The Gay and Lesbian Activists Alliance on Oct. 10 boosted its ratings for D.C.
Council member Anita Bonds (D-At-Large) from a +6 to +7.5 after she submitted
a revised questionnaire that the group says added substance and provided
more information about her record on LGBT issues.
Bonds is competing with 14 other candidates in her bid for re-election to one
of two at-large Council seats up for election on Nov. 4. A long-time supporter
of LGBT rights, Bonds has received the endorsement of the Gertrude Stein
Democratic, the citys largest LGBT political group.
Communications rm executive and veteran lesbian activist Courtney
Snowden, whos also running for one of the two at-large Council seats as an
independent, received a +10 from GLAA, the highest possible rating. The group
rates candidates on a scale of -10, the worst possible score, to +10.
GLAA issued its rating to Snowden when it released its rst round of candidate
ratings for the November election on Sept. 17.
The group raised its ratings on Oct. 10 for four other candidates, including
at-large Council contenders Khalid Pitts (I) and Kishan Putta (I), who failed to
submit a questionnaire in the groups rst round of ratings last month but who
subsequently returned the questionnaires.
The group raised its rating for Putta, a Dupont Circle Advisory Neighborhood
Commissioner, from 0 to +6. It boosted its rating for Pitts, a restaurant owner and
labor and community activist, from 0 to +5. Both are running as independents
and have expressed strong support for LGBT equality and both have reached
out to LGBT voters.
The other two candidates to receive a ratings hike were Kris Hammond, a
Republican running for the D.C. Council chair seat; and Preston Cornish, the
Libertarian Party nominee for the Ward 5 Council seat. GLAA raised Hammonds
rating from 0 to +3.5 and boosted Cornishs rating from 0 to +1.5 after the two
submitted the questionnaire they did not turn in for the earlier round of ratings.
GLAA has said it assigns an automatic 0 rating to candidates that dont return
a questionnaire and whose past record on LGBT issues is unknown to the group.

Rural couples join
stampede to wed after
Supreme Court inaction

Jim Early and Garland Tillery of Virginia
Beach were at home on Oct. 6 when
a relative called to tell them the U.S.
Supreme Court had declined to hear a case
that challenged Virginias constitutional
amendment that dened marriage as
between a man and a woman.
The gay couple that has been together
for 34 years arrived at Virginia Beach
Circuit Court around 11 a.m. Early and
Tillery exchanged vows less than three
hours later.
We didnt have to give it anymore
thought, Early told the Washington Blade
on Tuesday. We just got up from our
breakfast table to go down to the clerks
o ce in Virginia Beach and applied for
the marriage licenses.
Same-sex couples, LGBT rights
advocates and o cials outside of
Northern Virginia with whom the Blade
has spoken in recent days continue to
celebrate the legalization of nuptials for
gays and lesbians in the commonwealth.
They also remain somewhat surprised by
the speed at which same-sex marriage
became legal in the state.
Its just thrilling, said Molly McClintock
of Christiansburg, who married her
spouse of 30 years, Irene Peterson, in
Canada in 2005 and in New York in 2012.
We keep waking up every day and saying
did that really happen?
Joel McDonald, a gay member of the
Virginia Beach School Board, on Oct.
8 attended the wedding of his former
high school government teacher, Denise
Trombino, and her long-time partner,
Grace Clark.
Trombino and Clark have been together
since 1995.
The two women married in a Unitarian
Universalist church the following year,
but Trombino noted to the Blade it had
no legal standing. They are the rst
lesbians to legally marry in Virginia Beach
on Oct. 6 after the 4th U.S. Circuit Court
of Appeals ruling that struck down the
commonwealths marriage amendment
took eect.
We waited a long time for this, said
Trombino.
As someone who has been advocating
and lobbying alongside so many, the
reality of the SCOTUS non-decision hit
home watching them exchange their
vows, added McDonald.
Gay Blacksburg Town Council
member Michael Sutphin in February
2004 organized a pro-gay marriage
demonstration at Virginia Tech where he
was a student at the time.
Then-San Francisco Mayor Gavin
Newsom had just begun to issue marriage
licenses to same-sex couples, even though
gays and lesbians could not legally marry
in California at the time. Former President
George W. Bush during his 2004 re-
election campaign supported eorts to
amend the U.S. Constitution to dene
marriage as between a man and a woman.
Virginia voters in 2006 by a 56-43
percent margin approved the states
marriage amendment.
At the time [same-sex marriage
in Virginia] seemed almost like a
pipedream, said Sutphin.
A 2013 Human Rights Campaign poll
found 53 percent of respondents from
central Virginia and 51 percent of those who
live in the eastern part of the state supported
marriage rights for same-sex couples.
Lieutenant Gov. Ralph Northam,
a former state senator who grew up
on Virginias Eastern Shore, told the
Blade last November before defeating
Chesapeake pastor E.W. Jackson in the
race to succeed Republican Bill Bolling
that same-sex marriage is just the
sensible way to go. State Del. Joseph Yost
(R-Giles County), who represents several
counties in southwestern Virginia in the
House of Delegates, in January became
the rst Republican state lawmaker to
publicly back the issue.
As far as same-sex marriage goes, it
does not bother me, Yost told the Blade
during an exclusive interview at Equality
Virginias annual lobby day in Richmond.
The majority of the states Republican
lawmakers and their supporters
remain opposed to marriage rights for
same-sex couples.
State Del. Bob Marshall (R-Prince William
County), who co-sponsored the marriage
amendment that bore his name, last week
in a statement said marriage will soon
include polygamy, or threesomes once
natural marriage is abolished.
State Del. Todd Gilbert (R-Shenandoah
County) in January co-sponsored a bill
alongside Marshall that would have
allowed any state lawmaker to defend a
law after Attorney General Mark Herring
announced he would no longer defend
Virginias marriage amendment.
A state Senate subcommittee in
February struck down the proposal. Gov.
Terry McAulie, who o ciated a lesbian
couples wedding in northern Virginia
on Oct. 10, also denied a request from
Marshall, Gilbert and 28 other legislators
to appoint a special counsel to defend the
marriage amendment.
House Speaker Bill Howell (R-Staord
County) in an Oct. 6 statement criticized
Herring for not defending Virginias
marriage amendment.
I am a strong supporter of traditional
marriage, said Howell. There are many
Virginians who agree with me and some
who do not. Regardless of how one feels
about marriage, we should all agree that
Virginians deserve to have their voices
heard and votes vigorously defended in
court. That did not happen in this case.

