The Concordance database on
the disc is ready to use.
However, the new production that is coming next week will be a bit different. It will contain a Concordance data load
file and the native copies of the files (instead of images for iPro). The Concordance data load file will have a field
containing a hyperlink to the native document. I anticipate receiving this production from the FBI next week.

WASHINGTON The Justice Department has shut down a wave of high-profile investigations of members of Congress over the past
few months, drawing criticism that the government's premier anticorruption agency has lost its nerve after the disastrous collapse last
year of its case against former Senator Ted Stevens.
This month, lawyers for Senator John Ensign, Republican of Nevada, announced that federal prosecutors had told them they would not
charge the senator with conspiring to help a former aide, with whose wife he had had an extramarital affair, violate a lobbying law.
A few days later, lawyers for Representative Jerry Lewis, Republican of California, facing scrutiny for steering government spending to
campaign donors, said they were told that their client would not be charged, either.
Other federal corruption investigations known to have been ended without charges this year had focused on Tom DeLay, the former
House majority leader and Republican of Texas; Representative Don Young, Republican of Alaska; and Representative Alan B.
Mollohan, Democrat of West Virginia.
"They're gun-shy," said J. Gerald Hebert, the executive director of the Campaign Legal Center, a nonpartisan group that seeks greater
disclosure of how money influences politics.
But in interviews, Jack Smith, chief of the Public Integrity Section at the Justice Department, and his supervisor, Lanny Breuer, the
assistant attorney general for the Criminal Division, hotly contested the contention that prosecutors were in retreat from taking on
Congressional corruption.
"It's just not the case that anyone is gun-shy," Mr. Breuer said. "If a case cannot be brought, it's because we've taken a hard look and
made the determination that this case cannot be proved beyond a reasonable doubt. And with all due respect to those outside the
department, they haven't seen the evidence. They don't know the materials, and we've looked at it all."
The officials would not discuss why they declined to bring charges in specific investigations. The subjects of inquiries are free to
announce that cases have been closed, however, and frequently portray such decisions as proof that they had done nothing wrong.

"I understand why the question is asked," Mr. Smith said. "But if I were the sort of person who could be cowed 'I know we should
bring this case, I know the person did it, but we could lose, and that will look bad,' I would find another line of work. I can't imagine how
someone who does what I do or has worked with me could think that"
Mr. Smith took over the section six months ago. Before

that, he helped prosecute police officers in the Abner Louima police brutality
case in New York and investigated war crimes for the International Criminal Court.
One partial explanation behind the flurry of closings was the timing of Mr. Smith's arrival. One of his first steps, he said, was to review
every open case and push for a conclusion one way or the other, saying it was not fair to let inquiries linger unnecessarily.
Mr. Breuer said, "There is no question that if we thought a case was not going where it needed to, because the facts were what they were
and it was too old, that we should make the tough decision and move on."
Both officials also said that whether the subject of an investigation was a member of Congress made no difference to their evaluations of
cases.
That assertion drew some skepticism.
"I don't think there is any question that the decision to charge a sitting member of Congress is going to get far more scrutiny and it's
going to be agonized over by a lot more people," said Peter Zeidenberg, a former public integrity prosecutor.
Mr. Zeidenberg also said prosecuting lawmakers had become more difficult in recent years because of federal court rulings. They
narrowed what counts as "honest services fraud" or an "official act" for the purposes of a bribery charge, and banned certain searches
that could expose legislative information protected by the Constitution's "speech and debate" clause, he said.
It does not appear, however, that any of the recent decisions not to charge members of Congress turned on those rulings.
Despite the quiet end to several of its highest-profile investigations, both Mr. Smith and Mr. Breuer portrayed the Public Integrity
Section as reinvigorated after the turbulence it experienced

months ago, when its case against Mr. Stevens, Republican of Alaska,
who died in August, collapsed because the trial team had improperly failed to disclose mitigating evidence.
In the fallout, the trial team found itself under investigation, the section's top two leaders were re-assigned and one member of the trial
team later committed suicide.
But Mr. Smith said that morale in the section was now good and that hundreds of lawyers had applied for recent job openings there,
despite the travel demands and what he described as the inevitable criticism that comes with handling corruption cases.
He also as instituted practice runs for trials, in which veterans critique opening statements and offer advice, while telling prosecutors to
focus less on the number of cases they bring than on bringing "high impact" cases with deterrent effects.
As an example, he pointed to the recent indictment of ir Alabama state legislators, staff members and lobbyists over an alleged vote-
buying scheme. (One lobbyist pleaded guilty to bribery charges on Monday.)

