1. Jurisdiction -

This applies to all Risks located in India.
2 Scope
This Tariff applies to Erection All Risks/ Storage Cum Erection Insurance
Rating of Risks with Sum Insured upto Rs. !! crores. "Risks with Sum Insured
a#o$e Rs. !! crores and upto Rs. %!! crores shall #e rated #& Insurers as per

departments* the matter relating to Erection All Risks/Storage4Cum4Erection
Co$er is re5uired to #e underwritten* su#2ect to these 6eneral Regulations.

%. Su&-'ontracts (or)in* part o+ a pro,ect -
As regards Su#4Contracts forming part of a 3ro2ect* it is clarified that
irrespecti$e of whether the 3ro2ect $alue has #een #roken into $arious
Sections and orders/contracts are placed with different suppliers/
contractors/Su#4Contractors or the Insureds carr& out the work themsel$es
departmentall&* the Insurances for all such Su#4Contracts are su#2ect to these
6eneral Regulations.
-. SUM INSURE. .e+inition -

7or this purpose* the Sum Insured on the following items are to #e taken
into account 4

9:T; I< CASE =7 =>ERSEAS C=<SI6<1E<TS ?
In respect of o$erseas consignments certain additional $aluation on
account of the following will get added to the CI7 $alue* after the goods
are cleared at the docks 44

i/ Custom 9ut& paid on clearance and
ii/ Clearing - forwarding charges to the agents concerned.
In such cases the @9ut&A can #e co$ered at full rate applica#le for 1arine
"imports/.
/. Stora*e Ris!s at t#e (a&ricator0s 1re)ises2or!s#op

The Storage Risks at the 7a#ricator.s 3remises/0orkshop can #e co$ered
as an e,tension to the EAR/SCE policies and for such storage the Rate
and E,cess are as under ?

3. 4ERE'TION ALL RIS50 RATES -
A/ / Column <o.D of Rate Schedule4 3rescri#es rate for first two
months of the pro2ect period "first month plus one month.s testing/* the
same rate will appl& for EAR Insurances for a period of two months
e$en where the testing co$er is not re5uired.

Similarl&* the rate prescri#ed under column <o.D will appl& for EAR
Insurances where the polic& period "including testing period/ is two
months or less and the testing period is one month or less.
2) EAR/SCE period 4
The EAR/SCE period has to commence from the date of arri$al of first
consignment at the site of erection. 8owe$er* it ma& happen that in a
few cases the Insured ma& take EAR/SCE insurance at a much later
date. In all such cases irrespecti$e of the date of commencement of
the insurance* the SCE rate has to #e computed for the total period

commencing from the date of arri$al of the first consignment at the
site of erection.
In all such cases the Insurers should clearl& stipulate that an& damages
which ha$e taken place prior to commencement of the insurance*
are not co$ered #& the polic&.

The 9ismantling E,tra of H! C should #e applied on the total EAR/SCE Rate

a/ All @Acts of 6od. perils other than Earth5uake "7ire - Shock/ are taken
care of in the SCE Rates prescri#ed. 8owe$er no reduction in the rate can #e
allowed for e,cluding an& of these perils.

are to #e charged o$er the SCE rate for risks located in Earth5uake Iones "as

on first loss #asis with Sum Insured limits of '!C "=R !C/ of the total Sum

sum insured.
1B. EC'ESS (OR 'LAIMS ARISING OUT O( MAJOR 1ERILSA'TS O( GO. 1ERILS -
The minimum e,cess for claims arising out of Acts of 6od 3erils "$iG.
Earth5uake47ireandShock* Jandslide/ Rockslide/ Su#sidence* 7lood/
Inundation* Storm/Tempest/8urricane/T&phoon/C&clone/ shall #e as under ?
E,cess for A=6 3erils ! C of the claim amount su#2ect to a minimum of
the Testing 3eriod E,cess with an upper limit of Rs. %