McAulife: Gay adoption now legal in Va.
Gov. Terry McAulie on Friday announced gay couples can now adopt in
Virginia.
The McAulie administration noted the legalization of same-sex marriage in the
commonwealth on Monday in a bulletin to the Virginia Department of Social Services.
Now that same-sex marriage in Virginia is o cially legal, we owe it to all
Virginians to ensure that every couple is treated equally under all of our laws, no
matter whom they love, said McAulie in a press release that announced the
bulletin. This historic decision opened the door to marriage equality, and now it
is my sincerest hope that it will also open more doors for Virginia children who
need loving families.
By formally recognizing that same-sex couples can now legally adopt, we are
more fully complying with the ruling in this important case, and sending the message
once again that Virginia is open and welcoming to everyone, added the governor.
Dozens of same-sex couples have married in Virginia since the U.S. Supreme
Court on Monday announced it would not consider marriage cases from the
commonwealth and other states.
Mary Townley and Carol Schall of Chestereld, who were one of the plainti
couples in the lawsuit that challenged Virginias constitutional amendment that
dened marriage as between a man and a woman, on Monday renewed their
California marriage vows.
Emily Schall-Townley, the couples 16-year-old daughter, stood by her parents side
during the brief Richmond ceremony that Attorney General Mark Herring o ciated.
For the rst time legally in Virginia I can say Im here with my wife Mary and
my daughter Emily, said Schall.
Joanne Harris and Jessica Du of Stanton and Victoria Kidd and Christy
Bergho of Winchester the two plainti couples in a second lawsuit against the
commonwealths marriage amendment the American Civil Liberties Union and
Lambda Legal led last summer have a young son and daughter respectively.
India Lipton of Chestereld told the Blade on Monday that she and her partner
of 11 years, Shirley Lesser, decided to marry so her spouse could legally adopt
their son Dylan.
We really wanted to get the legal part done now so that way she can begin the
proceedings to adopt our son, said Lipton.

