COMPANY STATEMENT

Cy Tokmakjian who at 74 years of age has been imprisoned in Cuba for more than three years and
counting. Today we received the verdict which we fully expected to be absurd, as the Cuban Authorities
deemed it necessary to justify what they intentionally did, which was to destroy him and his Companies
and seize all related assets totalling approximately $100M.
The deception taking place in Cuba is beyond imagination. Throughout this ordeal, Cy has consistently
maintained that he never participated in any form of corrupt practice whatsoever. The so-called trial
was the further possible thing from an example of the Rule of Law. Among other completely
unacceptable faults in the process, Cy was denied permission to call 14 of 18 key foreign expert,
commercial and management witnesses, and his defence, which clearly proved that no laws were
violated, was largely ignored. Furthermore, consistent with its utter disregard for any measure of fair
process, the court imposed a 15 year period of incarceration on Cy without even giving him the
opportunity to make submissions on sentence.
Lack of due process doesnt begin to describe the travesty of justice that is being suffered by foreign
businessmen in Cuba. In our case a business that has existed successfully and without incident in Cuba
for more than twenty years was wiped out by Cuban Authorities with their own pre-determined agenda.
Foreign dignitaries attended the show trial and observed it with astonishment.
As a Company we can only achieve justice internationally by means of the claims we have already filed
in excess of $200M against the Republic of Cuba through both the International Chamber of Commerce
in Paris, France, and in Canada through the Ontario Superior Court.
Sadly Cy remains in Cuba suffering physically and mentally not knowing when he will be reunited with
his family. We pray that this nightmare will be over shortly, and we pray that this never happens again
to anyone else. Unfortunately the deception in Cuba entices foreign businessmen to invest, and tourists
to enjoy the beaches and weather, but underlying all of this is huge risk that should be a major concern
for all travellers to Cuba.
We are confident that in keeping with Canadas recent and frequently cited public commitment to the
need to recognize and respect human rights, which of course include the right to a fair trial before an
impartial tribunal, the Canadian Government will endeavour to take whatever steps necessary to bring
Cy home.
