Anti-gay laws take a beating as court scrutinizes Mich., Ohio, Tenn., Ky.

CINCINNATI State bans on same-sex marriage took a beating Wednesday during oral arguments
before the U.S. Sixth Circuit Court of Appeals. A three-judge panel had tough questions for o cials seeking
to defend the prohibition on gay nuptials in four states.
Delgado under investigation after
calling gay cop demeaning name

The supervisor of the D.C. police departments Gay
and Lesbian Liaison Unit has led an internal police
complaint accusing the captain in charge of the unit
with repeatedly addressing a gay male o cer assigned
to the GLLU by using a female version of his name.
According to sources familiar with the development,
who spoke on condition of anonymity, GLLU Sgt.
Matthew Mahl led the complaint against Capt.
Edward Delgado with the departments Internal Aairs
Division on behalf of GLLU O cer Justin Markiewicz.
The sources say the complaint accuses Delgado of
addressing Markiewicz as Justine repeatedly in face-
to-face conversations and in at least four separate
emails, copies of which have been obtained by the
Washington Blade.
Among the recipients of one of the emails in which
Delgado addressed Markiewicz as Justine, which was
transmitted on Jan. 13, 2012, were Deputy D.C. Police
Chief Diane Groomes and former GLLU supervisor
Sgt. Carlos Mejia.
Mahl and Markiewicz, when contacted this week
by the Blade, declined to comment, saying they
are required to refer all media inquiries to the
departments public information o ce.
Gwendolyn Crump, director of the Public
Information O ce, said she too was not authorized to
comment on the matter.
This is a personnel matter that is being investigated
by the MPDs Internal Aairs Division, she said in an
email. I cannot comment further at this time.
The sources said Mahl led the complaint with
Internal Aairs on July 29 after Markiewicz conded
in him that he was troubled and under stress over
Delgados alleged repeated references to him using
a female name. Markiewicz reportedly considered

U.S. Attorney retains hate crime charge in trans stabbing
The U.S. Attorneys o ce has upheld the decision by Metro Transit Police to classify
as a hate crime the July 30 stabbing of a 15-year-old transgender girl on board a Green
Line Metro train near the Fort Totten Station.
In court papers led on July 31, prosecutors with the U.S. Attorneys o ce charged
Reginald Anthony Klaiber, 24, of Greenbelt, Md., with assault with a dangerous weapon-
bias related in connection with the stabbing incident.
Such criminal act demonstrated the prejudice of Reginald Klaiber based on the actual
or perceived gender identity and expression of [the victim], one of the prosecutors
states in a criminal complaint led in D.C. Superior Court.
The victim, who was being treated for a non-life threatening stab wound at Washington
Hospital Center, was tentatively scheduled to be sent home on Friday, according to Jae-
La White, one of two friends who were with the victim at the time of the stabbing.
Superior Court Judge Karen Howze ordered Klaiber held in jail until he appeared in
court last Friday, for a preliminary hearing. But at the start of Fridays hearing, defense
attorney Veronice Holt said she and her client werent prepared for the hearing, saying
she was unable to schedule su cient time to consult with Klaiber.
At Holts request, Superior Court Judge Frederick Sullivan agreed to postpone the hearing
until Wednesday, Aug. 6. Sullivan ordered that Klaiber remain in custody until the Aug.
6 hearing, when he is expected to rule on whether Klaiber should remain held until the
time of his trial or until a possible agreement is reached in which he pleads guilty with the
promise by prosecutors of a reduced sentence. Visit washingtonblade.com for updates.
Under the D.C. criminal code, a conviction for assault with a dangerous/deadly
weapon carries a maximum penalty of 10 years in prison. A conviction for that oense
with a hate crime designation could subject Klaiber to a one-and-a-half times enhanced
penalty at the discretion of the judge.

Longtime matre d Phillip Gaines dies at 62

Phillip Gene Gaines, a longtime D.C. resident who worked as a matre d at the popular
D.C. restaurant Port of Piraeus for more than 20 years, died July 24 at a hospice in
Arlington, Va., from a heart infection. He was 62.
Gaines was born and raised in Hagerstown, Md., and was a 1970 graduate of South
Hagerstown High School and a member of the Hagerstown Christian Church, according
to information released by a family member.
He and his brother Gregory sang with local Hagerstown bands and musical groups.
He also worked as a ballroom dance instructor in Hagerstown.
Wallace Dickson, his partner of 40 years, said Gaines began work in the bar and
restaurant business shortly after moving to Washington in the early 1970s. Among his
rst jobs in D.C. was that of a bar back at the Georgetown Grill, a popular gay bar at the
time, Dickson said.
Gaines worked in several other establishments before landing a job at Port of Piraeus
at its location at the time at 1155 21st St., N.W., in the citys West End section. Dickson
said that during his tenure at the popular Greek restaurant Gaines saw its ownership
change from father to son.
He knew every customer by name, said Dickson. He never forgot a name or a face.
Dickson said he rst met Gaines in the early 1970s at the then newly opened gay bar
Mr. Ps near Dupont Circle about a year after Dickson separated from his wife and was
just becoming acquainted with D.C.s gay scene.
He knew people all over town from the bars, Dickson said. He was my ambassador
to the gay community. And he became my savior.
Dickson said that in May 2008 Gaines suered a severe stroke that resulted in the
loss of his kidney function, requiring dialysis treatments three days a week. This forced
Gaines to take an early retirement on disability.
The kidney problems led to further health issues that recently precipitated a severe
infection of a heart valve, which was the immediate cause of his death, Dickson said.
He had a long journey with the kidney problems, said Dickson. He never complained
once. He was a happy and cheerful guy. He always had a bright outlook on life. He was
a dear person and hes going to be missed by me.
In addition to Dickson, Gaines is survived by his siblings, Arthur D. Gaines Jr., Judith
Gaines, JoAnn Gaines Claybon, and Denise Gaines, all of Hagerstown; Julia Gaines Harris
of Winchester, Va.; Timothy Gaines Simmons of Suitland, Md.; and many nieces and
nephews, other cherished relatives and many dear friends.
Burial of his ashes is scheduled for Sept. 26 at Rose Hill Cemetery in Hagerstown to be
followed by a memorial service on Sept. 27 at a location to be announced.
A gathering of friends and neighbors in Washington in a celebration of his life is
scheduled for Aug. 17, at 11 a.m., at the home of A. Cornelius Baker, Apt. 500, 1707
Columbia Rd., N.W.

Catania les 7,000 signatures
to get on ballot
D.C. Council member David Catania (I-At-Large) delivered 7,000 petition
signatures to the citys Board of Elections o ce on Tuesday to place his name
on the ballot in November as an independent candidate for mayor.
Just 3,000 valid signatures are needed to be placed on the ballot.
With a pack of news reporters accompanying him, Catania said he is condent
he will win the race and become the rst non-Democrat to be elected mayor
since the start of the citys modern era home rule government in 1974.
Catania, who, if elected, would also become the citys rst out gay mayor, said
his record on LGBT issues is by far the strongest compared to his two main
rivals Council member Muriel Bowser (D-Ward 4), the Democratic nominee;
and former Council member Carol Schwartz (R-At-Large), who changed her party
registration to independent to run for mayor this year.
Schwartz enjoyed strong support from the LGBT community as a Council
member. She said she would deliver her petition signatures to the Board of
Election o ce on Wednesday, the deadline for ling ballot petitions for the
November election.
With Schwartz and Bowser pushing hard to line up support in the LGBT
community, the Blade asked Catania how he thinks he will fare with the LGBT vote.
Ive always asked people to vote for me based on whether or not Ive
supported the community, not because Im a member of the community the
LGBT community, he said. And theres really only one person in this race who
has a solid record on LGBT issues Im the one.
He noted that he was the author of the citys marriage equality legislation in
2009 and played a key role in helping shape the citys response to HIV/AIDS in his
role as chair of the Councils Committee on Health up until two years ago. He was
the author and lead sponsor last year of a bill to make it easier for transgender
people to change their birth certicates, Catania said at the election board o ce.
There is no question that I have the stronger record, he said. And what
people have to decide is do they want someone who will sit on the back of
a bench and vote a particular way or do they want a champion? And I have
no doubt in my mind that the vast majority of the LGBTQ community will be
supporting me.
Bowser and Schwartz have each pointed to their own record of support on
LGBT issues, saying they too would be a champion for the LGBT community if
elected mayor.
Also running for mayor this year is gay Libertarian candidate Bruce Majors,
who secured placement on the ballot by winning his partys primary in an
unopposed race in April. Statehood Green Party candidate Faith, who uses only
that name, also won her partys primary on April 1.
In addition, ve other lesser known independent candidates have taken out
petitions to run for mayor. Political observers say it is uncertain how many of them
will obtain the required 3,000 petition signatures to secure placement on the ballot.

secretary backed LGBT
rights, lived in beach town

The death of former presidential press
secretary and gun control advocate James
Brady on Monday drew expressions of
sorrow and fond memories of his life
from LGBT activists in Rehoboth Beach,
where Brady and his wife Sarah lived
since the late 1990s.
Brady, who served as President
Ronald Reagans press secretary during
Reagans rst year in o ce, became an
internationally recognized gure after
being shot in the head in an assassination
attempt on Reagan in Washington in 1981.
Bradys notoriety stemmed from his and
his wifes work in the cause of gun control in
the years following the shooting by would-
be assassin John Hinckley, who wounded
Reagan, Brady and two others outside the
Washington Hilton Hotel on March 30, 1981.
Despite a brain injury that left him
partially paralyzed and wheel chair
bound, people who knew Brady said he
kept his wry sense of humor and warm
personality, which he used to lobby
Congress and many state legislatures to
enact gun control legislation.
With political ties to Delaware dating
back to before he became Reagans press
secretary, Brady and his wife moved
to Dewey Beach, Del., which is located
next to Rehoboth Beach, in 1991 before
moving to Rehoboth several years later,
according to the Delaware News Journal.
Gay Democratic activist Peter Schott,
a longtime Rehoboth resident, said he
became friends with Jim and Sarah Brady
through political circles after the Bradys
moved to Rehoboth.
I can tell you I attended a number of
political fundraisers at their home for
Democratic candidates, Schott said.
They of course knew that I was gay.
In August 2006, the Delaware
Stonewall Democratic Club, an LGBT
group that Schott headed at the time,
honored Jim and Sarah Brady at a
reception in Rehoboth Beach. The event
took place sometime after the Bradys
changed their party registration from
Republican to Democrat.
Mitch Crane, the gay chair of the Sussex
County, Del., Democratic Committee, said
he has worked with the Bradys on various
political endeavors.
She did speak and did make comments
stating that they were in support of LGBT
rights, Crane said of Sarah Brady.
John Brady, a gay attorney who won
election in Sussex County last year as
Clerk of the Peace, said he became
friends of the Bradys at a time when he
too changed his party a liation from
Republican to Democrat.