Mr. Smith also pointed to the case against the lobbyist, Paul Magliocchetti. A former aide to John P. Murtha, the late Democrat of
Pennsylvania and House Appropriations Committee chairman, Mr. Magliocchetti pleaded guilty to making illegal campaign
contributions in September.
Still, the record of a wider investigation into a circle of lawmakers who had steered federal spending to Mr. Magliocchetti's clients is
murkier.
One main figure, Mr. Murtha, died in February. Another, Representative Peter J. Visclosky, Democrat of Indiana and an appropriations
subcommittee chairman, received a subpoena in May 2009, but there has been no public sign of further developments.
The investigation into a third lawmaker with ties to Mr. Magliocchetti's firm, Mr. Mollohan, was closed in January. Several months
later, after his primary campaign opponent attacked his ethics, he was defeated.
Mr. Breuer, emphasizing that he was not discussing any particular case, noted that criminal law was just one of several ways by which
society policed the behavior of elected officials.
"Conduct that people think is reprehensible or immoral doesn't mean it's criminal," Mr. Breuer said. "If there is a criminal case to bring,
we'll bring it, If there isn't one to be brought no matter if we like the conduct or don't like the conduct, like the people or don't like the
people we won't bring it."

In order to expedite our review of the voluminous database, I had a few questions for you. First, I understand that the

John Ensign
is expected to plead guilty Thursday in U.S.
district court to a misdemeanor violation of a federal lobbying law, according to a person close to the case.
Doug Hampton
left his job as Ensign's administrative assistant four years ago after discovering Ensign, R-Nev., had been
having an affair with his wife. Federal prosecutors alleged Hampton then began lobbying the senator's office on behalf of
Nevada-based clients in violation of the yearlong ban on foimer employees lobbying the Senate.
The person close to the case said sentencing guidelines for the misdemeanor call for up to six months of jail time and
could include probation. The source spoke on condition of anonymity because the plea agreement has not yet been
approved by the court.
Prosecutors had charged Hampton with seven felony counts of violating the one-year lobbying
ban.
Ensign resigned last year as the
Senate Ethics Committee
was concluding its investigation of the senator's conduct as he
sought to conceal the affair. The committee issued a scathing report that called for investigations from the
Justice
Department and the
Federal Election Commission.
The source said that Hampton's cooperation in other investigations is
not part of the plea agreement, and when pressed on whether Hampton was cooperating in any investigations, the source
declined to confirm or deny.
Ensign apologized for his conduct while serving in the Senate, but he
and
his attorneys consistently rejected the notion
that he violated any laws or Senate rules. Ensign has not been charged with any wrongdoing.
The report from the Senate Ethics Committee said Ensign had conspired to violate the lobbying restriction for staffers and
that he had aided and abetted Hampton's violations of the prohibition.
Beyond those conclusions, the committee said Ensign deleted documents and files after he knew they were likely to be
subject of legal proceedings.
Hampton was not immediately reachable for comment.

