It all began in the early 1900s when tin ore was discovered in the
Kathu area and hundreds of Hokkien Chinese were drafted in to
do the mining. They either brought their families with themor
intermarried with the locals. A thriving community blossomed,
and in 1825 the Governor Praya Jermmoved the capital town
from Ta Reua to Kathu.
Each year,at this time, the area around Phukets
Fresh Market becomes congested with food
stalls and everywhere is festooned with red
lanterns and Chinese dragons, all centred on
the Jui Tui shrine. One of the fascinating aspects
of Phukets cultural traditions is the complex
fusion of Chinese religious beliefs, with those of
the original inhabitants of the island.
The Chinese community had such critical mass that an itinerant
Chinese opera company visited to entertain them. Here the story gets
a little confused, but basically the whole area was struck by a major
epidemic and almost everybody except the opera players became
sick. Following their beliefs, the players had stuck to their religious
calendar, which at this time of year required that they observe a strict
vegetarian diet and ofer prayers to two Chinese gods, Kiew Ong Tai
and Yok Ong Sone Teh. The residents attributed their invulnerability to
these religious observances.
An alternative explanation may be that since Kathu was a swampy
jungle and it was the time of the monsoon rains, the visitors may have
introduced a malarial strain, to which they themselves were immune,
to the local mosquitoes which thrived in the damp conditions. When
the rains stopped the insects breeding ponds disappeared and the
epidemic abated naturally.
Be that as it may. The following year, the Haio Lan and Lian Tui regalia
and sacred scripts were brought fromChina. When this precious cargo
arrived at Bang Niao, the whole community went there to welcome
the ship. The tradition of processions was thus born.

Onshore, Cape Panwa Hotel underlined its reputation for excellence,
hosting four fantastic parties that kicked of with the Mount Gay
Rum opening party, fnishing with a fnal night of great food, wine,
beer and cocktails, and live entertainment including Gig and the
Z-Machine, keeping sailors, friends and island luminaries partying
into the wee hours.
Mr. Byron Jones, Managing Director of organisers Media Business
Services (MBS) commented, The Host Venue and Title Sponsor,
Cape Panwa Hotel have done a fantastic job again this year. The
parties, the venue, the service, everything went really well and we
had lots of very encouraging feedback fromthe sailors. Cape Panwa
Hotel is a key ingredient in the success of Raceweek and we are
working closely together to make next years Regatta even better.
Split over seven classes the 36 boats racing this year represented
one of the most competitive feets in the Regattas history.
As the saying goes, size isn't everything and two wins on Day One
were followed by two more wins on Day Two for the Mills King 40
Foxy Lady VI, smallest in the IRC Racing I class. Despite a fourth place
in the last race Foxy Lady VI had already done enough to win the
class ahead of Island Fling in second and the TP52 Oi! in third place.
Apparently not much, as this year's Cape Panwa Hotel Phuket
Raceweek saw more international entries, more sailors chartering
local boats to race, and more countries represented than ever
before.
Raceweek has established a well-earned reputation for delivering
some of the best beachside regatta parties in Asia combined with
world-class racing, and this year was no diferent. An experienced
local Race Management team lead by ISAF International Race
Of cer Simon James endured a tough four days with everything
from good breezes to light breezes to no breezes to contend with,
and they took it all in their stride fnishing with a full complement
of races for all classes.