and a form of harassment based on his
sexual orientation, the sources said.
Mahl reportedly felt duty bound to le
the complaint, which requires Internal
Aairs to open an investigation, based on
a longstanding MPD policy that requires
both police o cials and rank-and-le
o cers to report all instances of possible
improper conduct committed by a
member of the police force within two
hours of learning about such conduct,
one of the sources said.
Delgado serves as commander of the
Special Liaison Division, which oversees
the GLLU and three other police liaison
units the Latino Liaison Unit, the Asian
and Pacic Islander Liaison Unit and the
Deaf and Hard of Hearing Liaison Unit.
In addition to the Jan. 13, 2012 email,
the complaint led by Mahl includes
copies of emails dated Sept. 20, 2012;
June 6, 2014; and July 7, 2014, according
to the sources. In each of those emails
Delgado refers to Markiewicz as Justine.
The July 7, 2014 email has a subject
heading that states, RE: Sixth District
Listserv Message PROSTITUTION,
DISORDERLY CONDUCT, AND PUBLIC
NUISANCES ON EASTERN AVE, NE. It goes
on to state, Flag for follow up and adds,
Justineplease ensure that we stay on
top of this.
The June 6 email message by
Delgado was a response to an email
from Markiewicz to him with the
subject heading, Pride photo. A photo
embedded in the email has a caption
saying, Group photo from La Fiesta
Latino Dance Party. This has been a very
successful pride thus far!

Justine.
Paul Tupper, chair of the local group
Gays and Lesbians Opposing Violence
(GLOV), which works with the GLLU and
MPD o cials to help curtail anti-LGBT
violence, including hate crimes, said
he has no direct knowledge about the
complaint led against Delgado.
Although GLOV is not familiar with the
particulars of this complaint it serves as
a reminder that if any members of the
LGBT community have concerns about a
member of the MPD force, they should
report it, and that includes those within
the MPD, Tupper told the Blade.
Chris Farris, a former GLOV co-chair,
said he has had dealings with Delgado
over a period of several years and the
nature of the complaint led against him
came as a surprise.
Ive always found him to be a pretty
open and approachable person, Farris
said. Ive never had any reason to believe
he was homophobic. But I will also tell you
that Justin is a great person. Hes a very
valuable asset to the GLLU, said Farris,
who added, And so I would also have
no reason to believe that he wouldnt be
telling the truth.
Farris called on the department to
conduct a thorough investigation into
the complaint and to report its ndings to
the public.
Two other LGBT activists who have had
dealings with Delgado, and who spoke
on condition that they are not identied,
shared Farriss assessment, saying
they were caught by surprise over the
complaint.
But the sources familiar with the
complaint say that Delgados persistent
references to Markiewicz as Justine
could be viewed as a form of workplace
harassment that has the potential of
harming the overall eectiveness of the
GLLU.
They said the matter was especially
troubling for Mahl, prompting him to
le a separate police incident report
on Delgados alleged action toward
Markiewicz that is part of the departments
public records.
The report, however, refers to Delgado
and Markiewicz only by their initials. It lists
the incidents as anti-male homosexual
(gay) in nature and describes them as
demeaning and harassing language.
The complaint led by Mahl with the
Internal Aairs Division and the incident
report come at a time when most LGBT
activists say relations between the LGBT
community and the MPD have improved
signicantly over the past several years.
At a town hall meeting earlier this year
organized jointly by MPD and the LGBT
community that focused on transgender
issues, Police Chief Cathy Lanier said
the department continues to improve
its longstanding policies and procedures
calling for treating LGBT people with
respect and for thoroughly investigating
crimes committed against members of
the LGBT community.

Efort to repeal Houston ordinance fails
HOUSTON Opponents of an LGBT-inclusive human rights ordinance have
not collected enough valid signatures to force a referendum on it.
A press release the city of Houston released on Aug. 4 said opponents of
the Houston Equal Rights Ordinance collected 15,249 valid signatures, which is
2,020 less than the required 17,269 needed to prompt a referendum.
Houston o cials noted the petitioners submitted 5,199 pages of signatures.
They said in their press release that only 2,449 pages qualify for consideration.
The Charter requirements are in place to ensure a fair and legal process,
absent of fraud, said Houston City Attorney David Feldman. In this instance,
there are too many documents with irregularities and problems to overlook.The
petition is simply invalid.There is no other conclusion.
The Houston City Council in May approved the ordinance that extends
protections to LGBT Houstonians by an 11-6 vote margin.
Mayor Annise Parker, who is a lesbian, said in a press release that she expects
opponents of the Houston Equal Rights Ordinance to challenge the citys decision
to disqualify some of the signatures they collected.
Ark. city hosts mass gay wedding reception
EUREKA SPRINGS, Ark. A small Arkansas city in the Ozark Mountains on Aug.
2 hosted what one television station described as the rst mass gay wedding
reception in the Bible Belt.
KFSM reported that hundreds of same-sex couples attended a reception the
city of Eureka Springs hosted. The television station said more than 40 local
businesses contributed items to the reception that drew same-sex couples from
across the region.
The Eureka Springs City Council in 2012 approved a resolution in support of
marriage rights for same-sex couples.
Circuit Judge Chris Piazza in May ruled the states same-sex marriage ban is
unconstitutional.
Jennifer Rambo and Kristin Seaton became the rst same-sex couple to legally
marry in the state after they received a marriage license in Eureka Springs the
day after Piazza issued his decision.
The Arkansas Supreme Court on May 17 stayed Piazzas ruling, pending the
outcome of an appeal.
GetEQUAL to join anti-Klan rally
WELCOME, N.C. An LGBT advocacy group has announced it will join
immigrant rights groups that plan to protest an upcoming anti-immigration rally
the Ku Klux Klan has organized.
GetEQUAL North Carolina said in a press release it plans to stage a Hatred
Not Welcome Here counter-protest outside the rally in Welcome, N.C., on Aug.
9 with El Cambio.
To me, this action means a lot we are letting the KKK and the town of
Welcome know that we are all immigrants, said Maura Pereira, who helped
organize the counter-protest.
Welcome, which has a population of slightly more than 4,100, is roughly 20
miles south of Winston-Salem in the North Carolina Piedmont.

faith-based agencies
to refuse gay parents

New legislation introduced in both the
House and Senate was criticized on Monday
by national LGBT groups as a means to
allow discrimination against same-sex
couples seeking to adopt children.
The bill, known as the Child Welfare
Provider Inclusion Act of 2014, was
introduced last week by Rep. Mike Kelly
(R-Pa.) and Sen. Mike Enzi (R-Wyo.), who
billed the measure as a way to prevent
faith-based organizations from being
excluded from providing adoption and
foster care services based on their
religious beliefs.
Faith-based charities and
organizations do an amazing job of
administering adoption, foster care and
a host of other services, said Enzi in a
statement. Limiting their work because
someone might disagree with what they
believe only ends up hurting the families
they could be bringing together.
But LGBT groups pounced on the
legislation as a means to allow Hobby
Lobby-like carve outs within the law,
enabling faith-based adoption agencies
to discriminate against same-sex couples
seeking to become parents.
According to the Human Rights
Campaign, the legislation would allow
religiously a liated adoption agencies to
deny services to gay and lesbian couples
wanting to adopt or foster a child.
Additionally, it would enable religious
adoption agencies from non-Christian
faiths to deny services to straight,
Christian couples, or a single parent
seeking to foster a child, HRC said.
Ellen Kahn, director of the HRC
Foundations Children, Youth & Families
Program, said the bill has nothing to do
with protecting the religious liberties of
faith-based organizations.
Its increasingly clear that, post-Hobby
Lobby, some in positions of power believe
that religious freedom should only belong
to a few, Kahn said. Taxpayer funds
should not be used to discriminate and
too many children need loving families
right now for our elected o cials to be
playing these kinds of dangerous political
games. This bill has nothing to do with
faith and it must be condemned.
The House version of the legislation
had as of Tuesday 31 co-sponsors, each of
whom are Republicans, such as anti-LGBT
lawmakers like Reps. Michele Bachmann
(R-Minn.), Tim Huelskamp (R-Kan.) and
Vicki Hartzler (R-Mo.). Also among the
co-sponsors is Rep. David Jolly (R-Fla.),
who recently became the fourth sitting
U.S. House Republican to come out in
support of civil marriage equality. As of
Tuesday, the Senate bill doesnt have any
co-sponsors.
In a statement to the Washington Blade,
Kelly responded to the criticism by saying
the bill is not anti anyone or anything
except government discrimination
against child welfare service providers.
Nothing in the Inclusion Act prevents
any parents or any child welfare service
provider from participating in child
welfare services nothing, Kelly said. It
simply ensures that a provider will not be
excluded in any manner from participating
in such services on the basis of its religious
and moral beliefs, which is one reason the
Act is called the Inclusion Act.
Kelly added the bill is 100 percent
inclusive and despite diering social
and political views tolerance must
come rst to ensure a positive outcome
for children.
Tolerance on this issue means
accepting that dierent providers with
dierent worldviews pursuing the noble
work of nding families for children is
ideal, Kelly said. It means greater choice
for parents and more positive outcomes
for the greatest number of children.
Debate is constructive, but we must make
sure it stays focused on the subjects of
this legislation, which are the young,
innocent children around our country
waiting for a home.
The Blade has also placed a request
with Enzis o ce to respond to LGBT
criticism of the legislation.