Supporters hope to honor
slain gay activist with vessel
bearing his name

Organizers insist that a national
campaign to persuade the United States
Navy to christen the next appropriate
ship the USS Harvey Milk in honor of the
slain civil rights leader and naval veteran,
launched nearly two years ago, is still on
course. But they confess that achieving
their goal is far from a sure thing.
To date, the highest-level, o cially
acknowledged conversation about the
prospect of the U.S. Navy naming a ship
after Milk happened during the tenure
of gay San Diego City Council President
Todd Glorias term as interim mayor with
Secretary of the Navy Ray Mabus.
I remain optimistic that Harvey Milk
will be appropriately honored and a Navy
vessel will bear his name, Gloria told the
Blade. San Diego, where the USS Harvey
Milk Navy Ship Campaign was launched, is
the principal homeport to the U.S. Navys
Pacic Fleet and its more than 50 ships.
The O ce of the Secretary of the
Navy did not respond to a request for
comment.
Lt. Junior Grade Harvey Milk trained
to become a master diver at what is now
Naval Base San Diego. Gloria and one of
the lead proponents of the USS Harvey
Milk ship campaign, San Diego City
Commissioner Nicole Murray Ramirez,
say they are condent the campaign
remains on track to win Navy support for
the idea of honoring Milk with a vessel
bearing his name.
However, more than nine months have
passed since Gloria met with Secretary
Mabus and two years since the ship-
naming campaign began. The Navy has
yet to a rm that it is considering naming
a vessel for Milk.
The State of California has designated
May 22 annually as Harvey Milk Day,
wrote Gloria in a letter to Mabus around
the same time of his in-person meeting
with the Navy secretary in Washington.
Given the repeal of Dont Ask, Dont Tell,
I believe that naming a vessel in honor
of Harvey Milk will continue the strong
message that as Americans we honor the
service of all equally.
Glorias letter to Mabus also noted that
Milk was posthumously bestowed with
the Presidential Medal of Freedom, the
nations highest honor for a civilian by
President Obama in 2009.
What class of Navy ship might one day
be called the Harvey Milk, maybe an
aircraft carrier or nuclear submarine?
Thats not likely as those are historically
named only after presidents. If the
examples of Cesar Chavez and former
congresswoman Gabrielle Giords, both
of whom have been so honored, oer
guidance, then a ship named after Milk is
likely to be a littoral or cargo vessel.
We arent concerned with what type of
ship it is, Ramirez said. Thats up to the
Navy. What we care about is that a ship
is named for this deserving Navy veteran
and American hero.
According to Ramirez, the decision
about whether to name a vessel after
the late Harvey Milk rests solely with the
secretary of the Navy. If the campaign
succeeds, it will be the rst time a Naval
vessel is named after an openly gay man.
Sean Sala, also a Navy veteran, is
a Servicemembers United national
leadership committee member and
current national coordinator for the
Military Freedom Coalition, an LGBT
service members advocacy group. Like
Milk before him, Sala was also stationed
at Naval Base San Diego. He said it would
be di cult to overestimate the value to
the nations LGBT population to know
that there is a naval vessel named in
honor of Milk.

N.Y. governor launches HIV/AIDS task force
ALBANY, N.Y. New York
Gov. Andrew Cuomo on Oct.
14 announced the creation of
a new task force designed to
end the HIV/AIDS epidemic in
the Empire State.
A press release from
the governors o ce said
members of the Ending the
Epidemic Task Force will work
to cut the number of new HIV
infections in New York to 750
each year by 2020.
HIV/AIDS has plagued
families across the state for too
long, and together we are going
to put an end to this epidemic,
said Cuomo. This disease can
impact people from all walks
of life, and the sooner society
realizes that, the sooner we
can end the stigma that keeps
too many people from getting
tested and treated.

Marine detained over trans womans murder
SUBIC BAY, Philippines A U.S. Marine has been detained in connection with
the murder of a Philippine trans woman.
The Marine Corps Times on Tuesday reported that Philippine o cials said
Marine Pfc. Joseph Pemberton is the primary suspect in the death of Jennifer
Laude Sueselback.
Stars and Stripes reported that Laude, 26, was last seen entering a hotel in
Olongapo, which is adjacent to Subic Bay, late on Oct. 11. The newspaper said
authorities found the trans womans naked body in a hotel bathroom.
A State Department spokesperson told Stars and Stripes that Pemberton,
who is based in Camp Lejeune in North Carolina, remains in custody on the
USS Peleliu. Four other American ships remain docked in the Philippines as the
investigation into Laudes murder continues.
Filipino LGBT rights advocates have expressed outage over the murder.
Jennifer and many like her have been suering from violence all her life, but
she did not have to die to give us a wake-up call, said Angie Umbac, president of
the Rainbow Rights, according to Outrage, a Philippine LGBT magazine.
A growing number of Philippine LGBT rights advocates have described Laudes
murder as a hate crime.