WASHINGTON The Justice Department's Public Integrity Section has a storied 34-year history of pursuing
corruption in government and safeguarding the public trust.
That trust was breached, however, when some of the unit's prosecutors failed to turn over evidence favorable to
the defense in their high-profile criminal trial of Sen. Ted Stevens, R-Alaska, who died earlier this month in a
plane crash.
Now Jack Smith, a 41-year-old prosecutor with a love for courtroom work and an impressive record, has been
brought in to restore the elite unit's credibility.
Before Stevens, Public Integrity's renown was built on large successes like the prosecution of the Jack
Abramoff lobbying scandal and convictions of federal and state judges, members of Congress and state
legislators, military officers, federal lawmen and bureaucrats and their state counterparts over the years.
But its stumble not disclosing exculpatory evidence as Supreme Court precedent requires was equally
large. It was so serious that Attorney General Eric Holder, one of Public Integrity's distinguished alums, stepped
in and asked a federal judge to throw out Stevens' convictions.
At the time of the Stevens debacle, Smith was overseeing all investigations for the international war crimes
office at The Hague in the Netherlands. He'd read about the Stevens case. Offered the chance to take over
Public Integrity, he couldn't stay away.
"I had a dream job and I had no desire to leave it, but opportunities like this don't come up very often," Smith
said in an interview. "I left the dream job for a better one."
Smith said he arrived with an open mind, and "I found the Unit I inherited operating at a high level. I have no
excuses if we don't achieve great things."
Smith sees his job as serving people like his parents and the values they instilled as he grew up in the upstate
New York town of Clay: "They pay their taxes, follow the rules and they expect their public officials to do the
same."
Smith is in charge of politically sensitive criminal investigations he will neither discuss nor even acknowledge.
They are known to include a probe of whether Sen. John Ensign, R-Nev., conspired with an ex-aide to violate
lobbying restrictions.
A Harvard Law School graduate, Smith's first legal job was in the Manhattan district attorney's office.
"There were 40 or 50 of us who started together and all of us thought we wanted to be trial attorneys," Smith
recalls.
Smith was among those still standing after the baptism by fire
all young prosecutors face: Being g on your feet in
a courtroom, getting yelled at by judges and dealing with the daily pressures prosecutors face, but which a few,
including Smith, seem to embrace.
"I don't think I was very talented, but you field a lot of ground balls, you're a good shortstop," says Smith.
Accounts of Smith's work ethic are legion. He spent a weekend sleeping in the hallway of a New York
apartment building so he Could intercept a victim who was afraid to testify in a domestic violence oase. After
what Smith calls "along, long talk," the woman took the stand.
Smith's next stop was the U.S. attorney's office in Brooklyn, where he was in command of some of the most
high-profile cases in the city, including prosecution of police officers in the sodomy of Haitian immigrant
Abner Louima.
In a murder-for-hire trial that appeared to be a long-shot for prosecutors, Smith put the defendant's brother on
the stand, a hostile witness. The story the brother told conflicted on a key point with the story the defendants'
lawyers had been presenting a difference Smith highlighted with devastating effectiveness. Jurors took two
hours to return a guilty verdict, and one of them jokingly called across the street to Smith afterward outside the
courthouse: "Will you be my lawyer?"
But he's had setbacks too: In a recent 2-1 decision, a federal appeals court dismissed a death sentence Smith
won against a man for killing two New York police officers. The majority found Smith violated defendant
Ronell Wilson's constitutional rights by suggesting to the jury during the trial's penalty
.phase that Wilson's
decisions to exercise his rights to go to trial and to not testify should call into question Wilson's post-conviction
expression of remorse. The dissenting judge said an error, if there was one, had no effect on the jury.
The head of Justice's criminal division, Assistant Attorney General Lanny Breuer, praises Smith's work: "I have
the best guy I could have in that job. I'm looking for a natural leader, someone with tremendous energy,
someone with tremendous judgment."
Repercussions from the Stevens case still echo.
The section's conduct is under investigation by a court-appointed special prosecutor and an internal Justice
watchdog unit. Smith's predecessor, William Welch, and three members of the trial team left for other criminal
division jobs. The 30-member office is pursuing scores of investigations. Each year the section charges dozens
of people and assists U.S. attorneys around the country in hundreds of other cases.

But when the facts don't warrant a prosecution, "you have to be able to admit that if it's not there, it's not there,"
Smith said. "1 think that's hard for people to do and having been a prosecutor for 15 years that is something I
can do."
And something he has done repeatedly in recent months: He closed long-running investigations of former
House Majority Leader Tom DeLay, R-Texas; Rep. Don Young, R-Alaska, and fonner Rep. John Doolittle, R-
Calif. without charges. And adhering strictly to policy, Smith left it to the other side to disclose the closures.

Here are the answers to your questions. Sorry it took me awhile to get back to you,

To our knowledge, there are no such MOUs with the House or Senate.

The protocol is for us to first send a letter request and then follow with a subpoena, same as we do with the House.

We don't believe that there would be a formal sanction. As a practical matter, the House could complain and refuse
to participate in the search if they thought we did not comply with the MOU, but we see no way that the House would
have standing to seek the suppression of evidence. The agreement is a matter of comity, so the enforcement turns on
good faith. The House can cancel the MOU if they're not satisfied with our performance under it,

and have been advised that 5 to 10 Investigative Analysts (IA's) were recently TDY's to
WFO/NVRA from FBIHQ. This TDY will be in effect for approximately 30 days starting immediately and their supervisor is
looking to put them to work. la can facilitate getting some 1A's temporarily assigned to Ensign investigation to
facilitate E-mail review (or handle any other tasks).

Logistically, I think we can do this because of the system
came up with to review the Emails...We would only need

to get the assigned IA's on the 6e list and get them access to a unclass FBI computer with Adobe, Outlook, and the
Microsoft package. The only potential draw-back would be immediate lack of knowledge of the case.