Ambivalence seen despite
Obama signing exec order

Two years ago, President Obamas
announcement that he supported
marriage rights for gay couples
galvanized his progressive base and
prompted donors to pump money into
his coers ahead of Election Day in
November 2012. But two years later, after
Obama signed an executive order barring
LGBT discrimination among federal
contractors, some key LGBT donors arent
having the same enthusiastic response.
Based on comments to the Washington
Blade, the sense anecdotally is that
some prominent LGBT donors who were
motivated to contribute to Obamas re-
election campaign after he came out
for marriage equality arent motivated
to donate to the Democratic National
Committee during the congressional
mid-terms. Moreover, a Blade analysis
of fundraising numbers in the three-day
period after the order announcement
shows no increase in the degree of
contributions to the DNC, although the
number of individual donors who gave
money did increase.
Some donors expressed resentment
over the fact that Obama withheld
employment protections for LGBT workers
until the sixth year of his administration.
Juan Ahonen-Jover, a gay donor and
co-founder of eQualityGiving, said he
and spouse Ken contributed $10,000
within minutes of Obama coming out
for marriage equality in 2012, but the
executive order hasnt prompted him
or other donors he knows to contribute
money to the Democratic Party.
While Ken and I appreciate the value
of the executive order, it took lots of work
from many donors, activists, insiders, and
many others to get it signed, Ahonen-
Jover said. Actually, it took six years of
pushing to get this done much more
eort than one would expect from a erce
advocate for our cause. There was no real
justication for him to wait well past his
rst election much less his re-election to
issue an executive order which simply
expanded an executive orders already
signed by prior presidents.
Lane Hudson, a D.C.-based Democratic
activist, was among those who were critical
of Obama for the timing of the executive
order, saying hes not motivated to give to
the Democratic Party because of the delay.
Given the amount of time, eort and
resources that went into this instead
of electing more Democrats, Im not
inclined to get excited enough to increase
my giving or raising for the Democratic
Party, Hudson said. I view this as a tardy
fulllment of a long ago promise. If the
president had done this in a more timely
manner, then it might be dierent.
That stands in contrast to 2012, when
Hudson, upon Obamas endorsement of
marriage equality, helped raise $16,283
for Obamas re-election via a page set up
on the presidents campaign website.
The executive order was announced
in June as Obama participated in a urry
of DNC fundraisers. Presumably, the
White House announced plans to sign
the executive order at that time to bolster
fundraising eorts among gay donors as
the Democrats try to hold the U.S. Senate
in the 2014 mid-term elections.
Jonathan Lewis, a gay Miami-based
philanthropist, last year said he wouldnt
donate more money to Democrats in
part because of delays over the executive
order. Now that Obama has signed the
directive, he said hes unsure whether
hell contribute to the DNC.
Today, its important to watch as the
apologists who protected the presidents
inaction by claiming the EO was weak or
not needed, sing his praises and talk about
how important and historic this move
is something we knew and pushed
for impatiently and unapologetically for
years, Lewis said.
Despite his pledge to withhold money,
Lewis this cycle has contributed to
individual Democrats who support LGBT
rights, such as Rep. Scott Peters (D-Calif.),
Rep. Ami Bera (D-Calif.) and U.S. House
candidate in Pennsylvania Kevin Strouse.
Known for backing causes that push
Democrats to act on LGBT rights, Lewis
also indicated he plans to withhold
donations to Hillary Clinton following her
testy interview on National Public Radio
in which she talked about a state-by-state
approach to advancing marriage equality.
Looking to the future, as much as I like
Hillary, with her recent statements that
marriage equality should be determined
state-by-state, it might be wise to hold o
until societys progress on LGBT equality
has made its way into Secretary Clintons
campaign, Lewis said.
According to an analysis from National
Public Radio, the amount of contributions
to Obamas re-election committee went
up three-fold in the 72 hours after his
marriage announcement. In the three
days prior to the endorsement, he took in
$3.4 million, but afterward he saw a three-
day spike to $8.8 million in donations. In
the next three days,his fundraising went
back down to $2.7 million. Those numbers
reected donations greater than $200.
But a Blade analysis of numbers
provided by the Federal Election
Commission this time around on DNC
fundraising yielded no similar spike.
In the three-day period from June 15-
June 17 prior to the announcement, the
DNC raised $510,005, but in the three-
day period from June 18-20 after the
announcement, the DNC raised$405,584,
and in the subsequent three days from
June 21-23, the DNC raised $246,221.
Despite those numbers, there was a
spike in the number of individual donations
made to the DNC. In the rst three-day
period prior to the announcement, 1,336
people donated to the DNC, the second
three-day period after the announcement,
that number went up to 2,882 people, but
in the next three days it went down to 914
people. Like with the marriage numbers,
these numbers reect donors who gave
$200 or more.
The fundraising numbers for the time
period when Obama actually signed the
executive order in July arent yet available.
Dan Pinello, a political scientist at the
City University of New York, accounted for
the discrepancy between now and 2012 by
saying discrimination in marriage is faced
by LGBT people on a constant basis as
opposed to discrimination in the workforce.
There are a lot more LGBT people in
the United States who are conspicuously
being denied the right to marry than there
are LGBT people who are blatantly being
denied, or red from, jobs, Pinello said.
In other words, the sense of urgency
surrounding the pursuit of marriage
equality is, comparatively, enormous,
while the same isnt true of a quest for
job security as a nationwide policy issue.
Still, there are other indications that the
executive order was deeply appreciated
within the LGBT community. At a New
York City gala to raise money for the DNC
that took place days after the White House
announced Obamas intention to sign the
executive order, attendees welcomed
a reference to the planned order with
sustained applause. Tickets for the high-
dollar event, which was attended by 550
people and sold out, ranged from$1,200
to $32,400.
Ian Sams, a spokesperson for the
Democratic National Committee, pointed
to the success of the fundraiser as evidence
that the LGBT community is excited about
the Democrats in the aftermath of the
signing of the executive order.
The Democratic Party continues to
maintain deep ties to the LGBT community,
and theyve been strengthened in recent
years as Democrats, led by President
Obama, have secured victories in the ght
for equality, Sams said. And for what its
worth, just last month, more than 500
supporters helped the DNC sell out its
annual LGBT Gala in New York, which was
one of the most successful LGBT events
that weve ever had.
Hilary Rosen, a D.C.-based Democratic
activist, said withholding donations to the
Democratic Party in the aftermath of the
executive order makes no sense to me,
although she acknowledged the order
hasnt had an impact on her own donations.
Its not too little, too late, Rosen said.
The president has done a lot and deserved
our support even before this moment.
Even though the EO took too long, this is
an issue we really need Congress to pass
ENDA for. From a donor perspective
and I am a donor elections are about
choices, not perfection. While I am glad
some are bringing Republicans along,
I still nd Democrats a much better
community investment.

Poverty, lack of health
care among problems

CEO Kathie Hiers will never forget the
day in 1985 when she and her partner
were at Dennys in her hometown of
Mobile, Ala., when six of her best gay
boyfriends walked in and said they had
all tested positive for HIV.
They had gone to nearby Pensacola,
Fla., to get tested because Florida oered
anonymous testing, unlike Alabama.
I was like Oh my God, what is happening,
Hiers told the Washington Blade during a
July 16 interview at her Birmingham o ce
before traveling to the 2014 International
AIDS Conference in Australia. Today one of
those six guys is still alive.
More than three decades after
the Centers for Disease Control and
Prevention reported the rst cases of what
became known as AIDS, the epidemic
continues to have a disproportionate
impact on the South.
The CDC in 2010 noted nearly half of all
new HIV infections in the U.S. were in the
South, according to a policy report from
the Southern AIDS Coalition. Eight of the
10 states with the highest rates of HIV
Florida, Georgia, Louisiana, Mississippi,
North Carolina, South Carolina, Texas and
Tennessee are in the region.
The CDC notes Florida, Louisiana, Mississippi
and South Carolina are among the states with
the highest rates of AIDS diagnoses.
Hiers said the statistics are slightly lower
in Alabama because her organization has
partnered with all of the states HIV/AIDS
service organizations and works within all
of its 67 counties.
Weve got a pretty cohesive network,
she said. Its very dierent than the other
Southern states where you go to Atlanta
and theres a good bit, but you get outside
Atlanta and theres nothing. The same in
Louisiana with New Orleans and so on.
Hiers further noted the 1917 Clinic
where a number of groundbreaking
discoveries around HIV/AIDS have taken
place is located at the University of
Alabama-Birmingham.
Were always very connected to clinical
trials and so on, she said. Those two
things have helped Alabama.
The Duke Center for Health Policy
and Inequalities Research in 2011 noted
Mississippi had the highest number of
deaths from HIV of any state. Alabama,
Florida, Georgia, Louisiana, North
Carolina, South Carolina and Tennessee
were among the top 10.
The U.S. Census also indicates that
Mississippi is the poorest state in the
country, with 22.3 percent of residents
living below the poverty line between
2008-2012. Louisiana and Alabama have
the second and fourth highest rates of
poverty in the country respectively.
Statistics also indicate that people of
color are more likely to live in poverty
than whites.
Part of what happens with people who
are poor is they dont go to the doctor,
Kathryn Garner, executive director of
AIDS Service Coalition, an HIV/AIDS
service organization in Hattiesburg,
Miss., that serves people with the virus
who live in 71 of the states 82 counties,
told the Blade during a recent telephone
interview. If you dont go to the doctor,
you dont know youre HIV positive until
you go to the doctor when youre really
sick and then youre AIDS-dened.
Charlotte Dot Norwood, a prevention
counselor at Open Arms Healthcare
Center, an HIV/AIDS clinic in Jackson, Miss.,
that My Brothers Keeper, an organization
based in nearby Ridgeland, Miss., that
seeks to reduce health disparities among
minority groups, is known aectionately
as the AIDS Lady.
She told the Blade during a July 11
interview at the clinic that patients with
the virus are often unable to get a job.
[They] go for an interview, dont get
hired and it could be for many reasons,
she said. Sometimes I think its because
you know maybe they go in and the
persons rst perception masculine,
things like that.
People with HIV/AIDS fall under the
Americans with Disabilities Act. It also
bans all public entities and private
companies that employ more than 15
people from discriminating against their
employees based on their status.
No Southern state bans anti-LGBT
employment discrimination. Louisiana,
Tennessee and Florida include sexual
orientation in their anti-hate crimes statutes,
but not gender identity and expression.
Carl Green, a gay white man who has
lived at Belle Reve, a residence in the
Fraubourg Marigny neighborhood of
New Orleans for people with HIV/AIDS
since May, told the Blade during a July 14
interview that he lost his job when he told
his then-manager he was living with HIV
after several hospitalizations.
Green said he eventually lost his
home and lived in his car until a bank
repossessed it.
The New Orleans AIDS Task Force, an
HIV/AIDS service organization that serves
people with the virus in the Crescent City
and throughout southeastern Louisiana,
referred Green to Belle Reve.
It was the universe saying you need
to go back to square one and get your
health together, said Green.
The Fair Housing Amendments Act of
1988 bans discrimination against people
living with HIV/AIDS and other disabilities.
In spite of this federal law, a lack of
housing remains an acute problem for low-
income people with HIV/AIDS in the South.
Fifteen people currently live in two
group homes in Belle Reve including
one called Belle Grace that Executive
Director Vicki Weeks joked opened
because of the grace of God. A third
building Belle Esprit has four
apartments for couples and families that
can accommodate between seven to 10
people with children at any given time.
Belle Reve was able to renovate all three
of its buildings several years ago after it
received $1,189,000 in funds from Housing
Opportunities for People with AIDS
(HOPWA) from the New Orleans O ce of
Community Development, $300,000 from
the U.S. Department of Housing and Urban
Development, grants from the National
AIDS Fund and other groups and money
from the Qatari government.
Im happy until I can get on my own
and start over again, a Belle Reve
resident of color who describes himself
as very-much gay, but asked to remain
anonymous told the Blade. He worked at
Tulane Hospital in New Orleans for four
years before he tested positive in May
2013. Im looking for another job, but
Ive been having a little problem with that
because I guess Im gay. They look at you
and they judge you.
Miss Eddie, a 58-year-old transgender
woman who has lived with HIV since the
1980s, moved from the New Orleans
suburb of Kenner to Belle Reve in late
May after her former lover died.
Its a great blessing being here, she
told the Blade.
Thirty-two people with HIV/AIDS
currently live at Grace House, a residence
in Jackson, Miss.
AIDS Services Coalition runs two
residences in Hattiesburg for people
living with the virus.
Eight men live in 121 Haven House, a
Victorian home built in the 1880s that
serves as a transitional shelter. More than
a dozen women with HIV and a family live
in a second facility 227 Place with
nine two-bedroom apartments.
AIDS Service Coalition last month
bought a 16-unit apartment complex with
four fourplexes.
Garner said they should be renovated
by the end of the year.
Our goal of course if someones able to
work or able to function out in the world,
she told the Blade. We do everything we
can to get them away so they can be out
in the world and do the things everything
they want to do.
The South Mississippi AIDS Task Force
in Biloxi, Miss., operates a transitional
housing facility for people with HIV/AIDS
on the states Gulf Coast.
Everyone we have in any of our shelters
either have no income or have disability
or a low-paying job, said Garner. Its
really di cult if youre making $790 a
month when a one-bedroom apartment in
Hattiesburg is $550 to $600 a month. The
math on that just doesnt work and theres
not enough public housing and theres not
enough housing choice vouchers.