Aventure, Classic class, Day 1_CPHPRW2014
New to the Asian circuit, Jessandra II, was one of the unknowns
in IRC Racing II, and with a combination of onboard international
experience and local knowledge they sailed the perfect regatta,
undefeated fve wins from fve races while Greg Reynolds'
Mumm30 Foreign Afair held of Ruby Tuesday for second and third
respectively.
In Cruising, an RAF for local sailor MikeDownars Sail in Asia Pinocchio
in Race Three (Day Two) proved to be their downfall, pushing them
into second overall. Consistent sailing from Hedonist with a 2, 2, 1,
2 scoreline saw them take the class title while the all-Thai crew on
Sansiri Windstar placed third.
There was some close racing in the Charter/ Bareboat class with
three boats all sharing the top step of the podium over the series.
With no drop race available, Ventures fourth in the frst and last race
hit them hard placing them second overall behind eventual class
winner Little Eva.
Alan Carwardine skippered Asia Catamarans Hurricane to two wins
on the opening day and a share of the spoils with sister-ship Java in
Multihull Racing on Day Two. However, the last day belonged to the
smallest in the class, Bullet, who sailed to their frst win of the series
enough for themto secure third overall behind Java in second but
no-one could catch Asia Catamarans Hurricane who fnished top of
the standings.
Back to defend their title in the Firefy 850 class were Twin Sharks,
and Advanced Racing Mamba was close on their heels. A DSQ in
Race Four for Mamba put an end to their title hopes and they had to
settle for second place behind back-to-back Raceweek winner Twin
Sharks, with Voodoo fnishing third.
Having long promoted classic sailing, Raceweek welcomed three
classics this year an impressive vista of age and beauty. The new-
build-old-design Aventure took the frst race win with Sirius winning
Race Two and Seraph Race Three. Sharing the spoils was ftting for
these Grande Dames but there had to be an eventual a winner, and
it was the centenarian Seraph who took home the perpetual classic
trophy at the fnal prize-giving party.
The line-upof boats and the on-water racing this year was probably
one of the most competitive ever. The increased international
participation is a good sign for the future and something we will
continue to develop as the regatta grows into its twelfth year next
year, added Jones.
The award-winning Cape Panwa Hotel Phuket Raceweek continues
to deliver great racing and magical party nights in Phuket's summer
season and is the opening event of the 2014/15 AsianYachting
Grand Prix. Mark your diaries: The 12th Cape Panwa Hotel Phuket
Raceweek will take place 15th to 19th July 2015.

What do you like most about living in Phuket? I like the
openness of the local Thai society. Almost everyone I've met here,
fromfarmhands to Senators, has been welcoming. Come inside!
Have you eaten yet? I count myself lucky to have so many good Thai
friends
Whats the hardest/most frustrating thing about living here?
I fnd dealing with bureaucratsin a word: stressful. Unnecessarily
so I dont like the abiding attitude that they are somehowsuperior
to everyone, especially when my taxes and those of all honest
citizens are paying their wages.
Howold are you? Im63 years old.
What do you think the future holds for you? When you think
about it theres not a huge amount of it left, is there? But Imlooking
forward to slowing down a little. Ive defnitely been working too
hard for too many years.
How do you evaluate success? To me, success is not at all about
possessions or money though like most people I like having
enough for us to be comfortable. Its more about doing things right.
My God, if anythingis Quality. I dont like to take anything on
unless I believe I can do it properly.
What do you do with your free time if you have any? I enjoy
painting water colours, going on road trips, exploring history. And
reading; I love to read.
Are you involved in any local charities, clubs or associations?
Imon the board of the Phuket Community Foundation some
people knowus as the Duck Race people though I have to admit
I dont have enough time to do as much as I should, or would like to.
Where are you from? ImfromNorth Wales in Britain, but close to
the border with England. My mother was English; my father was
Scots, so Ima bit of a mongrel.
When did you move to Phuket? We frst moved here in 1999 so
that makes around 15 years on the island.
Had you been here before? I frst came here on holiday with my
Thai wife Pen in 1980. We stayed in Patong. In those days it was
altogether diferent as there were just four bars along the beach, one
real hotel and Bangla Road was a dirt track with a fewshops along
the sides. Plus there was no road over Patong Hill! Mostly the terrain
consisted of rice felds with sugar palms soaring over them. In a
word, it was idyllic.
What made you decide to come and live here? I was in Hong
Kong when the Thai baht went through the foor in 1997, the day
after Hong Kong reverted to Chinese ownership, and all the Asian
economies followed. After two years I could see the magazine I was
working for was going nowhere, so I looked around for another job
in the region. It just so happened that there was a position going
in Phuket. This was good for us because Pen is fromThailand so for
her it was like coming home though because shes fromSrisaket
she had a lot of trouble understanding the Pak Tai (southerrn Thai)
regional accent at frst.
What did you do before you came to Phuket? I was six years
as a reporter and then sub-editor on local papers in the UK. Then
I went to the Middle East in 1978 where I spent two years in Saudi
Arabia, followed by four in Bahrain, two in Cyprus and two in Dubai.
I then spent 11 years in Hong Kong, always on the editorial side in
magazines or newspapers, just the same as nowadays.
Where do you live in Phuket and what infuenced your choice
of location? When we frst moved here we were living on the edge
of Phuket Town, renting, and had been on the lookout for a nice
place to buy. To tell you the truth we werent too worried about
where. We looked at many pieces of land and properties before
eventually we found a small fruit farm, with a house on it, and we
both said, Oh yes, this is it. We moved in almost 10 years ago, just
before the tsunami in 2004.
What kind of car do you drive and why? My wife drives a Honda
Jazz which I use when convenient, but I also have an Isuzu pick-up
truck. Its nearly 15 years old nowwith about half a million kilometres
on its clock, but its tough and keeps going forever like most diesels.
Weve done road trips all over Thailand apart fromthe south, which is
on our list for next time we want to explore. Granted, its a beast and
not that easy to park, but its a fne, reliable machine. Plus, repairs are
cheap and just about anywhere in Thailand you can fnd someone to
fx any problems when youre driving a diesel.

