Mr. Reynaud,
I have attached scanned copies of four (4) registration forms our office believes to be blatantly altered. Also
attached is a statement prepared by myself as well as affidavits that were completed by the registrars
responsible for the attached registration forms. Upon close examination you can see that an (R) was placed in
the party box after the registrant checked the "NO PARTY" box. I took my investigation further by callng Mr.
George Kozloski, the only registrant with a phone number, where he confirmed that he and his wife wish not to
be affiliated with any political party.
Mr. Kozloski also stated that he and his wife registered at the local republican party headquarters.
This lead to looking into additional registration forms that were submitted to our office by the local
headquarters in which two additional have be located thus far.
Please keep me updated on what transpires from the investigation.

Election Code Violation/Altered Registration Forms
Upon entering voter registration forms. Election Street Specialist, Bryan Carver
noticed two (2) different types of ink being used on two (2) different registration fOlll1S in
box #5 "Party aftiation". When closely examined both registration forms were blatantly
altered. Registrants checked the "NO PARTY" box on each of their registration forms
wishing not to be affiiated with a political party. It appears that aileI' completion the
voter registration agent "VRA" placed an "R" in the party box signifying that voters
wished to be registered as Republicans.
Prior to forwarding this matter to the authorities I placed a call to Mr. George
Kozloski. registrant who completed registration form, on October 4.20 10 at 10:33am. In
speaking with Mr. Kozloski regarding him and his wife's registration form he indicated
that he and his wife had checked a box wishing not to be affiliated with a im~jor political
party. Mr. Kozloski also said that he and his wife had completed their registration frms
at the local DoHa Ana Republican headquarters on 9-30-20 1 O. (Present during phone call
was Supervisor alEleclioiis Trey LaFleur and ElectonC'oordinator Lorrie M1I10:;)
In proceeding, I placed a call to the Republican Party office at 10:35am (526-
1332), where Lisa O. Tillery VRA#l 0599 answered. Ms. Tillery was also the agent that
registered Mr. and Mrs. Kozloski. I made Ms. Tillery fully aware of what I had
discovered in which she denied altering any registration forms. 1 reminded her that upon
becoming a VRA she was responsible for any and all voter registration forms distributed
to her and it was explained that under no circumstances may she alter a registration form.
i notified Ms. Tillery that i will be fOl'\/arding the matter on to the appropriate law
enforcement/authorities. (Present during phone call lFas Supervisor atElections Trey
LaFleur and Election Coordinator Lorrie Mu;'jo:)
Ms. Tillerys actions lead to further investigation by looking into additional
registration 10r11s submitted to our office by the local Republican headquarters in which
two (2) additional altered registration forms have been located thus far. Both registration
forms bare a similar ""R" to that placed on the registration forl1 submitted by Ms. Tillery.
One was submitted by, local Republican Chair. Mark VanDyke VRA #0140 and Doyle
Pruitt VRA# 0102.
The above actions are a clear violation of the Nevv Mexico Election Code

The penalties imposed by Sections i -20-3 through 1-20-23 NrvlSA 1978 do not apply to

1-20-2. Scope of penalty provision.
A. Unless otheiwise provided in the law goveming elections of a political subdivision,

apply to all elections conducted in the state.
B. "Election Code" as used in Sections i -20-4 through 1 -20-22 NMSA 1978 includes laws
goveming the elections of iminicipalities, school districts or bond elections held pursuant to the
Bond Election Act (6- 1 5-23 to 6- 1 5-28 NMSA i 978).

1-20-6. Unlawful possession of keys.
Un lawf. i possession of keys consists of the possession at any time of any key to a voting
machine or ballot box, or possession of an imitation or duplicate thereof, or making or causing to
be made any imitation or duplicate thereof, unless authorized by the Election Code (Chapter I
NMSA 1978).
Whoever commits unlawful possession of keys is guilty of a fourth degree flony.

1-20-7. Unlawful possession of absentee ballot.
Unlawful possession of absentee ballot consists of the possession at any time of absentee
ballot materials when not authorized by the Election Code (Chapter i NMSA 1978) to be in
possession of such materials, or when such materials were obtained in an unlawful manner. As
Used in this section, "absentee ballot materials" means an absentee ballot, absentee ballot
envelopes, the absentee ballot register or an absentee ballot return.
