AGREEMENT FOR GRANTING LEAVE AND LICENCE



THIS LEAVE AND LICENCE MADE IN THIS THE
day of MARCH 2013

mean and include his legal heirs, successors, successors-in-
interest, executors, administrators, legal representatives,

Smt.SEEMANA BANERJEE W/O Hindu by faith,
by occupation and a resident of Bhatbandh, P.O Purulia
P.S Purulia (T) and District- Purulia herein after called the
owner/ licensor (which expression shall mean and include his
legal heirs, successors, successors-in-interest, executors,
administrators, legal representatives, attorneys and assigns) of
the other Part

WEHERE AS the Aunt (Pisi Ma ) of the Owner/Licensor
executed a registered will vide its No. 14 for the year 1995 in
favour of the present owner and subsequently on her demise the
L.A Case No.5/01was preferred and disposed of by virtue of
which he became entitled to and came into possession of a
piece of land having its C.S Plot No 901/902(portion)
corresponding to R.S Plot No.4467 where in a house and
homestead already exits with in ward No. 1 of Purulia
Municipality initially the holding No of which was H295
thereafter the same was converted into 18,thereafter E17, there
after 71 ,thereafter 42 and finally 149 at present
AND
WHEREAS THE Party of the second Part ,approached and
requested to the owner/licensor for granting leave and license
purely on temporary basis only for 11 months in respect of a
north facing room of the building as mentioned above the
length of which is 15 feet 6 inches and in breadth the same is
11 feet 0 inches and the owner/licensor agreed with the very
proposal and became ready to grant her the said room at a
licence fee of Rs 3000/- only payable according to the
English calendar month in advance with in the 7
th
day of the
Month with effect from
Now both the parties herein agreed on the following terms and
conditions:

1. That the Party of the second Part will use the room as
mentioned above for business purpose only.(she will run a
beauty Parlour there in)
2. That the Agreement for granting leave and licence will be
valid for eleven months only will effect from
, there after the parties may enter into an agreement afresh
on mutual consent.
3. That the party of the second Part will pay the electricity
charges which she will consume and as same will transpire
from the sub meter (in accordance with the electricity bill
for each month).
4. That the party of the second part must not do any such
activities which may cause disturbances and difficulties to
the inhabitants of the rest portion of the house and
homestead and closed neighbours.
5. That as and when asked for by the party of the First Part or
his legal heir/heirs the second party or his legal heir or heirs
will allow the party of the first part or are legal heir or heirs
or her agent to enter into the said room as mentioned above
for its necessity maintenance and other services if any.
6. That the party of the second part do here by under take to
hand over the peaceful vacant possession of the portion of
the floor in question on the date of expiry of this agreement
to the owner /licensor in default he will pay damages
/compensation @ Rs 500 per day to the owner till delivery
of the peaceful vacant possession of the aforesaid premises.

7. That saves and except what are herein before provides the
rights and liabilities of the parties shall be governed by the
prevailing law.
8. That the party of the second part will not be at liberty to
sublet the room in question .
9. That the party of the second part will not make any
structural or permanent alteration of the premises. She may,
however, make any alteration necessary for the installation
of air conditioning ,air cooling equipments provided that
immediately upon termination of the agreement he shall
remove all such fixtures and restore the premise to the state
as it existed at her own cost .
10. That the party of the second part will repair such as
replacement of electrification ,leakage of water tapes and all
minor repairs to the premises caused by the normal wear and
tear at her own cost with the consent of the owner. Major
repairs such as cracks in wall, etc. will have to be done by
the owner.
11. It is hereby expressly provided and agreed by the parties
here to that both parties are entitled to enforce specific
performance of the agreement against each other in case of
breach of any conditions mentioned in this Agreement.