housing programs of any HIV/AIDS service
provider in the South with roughly 150

units throughout the state. The majority
of these are in Birmingham, the states
largest city.
AIDS Alabama also oers rental
assistance to people living with HIV across
the state through HOPWA.
Even so we always have waiting lists,
Hiers told the Blade. Housing is just a
huge need for people with HIV.
HIV/AIDS service providers with whom
the Blade spoke in Mississippi and
Alabama said access to transportation
and even food can adversely aect the
health of people living with the virus
especially those who live in rural areas.
Dr. Laura Beauchamps, an infectious
disease practitioner at Open Arms, told
the Blade as she prepared to administer
pre-exposure prophylaxis (PrEP) that
many people with HIV/AIDS who live in
rural areas are simply unable to travel to
Jackson to get checked on a regular basis.
They just dont take care of themselves
and they keep on spreading [the virus,]
she said as Norwood listened. It is just
very sad to see. In other states its not
the same because they have a better
transportation situation or ways to get
them to the clinics and continue [with
their treatment.]
Garner told the Blade one of her
organizations clients who lives in a
shelter in Columbus, Miss., travels to the
state capital, which is nearly two hours
away, to receive health care and HIV
treatments. AIDS Service Coalition also
provides her with support network, even
though its o ces are a 4-hour drive away
from where she currently lives.
She calls once a month and we visit,
said Garner. We do what we can do.
Hiers said the majority of AIDS Alabamas
clients in the Birmingham metropolitan area
do not own cars. The agency has three vans
that run full time to bring clients to their
appointments and other commitments, but
Hiers said its not enough.
Hiers described the citys public
transportation system as pitiful, noting
an AIDS Alabama client who takes a 5:30
a.m. bus from his home to get to his job
at 9:30 a.m. was almost red because
he was late.
Up to 170 families each month receive
food assistance from Open Arms.
Norwood noted the food pantry in the
back of the clinic that her son helps stock
with donations was a little bare because
the next delivery had yet to arrive from
a local food bank. She told the Blade she
personally delivers food to her clients
who are hungry and are unable to travel
to the clinic.
Ill step out of pocket and go get them
myself, or take food, said Norwood.
Sometimes I have my people who havent
ate in a few days and theyll call one of my
guys. And my guys will call me and say
hey Dot, honey can you help me Dot? Oh
yeah, thats not even to be asked.
Timothy Thompson, a peer educator
with the New Orleans AIDS Task Force,
told the Blade over dinner in the French
Quarter on July 13 that many people who
are disproportionately at risk for HIV in
the city do not get tested because of the
stigma attached to the virus.
One of the biggest things is that there
is the idea if I go and I test positive Ill be
alienized from my people, from my family
or the people that I hang out with or things
that Im able to do I wont be able to do
anymore, he said. There is a level of truth
to that because of the ongoing problems
that are faced because of the ignorance
that is around the disease itself.
Thompson said people with HIV/
AIDS with whom he has worked in New
Orleans have told him that people did not
want to have someone who is positive
eat in their home because they think the
virus spreads through saliva.
Theyre not aware of the dierent
things that really transmit the disease as
well as the dierent things that you can
do to make sure that the people you are
around that are aected about it still feel
like they are normal human beings, said
Thompson. Youre aware that this does
not transmit this way and most people
arent aware and they tend to oend
people by their lack of education.
The Blade heard similar stories from
service providers and LGBT rights activists
in Mississippi.
We have folks and this is 2014 who
are being asked in their family homes to eat
o of paper plates, said Garner.

Obama seeks to
strengthen economic
ties with continent

LGBT rights largely took a back seat
to economic issues during this weeks
summit in D.C. that drew nearly 50 African
heads of state.
President Obama on Tuesday broadly
mentioned LGBT rights as he spoke
with Takunda Chingonzo, a 21-year-
old Zimbabwean entrepreneur, during
a business forum that Secretary of
Commerce Penny Pritzker and former
New York City Mayor Michael Bloomberg
co-hosted at the Mandarin Oriental Hotel
in Southwest Washington.
Obama during a speech at the same
event announced the U.S. had pledged
an additional $33 billion to promote
investment and further economic
development in Africa.
Some of the incredible cultures of
some of our U.S. businesses that do a
really good job promoting people and
maintaining a meritocracy, and treating
women equally, and treating people of
dierent races and faiths and sexual
orientations fairly and equally, and making
sure that there are typical norms of how
you deal with people in contracts and
respect legal constraints, said Obama.
All those things I think can then take root
in a country like Zimbabwe or any other
country. Hopefully, governments are
encouraging that, not inhibiting that.
Obama said during a White House
dinner on Tuesday that he and his family
have been inspired by Africans ordinary
Africans doing extraordinary things.
Farmers boosting their yields, health
workers saving lives from HIV/AIDS,
advocates standing up for justice and the
rule of law, courageous women asserting
their rights, entrepreneurs creating jobs,
African peacekeepers risking their lives to
save the innocent, he said.
Secretary of State John Kerry on
Monday specically applauded Frank
Mugisha, executive director of Sexual
Minorities Uganda, a Ugandan LGBT
advocacy group, during a forum at the
National Academy of Sciences.
We will continue to stand up and
speak for the rights of all persons with
disabilities, and we will continue to stand
up and speak out for LGBT activists who
are working for the day when tolerance
and understanding really do conquer
hate, said Kerry. We will do so because
we know that countries are stronger and
more stable when people are listened to
and given shared power.
LGBT rights were not specically
included in the agenda of the summit itself
that took place at the State Department
on Wednesday.
We have the opportunity to strengthen
the governance upon which economic
growth and free societies depend, said
Obama before he opened the gathering.
Today we can focus on the ingredients of
progress: Rule of law, open government,
accountable and transparent institutions,
strong civil societies and respect for the
universal human rights of all people.
Homosexuality remains criminalized in
more than 30 African countries.
Ugandan President Yoweri Museveni
in February signed into law the so-called
Anti-Homosexuality Bill under which
those convicted of repeated same-sex
sexual acts face a life sentence.
The White House subsequently cut aid
to the East African country that funded
HIV/AIDS programs and other initiatives.
The Obama administration in June
announced a travel ban against Ugandan
o cials responsible for anti-LGBT human
rights abuses.
The Ugandan Constitutional
Court on Friday struck down the
Anti-Homosexuality Bill, arguing
parliamentarians passed it last December
without the necessary quorum.
Nigerian President Goodluck Jonathan
in January signed a draconian bill into
law that punishes those who enter
into same-sex marriages with up to 14
years in prison. The statute also bans
anyone from o ciating a gay union, bans
same-sex amorous relationships and
membership in an LGBT advocacy group.
Museveni and Jonathan are among the
African leaders who attended the White
House dinner.
The African leaders, along with
Gambian President Yahya Jammeh, who
described gay men as vermin during a
February speech that commemorated his
countrys independence from the U.K.,
are among those who posed for pictures
with Obama and First Lady Michelle
Obama as they arrived.