BAY SHORE, N.Y. A Long Island LGBT advocacy group last week received
letters that included threats to kill its CEO and burn down a planned housing
complex for gay seniors.
Long Island GLBT Services Network CEO David Kilmnick told WCBS that
expletive-laced letters arrived at his organizations headquarters in Bay Shore
in Suolk County on Oct. 9. He said the letters also arrived at Long Island GLBT
Services Networks o ce in neighboring Nassau County on the same day.
Getting these letters, which are extremely degrading, hateful, homophobic
and violent in nature, is certainly unnerving, Kilmnick told WCBS. You know, I
think the intent of this individual or individuals is to scare and put us back in the
closet, and thats not going to happen.
The letters arrived two days after Kilmnick and local o cials announced plans
for an aordable housing complex for LGBT seniors in Bay Shore.
WCBS reported the Long Island GLBT Services Network has received a series
of threatening letters over the last two years.
Suolk County police continue to investigate the incidents as hate crimes.

LGBT advocates this week welcomed
a draft document from Catholic bishops
that states gays have gifts and qualities
to oer to the church.
The Vatican Press O ce on Monday
posted to its website the document that
summarizes the two-week meeting or
synod of bishops on family issues that
began on Oct. 5.
Homosexuals have gifts and qualities to
oer to the Christian community, it reads.
The document contains rhetorical
questions that ask whether the church
can oer gays a welcoming home
and whether our communities are
capable of providing that, accepting and
valuing their sexual orientation, without
compromising Catholic doctrine on the
family and matrimony.
The question of homosexuality leads
to a serious reection on how to elaborate
realistic paths of aective growth
and human and evangelical maturity
integrating the sexual dimension: it
appears therefore as an important
educative challenge, it reads.
The document a rms that unions
between people of the same sex cannot
be considered on the same footing as
matrimony between man and woman.
Nor is it acceptable that pressure
be brought to bear on pastors or that
international bodies make nancial aid
dependent on the introduction of regulations
inspired by gender ideology, it reads.
The document nevertheless
acknowledges gay relationships can
prove positive.
Without denying the moral problems
connected to homosexual unions, it
has to be noted that there are cases in
which mutual aid to the point of sacrice
constitutes a precious support in the life
of the partners, reads the document.
Furthermore, the church pays special
attention to the children who live with
couples of the same sex, emphasizing
that the needs and rights of the little ones
must always be given priority.
The document comes against the
backdrop of Pope Francis more moderate
approach to homosexuality and gay
people since his election as ponti in
March 2013.
Francis a few months after he
succeeded Pope Benedict XVI told an
Italian Jesuit magazine that the church
had grown obsessed with same-sex
marriage, abortion and contraception.
The Argentine-born ponti in July 2013
told reporters who asked him about the
reported homosexuality of the man he
appointed to oversee the Vatican bank
that gay men and lesbians should not be
judged or marginalized.
Overall I am very excited by this news,
said Francis DeBernardo, executive
director of New Ways Ministry, an LGBT-
friendly Catholic ministry in Mount
Rainier, Md., told the Washington Blade
on Monday. Its really a total reversal of
the attitude and approach the church
leaders have taken regarding lesbian and
gay people for decades now.
Marianne Duddy-Burke, executive
director of Dignity USA, an LGBT Catholic
group, described the document as
surprisingly positive.
For the rst time the Vatican has
said something positive about same-
sex couples, she told the Blade. Sort of
acknowledging there could be mutuality
and sacrice in the commitments that
we make to one another, that is a
tremendous step forward.
Catholic conservatives were quick to
criticize the document.
The Associated Press reported that Polish
Cardinal Stanislaw Gadecki described it
as unacceptable and counter to church
teaching. John Smeaton, co-founder of
Voice of the Family, said in a statement
those controlling the Synod have betrayed
Catholic parents worldwide.
The Archdiocese of Washington did
not respond to the Blades request for
comment.
It is a working document, which
summarizes the interventions and debate
of the rst week, said the Vatican in a
Tuesday statement in response to those
who have criticized the synod.
Advocates from predominantly Catholic
countries nevertheless welcomed
the document and the churchs more
moderate tone toward homosexuality
and LGBT people.
Todays comments from the Vatican
suggest a change in the tone of the
Catholic Churchs approach to gay people,
and are welcome, said Kieran Rose, chair
of the Gay and Lesbian Equality Network
in Ireland. The Vatican document
provides an opportunity for the Catholic
Church to change the way it treats lesbian
and gay people.
Estebn Pauln, president of the LGBT
Federation of Argentina, agreed.
The statements made within the
framework of the synod on families
in relation to the LGBT community
represent a concrete advance in the
way the Catholic hierarchy looks at our
community, he told the Blade.
Advocates remain largely critical of
the church in spite of its recent eorts
to moderate its tone towards marriage
rights for same-sex couples and other
LGBT-specic issues.
The church still views gays and lesbians
as intrinsically disordered.