Anybody walking down the street in a Paul Ropp outft
will soon get used to hearing, Oh my God! That fabric
is incredible!! Paul Ropp customers know quite well
that the fabrics used to make their clothes is one of the
major aspects that make themlook so desirable. Intricate
designs, the majority of which are hand loomed, hand
printed, hand embroidered, and hand produced.
Everything about the creation of Paul Ropp clothing
is done by people not machines. There is an intimate
connection between PR clothing and the PR wearer
stemming fromthe handcrafted materials that creates the
adventurous designs we wear.
Paul Ropp fabrics are created in all corners of the Indian
sub continent, fromnorthern villages in Varanasi, western
villages in Bengal, and the eastern villages in Tamilnadu
in the south. The production of these fabrics not only
provides direct, or indirect, employment to thousands of
people in rural India, but it also aids in the preservation of
traditional techniques of intricate handloomweaving and
embroidery. The process of providing these villages with
this means of livelihood is in keeping with the Ghandian
philosophy of providing self sustenance to the villages in
order to eliminate the dependency of village dwellers on
city life and city resources.

Varanasi, on the other hand, is the source for the intricate
silk jacquard fabrics. These creations are produced by
means of fne silks woven on jacquard handlooms. The
loose threads on the back of the fabric, once completed,
are precisely hand cut to add the elegance that the fabric
exudes.
Paul Ropp values this hard work, and he prefers to use
the reverse side of the fabric in most of his hand cut silk
collections in order to bring out the dimensions and
texture that the fabric is able to provide. Usually, creating
a fabric such as this requires one week of hard work (from
weaving, to hand cutting, to production) in order to
merely make just ONE hand cut silk scarf.
Furthermore, Tamilnadus famous rich cultural heritage
and ancient weaving techniques allow for this destination
to be our main hotspot for woven country fabrics. Once
the fabrics fromtheir specifed locations are created, these
villages use silk screening methods, hand printing, or hand
embroidering in order to create the fnal production of the
elegant fabric as seen in Paul Ropp garments.
These methods and techniques of craftsmanship are what
give Paul Ropp fabric such importance and high value.
Each piece of fabric is unique and irreplaceable, which
only adds to the intense beauty it exudes. Interestingly,
the route which the creation of Paul Ropp pieces takes
touches all corners of the world, and all types of religious
values. Initially produced in Hindu India, the fabrics
are then shipped for manufacturing in majorly Muslim

The main source of the PR featherlight fabrics is West
Bengal, which was once famous for the fnest of muslins.
These fne-count fabrics are intricately woven on
handlooms and the only necessary means of production
these villagers depend on are their delicate hands, with
skills that have been passed down fromgenerations
within the village, and a passion borne out of years
of practice. This process of hand looming requires no
machines, constructing an array of entirely unique designs
for each development, making it almost impossible to
recreate.
Due to the intricacies of this fabric production, the
amount of weaving completed in a full days work only
results in a couple metres of fabric.
Indonesia where the pieces are worked on by Muslims,
Hindus, Buddhists and Christians. These pieces are then
exported to countries such as Buddhist Thailand and
Catholic Philippines among 35 other countries. The world
travel of Paul Ropp fabrics, to export production exposes
a constructive example of global cohabitation which
produces a sustainable alternative branching out to
global cooperation. Thus, Paul Ropp garments are one-
of-a-kind pieces that create todays look as tomorrows
valued possessions. The intricacy and skill of the process of