The three-hour arguments were
historic because they marked the rst
time a court heard over the course of one
day challenges to marriage bans in four
states. The Sixth Circuit heard six lawsuits
challenging laws in each of the states
within its jurisdiction: Michigan, Ohio,
Tennessee and Kentucky.
Based on their line of questioning,two
judges U.S. Circuit Judge Martha Craig
Daughtry and U.S. Circuit Judge Jerey
Sutton seemed prepared to rule
against bans on same-sex marriage.
The remaining judge, U.S. Circuit Judge
Deborah Cook, was relatively quiet, but
appeared poised to rule in favor of the
laws. Similar to other federal appeals
courts, the panel seems headed to make a
2-1 decision in favor of marriage equality.
Although Sutton didnt telegraph how
hed rule, throughout his questioning he
suggested he believes prohibitions on gay
nuptials are unconstitutional. Ruminating
on the changing societal perception of
marriage, Sutton said a ban on same-sex
marriage seems hard to justify even on
rational basis grounds if the institution is
intended to express love and commitment.
That said, Sutton also had tough
questions for attorneys seeking to
overturn bans on same-sex marriage,
asking why the LGBT rights movement
would want to proceed through the
judicial process as opposed to the
legislative or ballot process if the
desired result was changing hearts and
minds to achieve greater acceptance.
But Daughtry was the most skeptical
of the three judges, invoking the 1967
U.S. Supreme Court decision in Loving
v. Virginia, which ended state bans on
interracial marriage, as precedent for a
legal basis that the right to marry whom
someone chooses is fundamental. Noting
that 19 states already have legalized
same-sex marriage, Daughtry observed,
it doesnt look like the sky is falling in.
When state attorneys made the
arguments that bans on same-sex marriage
had a rational basis because the purpose
of marriage was procreation, Daughtry
took them to task, repeatedly asking them
why excluding same-sex couples from the
institution was necessary when opposite-
sex couples can procreate with or without
marriage.
Theres nothing about this that has
stopped heterosexual couples from
getting married [or] getting pregnant
accidentally, Daughtry said.
The attorney for Kentucky
maintained the states position was that
marriage enabled procreation, while the
attorney for Tennessee simply refused to
answer Daughtrys questions.
Cook only spoke a handful of times
over the course of nearly four hours of
marriage arguments, but when she did,
she indicated bans on same-sex marriage
could withstand scrutiny by the courts.
At one point, she suggested certain
benets and consistency for a state that
only recognized opposite-sex marriages.
When an attorney made the claim that
bans on same-sex marriage created a
two-class system, Cook posited that was
only the result of the laws, not the intent.
The six lawsuits before the Sixth Circuit
are: DeBoer v. Snyder in Michigan; Tanco v.
Haslam in Tennessee; Love v. Beshear and
Bourke v. Beshear in Kentucky; and Henry
v. Himes and Obergefell v. Himes in Ohio.
Each of the attorneys arguing against
bans on same-sex marriage also had
diering takes based on the diering
nature of their lawsuits. For example,
while attorneys for couples in Michigan
and Kentucky were arguing for the right
of same-sex couples to marry in those
states, lawyers for couples in Tennessee
and Ohio took a narrower approach
because they were seeking recognition of
out-of-state unions.
Carole Margaret Stanyar, an attorney
representing same-sex couples in the
Michigan lawsuit, made the case that
the states marriage ban had the eect
of treating individuals in a same-sex
relationship like strangers to each other.
We are not seeking to redene the
marital relationship, Stanyar said. We
are merely [asking] for the end of the
exclusion of same-sex couples from the
right to marry.
After Sutton asked whether the 1972
marriage case known as Baker v. Nelson,
which the Supreme Court declined to
hear, should serve as precedent, Stanyar
said she doesnt believe so because the
understanding of marriage has evolved
since that time.
Following the Supreme Court ruling
against the Defense of Marriage Act,
Stanyar noted that every single court
in the country has ruled for marriage
equality despite Baker. Additionally,
Stanyar observed the Supreme Court
agreed to take up the challenge to
Californias Proposition 8 after Baker,
even though justices side-stepped the
marriage issue by ruling on the basis of
standing.
Alphonse Gerhardstein, an attorney
representing same-sex couples in
Ohio, on the other hand, said while he
agrees with arguments presented in the
Michigan case, the Buckeye State must
recognize the out-of-state marriages of
same-sex couples.
I represent four couples; their kids
deserve two parents, Gerhardstein said.
They deserve them today.
Additionally, Gerhardstein said
language in the Ohio marriage law
prohibiting not only same-sex marriage,
but marriage-like unions, demonstrates a
real prejudice.
Its saying get away from us as far as
you can, Gerhardstein said. These are
the kinds of things the Supreme Court
looks at.
Gerhardstein also said the ban on
same-sex marriages harms the state, as
well as children, because it makes it so
same-sex parents who are negligent cant
be prosecuted under current law. The
marriage ban, Gerhardstein said, creates
the practical problem of children not
getting recognition of their parents.
The discussion of whether animus
was a motivating factor in passage of the
marriage bans was most piqued when
Laura Landenwich, an attorney for same-
sex couples, made that a component of
her argument that Kentuckys law places a
badge of inferiority on people and families.
Animus in a constitutional sense
does not mean bigotry and prejudice, it
can mean thoughtless or insensitivity,
Landenwich said.
Landenwich urged the court to rule
against Kentuckys ban on same-sex
marriage because its duty is to protect
the minority from the will of the majority.
The fundamental right to marry has
not changed, Landenwich said. What has
changed is a fundamental understanding
of what it means to be gay and lesbian.
William Harbison, attorney for Sherrard
& Roe whos litigating for same-sex
couples in Tennessee, made the case that
the law causes extreme intrusion into
the lives of plainti same-sex couples
seeking recognition of their unions.
For the life of me, I cannot see the
logical connection of the eect of the
laws, which is excluding same-sex couples
from marriage, and anything related to
procreation, Harbison said.
A common theme among lawyers
defending marriage bans was that they
served a governmental interest to enable
procreation and ensure children have
opposite-sex parents.
Michigan Solicitor General Aaron
Lindstrom said the ban makes it more
likely a child will have both a mother and
father in a marriage established by the
democratic process.
Asked by Daughtrey whether the state
has a rational basis to exclude other
couples from marriage, such as opposite-
sex couples who cant procreate,
Lindstrom replied that scenario would be
an infringement upon the fundamental
right to marry.
In addition to making this argument on
behalf of Kentucky, Latherow took aim
at U.S. District Judge John Heyburn II for
striking down the states marriage law in
a decision that determined homosexuals
are a suspect class.
It was not necessary for him to make
that ruling, but he made it nonetheless,
Latherow said.
Now that the Sixth Circuit has heard
arguments, the next step is for judges to
produce a ruling or multiple rulings
to settle the lawsuits that are at hand.
James Esseks, director of the LGBT project
at the American Civil Liberties Union, told
the Washington Blade a decision could
come in another month or two.
I think at this point in time the courts
of appeals appear in some kind of friendly
competition in terms of deciding the
issues, and having their say and weighing
in because they all know its going to
be fodder for what the Supreme Court
is going to do, Esseks said. So, I think
those judges are going to go back to their
chambers and sit down and decide what
theyre going to do, but then I think theyre
going to sit down and start writing.
But the sense that the U.S. Constitution
guarantees the right of same-sex couples
to marry was most clearly expressed by
Stanyar at end of her argument.
It can and must be interpreted to
recognize a changing society, Stanyar
said. There is no reason to treat people
this way.

Merki to step down
Aaron Merki, one of the founders of
FreeState Legal, will step down from his post
as executive director, which he has held for
two years. FreeState Legal is a Baltimore-
based non-prot legal services organization
that works to improve the lives of Marylands
low-income LGBT community.
This has been an incredibly exciting
time, and we all of us have built
the organization into a national model
for LGBT legal services and systemic
advocacy, said Shannon Avery, chair of
FreeState Legal Project, Inc.
Avery, an associate judge in the District
Court of Maryland for Baltimore City, said
Merki has decided to move on to the
next phase of his career.
Merki will continue as executive director
until October. The board of directors has
convened an executive search committee.

Serving as the executive director of
FreeState Legal has been an enormous
privilege, Merki told the Blade.
JQ Baltimore hosts
Mother/Son event
Members of JQ Baltimore, an
organization that works to make
Baltimore a welcoming community for
Jewish LGBT people, will attend the
opening night of the solo play Mother/
Son on Aug. 14.
Making its Baltimore premiere and
running from Aug. 14-17, Mother/Son
will be performed at the Theatre Project,
45 West Preston St., in Baltimore. Jerey
Solomons play is about a Jewish mother
and son navigating the coming out journey.
JQ Baltimore will host a pre-show
wine and cheese reception ($5 donation
suggested) at 7 p.m. followed by the
performance at 8 p.m. Following the
show there will be a Q&A with Solomon
and area rabbis about the topic of LGBTQ
inclusion in the Jewish community.

Aussie med students seek gay health lessons
SYDNEY, Australia Medical students in Australia, concerned about gaps in their
education concerning LGBT health, have started taking supplementary courses on the
topic, the Star Observer, an Aussie gay news publication, reports.
In response to concerns from students and advocacy groups about a lack of
content relating to sex, sexuality, and gender identity in university medicine degrees,
the Australian Medical Students Association (AMSA) has launched a series of online
modules called AMSA Academy, the article notes.
One of the most recent modules, called Lets Talk About Sex, has a signicant LGBT
component the online courses oer students presentations, forums and even
assessment.
Dr. Ruth McNair from the University of Melbourne and the Australian Lesbian Medical
Association provided signicant input into the modules. While she hoped the modules
would increase pressure on universities to change content in the curriculum, she told
the Star Observer it was becoming harder to include information on any subject in
increasingly crowded medical courses.
Its similar everywhere theres more and more content to include and increasingly
students are being asked to self-select topics and nd their own information about even
core information, McNair said.
Even topics listed as core are not entirely delivered through tutorials and lectures,
so medical students are encouraged more and more to seek out information
independently, the article said.
Chinese man sues after conversion therapy
BEIJING A gay Chinese man said last week he was suing a psychological clinic for
carrying out electric shocks intended to turn him straight, as well as the search engine
giant Baidu for advertising the center, the Associated Press reports.
The Beijing LGBT Center, which campaigns for gay rights, said it was the rst court
case involving so-called conversion therapy in China. China declassied homosexuality
as a mental disorder in 2001.
The centers executive director, Xin Ying, said some professional hospitals in China, as
well as smaller private clinics, still provide conversion therapy and that the group hopes
the case at the Haidian District Peoples Court in Beijing will lead to a ban on the therapy,
the AP article says.
Yang Teng, 30, told the Associated Press that the therapy given to him included
hypnosis and electric shock and he was left physically and mentally hurt. He said he
voluntarily underwent the therapy in February following pressure from his parents to
get married and have a child.
My hometown is a small city, people there still care about carrying on the family line,
Yang was quoted as having said, adding that now he can nally accept his homosexuality.
His lawyer, Li Duilong, said Yang was suing the Chongqing Xinyu Piaoxiang clinic for
infringing his personal and health rights because they told him electric shock treatment
was not dangerous but then harmed his health. He also said that Baidu bore joint
liability because it carried its advertisement, the AP said.
Conversion therapy case
dismissed in New Jersey
TRENTON, N.J. For the second time in nine months, a federal judge in New
Jersey has dismissed a lawsuit challenging the states ban on gay conversion
therapy, the Associated Press reported last week.
The ruling led July 31 by U.S. District Judge Freda Wolfson rejected the claims
of a New Jersey couple who said their constitutional rights were being violated
because the law prevents them from seeking treatment for their 15-year-old son.
Last November, Wolfson dismissed another challenge to the law led by a
group of plaintis that included two licensed therapists who practice what are
called sexual orientation change eorts, referred to in court lings as SOCE,
the AP article said.
Gov. Chris Christie signed a law last year banning the therapy in New Jersey,
saying at the time that the potential health risks trumped concerns over the
government setting limits on parental choice. New Jersey was the second state
to pass such a law; California passed a similar law in 2012, and the U.S. Supreme
Court turned aside a challenge to that law in June.
The unidentied New Jersey couple claimed in their suit that the states law
violated their rights to free speech and freedom of religion, as well as their 14th
Amendment right to equal protection, by denying minors the opportunity to
pursue a particular course of action that can help them address the conicts
between their religious and moral values and same-sex attractions, behaviors
or identity, the AP reports.
In her opinion, Wolfson wrote that the law doesnt impinge on free speech
because it covers conduct the therapy, specically and not speech.
New Jersey Gov. CHRIS CHRISTIE signed a law last year banning conversion therapy in
New Jersey.