e.gF 4If e,cess for <ormal and Testing period are Rs.!*
!!!/4 and Rs. D!*!!!/4 respecti$el& then the E,cess for
claims arising out of the Acts of 6od 3erils shall #e ! C of
the claim amount su#2ect to minimum of Rs.D!* !!!/4 with
an upper limit of Rs. % Crores.
The a#o$e e,cess shall appl& separatel& to each incident4gi$ing rise to loss
or damage. 7or this purpose an incident shall not #e considered to ha$e
terminated until there ha$e #een se$en consecuti$e da&s freedom from the
perils concerned and onl& thereafter will the a#o$e e,cess amount appl&
afresh.
In respect of those EAR/SCE risks located in Earth5uake Ione I or II where the
clients do not re5uire co$er for Earth5uake 3erils* the a#o$e e,cess will #e
applica#le for all Acts of 6od perils other than Earth5uake "7ire - Shock/.
Note 4 The e,cess should appl& on the net claim amount after ad2usting for
Sal$age* depreciation and under insurance.
11. RULES (OR (IRE 1ROTE'TION (OR 'ONSTRU'TIONERE'TION SITES -
7or unprotected construction/erection sites of risks ha$ing Sum Insured less
than Rs. %! Crores e,cess applica#le shall #e !C of claim amount su#2ect to
minimum of testing period e,cess with an upper limit of Rs. ' Crores.
In respect of Risks with Sum Insured of Rs. %! Crores and a#o$e* the e,cess
applica#le shall #e '!C of claim amount su#2ect to minimum of testing
period e,cess with an upper limit of Rs. B Crores.

Insurers ma& reduce the e,cess to !C of claim amount su#2ect to minimum
of testing period e,cess* with upper limit of Rs. ' Crores where$er
re5uirements under Rule A"I/ #elow are complied with within first '%C of the
pro2ect period OR ' months whiche$er is less.
Insurers ma& also grant '.%C discount on EAR/SCE premium rates and reduce
the e,cess for fire/e,plosion claims to % C of claim amount su#2ect to
minimum of testing period e,cess with an upper limit of Rs. ' Crores in respect
of proposals which compl& with the rele$ant regulations under Rule A"I/ -
"II/ within first '% C of the pro2ect period OR ' months whiche$er is less.

i) =ne porta#le fire e,tinguisher of Soda Acid or 0ater t&pe for
e$er& B!! s5. m of storage/erection site area or small #ore hose
reels as per Re$e:ant Section o+ (ire 1rotection Manua$ o+ TA' shall
#e pro$ided. The location of fire e,tinguishers shall #e
conspicuousl& marked #& clearl& $isi#le signs. Checking and
maintenances at regular inter$als shall #e recorded.
ii/ Trained fire fighting s5uad shall #e maintained for the site.
iii/ 0atch and 0ard facilit& shall #e pro$ided round the clock at
the site/premises.
i$/ =ne fire engine of D!! 631 , !! 3SI shall alwa&s #e stationed
at site.
Note 4 <ot applica#le to polic& with Sum Insured upto Rs. %! crores
$/ 1aterials and e5uipments stored in #uildings "sheds/ or in open
area shall #e di$ided into su#4units with the $alue* which shall not
e,ceed !C of the sum insured or Rs. %! Crores whiche$er is less.
0here$er $alue of single e5uipment stored e,ceeds this limit* its
$alue shall #e taken as the limit. The su#4units in open area shall #e
separated from each other #& a distance of atleast % m. In case
of storage #uildings* firewalls of KL thickness carried upto roof shall
#e erected without an& wall openings #etween the su#4units.
$i/ 3acking materials* scaffolding etc. com#usti#le materials and
li5uids and e,plosi$e su#stances should #e stored at a B! 1 safe
distance from other #uildings* plants and stores.

$ii/ :tmost attention should #e paid to good housekeeping such as 4

either #& #urning on site at a safe distance of !! 1 or remo$al
from the siteM
Clean4up of site atleast once a weekM
$iii/=pen flame work "welding* cutting etc./ re5uires utmost caution.
All com#usti#le materials l&ing around must #e remo$ed or
co$ered.
i,/ 6rass and/or an& other $egetation in and around the site are
regularl& remo$ed.
,/ L<o smokingL rules must #e enforced in areas e,posed to fire "stores
etc./ and in the $icinit& of haGardous operations.
,i/ Ji$ing 5uarters should #e well separated "!! 1 awa&/ from
construction site.
,ii/ In addition to a#o$e* the following fire pre$ention measures are
recommendedF
a/ The site #e secured #& properl& constructed fence.
#/ Temporar& #uildings "offices* rest rooms* material stores etc./ #e
made of non 4 com#usti#le materials. Safe distances of % 1
#e kept #etween temporar& #uildings "this applies in particular
to material stores/.
II7 Additiona$ (ire 1rotection ReDuire)ents +or earnin* .iscount on
EARS'E 1re)iu)