Senate ramps up Ensign probe

Oklahoma Sen. Tom Coburn was recently interviewed by Senate investigators about Sen.
John Errsign's sex scandal, the latest sign that the Senate ethics inquiry into the Nevada
Republican is intensifying, sources tell POLITICO.
Coburn's appearance before the secretive panel comes as the Senate Select Committee
on Ethics announced Feb. 1that it would take the unusual step of appointing a special
counsel, Carol Elder Bruce, to oversee the probe.
Ensign's political career has been severely damaged by the ongoing scandal. The Nevada
Republican claims he will raise as much as $12 million for his reelection effort, but he
badly trails GOP Rep. Dean Heller in a potential primary matchup, according to the latest
polls. The scandal continues to dog him among Nevada voters: During a town hall
meeting in Sun City last week, Ensign was asked whether he had "repented to God for
your affair."
As he racks up legal bills in the scandal, Ensign's legal defense fund is filling up with cash
from casino moguls and industry executives, including a total of $40,000 from Las Vegas
billionaires Steve Wynn and Sheldon Adelson, among others. In the last half of 2010,
Ensign actually raised more money to cover legal bills than to fund his reelection
campaign.
Ensign told POLITICO on Tuesday that he had not yet been interviewed by the ethics
committee.
It is unclear precisely what Coburn told Senate investigators and whether the information
could further implicate Ensign, but sources say the scope of the ethics cOmmittee's
investigation into the Nevada Republican is widening and that more information that could
be harmful to him could emerge just as Ensign gears up to run for another term in 2012, a
race Democrats privately hope he continues to wage. Coburn lived with Ensign at a
Capitol Hill home, known as the C Street house, run by a Christian fellowship during the
period of Ensign's extramarital affair.
Coburn acted as an intermediary in negotiations between Ensign and former aides Doug
and Cynthia Hampton during which the Hamptons sought as much as $8 million, including
a potential purchase of their Las Vegas home, from Ensign, according to Doug Hampton.
Ensign's parents gave $96,000 to the Hamptons, but Ensign himself balked at paying
more to the couple. When Doug Hampton contacted Fox News about the affair, Ensign
went public with it.
As they review their case against Ensign, Senate investigators appear to have all the
information they need from Coburn. Last year, Coburn handed more than 1,200 e-mails
and other records to the Justice Department, and he turned over the same documents to
the Senate ethics committee investigators.
Coburn, who in the past has not been shy about publicly commenting on his involvement
in the Ensign scandal, has recently grown tired of discussing his Nevada colleague.
"I'm not commenting anymore on Ensign," said Coburn. "I'm through."
To protect himself during the investigation, Ensign has hired top-flight Washington lawyers
and is seeking help from big shots along the Las Vegas strip and casino magnates to help
pay his mounting legal bills, according to a review of federal records.
According to Federal Election Commission records, Ensign has shelled out more than
$753,000 in legal fees from his reelection campaign since the scandal broke, leaving him
with less than $225,000 in cash in the bank as of Dec. 31.
Some of the attorney fees went to lawyers representing Ensign aides caught up in the
controversy.
To help defray his legal overhead, Ensign has created a legal defense fund. During the
last six months of 2010, Ensign raised more than $125,000 for the fund.
Within that same period, however, Ensign raised only $4,200 from individuals for his
reelection campaign, demonstrating just how far his political stock has fallen.
From October to December 2010, Ensign's legal defense fund paid $97,000 to the
Washington firm Wiley Rein, from which he has enlisted one of Capitol Hill's foremost
ethics experts, Rob Walker, to represent him. Walker is a former staff director and chief
counsel on both the House and Senate ethics committees.
Ensign has also relied heavily on the top figures in the casino industry to cover his legal
bills. Ensign's parents are wealthy casino owners.
Of the $62,000 Ensign raised for his legal fees last quarter, $30,000 came from the family
of Adelson, chairman of the Las Vegas Sands Corp., which owns the Venetian casino and
the Sands Expo and Convention Center.
In addition, Wynn whose properties have included the Bellagio and the M irage has
chipped in with $10,000 to help Ensign.
In the previous quarter, Terry Lanni, former chairman and CEO of the M GM M irage,
donated $10,000 to Ensign, and M arc Schorr, chief operating officer of Wynn Resorts,
gave Ensign $5,000. Another longtime gaming executive, Antonio Alamo, supplied Ensign
with $10,000. Two other gaming officials who worked for M andalay Resort Group Peter
Simon and Randall Roberts gave a total of $6,000 to Ensign. Ensign's father, M ichael,
is a former chairman of the board at M andalay.
Ensign has also leaned on other business sectors in Nevada for help, including
construction firms, physicians and the real estate industry. He even received $1,000 from
a Cadillac dealer in Las Vegas. Former Nevada Rep. Barbara Vucanovich donated $1,000
to Ensign's defense fund, and GOP state Sen. Dean Rhoads kicked in $300.
Publicly, Senate Democratic campaign leaders have said very little about the Ensign case,
but party operatives said "their dream" is that he hangs on into 2012 as an unelectable
incumbent.
"It would be the best thing that could possibly happen for Democrats if Ensign were to stay
on," said a Senate Democratic strategist, speaking on condition of anonymity. "Every day
he's in the Senate is a gift for us."