I dont know about you, but it feels to me
like the summer is ying by. Fortunately
we still have a few beach weekends left so
if you havent had the chance, get out there

With the summer waning, I nd that many

goals can easily falter. Luckily we live in
2014 and there is motivation in something
we keep with us 24/7 our phones. Today
I want to give you a few of the hottest apps
out there to keep your body on track and
away from the fat relapse.
Argus Though the name reminds
me of one of the soldiers from the 300
movie, this app is here to help you ght
against falling o the wagon. Argus is
the all-in-one calorie counter, workout
tracker, pedometer and everything elser
that you get with the popular Fitbit or
Nike fuel band, but its all on your phone.
And its free. The one down fall is that this
app drains the hell out of your battery, so
if Grindr is your priority, this may not be
the app for you.
Digit Icardio If youre driven by
numbers and cardio is your game, then
youll love this app. If you tend to not work
as hard as you should in the gym, then you
especially need this app. Icardio is another
free app that connects to your current heart
rate monitor to display on your screen
exactly how hard youre working. It also
tracks distance traveled and the time of
your workout. Remember during exercise,
monitoring the change of your heart rate
is a better method of testing exertion than
believing whatever the calories on the
treadmill say. Ive tried it and this app will
make you go harder, longer.
Fitbit This is an app that connects
with the small Fitbit device which tracks
your calories, steps, distance travelled
and ights of stairs youve walked. Some
versions even vibrate if you have been
inactive too long, reminding you to get
up o that rear end and move. Though
I wasnt a fan of the rst version, which
seamlessly clipped on to your clothes, I
do like the new bracelet option they have
now. Its comfortable and doesnt fall o
during workout like my old clip on did.
One another upside is that Fitbits app
has a free version, but it goes up to $50
a year for the premium serieswith all the
bells and whistles.
Mytnesspal This is still my favorite
when it comes to calorie counter apps. I
love that it also has the desktop version,
so theres no excuse for you not to log
everything. The library of food is also so
robust that I always nd the foods I eat on
it. If for some reason you cannot, you can
put your own meal in and the app will save
it. To make it even better, Mytnesspal has
recently linked up with Fitbit so your activity
stats can automatically upload to your
calorie log. In other words, when you run
with your Fitbit your Mytnesspal account
automatically know you earned extra
calories and deserve that extra cookie.
Fooducate I saved the best for last.
When it comes to meeting and achieving
any tness goal it really comes down to
nutrition and this app may be your life
saver. Fooducate is an app that helps you
to make better decisions before you buy
foods in the grocery store. Thats right,
this app wont even let you bring the bad
stu into your house. It turns the camera
in your phone into a barcode scanner and
allows you to scan any food with a barcode
to see its Fooducate health rating.
Foods are rated on a schoolhouse scale
from A to F with A meaning, Eat as
much of me as you want, and F saying,
Dont even think about it. The best part
is that the app will also tell you where
the food ranks compared to other foods
of its type and even give you healthier
suggestions of similar foods. As much
as I love looking at the back of nutrition
labels, this sure saves time and worry.
I was glad to nd out I was eating the
healthiest brandof ice cream out there.
When it comes to staying motivated
to your health and tness we dont have
to look farther than our phone for help.
Many of the apps out today can help you
to become more active and eat healthier.
Remember in the game of healthy living,
its a marathon not a sprint so any tricks
you can use to keep on track are great to
have in your back pocket.

Numbers matter for
a range of reasons
Once again, the release of a new fed-
eral survey has stirred debate about how
many gays and lesbians there are in the
United States. Many believe that for polit-
ical reasons it is important to know what
percentage of the population we make
up. In the National Health Interview Sur-
vey (NHIS) the answer is less than 3 per-
cent of the population identies as gay,
lesbian or bisexual.
Many think that this number is much
too low and that the LGBT community
was under-counted. It shouldnt matter,
yet the reality is that it would be better for
us if we could say that ve or 10 percent
of the population is gay or lesbian.
As we achieve success in our ght for
civil and human rights, gays and lesbi-
ans are assimilating very quickly into the
broader community and are getting mar-
ried, having children, and worrying about
christenings, a bris, getting kids into the
best pre-school, conrmations and bar
and bat mitzvahs. What happened to the
good old days when a gay guy could move
to the Castro in San Francisco, Greenwich
Village or Chelsea in New York, or Dupont
Circle in Washington, D.C. and enjoy life
without family pressure to get married
and have kids? But then as far back as
2007 the New York Times published an
article with the title Gay Enclaves Face
the Prospect of Being Pass.
Numbers do count in politics and what-
ever the true numbers are we have made
a statement for our community that
would seem to come from more than
three percent. Our clout also comes from
the resonance of what Shane Snowdon,
director of the health and aging program
for the Human Rights Campaign is quot-
ed as saying in Sandhya Somashekhars
column in the Washington Post, Theres
a saying within the Beltway that you dont
count if youre not counted, and I really
contest that. We would deserve protec-
tion if our numbers were a fraction of
what they are in the NHIS.
In the same column Je Johnston, is-
sues analyst with Focus on the Family,
a Christian nonprot that opposes gay
rights said, Whats interesting is compar-
ing that number with public perception.
The average person thinks the percent-
age is much higher, probably because of
the high prole that entertainment, news
media and other inuential sources have
given homosexuality in recent years.
Well that may be true and it is possible
we are represented in higher numbers in
those communities or they just are more
passionate about securing civil and hu-
man rights for all people. Somashekhar
writes, There are broad misconceptions
about the numbers, however. Many
Americans believe the proportion of U.S.
gays to be 1 in 10 a false gure pro-
moted in the 1960s, drawn from a book
by sex researcher Alfred Kinsey. The poll-
ing organization Gallup has found that
a majority of Americans actually believe
the proportion is even higher, closer to
25percent. My own thought on that last
gure is it may come from interviews with
single straight women in D.C. about what
their experience has been in nding a de-
cent, single straight man to date.
In all seriousness, the numbers do
count for many reasons. They include
training doctors to deal with issues par-
ticular to gays and lesbians and having
a builder determine whether it is a wise
business decision to build senior hous-
ing specically for the LGBT community.
In addition, understanding that when we
teach our children about diversity in our
communities issues related to the LGBT
community should be included in those
lessons. And explaining to legislators why
it is crucial to pass legislation to protect
the LGBT community from discrimination
in jobs and housing among other areas.
Whatever our numbers, we are chil-
dren of God like everyone else. We need
to continue the ght until we have all of
our civil and human rights guaranteed by
law and are accepted in the culture of ev-
ery community.