Bruce introduced last year that would
allow same-sex couples to enter into civil
unions in the South American country.
Philippine advocates with whom
the Blade has recently spoken say the
Catholic Bishops Conference of the
Philippines and other Vatican-aligned
groups continue to block comprehensive
anti-discrimination bills and other pro-
LGBT measures and initiatives.

Education Dept. settles trans harassment case
A California school district will be required to ensure all students are protected
from discrimination or harassment on the basis of their gender identity as a
result of a voluntary agreement reached with the Department of Education.
The O ce for Civil Rights of the Department of Education announced Tuesday
it entered into the agreement with Californias Downey Unied School District as
a result of a complaint over the harassment and discriminatory treatment of a
transgender student.
Our federal civil rights laws protect all students from sex-based discrimination
and harassment, said Catherine E. Lhamon, assistant secretary for civil rights.
I commend the Downey Unied School District for entering into this agreement
to ensure that each of its students, including transgender students and students
who do not conform to stereotyped notions of masculinity or femininity, can
learn in a safe, educational environment.
According to a letter to the district dated Oct. 14, the student, a transgender
girl whose name isnt disclosed, faced discrimination from her elementary
school and fellow students on the basis of her gender identity while attending
fth grade, and by her peers in middle school. The Department of Education
received the complaint in November 2011.
Sta at her elementary school allegedly conscated the students make-up
even though other girls in her class were permitted to wear make-up and made
the student write an apology letter for making male students uncomfortable by
putting on make-up. The school also discouraged the student from discussing
her gender identity and wasnt allowed in group counseling sessions with other
students based, at least in part, on concern the student might discuss her
gender identity.