Phuket Museums:
Kitschy Time Trip
Museums by their nature tend to be fusty and odd
and Phuket's two largest museums are no exception.
Informative? Sure. Eccentric? Defnitely.
Let's take a stroll through time ...
Millions of holidaymakers visit Phuket every year for a tropical
escape and leave with sunburns, smiles and sand between their
toes but, sadly, little idea of the island's rich history and culture.
Aiming to shore up the knowledge gap are two museums, the
Thalang National Museum, just east of the Heroine's Monument,
and the Phuket Mining Museum in Kathu.
The Mining Museumtakes some efort to reach but once you're
there you can't miss it. Housed in a large pink Sino-Portuguese
style building with a courtyard and fronted by a park and lagoon,
it's a rather incongruous sight in this remote, jungle-clad area of
Kathu.
In planning a museumthere must be decisions to be made
initially on how far back into the past to go. In this, the Mining
Museum leaves nothing to chance, ambitiously starting from
the beginning of time. Or, to be more specifc, the origin of the
sun, illustrated in a colourful hall with big dangling planets.
Fromthe space hall you enter a cave-like tunnel lined with
pictures of prehistoric creatures until you come face-to-face
with a hominid well, an ape-like, wild-eyed mannequin with
matted black hair, crouched in a cave, stone-age tools in hand.
Further along there's a more modern caveman clad in a rather
fashionable-looking leopard-skin loincloth, holding a spear,
looking none too pleased to see you. At this point you start to
wonder: Where's the tin?
The next hall answers this, featuring the museum's best
installation, an elaborate miniature diorama of an open-pit tin
mine operation in action. Hundreds of tiny workers are seen
working busily on the site, illustrated in great detail and whimsy.
While this and other, larger scenes depict some hard-working
souls toiling in the mines you can even see the sweat glistening
on their arms others show those who obviously didn't pull
their weight in Phuket's drive to tin-toned glory. In one hall
highlighting the arrival of the Chinese by sea, you walk a plank
between two large wooden ship models. Peek inside one of the
boats, and you'll spot a layabout, having a snooze on the deck.
Further along in the Chinese culture hall there's a man lazing on
a platformbed, sucking on an opiumpipe.
Some indoor and outdoor displays have explanatory signs in Thai
and English, while some are in Thai only. Others have peculiar
English phrasing, and some have no accompanying text at all.
The museumgives you some idea about Phuket's economic
and cultural development, but in a world with encyclopaedic
information and vivid imagery available at the touch of an
iPad screen, it falls a bit short in entertaining and informing
youngsters especially. And though it's only three years old,
there's already a distinct feel of neglect about the place.
Thalang National Museum, built more than 20 years ago, also depicts
scenes of times past with life-sized mannequins, the main one
featuring the legendary Phuket Heroines, Lady Chan and Lady Mook,
whose clever battle tactics saved the island frominvading Burmese
forces in 1785. Another scene shows King Rama I honouring the
sisters for their bravery and bestowing themwith the titles Thao
Thepkrassatri andThao Srisunthorn.
A small but informative place, the museumhighlights the geology,
geography and people that have shaped the culture of Phuket
and the Andaman region. The main entrance hall features exhibits
of Thai history in general, including its ties to the ancient Khmer
Kingdom, as well as the Indian infuence on the Andaman regions
culture and religion. Standing in the main hall is a 2.35-metre, 9th
century statue of Vishnu, found in the forest of Kapong district of
Phang Nga, a stunning example of Indias ancient link to the area.
The Hokkien Chinese infuence on the islands commerce,
architecture and culture is displayed in the third
hall, with shopfront scenes ofering
a peek into the daily life and
business of Chinese families.

including a scene of a sea gypsy boat-foating ceremony. In an
outdoor display are more sea-gypsy artefacts including model
thatch-roof huts and a traditional fshing boat.
Earning our vote as Phuket's most bizarre museumdisplay is the
Tsunami Exhibition Hall. Outside under a tin roof are long-tail boat
bits, a crunched-up car and other items salvaged fromtsunami
wreckage, arranged in a way that looks like, well, a trash heap. And
there are mannequins, of course! Mannequin body parts are strewn
among the wreckage, a head here, a torso there.
The takeaway fromthis tableau is that tsunamis smash stuf, but not
much else. Given the impact the 2004 Asian tsunami had on tens
of thousands of people across the region, much more could have
been done to memorialise this disaster.

Our verdict: More context, more interactivity, and fewer mannequins,
please! Our kids' verdict: 'Kinda creepy'. Upon seeing the hominid
model they wanted to leave!
Our verdict: Like the Mining Museum, the Wow! factor at Thalang
National Museumis low, but for a quick 'n' easy peek into Phuket's past
it's well worth a visit. Both are well worth including on your 'what to do
when it won't stop raining' list...