Eforts to legitimize
certain immigrants
could lead to exclusion

What has been a topic of rancor for Con-
gress in recent months has, in the last couple of
weeks, become inevitable: President Obama
will take executive action to provide adminis-
trative relief to undocumented immigrants.
And while this administration has exerted its
authority in strengthening protections for LG-
BTQ people in areas like education, housing
and healthcare, concern remains on whether
and how inclusive the immigration executive
order will be for the estimated 267,000 undoc-
umented LGBTQ adults and our families living
in the United States.
In particular, eorts to legitimize certain
kinds of undocumented immigrants from oth-
ers, we fear, will result in the exclusion of the
most vulnerable members of the LGBTQ un-
documented community.
In February, Rep. Jared Polis (D-Colo.) called
on President Obama to bring an end to depor-
tations in a speech to the House of Represen-
tatives. He said, Even if this body doesnt act,
the president can stop deporting non-criminal
detainees. If somebody has violated our crimi-
nal laws, they should suer the consequences
of their crimes.
Although Poliss sentiments are in the
right place, his misguided views dont take
into account how the criminal justice system
often works to criminalize large portions of
LGBTQ people.
For example, the Secure Communities
programwhich allows federal immigra-
tion authorities to identify criminal immi-
grantsand other eorts that deputize local
law enforcement to function as immigration
authorities, paired with unfair raids and drag-
net operations has fostered bias and proling
in law enforcement.
LGBTQ people, especially transgender
women of color, are frequently caught
up in these programs. LGBTQ people face
higher rates of criminalization and incar-
ceration due to their involvement in un-
derground economies. When many laws
and policies fail to clearly protect LGBTQ
people at work, many members of our
community are forced to turn to criminal
activity in order to get by. For example,
more than half (54 percent) of respon-
dents in a national survey of 6,500 trans-
gender people have had some kind of con-
tact with police. And 46 percent of those
respondents indicated feeling uncomfort-
able seeking help from police.
Programs like Secure Communities
and other immigration enforcement poli-
cies threaten this already frail relationship
between undocumented LGBTQ people,
immigration authorities and law enforce-
ment. That is why organizations like ours
Familia: Trans Queer Liberation Movement
(Familia: TQLM) and Southerners on New
Ground (SONG)have been on the front
lines of these ghts.
It is time to move beyond a binary conversa-
tion of criminal vs. non-criminal immigrants,
and recognize that the survival decisions put
in front of undocumented LGBTQ immigrants
only range from bad to worse. From driving
without a license, to using aliases to secure
employment, to taking on high-risk jobs that
often leave us sick, injured or disabled these
decisions have forced many of us into corners
that criminalize our existence and deem us
unworthy of redemption.
Polis and others have failed to see this con-
nection. But the Obama administration has
an opportunity, through this executive order,
to avoid protecting some undocumented im-
migrants at the expense of others. To be clear,
a fair and just executive order ensures that no
undocumented person is marginalized, pun-
ished or deported because of survival deci-
sions theyve been forced to make.
Familia: Trans Queer Liberation Movement
and Southerners on New Ground are working
to ensure that those who are most aected
by new policy are at the helm of the conver-
sationthat we are here to voice the realities
that remain unspoken.
We are in a position to move the needle
forward against the criminalization of our
communities, and administrative relief can
be a modest step forward. As movement and
progressive organizations in a position to ad-
vocate and weigh in on this issue, we need to
ensure that those most aected and criminal-
ized have an opportunity to advocate for our-
selves and we must.
As President Obama embraces the social,
political and cultural equality of LGBTQ people
here and abroad, we urge him to do right by all
LGBTQ undocumented people in the United
States and provide real safety and security for
all of our families.
Largest federal survey
reports gay, bisexual
population percentage
The percentage of the U.S. population that
is gay, lesbian, bisexual or transgender, by all
credible contemporary counting, is situated
somewhere between three and four percent.
This statistic still seems to startle some
of us.
The announcement by the federal gov-
ernment last month, concerning its latest
and most thorough estimation ever, oered
not much new or surprising in assessing our
national prevalence. Many in the gay com-
munity, however, reacted as if the ndings
were cataclysmic.
Despite the widely reported distress, dis-
may, denial and denunciation from gay activ-
ists, accepting dimension is not diminishment.
Nor should the validity of our quest for equal
treatment and opportunity rely on how many
of us exist.
While the top-line statistic highlighting
the number of gays and lesbians generated
media headlines, both the actual segmented
and combined gures comport with prior
consensus estimates and other well-regard-
ed numerical counts. The latest ndings in-
dicate that 96.6 percent of American adults
identify as straight, 1.6 percent as gay or les-
bian, and 0.7 percent as bisexual. In addition,
1.1 percent identied as something else, re-
sponded by saying I dont know the answer
or refused to provide an answer. This latter
category likely also includes the very small
portion of the population that is transgen-
der. Adding them all together, with a caveat
or two in adjustment, puts it within the com-
monly accepted range.
These newest gures result from the largest
and most in-depth survey of sexual orientation
in American history, conducted by the Centers
for Disease Control throughout last year for
the purpose of assessing Sexual Orientation
and Health Among U.S. Adults as part of the
2013 National Health Interview Survey. The
National Health Statistics Report, released July
15, reported the results of 34,557 in-person
one-on-one interviews. LGBT community
leaders had long encouraged this count to in-
clude sexual orientation identication.
Of course, to those living in Washington,
the national number can seem low. In an
extensive mid-2013 Gallup survey of all 50
states and the District, D.C. ranked rst with
10 percent of the population identifying as
either lesbian, gay or bisexual, or transgen-
der of either gay or non-gay orientation. The
Gallup report, the largest single study of the
distribution of LGBT Americans on record,
indicated that the national combined portion
was 3.5 percent.
While both urban areas and states where
social environments encourage acceptance
included higher numbers of gay and lesbian
residents, Gallup found that the variation in
LGBT identication among states was relative-
ly small. It likely indicates the known migration
by those who are gay, lesbian and transgen-
der to areas more accepting socially and pro-
tective politically.
There are, of course, unique challenges
in determining sexual orientation statistics,
including a hesitation by some to self-iden-
tify. The vagaries of classication denition
can also pose variance in results. Including
adults who have experienced a same-sex
attraction or engaged in sexual relations
with someone of the same gender likewise
skews the results.
Is the LGBT community undercounted as a
result of these challenges? Probably. But it is
highly unlikely any undercount is statistically
signicant, especially in a more modern era
beneting from high levels of acceptance and
a general willingness to self-identify in con-
trolled and condential settings.
In fact, a recent ve-year study funded by
the Ford Foundation examining a broad range
of issues related to survey quantication of
the number of LGBT Americans led scholars
to the conclusion that such concerns were
unfounded. The reality is that Americans are
more reluctant to answer inquiries regarding
income than sexual orientation.
One interesting aspect of popular opinion,
however, is that large numbers believe that
the prevalence of LGBT Americans is much
higher than it actually is. A recent Gallup poll
indicated that a majority set the number at
nearly 25 percent.
Weve long demanded that we be counted,
including by government and independent
survey. We cant now complain that there are
fewer of us than some may have thought or
we may have hoped.

competing for
Gay Games gold in Ohio

It has been four years since Washington
lost the bid to host the 2014 Gay Games
to Cleveland/Akron and it has been four
years of wondering if that Ohio metro
area was capable of luring athletes from
all over the world.
No more wondering. Today, close to
7,000 athletes from 51 countries are
traveling to northern Ohio to compete in
about 35 sports and two cultural events,
band and chorus. The founding principles
of the Gay Games, participation, inclusion
and personal best, are once again ringing
true and Cleveland/Akron is ready to host
the largest LGBT sporting event in the world.
We are excited to welcome athletes
and their supporters from all over the
world to the Cleveland/Akron area, says
Tom Nobbe, executive director of Gay
Games 9. We expect people to compete
at whatever level they are capable of
during the day and then enjoy all that
Cleveland/Akron has to oer at night.
Last week at the Team D.C. uniform
party at Nellies Sports Bar, there was
excitement in the air.
Festival Village is going to be the place
where everyone will want to start their
night, Nobbe says. We have lined up
some fantastic entertainment and then
everyone can head o to the parties
being oered such as White Party, Black
Party, Block Party and Womens Party.
There will also be free buses shuttling
people to Akron for events such as the
Indigo Girls concert.
Though the participation numbers for
Cleveland/Akron are lower than the 2010
Cologne Games (8,800 athletes with 2,900
from Germany alone), the Team D.C.
contingent has tripled in size to almost
300 athletes who will compete in 19
sports along with several D.C. musicians
who are going for the band event.
Any one of the teams or individuals
from the Team D.C. contingent could be
considered potential medal contenders.
In the team competitions, the players
from the D.C. Sentinels basketball team,
the ag football players from the D.C. Gay
Flag Football League and the Washington
Wetskins water polo team have all
notched tournament wins in the last year.
I am excited to see what Cleveland has

How long have you been out and who
was the hardest person to tell?
Ive been out since I was 12. The
hardest person to tell was my father. But
he has come around and he has been
very accepting.
Whos your LGBT hero?
Kristina Kelly. She never ceases to
amaze me. She cares for everyone even
if they dont care back. She inspires me
to become a better person.
Whats Washingtons best
nightspot, past or present?
Cobalt on Monday nights! Its a total
drama-free zone and such a diverse non-
judgmental crowd. But of course I love
Freddies and Ziegfelds/Secrets almost as
much. They have all become my home.
Describe your dream wedding.
Family and friends gathered in a
beautiful air-conditioned building.
Flowers everywhere. All white with jet
black tuxes.

you most passionate about?
Unemployment. There are so many
unemployed people that ght so hard to
nd a job and in our economy it is such
a struggle.

Sometimes I ask myself the same
question. In all honesty, my friends. They
are what has kept me in the D.C. area.
They are some of the strongest people I
have ever met and I couldnt see myself
without them.

Local nightlife entertainer Matt Strother, who performs as Matthew Jay
Kelly, won the title Entertainer of the Year in one of three categories in late
July as part of the annual competition held by the SLS Pride Foundation, Inc.,
in Louisville, Ky.
Kelly, who performs as a man, won the Mr. competition. He was one of
nine vying for the title.
Kelly, who performed elaborate stage recreations inspired by the movies
Beetlejuice and Edward Scissorhands, says winning was a huge thrill.
I couldnt stop crying, the Alexandria, Va., resident, who qualied for the
title by winning a regional pageant in Florida (D.C. doesnt have a regional
preliminary), said. It still hasnt fully set in.
Kelly, 29, credits his drag mother Kristina Kelly, for much of his success. The
two met at Ziegfelds/Secrets a few years ago and he now performs with her
most Monday nights at Cobalt.
Shes absolutely amazing, he says. She sat me down and said, I really
think you could do something like this. Shes been such an inspiration.
Kelly works at Freddies Beach Bar and Secrets, where he won Washington
Blade Best of Gay D.C. awards in 2011 and 2012.
Kelly lives with his partner, Brian Embly. He enjoys music, dance and
traveling in his free time.

Female-dominated Cirque
show a wonder

You can spot Cirque du Soleils
trademark blue and white striped tent
from miles away. Sitting on a blu
above the National Harbor complex on
the banks of the Potomac in Maryland,
the big top conjures the kind of circus
excitement you knew as kid. But forget
the whip-toting tamer putting defanged
lions through the paces. Cirque is about
what people can do.
With its latest installation Amaluna,
the Quebec-based franchise pays tribute
to the power and allure of women.
From its young woman coming-of-age
storyline to its core female performers
to its all-girl band, Amaluna oers a
less-testosterone-fueled experience than
Cirques other shows. But dont fear,
along with the daring, body-bending
ladies, theres plenty nimble beefcake on
hand to keep everyone happy.
Amaluna (an etymological mash
of mother and moon) refers to a
mysterious, lunar-lit island inhabited by
women and watched over by goddesses.
Staged by Broadways Diane Paulus (best
known for her celebrated revivals of
musicals Pippin and Porgy and Bess),
this dazzling amalgam of street theater
and Vegas follows a narrative loosely
based on Shakespeares The Tempest,
only in this telling its singing sorceress
Prospera (Julie McInnes) not Prospero
whose magic sets the action in motion.
Prosperas daughter Miranda needs
a mate. The only male on hand is her
half human, lizard-tailed pal Cali (Viktor
Kee). Despite his enviable abs, he doesnt
make the grade, so mother summons a
storm landing a crew of displaced young
men on Amalunas shores. Miranda falls
for Romeo (Evgeny Kurkin), the cutest
of the bunch. But nothing comes easy.
The pairs edgling infatuation must face
many tests of the uniquely Cirque variety:
for bikini-clad Miranda (the comely
and cut Julia Mykhailova), its a series of
contortionist moves on the slippery lip of
a huge glass bowl. As Romeo, bu Kurkin
demonstrates his outrageous upper body
strength with a super tall, death-defying
Chinese pole. Its amazing stu.
The climate-controlled venue is
cavernous allowing the cast to soar through
the night sky on aerial straps. And while the
moody lighting creates a world of sea, stars
and moon, its the performers athleticism
and superbly executed physical feats that
make the show.
The acts are varied ranging from
highying acrobatics to Calis immensely
enjoyable juggling act which combines
the tradition of circus and the ash
that is Cirque. The unicycle tricks are
incredible. Not at all the usual circus ller
fare that you might expect. The all-male
teeterboard act features a crew of well-
built shirtless guys attempting to escape
from a makeshift prison. Its an exciting
demonstration of strength and tumbling.
Not to say, the show is without aws. Ever
wonder where Olympic wannabes go? It
appears the female gymnasts end up doing
the uneven bar en masse with a traveling
circus. Its not easy. But when you come to
Cirque, you expect to be blown away. This
act was underwhelming. And what would a
circus be without clowns? In this case, better.
Sadly, the comic relief is tiresome.
The shows highlight is titled
Manipulation, an exotic balancing
act performed by Alvin Ailey-trained
dancer, Lara Jacobs Rigolo. Bit by bit, she
deliberately picks up palm leaf ribs with
her toes, slowly but surely assembling