they just let all the circuit courts fall in line,
and then weve got a national rule thats
just kind of a whole series of decisions,
Esseks said.
Marc Solomon, author of Winning
Marriage and national campaign director
for the LGBT group Freedom to Marry, said
he remains hopeful nationwide marriage
equality will happen in 2015 regardless of
whether or not the Supreme Court rules.
Obviously, the court rejected those ve
states petitions, but there very well could
be others this year out of the Sixth Circuit
potentially ... and get to us to a national
resolution, Solomon said. If that doesnt
happen, I still think 2015 is a possibility.
Its been said the Fifth, Eighth and
Eleventh Circuits were too conservative
for a positive outcome for supporters of
same-sex marriage and possibly the
Sixth, where U.S. Circuit Judge Jerey
Sutton was seen as a deciding vote on a
three-judge panel that is considering the
issue. But legal experts say the denial of
certiorari in marriage cases may make
conservative judges reconsider upholding
bans on same-sex marriage.
Richard Socarides, a former adviser to
President Clinton who writes about gay
rights for The New Yorker, said a circuit
court ruling in favor of bans on same-sex
marriage is hard to imagine in light of
actions from the Supreme Court.
Circuit courts dont like to be
overturned by the Supreme Court; they
dont like to cause problems, Socarides
said. My suspicion is there will be at this
point no circuit court willing to rule against
marriage equality, and that we will get to
45 states very quickly probably within
12 months, denitely within 18 months.
The last few states will take a while
longer, Socarides added, but he predicted
two years, three years, maybe four years,
not 10 years for all 50 states to comply.
The perception that chances are now
better in more conservative circuits
for rulings favorable to marriage
equality would be consistent with the
announcement last week from the LGBT
group Lambda Legal that its joining as co-
counsel to plainti same-sex couples in a
Louisiana lawsuit. The group announced
it would join the case, which is pending
before the Fifth Circuit, the day after the
orders came down from the Supreme
Court indicating its denial of certiorari in
the marriage cases.
With a renewed focus on rulings by
the circuit courts, Solomon said the
work of making the case that same-sex
couples are harmed by the lack of access
to marriage has become all the more
important.
And the other thing I think we all need
to be pointing to is how smoothly things
have gone in the states where marriages
have taken place in some very conservative
states like Utah and Oklahoma, Solomon
said. So the predictions of serious
backlash and protests, etc., just havent
materialized, and thats because they
wont materialize.
Work along those lines has already
taken place in states that recently gained
marriage equality, Solomon said, but his
organization is recalibrating for the nal
stretch to hone in on the outstanding
states like Texas and Louisiana.
Still, in the event an appeals court
decides to uphold a ban on same-sex
marriage, theres widespread belief the
split would lead justices to take up the
case to reverse the ruling and make a
nationwide decision on marriage for
themselves.
It takes a vote of four justices to grant
certiorari (or decide to take up a case),
which would likely be present on the
nine-member bench to hear an adverse
decision for marriage-equality supporters
given the actions by justices last week.
The probable candidate for the next
circuit court to rule is the Sixth, which
heard oral arguments in August on cases
challenging marriage bans in Michigan,
Ohio, Kentucky and Tennessee and where
a decision is expected imminently. Next
up is the Fifth, where appeals of decisions
on marriage in Texas and Louisiana are
being considered and will likely be argued
in November, December or January.
But thats likely the cut-o point if a
circuit court was going to make a decision
in favor of a marriage ban in time for a
nationwide decision by the Supreme
Court in the middle of next year.
Conferences where justices will
consider whether or not to take up a
case are scheduled only until mid-January
for any given term, and from that time
it takes about the end of a term to fully
brief a case, so any petition for certiorari
after that would come too late.
Thats probably what would happen
for the ruling from the Eleventh Circuit,
where an appeal of a decision against
Floridas marriage ban wont likely be
heard until January, February or March.
The same holds true for the Eighth Circuit,
which is likely the last circuit to decide on
marriage because no district court has
ruled yet in that jurisdiction.
If it takes this long to get a decision
upholding marriage bans, supporters of
gay nuptials will likely have to wait until the
Supreme Courts term next year for the
cases to be docketed for a decision in favor
of same-sex marriage by summer 2016.
Another possible, but unlikely, scenario
for a delay could be the result of a Sixth
Circuit decision upholding bans on same-
sex marriage. That would make for the
rst time available to the Supreme Court
two cases one from Ohio, the other
Tennessee that are seeking not outright
marriage equality, but recognition of out-
of-state same-sex marriages within a
particular state.
Under this scenario, the court could take
up only the issue of marriage recognition
for the current term, then leave the
decision of the right of same-sex couples
to marry until a decision in 2016.
Esseks said, however, the Supreme
Court is unlikely to take up recognition rst,
the right to marry second, given the current
situation in which through their orders,
marriage equality came to 16 new states.
Having issued orders that had that
result, it would seem strange to me that
the court would then decide to take a
small piece of the legal question thats
outstanding that is, the recognition
and just take that as a prelude to doing
the marriage piece, Esseks said.
While at one time LGBT advocates
insisted that a ruling from the Supreme
Court to establish a nationwide right
to same-sex marriage was necessary,
that view seems to have softened in the
aftermath of the denial of certiorari.
Solomon said in so many respects, it
just doesnt matter whether or not the
Supreme Court steps in because either
way same-sex couples have won the right
to marry.
We would like to see a Supreme
Court ruling in 2015, and we have more
information now, Solomon said. We
know that the Supreme Court might not in
spite of what we want, and so, our job is
to create the climate in the court of public
opinion that will enable the job to nish as
quickly as possible. Whether that happens
through a nal Supreme Court ruling, or it
happens through a decision in the circuits,
that truly is beyond our control.
But the lack of a ruling from the Supreme
Court would mean the nations highest
court would never issue an extensive legal
rationale spelling out the right of same-sex
couples to have equal access to the same
institution of relationship recognition as
opposite-sex couples.
Nonetheless, as Esseks observed, a
detailed nationwide ruling in favor of
marriage equality complete with legal
analysis may have already occurred last
year in the form of U.S. Associate Justice
Anthony Kennedys decision against the
Defense of Marriage Act in Windsor v.
United States.
If we end up with a series of circuit
court rulings on marriage and people
want to know what the legal principles
that govern the freedom to marry in the
view of the Supreme Court, I think you
can look back at Windsor, Esseks said.
The Windsor decision clearly focuses
on how the Constitution protects the
equal dignity of Constitution requires the
freedom to marry for same-sex couples
throughout the country.