i/ =ne fire engine or two trailer pumps of D!! 631 , !! 3SI shall
#e pro$ided for e$er& !*!!! S54m of largest storage site with
ma,imum of two 7ire Engines or D trailer pumps. In case of Trailer
pumps* $ehicular arrangements shall #e a$aila#le for towing them.

ii/ Static water tanks of atleast !*!!! gallons capacit& shall #e
pro$ided* which shall #e so placed that no part of
storage/erection site lies #e&ond !! 1 of atleast ' tanks "%! 1 in

h&drant mains shall #e laid which shall alwa&s #e pressurised to .!
NSC from where fire engines/Trailer pumps can draw their suppl&

to a static water tank descri#ed a#o$e. 3umping capacit& of the
general water suppl& shall #e in e,cess of *!!*!!! litres.
iii/ BH hoses* % 1 long and E noGGles shall #e pro$ided to ensure
that all parts of the contract works can #e reached with water.
i$/ Trained fire fighting s5uad consisting of atleast E persons per
shift shall #e maintained at the site. "in lieu of Item A I"ii/ a#o$e/
6 Reduction in EEcess and *rantin* o+ .iscount in EARS'E 1re)iu) +or

risk complies with the additional re5uirements for 5ualif&ing for the
discount.
12. =IG=ER EC'ESS .IS'OUNT -
A/ All rates for SCE insurances are su#2ect to minimum e,cess per claim
separatel& for "a/ normal period and "#/ testing period as prescri#ed in the
rate schedule.
The scale of discounts for opting @8igher E,cessA "#oth for normal and

O/ It is permissi#le to grant discounts as per following scale in the Earth5uake
premium alone.

These discounts in the Earth5uake premium onl& can #e allowed

are opted or not for the EAR/SCE Co$er.
The higher Earth5uake E,cess will 5ualif& for discount in the Earth5uake
premium onl& and not in the SCE premium* for which the pro$isions
under Items <o. "A/ a#o$e shall appl&.
C/ The discounts applica#le in the SCE Rate and/or the Earth5uake
premium Pas e,plained in "A/ and "O/ a#o$eQ for selection of higher
E,cess amounts are also applica#le* as under on F
i/ Rates for E,tension #e&ond polic& period.

ii/ Additional rates for Earth5uake "7ire - Shock/ 3erils during E,tension
period .
9/ In respect of some of the Items "like Computer* Railwa& electrification*
Tanks* Transmission Jines etc./ of the Rate schedule and the claims arising
out of Acts of 6od and 7ire 3erils* the E,cess amount is e,pressed as
percentage of the claim amount. 7or such items* if higher E,cess amounts
are selected and corresponding discount is en2o&ed in the EAR/SCE rate*
the minimum amount for the e,cess e,pressed in percentage has to #e
increased in the same proportion of the <ormal and testing period
E,cesses.
1F. 'LEARAN'E AN. REMO8AL O( .E6RIS -
The rate applica#le for Storage4cum Erection co$er is to #e charged on
the limit of Sum Insured fi,ed for @Clearance and Remo$al of 9e#ris.A

0here the 3ro2ect is a mi, of #oth old and new machiner&* the EAR/SCE Rate
as applica#le for the new machiner& is to #e charged on the limit of sum
insured selected for Clearance and Remo$al of 9e#ris.

Note4 In case of clearance and remo$al of de#ris clause* if no premium is
realiGed* the 5uestion of Indemnification of such e,penses would not
arise. 8owe$er* if for such damaged propert& which ma& ha$e a
sal$age $alue* retrie$al e,penses are incurred* such e,penses ma& #e
paid for on merits of each case.
The polic& E,cess "<ormal/Testing 3eriod/ should appl& for the Clearance
and Remo$al of 9e#risA claims.
<o separate e,cess for de#ris remo$al need #e applied. =nl& one e,cess
which shall #e the polic& e,cess shall appl& on such claims.