EDM music festival takes over Baltimore
The Moonrise Festival, a two-day EDM music festival, is at the Pimlico Race
Course (5201 Park Heights Ave., Baltimore) on Saturday and Sunday from 11
a.m.-11 p.m. each day.
The festival has four stages with popular local and mainstream EDM artists.
A ferris wheel and vendors will also be on the grounds for each day. Saturdays
headliner is Kaskade and Sundays headliner is Bassnectar. Other acts include
A$AP Ferg, Waka Flocka Flame and Rusko.
Tickets are $95 for a single-day general admission pass and $149.50 for a two-

I Am My Own Wife slated for Frederick run
I Am My Own Wife, a Pulitzer Prize-winning play about a German transvestite,
opens at the Maryland Ensemble Theatre (31 W. Patrick St., Frederick, Md.)
Thursday at 8 p.m. through Aug. 17 and Aug. 21-24.
The one-man show tells the true story about a German transvestite who
survived the Nazis and the East German Communist regime. Local actor Eric
Jones portrays all 35 of the plays characters. Local director Rebecca OLeary
directs the show.

career-ending story
The view from your o ce is quite
magnicent.
When you moved into that space, you
also got the perfect desk, a credenza to
match and a plushy, throne-like chair. Its
a workspace anyone would envy.
Yes, your o ce is well appointed. But your
closet? Not so much. Therefore, according
to John Browne in his new book The Glass
Closet, maybe its time to come out of it.
Starting as a young man in 1969,
Browne rose through the ranks at oil-
giant BP until 2007, when he resigned
as chief executive. He mightve still been
there, if not for an unfortunately splashy
scandal that seems tame today: Browne is
gay. When a tangled skein of allegations
pulled him out of the closet, he resigned
from his job, fearing his life was over.
Obviously, it was not, but he discovered
that his experiences arent unusual.
Even though there have been strides
made, and though nearly all Fortune
500 companies have in place policies to
prevent discrimination based on sexual
orientation and gender identity, more
than 40 percent of American LGBT workers
remain closeted on the job. According
to a survey, 90 percent of transgender
employees report problems at work.
Years of progress have reduced the
risk of harassment, says Browne, but
they have not completely eradicated it.
Coming out is still risky, as evidenced by
the interviews he completed with people
who mostly asked that their last names
not be used.
Businesses, Browne says, should
understand that inclusion levels the
playing eld and widens the choices
available in the war for talent, something
Fortune 500 companies already know.
Extending benets to same-sex partners
serves to retain workers and policies
supporting LGBT employees also send a
positive message to other minority groups.
Marketing and ad departments must
remember that the LGBT community is
traditionally under-served but represents
an often sizeable opportunity.
As for LGBT workers, Browne recalls
how much eort it took to keep his secret
and how much it weighed him down. Still,
no matter how skilled you think you are
at hiding your true self, those closest to
you will see you through the closet
door. Coming out is risky, but the risk
will be worth the reward.
Color me irritated.
Seemingly meant for business, The
Glass Closet is not exactly business
related for the rst third of it. Instead,
Browne begins with his life story and a
tired LGBT history that includes little to
nothing about the world of work.
That doesnt leave much room for
biz-related information in this too-short
book but getting past those rst pages
is where the irritation subsides. Browne
continues by oering eye-opening stats,
several interviews to prove that there
are others experiencing similar issues
and points to ponder, interspersed
with helpful info for employers and
employees, both LGBT and straight.
If youre interested in a biography, thats
here. The real appeal of this book, though, is
for the starter help it oers and the modicum
of support. For those small, brief, shaky
reasons, The Glass Closet is worth a look.

Cleveland State are top notch.
In the individual events, look for Chuck
Harney in cycling, Bryan Frank in triathlon
and the world champion D.C. Aquatics
Club swimmers including Lindsey Warren-
Shriner and Neill Williams to bring home
medals. At the 2010 Cologne Gay Games,
the DCAC swimmers won 58 of the 100
medals won by D.C. athletes.
The Gay Games does not track
individual medals won over the years
though they do track countries. In 2010,
the top ve medal winners in order were
the United States, Germany, United
Kingdom, Australia and France.
Neill Williams of DCAC has possibly
won more medals than anyone in the
history of the Games having won roughly
38 medals in swimming over ve Gay
Games, most of them gold. He is entered
in multiple events in Cleveland.
Records are also not tracked at the Gay
Games, though each governing body of
the sanctioned sports allows records to be
set and world and American records have
been broken many times over the years.
You will also be hard pressed to nd
many active Olympians or professional
athletes competing at the Games. Most
of those types of athletes are looking for
tune-up events against athletes they will
be competing against in the Olympics or
their respective world championships.
As for retired elite athletes, they
basically have a bullseye on their back
if they choose to compete. Former
professional football player Wade Davis
has said of competing in the Gay Bowl
ag football championships, I feel like
everyone is gunning for me. Who doesnt
want to take down a former pro athlete?
Olympic diving gold medalist Greg
Louganis and Olympic swimming gold
medalist Bruce Hayes both have competed
at the Gay Games after they ended their
Olympic careers. They both captured gold
medals in their respective sports.
This year in Cleveland/Akron, Olympic
short-track speed skater, Blake Skjellerup,
will be competing in the cycling road race.
As for the other high-prole LGBT
athletes, they appear as ambassadors at
the Gay Games and have included names
such as Louganis, Hayes, Skjellerup, Billy
Bean, Rudy Galindo, Martina Navratilova,
David Kopay, Matthew Mitcham, Leigh-
Ann Naidoo and Esera Tuaolo
For the rst time, several of the
competitions will be streamed live during
the week on the CCE Sports Network. The
network will also be live streaming during
the staging of the opening ceremonies,
the closing ceremonies and live interviews
with the athletes in Festival Village.
The sports with D.C. athletes are
basketball, volleyball, cycling, triathlon,
open water swimming, rock climbing,
tennis, water polo, bowling, swimming, golf,
racquetball, ag football, rowing, running,
soccer, softball, track & eld and sailing.
The Gay Games 9 website will have
updates on a daily basis for those
who wish to check in for results and
entertainment options.

Do you really know where you live?
When I started selling real estate in
D.C. in the 1990s, there were a number
of neighborhood monikers that had with-
stood the test of time.
Everyone knew Georgetown, for exam-
ple, with its expensive properties and the
restaurants and shops that lined M Street
and Wisconsin Avenue. Nearby Foggy Bot-
tom was also well known; its name still
produces the nervous giggles of a 10-year-
old from transplants to our fair city.
Capitol Hill had always been a promi-
nent section of the District although out-
of-towners generally associated it with
the government rather than the neigh-
borhood of historic homes its residents
know and love. And for other D.C. new-
bies, Dupont Circle was, and perhaps
still is, a frustrating roundabout where
one can drive in circles for an hour while
working up the courage to veer o in the
wrong direction, vowing never to return.
Areas like Cleveland Park and American
University Park were often a mystery to
newcomers who had never realized there
was a suburban-like aspect to D.C. And
why, they would ask, were there two dif-
ferent Chevy Chases and Takoma Parks?
As time passed and the District im-
proved its economic base, increased de-
velopment ourished. Legally known as
Old City II, easily the Rodney Dangereld
of names, D.C.s northwest area splin-
tered into a number of new subdivisions.
With the addition of each Starbucks a
neighborhood name was born.
Initially, when development headed
east from western parts of northwest
D.C., we added Dupont East, the U Street
Corridor, Logan Circle and Logan East, a
cachet name for Shaw, which, thankfully,
has returned to its roots as Shaw again.
Now we also have Bloomingdale,
Mount Vernon Square, Truxton Circle,
Kingman Park, NoMa and the Atlas Dis-
trict. Even Penn Quarter, one of the Dis-
tricts pricier downtown neighborhoods,
was not much more than a decaying com-
bination of dim sum restaurants and of-
ce buildings prior to 2004.
Because the boundaries of D.C. subdi-
visions are somewhat blurred, there are
often days when I travel around the city
never knowing where I am and according
to whom. Still, real estate agents must be
familiar with a number of areas so we can
introduce them to our buyers and sing
their praises on behalf of our sellers.
One good way to do this is by developing
neighborhood proles with information that
can be kept in a folder or binder for review at
an open house, inserted into a PowerPoint
presentation to appear on a website or be
accessed via tablet, or even take the form of
a PDF that can be shared with potential buy-
ers and their agents via email.
Its important to clarify that a neighbor-
hood prole should not include facts or
assumptions that could steer a buyer to
or from a given area or tread in any way
on fair housing laws. Be sure to let your
real estate agent guide you in drawing
that line in the sand.
Here are some items that sellers can
provide to their agents to help buyers
select their neighborhood and ultimately,
their home.
The URL of a website that provides
information about the neighborhood
Access to a listserv or other online
forum that includes other residents of
the area
The latest edition of a local paper or
community newsletter
A Walkscore map (www.walkscore.
com) that shows the homes proximity
to transportation, recreation, shop-
ping and nightlife
Metrobus schedules and Zipcar loca-
tions
Copies of articles about the neigh-
borhood from periodicals and maga-
zines
Background information on proper-
ties in historic districts
Information for pet parents: veteri-
narians, dog parks, daycare, walkers,
etc.
Reviews of favorite local restaurants
and hangouts, shops and markets,
and other areas of interest
So when youre putting your house on
the market, increase the visibility and de-
sirability of your area by assembling all the
good stu you would like to have known
before you moved there and keep it handy
for when your agent asks, Is there anything
in particular about your neighborhood that
I should make buyers aware of?
