JUDICIAL AFFIDAVIT OF
WITNESS JULIE CUABO

I, JULIE CUABO, of legal age, married, and living at 232 Gonzales
corner Roxas St., Surigao City, witness in this case, state under oath
as follows:

PRELIMINARY STATEMENT

The person examining me is Assistant City Prosecutor CLAYTON
DELGADO with address at Bagong Silang, Surigao City. The
examination is being held at the City Prosecutors Office, Surigao
City. I am answering his questions fully conscious that I do so under
oath and may face criminal liability for false testimony and perjury.

PURPOSE: This affidavit/testimony of witness JULIE CUABO is
being offered to prove that the accused EDWIN RAMOS made a
threat against the life of the deceased DONALD CUABO a week
before the incident occur and other facts relevant to this instant case.

1. Q: Please state your name and other personal
circumstances for the record.
A: I am Julie Cuabo, single, 29 years old, maried, residing
at 232 Gonzales corner Roxas St., Surigao City.

2. Q: You said that you are married, who is your husband?
A: I am married to DONALD CUABO.

3. Q: Where is he now?
A: He is already dead.

4. Q: How did he die?
A: He was shot in the head in front of our house.

5. Q: When did it happen?
A: At around 7:30 in the evening, on November 30, 2013.

6. Q: What was your husband doing during that day before
he died?
A: It was Saturday; it was his hobby to go to the poker
house every Saturday.

7. Q: Where is the poker house located?
A: In Borja Street sir.

8. Q: How far is the poker house from your house?
A: Walking distance sir, at around 600 meters from our
house.

9. Q: At what time he usually go home after playing poker?
A: He usually arrives at around 7:00pm for diner.

10. Q: What do you think is the motive of the assailant?
A: Anger sir.

11. Q: Why? Who do you think is the assailant?
A: The accused sir; Edwin Ramos, I heard him threaten to
kill my husband while they were in heated argument a
week before the incident happens.

12. Q: Where did you hear such threat?
A: At the poker house sir, I was with my husband when
he gave such threat.

13. Q: So you were in the poker house? What are you doing
there?
A: It was around 9:00pm, on Saturday of November 23,
2013, I was worried when my husband did not come
home for dinner, so I went to the poker house to check
him and ask him to have dinner.

14. Q: What did you see in the poker house?
A: I saw my husband and the Edwin Ramos had a heated
argument.

15. Q: What happen next?
A: I heard the accused said I will kill you.

16. Q: What did your husband do?
A: My husband said Do it, I am not afraid of you, make
sure you will kill me first

17. Q: What did you do?
A: I immediately embrace my husband and ask him to go
home.

18. Q: What did your husband do?
A: He heeded my request, and we went home.