7or Third 3art& Jia#ilit& claims arising out of Acts of 6od 3erils* the E,cess
applica#le to A=6 claims should appl&.

The Sum Insured for T3J Co$er cannot #e reinstated after occurrence of
loss.
The Tariff e,tension rate shall appl& for T3J Co$er also during e,tension
period.
0hen different sections of 3ro2ect are co$ered for different e,tension
periods under the polic&* the highest of such Tariff e,tension rates shall
#e charged for T3J co$er during e,tension.
Third 3art& Jia#ilit& Co$er cannot #e granted during e,tended
maintenance.
67 'ROSS LIA6ILITG 'O8ER -
The Third 3art& Jia#ilit& Co$er can #e modified to offer co$er to the
insured parties named in the 3olic& schedule as if a separate polic&
has #een issued to each part&. The additional premium for this
purpose shall #e %! C of the premium applica#le for T3J co$er as in "A/
a#o$e.
1-. TERRORISM 'O8ER -

<o additional rate is to #e charged for this co$er.
1/. 'I8IL 2OR5S -
The ci$il works related to machiner& foundations should necessaril& #e
co$ered along with the machiner& under EAR/SCE 3olicies.
The rate as applica#le for EAR/SCE co$er is to #e charged on the limit of Sum
Insured fi,ed for ci$il works.
The polic& e,cess "<ormal/Testing period/ should appl& for Ci$il 0orks also.
13. 'OST O( ERE'TION -

The rate applica#le to Cost of Erection would #e the EAR/SCE rate.
19. SURROUN.ING 1RO1ERTG O( T=E INSURE. -
7or co$ering the specified surrounding propert& of the Insured the rate
applica#le will #e %! C of the EAR/SCE rate and should #e charged on the
limit of sum Insured selected for surrounding propert&.

Reinstatement of the indemnit& limit on pa&ment of additional premium after
occurrence of claim can #e allowed for this e,tension.
1<. ES'ALATION 1RO8ISION -
0hene$er additional Sum Insured is re5uired for Escalation in the $alues* the
Escalation Oenefit will #e limited to a ma,imum of %! C of the sum insured for
EAR/SCE "the escalation limit shall #e e,pressed in percentage/ and will #e
permitted onl& once at the time of inception of the EAR/SCE 3olic&.
Additional 3remium should #e charged for AEscalation 3ro$ision. at the
rates prescri#ed for EAR /SCE/* #ut on the %! C of the amount of escalation.
The method of premium calculation will #e as underF ?

2B. MI.-TERM IN'REASE IN SUM INSURE. -
If the Sum Insured for EAR/SCE is re5uired to #e increased during the 3olic&
period the premium should #e collected on the additional Sum Insured at
applica#le EAR/SCE rate. It is not permissi#le to charge pro4rata premium on
such increased Sum Insured.
1id4term increase in Sum Insured shall #e affected onl& after the same has
#een recorded in the polic& #& the Compan&* #efore the occurrence of an&
claim.
In such cases* no additional $olume discount shall #e applica#le.

AN. O8ERTIME RATES O( 2AGES -
The additional premium for co$ering E,press 7reight "Air 7reight e,cluded/
8olida& and =$ertime Rate of 0ages will #e at the #asic SCE Rate
"e,cluding e,tras for Earth5uake* 9ismantling etc./ to #e applied on the limit
selected.
Reinstatement of the indemnit& limit on pa&ment of additional premium
after occurrence of claim can #e allowed for this e,tension.
22. A..ITIONAL RATE (OR AIR (REIG=T ONLG -
The Rate and E,cess as under shall #e charged e,clusi$el& for items of Air
7reight onl& and su#2ect to the limit selected #& the Insured for Indemnit&
against Air 7reight onl& ?
Rate % C on the amount of indemnit& selected
E,cess % C of the Air 7reight incurred per claim* in
addition to polic& E,cess.
Reinstatement of the indemnit& limit on pa&ment of additional premium after
occurrence of claim can #e allowed for this e,tension.
Air 7reight co$er applies to #oth 1arine and SCE portion of a 1CE 3olic&.
2F. A..ITIONAL 'USTOMS .UTG -
The co$er for Additional Customs 9ut& will #e su#2ect to the following rates*
terms and conditions 4
a/ The co$er for Additional Customs 9ut& will #e on first Joss Oasis.
#/ The specific amount for Additional Customs 9ut& has to #e selected #&
the insured at the inception of the polic& and cannot #e reinstated in the
e$ent of loss.
c/ The rate and e,cess will #e as under ?