The Ensign hard-drive is 16 0GB. Its been running since early this morning and is about 20 percent copied.
Barring any error codes, CART expects the copy (with validation) to be completed around midnight tonight.
CART was unable to use their higher-speed copying tools because the received drive was a USB hard-drive.
We should be able to get the copy out in FedEx on Monday morning barring any problems or we will drive it
down to DC USAO.
The copied image will also be placed into evidence. As such, II will need to sign property receipts for
receiving and returning the duplicate hard-drive to/from the FBI

I just spoke with SSA
and have been advised that 5 to 10 Investigative Analysts (IA's) were recently TDY's to
WFO/NVRA from FBIHQ. This TDY will be in effect for approximately 30 days starting immediately and their supervisor is
luoldnyt-o-parthein-t-o-wm-killik rifacititate-getting-so-Me-IA's temporarily - gne-d-t-o-E-tistgri investi-gatro-no
facilitate E-mail review (or handle any other tasks).
Logistically, I think we can do this because of the system came up with to review the Emails...We would only need
to get the assigned LA's on the 6e list and get them access to a unclass FBI computer with Adobe, Outlook, and the
Microsoft package. The only potential draw-back would be immediate lack of knowledge of the case.
Please discuss with and the gang and let me know what you think. If we want to proceed this, I try to get the ball

As we discussed, will be the P.O.C. on the document review and filtering everything between us and DOJ.

You may have already seen these, but there is a couple of interesting articles about the EEC's decision not to pursue
FECA violations against Ensign (despite the EEC's General Counsel's decision to go forward). Not sure, but it may be
beneficial to have open some line of communication with the FEC to see what the story is..What do you guys
think?. twill also try to get what public records I can from the FEC web-site.
I think the most interesting point is that the declination was partially based on a "pattern of giving between Ensign's
family and MI. However, clearly told us that.never told, anything from Ensign and ifamily. I
wonder if any of the affidavits the FEC has contradicts what was stated in any of our interviews. Could be nothing, but
just wanted to bring it to everyone's attention.

exceptions under the Privacy Act. Illrecommended that you take alook at 5 U.S.C. Section 552a(b)9 to see if this
exception applies to the matter at hand. If DOJ's official opinion is that the FD-302 can legally be released to the Ethics
Committee, I am okay with sharing the information.
I understand the need to offer-up the document in order to bolster DOJ's request for the Committee to stand-down on
the Immunity issue. However, I just want to make sure no policy is broken since the Ethics Committee is not alaw
enforcement partner or Executive branch entity.
Ilalso reviewed the FBI's Domestic Investigations & Operations Guide (DIOG) which is basically our policy bible. The
DIOG addresses the release of investigative information to certain entities and branches of government, but does not
address releasing information to the Legislative Branch.
If authorized to release the document, my only concern would be one from atactical standpoint. I don't think we
should give the Ethics Committee aphysical copy of the FD-302 because we will lose control over the document. [I
would rather not see my FD-302 published in the newspaper)] A possible solution to this would be to allow the Senate
Ethics Committee to read the FD-302 (and poss. take notes) while it remains in our possession and not give them a
copy.
Let me know what you think and if we can proceed. I just want to cover our bases and make sure I don't consent to
anything that violates policy.

The Las Vegas Review-Journal reports today that the payments to law firms are listed on Ensign's campaign's
latest FEC reports, Questioned about the payments, Ensign's spokeswoman confirmed that they were for staff
members.

At this point, I would include my supervisor (Supervisory Special Agent and the analyst that was
just assigned to our case (Investigative Analyst . Both are stationed at the NVRA same address

just came aboard this week and is already working on an investigative timeline for us. MI is also looking into the

Also, can you give Ensign's attorney a call to see what we should be expecting to receive in the future and will the return