Beginning in her high school days in
Midland, Texas, when she befriended gay
classmates, to her years on the D.C. school
board in the 1970s through her 16 years
on the City Council, Schwartz says she has
worked as diligently to advance LGBT rights
as she has in her role as a champion for all
city residents.
I dont think anybody, regardless of
their own sexual orientation, has a better
record than I do in this community, she
told the Washington Blade in an interview
last week.
Schwartz, 70, said in no uncertain terms
that she was referring to D.C. Council
member and mayoral candidate David
Catania (I-At-Large), whos gay, and Council
member and mayoral contender Muriel
Bowser (D-Ward 4) as among those whose
records on LGBT issues hers surpasses.
It was 40 years ago when I got elected
to the board of education, she said. I
immediately went about getting a rule
change a rule addition to make
discrimination against gay and lesbian
teachers banned any discrimination
based on a persons sexual orientation.
Schwartz has strongly disputed
claims by detractors that she entered
the mayoral race this year in retaliation
against Catania, who helped orchestrate
her defeat inher 2008re-election bid for
the Council.
While saying she is better qualied to
be mayor than Bowser, Schwartz leveled
her strongest criticism against Catania in
her interview with the Blade.
Among other things, she said Catanias
decision to leave the Republican Party
in 2004 and denounce then President
George W. Bush for his support for a
constitutional amendment to ban same-
sex marriage came ve minutes after
Catania had raised large sums of money
for Bushs re-election campaign.
I never raised money for George W.
Bush, she said in referring to her role as
a longtime Republican. And he came to
me and asked for money for the Bush
campaign, Schwartz said in referring to
Catanias 2004 support for Bush before
the blowup over the marriage issue.
The only check I ever gave to a Republican
president was when [Catania] was like
browbeating me to do so, she said.
Schwartz said she has raised Catanias
initial support for Bush in an eort to deect
criticism of her a liation with the Republican
Party prior to her decision to switch from
Republican to independent earlier this year
when she decided to run for mayor.
If youre going to mention it about me
you need to mention it about him, she
said of her and Catanias roots in the
Republican Party.
Catania has said that although he
switched from being a Republican to an
independent after Bush announced his
support for the anti-gay federal marriage
amendment in 2004, he likely would have
left the GOP anyway a short time later
due to its continuing tilt to the right. Like
Schwartz, Catania described himself as a
progressive Republican.
So Im running to win the election,
Schwartz said. Im running to siphon o
votes from both of them and also the
other three who are in the race. Im really
in it to win.