Ingredients
5 pcs chicken thigh (boneless) 1 tbsp garammasala
1 cup plain yoghurt 1/2 tbsp ground cumin
2 tbsp garlic & ginger paste tbsp coriander powder
1 tbsp deggi mirch powder tbsp mustard oil
1 tbsp salt
Method
Wash the chicken. Cut of and discard as much of the fat
as possible fromunder the skin, because the fat catches
fre while cooking and causes the chicken to burn. Dry the
pieces.
For the marination, combine all the ingredients.
Mix the marinade and the chicken and leave it for an hour
in the fridge, turning once or twice.
To barbecue, either a wood or a charcoal fre will do. Turn
the chicken often so that it doesn't burn, and when the
fre does fare up, extinguish the blaze by spraying it with
water fromyour spritzer. It takes about 15-20 minutes to
cook the chicken tikka.
Serve it with sliced onion rings, lemon and chilli with mint
sauce on the side.

What are the main challenges? Tarn: There are a lot of challenges.
Firstly, there are new hotels appearing here and there which
sharpens the competition. Therefore, in terms of marketing, we
cannot stay still and have to constantly improve both our facilities
and services to be ready for the competition in the market.
Note: Secondly, the shortage of adequate manpower in the market.
Phuket hotels have sufered fromthis problemfor a long time
and unfortunately it will continue. Lastly, the politics; the recent
[situation in Bangkok] is a nightmare for all hoteliers and the Thai
travel industry. Drops in occupancy can be found everywhere
throughout the island. Fortunately, it seems that everything will get
back in place soon.
Whats your main target market? Tarn: Australians, SEAs, Oriental
countries and Europeans.
What do you like most about what you do? Tarn: I've a chance
to travel to many places and meet people around the world. I have
experienced many diferent cultures, cuisine and art. Also I have
gained knowledge by sharing information with people I have met.
And what do you like least? Tarn: The competition between
hoteliers especially marketing approaches that require lowering
roomrates and snatching people in manpower market.
What do you (and the business) hope / expect to achieve
within the next three-fve years? Note: I'd like the KEE Resort &
Spa to maintain its leading position as one of the best four-star
hotels in the market by ofering better hotel facilities and services.
I also expect to contribute more to society.
What do you see as your biggest successes to date? Note: The
biggest success is that the hotel has grown to be the leading 4 star
hotel in the market, is quite well known around the world, and the
business is still growing.
What changes have you seen in the market in your business
sector since you started? How have you responded to them?
Note: The mix of hotel guests changes every year. To counter
this, predicting trends in the market has to be done fromdaily
information gained frommany diferent sources.
Is The KEE Resort & Spa involved in any CSR programmes?
Note: The KEE Resort & Spa does a lot of CSR by taking part in many
social activities especially with the Patong Municipality. Right now
we send our staf members to help clean Patong beach every
Friday morning.
How would you describe your leadership style? Note: I'ma type
that works in a teamby taking opinions fromothers into account.
I always encourage my teamto share what their thoughts are.
Moreover, I always support themwhen problems arise and try
solving themtogether.
What is your over-riding ambition at this stage in your life?

icture the most idyllic beach scene ever: Nodding palms
languorously dancing in balmy westerly breezes, casting
ever-moving exotic shadows over a crescent-shaped
white-sand beach. Got it? Well youve pretty much envisaged
an archetypal idea of what most of Phuket Islands west coast
beaches looked like 25 years ago.
But fast forward to right now and youll see exactly the same vista.
So just how come Phuket managed to hold on to its 90s appeal?
To be honest it didnt and if youd visited the island just a year
ago youd have been forgiven for thinking that west coast Phuket
was Asias answer to Benidormwithout the high rises. Sure, the
beaches still had their obvious allure but, largely speaking, for the
most popular beaches of (fromsouth to north) Nai Harn, Kata,
Karon, Patong, Kamala and Surin, it was hard to see the sand for
sun loungers.
Happily all that has changed due to a recent vigorous and
impressively efective campaign to clean up Phukets beaches
and that means ridding the sands of not only sun loungers
but also many unwanted and ad hoc buildings, shacks, beach
clubs, restaurants, bars, shops, massage parlours, and other land
grabbing features. The islands coast has changed almost beyond
recognition and most defnitely for the better.
To understand this metamorphosis its necessary to go right to
the roots of the situation. By royal decree every beach in the
at Phukets beaches worthwhile activity.
This is mighty good news for those who love beaches without
any clutter and the resulting back-to-nature feel to them. And of
course for kids who love the freedomof a wide-open beach on
which to romp, build sand castles and do whatever they please
this is indeed a sandy Nirvana. But what about those who actually
enjoy end-to-end sun loungers and the immediate availability of
an ice-cold beer and a meal? Well, many of Phukets west coast
beaches have hordes of satellite businesses lining the roads
immediately next to the coastline. In other words, as long as a
business is not actually on the beach it is legal so you wont have
very far to go to fnd the amenities you desire and that includes
massages, meals, snacks and almost anything else along that line.
Its safe to say that when in Phuket do as the locals who much
prefer to take their own food and drink along, sit on shared straw
mats in the shade of the beachside trees and let the kids frolic in
the surf during the safe-to-swimmonths of November to April.
Beach life here is still loads of fun but with a lot more space in
which to enjoy it. Vive la difernce!