s&nchronisation is within (' hours from the date of introduction of steam into
tur#ine and shall continue till the Tur#o 6enerator Set is operated at full
load for a continuous period of (' hours or until e,pir& of testing period
granted under the polic& whiche$er is earlier. If* howe$er* the date of

the first trial operation test loading is deemed to ha$e commenced from the

29. TESTING 1ERIO. (OR 1LANTS OT=ER T=AN T=ERMAL 1O2ER 1LANTS -
Testing period a$aila#le under the polic& shall cease to operate with the
commencement of the commercial production or with the handing o$er of
the plant to the principal whiche$er is earlier. In no case* the duration of the
testing period shall e,ceed ' months.

2<. SUS1ENSION O( TESTING 1ERIO. -
If testing is suspended after commencement of test run and if such
period during which no testing acti$it& is carried on e,ceeds ( da&s in
duration* it can #e treated as erection period* pro$ided

and agreed that entire 3ower Station machiner& insured hereunder are deemed
to ha$e commenced their first test operation or test loading from the date of
s&nchronisation of the Tur#o 6enerator set with the grid s&stem/#us #ar pro$ided
the date of s&nchronisation is within (' hours from the date of introduction of
steam into tur#ine and shall continue till the Tur#o 6enerator Set is operated
at full load for a continuous period of (' hours or until e,pir& of testing period
granted under the polic& whiche$er is earlier. If* howe$er* the date of
s&nchronisation e,ceeds (' hours from the date of introduction of steam of the
first trial operation* test loading is deemed to ha$e commenced from the date of
introduction of steam into the tur#ine of the Tur#o 6enerator set.
If the trial operation/test loading is not completed within the time specified
hereunder the Compan& ma& e,tend the period of testing on receipt of
additional premium at agreed rates #ut in no case the total test period a$aila#le

ENGGEN.-1B<H =G.RO'AR6ON EN.ORSEMENT (OR TESTING @ 'OMMISSIONING
Artic$e 1 -
It is warranted that the insured shall gi$e pre$ious notice in writing to the
Compan& of the date of the initial start 4 up operation for testing of plant.
Commencing date of the initial start4up operation referred to in the preceding
paragraph shall mean the date of the first introduction of feed stock or initiall&
filled mi,ture of oil or 8&drocar#on for cleaning or purging or <aphtha 7uel for
#urning into the plant* whiche$er date is earlier. 8owe$er the operation carried
out for cleaning and purging in each indi$idual unit will #e considered a part of
erection work pro$ided such cleaning and purging work does not e,ceed a
period of two weeks in each unit. It is howe$er under stood and agreed that
during an& operation whate$er cleaning* purging* testing or commissioning*
where h&drocar#ons or 8&drogen are in$ol$ed the deducti#le e,cess shall #e %
C of claim amount su#2ect to minimum of Rs. %*!!*!!!/4.
Artic$e 2 -
As from the introduction of h&drocar#on/feedstock into the plant* the compan&
shall not #e lia#le for the loss or damage to 4
a/ Catal&sts unless specificall& co$ered #& separate endorsementM
#/ Reforming units due to o$erheating or cracking of an& tu#es.
Note- An& conse5uential damage to the neigh#ouring items of plant or
machiner& indirectl& due to cracking or o$erheating of tu#es in reforming
units is howe$er indemnifia#le under the polic&.
c/ The insured plant due to o$erheating or cracking following an e,othermic
reaction.
d/ The insured plant due to non4o#ser$ation of prescri#ed techni5ues or cutting
out of safet& de$ices and/or an& lia#ilit& resulting therefrom.
The Insurers shall onl& indemnif& the Insured for loss or damage resulting directl&
or indirectl& from fire and/or e,plosion if ade5uate fire fighting facilities for the
insured plant are installed and rendered ser$icea#le immediatel& after the

