representingthattheinformationyousubmittedisaccurateandagreetoreceiveemailnotificationsfromtheBankof
AmericaChicagoMarathoninconnectionwiththe2014BankofAmericaChicagoMarathon(Event).

Bysigningbelow(or,ifsubmittedelectronically,byclickingIagreetotheabovewaiverwhichwillconstitutemyvalid
signature),Iacknowledgemyunderstandingthatmyparticipationinthe2014BankofAmericaChicagoMarathon
and/oranypreorpostraceactivities(theraceandpre/postraceactivitiesareindividuallyandcollectivelyreferredto
asthe"Event")involvesrigorousphysicalactivityandthatitpotentiallymaybehazardous.Iacknowledgethatitismy
responsibilitytounderstandtherisksassociatedwithparticipatingintheEventanddeterminewhetherIamfitto
safelycompletetheEventandtheprecautionsIshouldtake.Iattestandcertifythatmyphysicalconditionandability
tosafelycompletetheEventhavebeenverifiedbyalicensedmedicaldoctor(exceptwherethelatterisinviolationof
religiousprinciples);andthatIamphysicallyfitandhavesufficientlytrainedtocompletetheEvent.Iexpresslyassume
allknownandunknownrisksassociatedwiththeEvent,includingbutnotlimitedto:lossofordamagetomyproperty;
injury(includingdeath);accidents;theeffectsofweather;terrainconditionsthatmayvarywidely,andthatmay
includeunevenand/orslipperysurfaces,unpredictablespectators/participants,andnaturalandmanmadeobstacles
(includingwithoutlimitation,vehicles,securitybarriers,signs,cables,mats,anddebrisonthecourse);andthe
possibilitythatanEventmaybepostponed,endedearlyorcancelledaltogetherbyEventorganizerorgovernment
officials.Iacknowledgethatmyentryfeeisnonrefundable,eveniftheEventiscancelled.

InconsiderationofmyparticipationintheEvent,I,formyself,myheirs,executors,administrators,personal
representatives,successorsandassigns(a)waiveandreleaseanyandallrights,claimsandcausesofactionIhaveor
mayhaveagainstanyRaceOrganizer(asdefinedbelow)thatmayariseasaresultofmyparticipationintheEvent;and
(b)agreetoindemnify,defend,andholdharmlessallRaceOrganizersfromandagainstanyandallinjuries,losses,
causesofaction,liabilities,damages,expenses(includingattorneysfeesandcourtcosts)orclaims(collectively,
Claims)thatmightarisedirectlyorindirectlyfrommyparticipationintheEventand/ortheconditionoftheraceway,
property,facilitiesorequipmentusedfortheEvent,regardlessofwhensuchClaimmayariseincluding,without
limitation,Claimsrelatingto(i)theft,lossordisappearanceofproperty,(ii)bodilyinjury(includingfatality),and(iii)
propertydamage,forallclaimsandlosses(includingattorney'sfeesandcourtcosts),whichmaybebroughtagainst
anyoneormoreofthembyanyoneclaimingtohavebeeninjuredorotherwisetohavesufferedlossordamageasa
resultofmyparticipationintheEvent.Forthesepurposes,a"RaceOrganizer"isanyoneormoreofthefollowing:
BankofAmericaCorporation,BankofAmerica,N.A.andtheirsubsidiariesandaffiliates;ChicagoEventManagement;
ChicagoParkDistrict;allgovernmentalagenciesrepresentingtheterritoryinwhichtheEventwillbeheldandfrom
whichresources(suchas,withoutlimitation,fire,policeandambulancepersonnel)areprovided;allsponsors,agents,
vendors,medicalpersonnel,contractorsandvolunteersoforfortheEvent;USATrackandField;emergency(for
example,fireandpolice)andallmedicalserviceproviders;andthelicenses,officers,directors,employees,
representatives,successorsandassignsofeachoftheforegoing.

IfurthergrantfullpermissiontoanyandallRaceOrganizerstostore,use,reproduceand/orresellmyimageorlikeness
byanyaudioand/orvisualrecordingtechnique(includingelectronic/digital)nowinexistenceorhereafterinvented,for
anylegitimatepurpose,includingcommercialsalesandmarketingpurposes.Iunderstandandagreethatinformation
aboutmethatiscollectedbytheRaceOrganizers,includingwithoutlimitationinformationintheapplicationthisform,
andmyEventresults,andanyandallmedicalinformationthatImaydisclosetoEventmedicalpersonnel,maybe
disclosedtothirdpartiesforanylegitimatepurpose,includingresearch,commercialsales,andmarketingpurposes,
andthatitmaybesubjecttoredisclosurebytherecipient(s).IacknowledgeandagreetoabidebyanyOfficialRules
fortheEventthatmaybepostedattheEventorontheEvent'swebsiteorotherwisecommunicatedtomeverballyor
inwritingattheEventbyEventofficials.IherebyrepresentandwarrantthatIam18yearsofageorolderor,if
applicable,thatIamtheparentorlegalguardianofthechildundertheageof18yearsoldwhoIamregisteringforthe
EventandthatIhavethefullpowerandauthoritytoagreetothesetermsonbehalfofsuchchild,andtobindhim/her
totheseterms.