Kingdomof Thailand is public land. Its dif cult for sun-starved
westerners to comprehend a certain indiference in the Thai

generally allocated to sons of landowners who saw no future in
themor the land). Thai folks in the past saw no practical use at all
for their lovely beaches except to use themas construction sites
for their fshing boats and for repairing nets. Other than that they
were to Thai eyes relatively barren places.
Then of course over 20 years back the Thai tourist industry
erupted and visitors made a beeline for the beaches, almost
instantly creating a whole new and lucrative market for seaside
vendors and entrepreneurs on the lookout for as much proft
for the least investment possible. Little-by-little temporary, and
sometimes charmingly shambolic, businesses such as sun lounger
rentals and beach bars grew fromfy-by-night enterprises to
deadly serious money-spinners with a lot invested in the process.
And there lay the rub. No matter how charming or rustic that
favourite beach bar that you discovered is, its breaking Thai law.
Beaches are public land and building or doing business on them
in any way shape or formis by defnition illegal (if your hotel
claims to have a private beach lets just say that theyre stretching
the truth a little).
This is why recently the old laws were reinforced, causing a mass
evacuation of the beaches leaving themif not quite pristine,
totally changed. One question that has immediately cropped
up is, who will clean the beaches now that the sun lounger
people have gone? The encouraging response to this is that
locals both Thai and foreign residents have been organising
clean our beaches days out when hundreds of volunteers from
all walks of life collect and bag up the storm-driven southwest
monsoon detritus that washes up on Phukets west coast every

Lemongrass founder, Bobby Duchowny, studied aromatherapy
a healing art that promotes massage, when combined with specifc
herb and spice oils, as a method to reduce stress, boost energy and
heal certain physical ailments at the American Aromatherapy
Association.
Some years ago while on holiday in Thailand, he visited an organic
farm in Petchaboon province and became interested in the natural

If you wish to practise a strict observance during the
festival, here are the rules:
Maintain maximumbody hygiene

Dress in white or in very light colours
Behave yourself: physically and mentally
Abstain fromeating meat, fsh, eggs and milk
No sexual intercourse
Stay away fromalcoholic beverages and tobacco
People in mourning should not attend any ceremonies

On the frst night of the ninth lunar month (October the 20th in
the Christian calendar), the sacred 10-metre lantern pole is raised
to facilitate the arrival of the gods, and at midnight, nine lanterns
are suspended, one for each god. In a slightly anomalous add-on,
the Hindu god Shiva is also believed to be present, and just to be
on the safe side, oferings are made to LamTao and Pak Tao. The
festival then continues for nine more days with much burning of
incense, banging of drums and letting of of freworks to ward of
evil spirits.
One of the strange and even controversial aspects of the
various processions (see the timetable above) is the activities
of the Ma Song or possessed horses. These religious zealots
transformthemselves into a trancelike state and performacts
of mortifcation which range fromclimbing ladders with steel
blades for rungs, walking across red hot coals and immersing
themselves in hot oil. In a further rather gruesome practise,
adherents pierce their faces and tongues with everything from
skewers to bicycle spokes. Oddly enough, this self mutilation
results in little bleeding or subsequent scarring. Stranger than
fction. However its not for the queasy so its probably best not to
bring the kids!
For most, however, the festival isnt so fraught. Many

Weve been told that Nikitas is set to boost its seafood oferings,
with fresh selections to be on full view on seafood boats in front
of the restaurant. Certainly there are plenty of choices for Thai and

have a good choice of wine and cocktails to enjoy with your meal.

pretty to eat? Or is it the raw chocolate mousse at Friendship Beach,

Plunge Tropic Villas, found down a tiny soi of Sai Yuan, have
recently opened up a show home displaying their pool villas. With
a choice of one- or two-bedroomplans, these look to be ideal
especially for couples who want privacy and dont want a lot of
fuss. The villas also have one thing thats sadly lacking at many
developments in Phuket: a design by a certifed disability expert
that takes into consideration those in wheelchairs or with mobility
issues. The villas are still under construction and some are still
available for sale.