completion of the rough structure of the #uilding and #efore an& machiner& is
stored and/or installed therein.
All machiner& and e5uipments shall #e stored in such a manner that the $alue
of items stored per storing unit shall not e,ceed Rs WWW and that such indi$idual
storing unit shall #e at least WWWWW feet apart separated #& fireproof walls.
Should the $alue per storage unit e,ceed Rs. WWWW then in the e$ent of a claim*
the lia#ilit& of the Compan& shall #e in the same proportion as Rs WWWW #ears to
the total $alue of items stored in the concerned indi$idual storage unit as
defined a#o$e.

during storage upto a $alue per storage unit not e,ceeding the e5ui$alent of

In an& action* suit or other proceedings where the compan& allege that #&
reason of the pro$isions of E,clusion "a/ a#o$e an& loss* destruction* damage or
lia#ilit& is not co$ered #& this insurance* the #urden of pro$ing that such loss*
destruction* damage or lia#ilit& is co$ered shall #e upon the Insured.
57 1ERIO. O( 'O8ER
The lia#ilit& of the Compan& shall commence* "notwithstanding an& date to the
contrar& specified in the Schedule/ onl& from the time after the unloading of the
propert& specified in the Schedule from an& con$e&ance at the site specified in
the schedule and shall continue until immediatel& after the first test operation or
test loading is concluded "whiche$er is earlier/ #ut in no case #e&ond four
weeks from the da& on which after completion of erection a trial running is
made and/or readiness for work is declared #& the erectors/contractors*
whiche$er is earlier. If howe$er* a part of a plant or one or se$eral machine/s is/
are tested and put into operation the co$er and conse5uentl& the lia#ilit& of the
Compan& for that particular part of the plant or machine ceases whereas it
continues for the remaining parts which are not &et read&.
In case after the e,pir& of four weeks of trial running* appro$al of the plant or an&
part thereof is not gi$en #& the concerned Authorities the co$er for the
e,tended period of further trial running can #e co$ered at e,tra premium to #e
arranged #efore hand.
If the actual erection period is shorter than the period indicated in the Schedule*
no refund of premium shall #e allowed* unless specificall& allowed #& Insurers.
In the case of second4hand/used propert&* the insurance hereunder shall
howe$er* cease immediatel& on the commencement of the testing.
At the latest* the insurance shall e,pire on the date specified in the Schedule #ut
if the work of erection and test operations included in the insurance is not
completed within the time specified hereunder* the compan& ma& e,tend the
period of Insurance #ut the Insured shall pa& to the Compan& additional
premium at agreed rates.
GENERAL 'ON.ITIONS -
1. The due o#ser$ance and fulfillment of the terms of this 3olic& in so far as the&
relate to an&thing to #e done or complied with #& the Insured and the truth
of the statements and answers in the 5uestionnaire and proposal made #&
the Insured shall #e a condition precedent to an& lia#ilit& of the compan&
2. The Schedule and the Section"s/ shall #e deemed to #e incorporated in and

F. The Insured shall at his own e,pense take all reasona#le precautions and
compl& with all reasona#le recommendations of the Compan& to pre$ent
loss* damage or lia#ilit& and compl& with statutor& re5uirements and
manufacturersA recommendations.
%?a7 Representati$es of the Compan& shall at an& reasona#le time ha$e the
right to inspect and e,amine the risk and the Insured shall pro$ide the
representati$es of the compan& with all details and information necessar& for
the assessment of the risk.
&7 The Insured shall immediatel& notif& the Compan& #& telegram and in
writing of an& material change in the risk and cause at his own e,pense
such additional precautions to #e taken as circumstances ma& re5uire
and the scope of co$er and/or premium shall* if necessar& #e ad2usted
accordingl&.
<o material alteration shall #e made or admitted #& the Insured where#& the
risk is increased unless the continuance of the Insurance #e confirmed in
writing #& the Compan&.
-. In the e$ent of an& occurrence* which might gi$e rise to a claim under this
3olic&* the Insured shall 4
a/ immediatel& notif& the Compan& #& telephone or telegram as well as in
writing gi$ing an indication as to the nature and e,tent of loss or
damage.