Two new projects bring trans stories
into the mainstream

Transgender visibility in pop culture is at an all-time high
and now two of its most prominent players Against Me!
front woman Laura Jane Grace and actress Laverne Cox
who plays Sophia on the Netix smash Orange is the New
Black have each launched documentary projects in
which everyday trans folks from all walks of life will share
their stories.
Grace formed punk band Against Me! in Gainesville, Fla., in
1997. After a couple major-label, Billboard-charting albums,
Grace then known as Tom Gabel announced via a starkly
candid Rolling Stone interview in 2012 she was transitioning.
The autobiographical album Transgender Dysphoria
Blues came out in January and now Grace has hosted the
10-episode series True Trans with Laura Jane Grace for AOL.
The rst four episodes were released on National Coming
Out Day (Oct. 11) and are available at on.aol.com/truetrans.
Cox made history this year for her work on Orange.
She was the rst trans actress to be nominated for an
Emmy and the rst trans person to make the cover of
Time magazine. Her MTV/Logo documentary Laverne
Cox Presents: The T Word debuts tonight at 7 p.m. The
hour-long special, which features seven trans youth who
range in age from 12-24, is part of MTVs week-long Look
Dierent campaign (trans.lookdierent.org), which MTV,
mtvU and Logo TV are using to shed light on race, gender
and anti-LGBT bias.
The Washington Blade spoke with Grace by phone
before an Against Me! concert last week in Johnson City,
Tenn., and with Cox during a call on Oct. 7.
Grace says AOL approached her for the series in a pretty
open-ended pitch. After tracking down a list of about 50
transgender folks she met mostly on social media after her
own coming out, she and an AOL crew spent about three
weeks hearing their stories. The episodes are broken down
by topics such as transitioning or coming out and feature
many people in each episode. Grace also shares experiences
from her own life and some Against Me! live concert footage
is used as well.
She says a variety of factors inuenced her decision to
be brutally honest in detailing her journey from the Rolling
Stone interview to subsequent interviews to the AOL series.
When you come out, you start to get this momentum, this
feeling behind you, the 33-year-old rocker says. You feel
empowered, you feel good because this thing that youve
kept inside for so long, youre nally talking about it and I
denitely knew in my personal situation, for me, it would be
very public and there were lots of people who had questions,
so I went in with the attitude that if they had questions, I had
a chance to educate them and Id do my best. I hoped people
wouldnt be rude, but I went in with the attitude that theres
no such thing as a stupid question.
She says having been honest in her songwriting was a help.
Things Ive already said on records and in songs, to me
are way more personal than anything I could ever say in
an interview. A song is part of my soul, so putting that out
there is harder.
Cox calls The T Word a labor of love and says she has
tremendous respect for the seven young people she calls
amazing and courageous.
In this world, its still a big deal to come forward and
say youre transgender and open yourself to all kinds of
discrimination, potential violence and stigma, says Cox,
a Mobile, Ala., native. For these young people to come
forward on national television and tell their stories openly
and truthfully, I think they should be applauded and I love
every single one of them and I hope that this documentary
can be a critical intervention in how we think of trans
young people in this country and really humanize them.
Cox says shes been blown away by the resilience
demonstrated by those who participated and says shes
interested in shifting the focus on the way trans stories have
been told from focusing as she pointed out in her famous
interview with Katie Couric on transition and surgery and
bodies to elevate peoples stories as much as possible and
giving them a platform.
While Coxs project focuses on youth, the energy
and vision of whom she says is galvanizing, Grace says
shes learned just as much from older trans people who
transitioned many years before she did.
Even if nobody ever sees this series, I know what it has
meant to me to live it and to have these conversations,
she says. One of the most reassuring things hearing from
so many people, from older people or from those whove
been transitioning much longer, I would have assumed
they would have had it way more gured out, had more
concrete, denite answers, so to hear them say, Yeah, I
still dont know some things, or, Im still guring it out, or
even to hear them say theyre still in transition, that was so
reassuring to me and gave me the feeling of, Oh, OK. You
dont have to have it all gured out.

How long have you been out and who was
the hardest person to tell?
I struggled with coming out when I was
16. I am not sure when I actually became
comfortable with who I am. I still struggle. I
think most gay men do. Before I was 25 it was
hard to tell anyone. But I can truly say that
my family has never come to terms with my
sexuality.
Whos your LGBT hero?
My friend Steve Moore. Recently passed
away. He was a successfulcomedian who
was diagnosed with HIV just as hiscareerwas
taking o. In the early 90s he created an
HBO special Drop DeadGorgeous about his
life as an HIV-positivecomedian. He raised
awareness in a time where that stigma could
have ruined him. He was a ray of light in my
life. I wanted to emulate him and to some
degree I did because he taught me how to
live and love.
Whats Washingtons best
nightspot, past or present?
Tea Dance at the Lost and Found, late
nights at Tracks. And I spent some time at
Badlands and The Frat House in the 80s. My
favorite spot these days is Old Ebbitt Grill. Not
gay, but classy and tasty.
Describe your dream wedding.
Meh. Unfortunately,my mind is not there
yet. But there would be Chambord and
butteries.Too gay?
What non-LGBT issue are you most
passionate about?
As a gay white man I have been mistreated
and bullied by law enforcement. It is
impossible to wrap my head around how
many others are racially proled. I only hope
whats going on in Ferguson, Mo., will be a
gateway for awareness.
What historical outcome
would you change?
The Revolutionary War. Im not saying
Idontwant to be free from tyranny, Im just
saying I wouldsound cuter with a British
accent.