Set along Nai Harns main Sai Yuan road, DaVinci restaurant has
been busy expanding its oferings with the opening of its classic
style deli about a year ago. Its now become the go-to spot for

reetings Aliens, foreigners and all those who think they can
guess or hope the laws relating to labour and immigration
somehowwork in their favour. If you are planning to visit the
United Kingdom, my former home, anytime soon let me advise you
not to Google obtaining a VISA to go to, or attempting to work in,
the UK and then followthe advice blindly. Similarly, dont pick the
highest Google rated Thai or other country-based web forums for
your visa and work permit advice! And, if you ever hear the words
No problem, we can fx it, increase your radar settings to maximum
frequency for anything that might be a shortcut, misinterpretation
of the lawor downright cowboy-esque shootingfrom-the-hip style
approach to your right to be in this beautiful Kingdomof Thailand.
Can I just pop into Thailand and conduct a seminar?
No. The type of visa you require is a Type ED visa. This covers word
study tours, observation tours, participating in projects or seminars
and studying as a foreign Buddhist monk.
Once you have the correct visa, you then need to obtain either a
full work permit, or a temporary work license known as a WP.11
Ima hobby DJ and would like to bang out some tunes at my
favourite hotel bar and maybe pick up some chicks and free drinks
while I do so. I dont want to go through the hassle of obtaining a
temporary 15 day work license for just a fewhours. Is that OK?
Predictably, no. You may be a popular DJ in your local discotheque,
but that wont help you if you DJ in Thailand without the correct
legal documents. Performing as a musician or other type of
performance is not generally restricted under the list of activities
reserved for Thais in the Alien Employment Act.
If you intend to conduct a one-of performance, you may be able to
do so with an authorised WP.11, provided it clearly denotes precisely
what you will be doing and is supported by the correct visa.
Even if you live in Thailand and already have a work permit for another
job, unfortunately you cant simply pick up your memory stick and
CDs, visit your local club and start hammering out your tunes.
My accountant advised me to become a director of my Thai
company and told me I dont need a work permit for that. In my
home country, I have business friends who are Non-executive
Directors. If I dont sign any documents, but attend a few
meetings or teleconference calls here and there, surely I can get
away with not having a work permit. A friend of mine telephoned
a Global Big 20 frmand asked the same question, and they told
her over the telephone not to worry about it. Is that OK?
The defnition of work is to exert efort and employ knowledge
whether or not for wages or for other benefts. Clearly, you cant
avoid the law simply by not being paid. Further, there is a minimum
salary that foreigners who are working have to receive. By asserting
that you are not working, when in fact you are, and then further not
declaring the minimumsalary and paying tax on it, you will be in
violation of multiple laws and regulations.
If you receive verbal advice, or unqualifed advice, and rely upon
it, you run the risk of being placed in a situation where you are
interviewed by a government of cial and the best defense you can
ofer is that you received an OK on the telephone froma friend.
Even if you dont sign documents as a registered director of a
Thai company, you will most likely have to (a) attend a meeting
now and again, (b) discuss the business and apply your mind to
it, (c) communicate with shareholders or approve shareholder
communications, (d) accept liabilities and very importantly
whether you have signing authority or not, (e) potentially deal with
any litigation lodged against the company or you as a director.
Directors tend to panic somewhat when they realise they may
have to testify in court regarding a company matter, and will also
possibly have to explain that they dont have a work permit.
Recently, a Phuket Immigration of cer at the airport asked me if
I could speak Thai and when I admitted I could (Chai Khrap, Khop
Khun Khrap), he immediately asked me for my work permit. Do
all foreigners who speak Thai need to have work permits?
A work permit is not a document granting permission for you
to enter the Kingdomof Thailand. Your passport is your of cial
document and, in fact, the Immigration of cial is not carrying out
a specifc duty in requesting your work permit, as this is a duty of
a competent of cial or Registrar of the Employment Department
under Section 24 of the Alien Employment Act 2008. It is not illegal
for the Immigration of cer to ask, but you may politely decline to
answer, or state you do not have it with you or do not have a work
permit. You must make sure you are following the rules under the
Immigration Act 1979 though. But speaking Thai, and admitting
you do so, should not result in an additional requirement for you to
ofer up a work permit.
I bought an apartment overlooking a football stadium and a
beach club as part of a managed estate. Im a qualifed lawyer in
Australia and my neighbours thought it would be a good idea
if I joined the committee that manages the estates common
areas, fees and management decisions. As the committee is not
registered under Thai law, I dont think I need a work permit to
join. Additionally, my salary is so large in Australia that I dont
need a salary here, so I cant see how Im working if I simply join
this committee. AmI right?
No, you are wrong. A committee, often tellingly described as a
working group or steering committee is a function of persons
carrying out tasks in order to beneft their properties individually,
and collectively. On the face of the facts above, a temporary work
license would be required for each meeting WP.11, or a full work
permit for permanent membership of the committee. However,
to join a Housing Development which is regulated under Thai law,
and to be a committee member, it is arguable (but not absolute
fact) that a work permit should not be required. This is because
such functions are, under law, necessary as part of the functioning
of the estate. There are issues, though, with such an interpretation
as foreigners will generally own leasehold in such estate, or may
own a minority shareholding in a Thai company of which they are
most likely a director, and therefore do need a work permit.