The Compan& shall not in an& case #e lia#le for loss* damage or lia#ilit& of

detection.
:pon notification #eing gi$en to the Compan& under this condition* the
Insured ma& carr& out the repair or replacement of an& minor damage not
e,ceeding Rs. (*%!!/4. In all other cases a representati$e of the compan&

shall ha$e the opportunit& of inspecting the loss or damage #efore an&
repairs or alterations are affected. If a representati$e of the compan& does
not carr& out the inspection within a period of time which could #e
considered as ade5uate under the circumstances the Insured is entitled to
proceed with the repairs or replacement.
The lia#ilit& of the Compan& under this 3olic& in respect of an& item
sustaining damage shall cease if said item is not repaired properl& without
dela&.
/. The Insured shall at the e,pense of the Compan& do and concur in doing
and permit to #e done all such acts and things as ma& #e necessar& or
re5uired #& the Compan& in the interest of an& rights or remedies* or of
o#taining relief or indemnit& from parties "other than those insured under this
3olic&/ to which the compan& shall #e or would #ecome entitled or
su#rogated upon their pa&ing for or making good an& loss or damage under
this 3olic&* whether such acts and things shall #e or #ecome necessar& or
re5uired #efore or after the InsuredAs indemnification #& the compan&.
3. If an& dispute or difference shall arise as to the 5uantum to #e paid under this
3olic& "lia#ilit& #eing otherwise admitted/ such difference shall independentl&
of all other 5uestions #e referred to the decision of a sole ar#itrator* to #e
appointed in writing #& the parties to or* if the& cannot agree upon a single
ar#itrator within B! da&s of an& part& in$oking Ar#itration* the same shall #e
referred to a panel of three Ar#itrators comprising of two Ar#itrators 4 one to
#e appointed #& each of the parties to the dispute/difference* and the third
Ar#itrator to #e appointed #& such two Ar#itrators and ar#itration shall #e
conducted under and in accordance with the pro$isions of the Ar#itration
and Conciliation Act KKH.
It is clearl& agreed and understood that no difference or dispute shall #e
refera#le to ar#itration as herein#efore pro$ided* if the Compan& has
disputed or not accepted lia#ilit& under or in respect of this 3olic&.
It is here#& e,pressl& stipulated and declared that it shall #e a condition
precedent to an& right of action or suit upon this 3olic& that the award #&
such Ar#itrator/Ar#itrators of the amount of the loss or damage shall #e first
o#tained.
9. If a claim is in an& respect fraudulent* or if an& false declaration is made or
used in support thereof* or if an& fraudulent means or de$ices are used #& the
Insured or an&one acting on his #ehalf to o#tain an& #enefit under this 3olic&*
or if a claim is made and re2ected and no action or suit is commenced within
three months after such re2ection or* in case of ar#itration taking place as
pro$ided therein* within three months after the Ar#itrator or Ar#itrators or
:mpire ha$e made their award* all #enefit under this 3olic& shall #e
forfeited.

<. If at the time an& claim arises under this 3olic& there #e an& other insurance
co$ering the same loss* damage or lia#ilit& the compan& shall not #e lia#le to
pa& or contri#ute more than their ratea#le proportion of an& claim for such
loss* damage or lia#ilit&.
1B. This insurance ma& #e terminated at the re5uest of the Insured at an& time in
which case the Insurers will refund appropriate premium amount su#2ect to
the following conditions.
i/ Claims e,perience under the polic& as on date of cancellation should
#e less than H! C of reworked premium.
ii/ The une,pired period is not less than B months or '%C of the polic&
period* whiche$er is less
iii/ Testing period should not ha$e commenced.
This insurance ma& also at an& time #e terminated at the option of the Insurer
#& % da&s notice to that effect #eing gi$en to the Insured in which case the
Insurers shall #e lia#le to repa& on demand a ratea#le proportion of the
premium for the une,pired term from the date of cancellation.
SE'TION I - MATERIAL .AMAGE
The Compan& here#& agrees with the Insured "su#2ect to the e,clusions and
conditions contained herein or endorsed hereon/ that if* at an& time during the
period of insurance stated in the said Schedule* or during an& further period of
e,tension thereof the propert& "e,cept packing materials of an& kind/ or an&
part thereof descri#ed in the said Schedule #e lost* damaged or destro&ed #&
an& cause* other than those specificall& e,cluded hereunder* in a manner
necessitating replacement or repair the Compan& will pa& or make good all
such loss or damage up to an amount not e,ceeding in respect of each of the
items specified in the Schedule the sum set opposite thereto and not e,ceeding
in the whole the total sum insured here#& 4
The Compan& will also reim#urse the Insured for the cost of clearance and
remo$al of de#ris following upon an& e$ent gi$ing rise to an admissi#le claim
under this polic& #ut not e,ceeding in all the sum "if an&/ set opposite thereto in
the Schedule.
L7 EC'LUSION TO SE'TION I -

