This matter comes before the court for trial on the charge of interference with official acts. The state of Iowa appears by County Attorney Ben Smith. Defendant does not appear nor anyone on his behalf. The record reflects that the defendant was properly advised of the trial date and has voluntarily elected not to appear and contest the charge. The court notes that at the time of the defendant's initial appearance it advised the defendant than in the event that he entered a guilty plea that the court intended to impose a 10 day jail sentence and rather than accept that plea situation he elected to plead not guilty so that he could confer with his father about the matter. This matter then proceeded to trial. Testifying on behalf of the state was Brian Mentzer, the arresting officer. Having heard the evidence presented, the court finds that the officer's decision to place handcuffs on the defendant was well within his discretion in order to secure the scene of his investigation and to prevent any altercation between the defendant and Tyler Dungan. The court further finds that the state has met its burden of proving beyond a reasonable doubt that the defendant interfered with the officer's attempt to secure the scene and therefore is guilty of the crime of interference with official acts. Because the defendant was not present the court defers sentencing in this case until September 29, 2014 at 11:00 AM. The defendant shall be present at that time.

The defendant appears for sentencing on a charge of interference with official acts. The court sentences the defendant to spend 20 days in the Sac County jail with credit for any time previously served. Defendant must serve until 7:00 PM on October 5, 2014 at which point he shall be released and the balance of the jail sentence suspended for a period of one year during the defendant's good behavior.