Some of my football heroes are planning to visit Thailand to
take part in a friendly tournament. They receive sponsorship
benefts, and Im sure a few other benefts whilst theyre visiting.
Do they need a work permit?
Technically yes. A special Visa Type B is required, with a temporary
work license WP.11. However, applications can be made through
the Sport Authority of Thailand for special consideration fromthe
Ministry of Foreign Afairs to allow an expedited process, but within
the parameters of the law.
I applied for a work permit, and the of cer receiving my
application said he was very busy at the moment, and would get
back to me within a fewmonths. This is going to be a problemfor
me, as I need to pay rent, pay my Thai staf, and I cant see how
I can work and produce income without a work permit. Does the
of cer knowthis? Howlong is he supposed to take to process my
application? Can I sue himor the government department?
Of cers are generally aware that persons seeking a work permit need
ef cient processing of their applications for personal reasons relating
to income and prospective work. Under S.12 of the Alien Employment
Act 2008, the registrar must issue permits to aliens within seven days
of receiving the complete application. Issues can arise when an of cer
asserts an application has a defect or is incomplete.
If you feel you have been wronged in your application, you should
bear in mind the following law: Article 9, Para 2 of the Establishment
of Administrative Courts and Administrative Courts Procedure Act
1999, permitting action for a state of cials neglect of of cial duties
required by law to be performed without unreasonable delay.
An action under this provision can only be instituted where
an administrative agency or state of cial has a particular duty
to performunder the law, but neglects it or performs it with
unreasonable delay. In this case, the Administrative Court may
issue a decree by directing the Head of the Administrative Agency
concerned, or the state of cial in question, to performthe required
duty within the time specifed by the Court.
What is the penalty for working with no Work Permit?
Under S.5 Alien Employment Act: An alien working without a work
permit shall be liable for punishment of imprisonment not exceeding
5 years or a fne from2,000 baht up to 10,000 baht or both.
The consequences of a criminal conviction for foreigners who need
to stay in Thailand can be devastating. They may lose the rights to
enter Thailand in extreme circumstances, and thereby may lose the
right to see their families too.
What is the penalty if a government of cer asks for a bribe?
The penalty includes death. Under section 149 of the Thailand
Penal Code: Whoever, being an of cial, member of the State
Legislative Assembly, member of the Changwat Assembly or
member of the Municipal Assembly, wrongfully demands, accepts
or agrees to accept for himself or another person a property or any
other beneft for exercising or not exercising any of his functions,
whether such exercise or non-exercise of his functions is wrongful
or not, shall be punished with imprisonment of 5 to 20 years or
imprisonment for life, and fned 2,000 up to 40,000 baht, or death.

Sirinat Marine National Park on the north-west of the island

north road and turn left onto highway 4031 after Thalang.
Theres another pretty waterfall at Kathu fromPhuket City
take the Patong road and turn right opposite the Loch Palm
Golf Club. Like all the falls, Kathu is at its best during the
rainy season.
One of the great ways to enjoy Phuket is sailing in the