f/ loss of or damage to files* drawings* accounts* #ills* currenc&* stamps* deeds*

g/ an& damage or penalties on account of the InsuredAs non4 fulfillment of the
terms of deli$er& or completion under his Contract of Erection or of an&
o#ligations assumed thereunder including conse5uential loss of an& kind or
description or for an& aesthetic defects or operational deficiencies.
1RO8ISIONS A11LGING TO SE'TION I -
Me)o 1. SUM INSURE. ?
It is a re5uirement of this insurance that the Sum of Insurance stated in the
Schedule shall not #e less than the completel& erected $alue of the propert&
inclusi$e of freights* customs dut&* erection cost and the Insured undertakes to
increase or decrease the amount of insurance in the e$ent of an& material
fluctuation in the le$el of wages or prices. 3ro$ided alwa&s that such increase or
decrease shall take effect onl& after the same has #een recorded on the 3olic&
#& the Compan&.
If* in the e$ent of the occurrence of a loss* or damage it is found that the Sum
Insured representing the completel& erected $alue of the propert& and/or of
particular items in$ol$ed is less than the amount re5uired to #e insured the
amount reco$era#le #& the Insured under the 3olic& shall #e reduced in such
proportion as the Sum Insured #ears to the amount re5uired to #e insured.
M7 Me)o 2. 1REMIUM A.JUSTMENT ?
The sum insured under the 3olic& representing the completel& erected $alue of
the plant machiner&/pro2ect shall #e ad2usta#le at completion of erection on
the #asis of the actual $alues to #e declared #& the insured in respect of freight
and handling charges* customs dues and costs of erection and the difference in
premium shall #e met with #& pa&ment* at the rate agreed to or #& the insured

N7 Me)o F. 6ASIS O( LOSS SETTLEMENT 4
In the e$ent of an& loss or damage the #asis of an& settlement under this 3olic&
shall #e 4
a) in the case of damage which can #e repaired* the cost of repairs necessar&
to restore the items to their condition immediatel& #efore the occurrence
of the damage less sal$age* OR
b) in the case of a total loss the actual $alue of the items immediatel& #efore
the occurrence of the loss $ess sal$ageM
8owe$er* onl& to the e,tent the costs claimed has to #e #orne #& the Insured
and to the e,tent the& are included in the Sum Insured and pro$ided alwa&s that
the pro$isions and conditions ha$e #een complied with.
All damages which can #e repaired shall #e repaired* #ut if the cost of repairing
an& damage e5uals or e,ceeds the $alue of the items immediatel& #efore the
occurrence of the damage the settlement shall #e made on the #asis pro$ided
for in "#/ a#o$e.
The cost of an& pro$isional repairs will #e #orne #& the Compan& if such repairs
constitute part of the final repairs and do not increase the total repair e,penses.
The cost of an& alterations* additions and/or impro$ements shall not #e
reco$era#le under this 3olic&.
EEtension o+ 'o:er An& e,tra charges incurred for o$ertime* work on
holida&s* e,press freight "including air freight/* are not co$ered #& this
insurance* unless agreed upon at an additional premium.
In the e$ent of loss or damage the insurance shall notwithstanding #e
maintained in force during the period of insurance for the sum insured* the
insured undertaking to pa& a pro4rata additional premium of the full amount of
each claim for the loss or damage from the date of such loss to the e,pir& of the
